Neffner Lssistant Director of Contract Administration Enclosure • / d� r • • y I i EASEMENT / THIS AGREEMENT, made this 1st day of May 1954, by and between COMMERCIAL WATERWAY DISTRICT No. 2, King County, hereinafter called First Party, and BOEING AIRPLANE COMPANY, a corporation, hereinafter called Second Patty, WITNESSETH: WHEREAS Second Party is using what is known as the "Boeing Renton Plant" at the mouth of Cedar River in Renton, King County, Washington, and desires to install a pumping facility and place discharge pipe from said river to property d' the Second party, said pipes and pumping station to be located on property of the First Party, NOW, THEREFORE, In consideration of one ($1.00) Dollar and the covenants herein contained, First Party hereby grants Second Party for a period up to and including May 31, 1957, an easement over and across said property belonging to First Party, and the right to instal a pumping station on Cedar River approximately 100 feet south of the north line of the property heretofore leased to Leddingham and Associates, known as the "Boat House Leases", and to lay an 8 inch diameter pipe buried at least 18 inches underground from said pumping station for a distance of approximately 250 feet in a northeasterly direction over and across properties of the First Party into the said property used by the Boeing Airplane Company. The location and installation of said pump and piping shall in no way interfere or be located on property leased by the First Party to Leddingham, Second Party is also hereby granted an easement to extend electrical service to said pumping/station, to follow the same general route as the pipe line, service to be so established that there will be a minimum clearance overhead of 15 feet between the wires and existing roadway and lands. 1rp • • • It is understood and agreed that Second Party will construct said improvement in a workman like manner and protect First Party from any and all liability which may arise from said installation or the said use of said easement and property; and will so manage the same as not to interfere with any other present lessee of the First Party. It is understood that this easement terminates May 31, 1957. On termination of easement Second Party agrees to remove its said improve- ments at once. It is understood application for easement renewal may be made on or before 90 days prior to the termination of this easement. It is understood and agreed that if for any reason it is necess- ary for the First Party to make changes on the bank of said Cedar River or to improve or dredge same, or otherwise safeguard the danger of floods, on 30 days written notice from First Party, Second Party at its own expense will remove said pump and pipe line as may be necessary for the period of such emergency, IN WITNESS WHEREOF First and Second Party have caused these presents to be executed by these respective officials hereto fully authorized. The foregoing easement is grant:'d for the purpose of allotting the Grantee to construct, install, maintain and use a pumping station on the giant bank of the Cedar River together with necessary underground tratar mains and electrical conduits running from said pumping etatibn and river to the creat boundary of the Boeing Renton Plant property, together with the right at all times in the Grantee, its successors and assitnen of inereos to and ogress from the property covered by said ease- I meet across . adjacent lands of the Grantor for the purpose of construct- ins, installing and maintaining raid pump house, rater maine and electric conduits. 2, This easement shall be for a period of three years commencing July 10 1956, and expir ing midnight June 30, 1959, unless otherwise I extended. Vzritten application for extension of this easement shall be made to the Grantor on or before ninety (90) days rior to the expiration of this easement or any extension thereof. 5. Upon the expiration of this easement, the Grantee agrees to promptly remove any and all tmproverents placed on said property by the Grantee. 4. It is understood and agreed that if for any reason it is necess- ary for the Grantor to make changes on the banks of said Cedar River -2- • ti • or to improve or dredge same, or otherwise safeguard the danger of floods, or in the a 'ent of a war or similar emergency, Grantee, on 30 days written notice from Grantor, at its own expense, will remove said 1 pump and pipe line as may be necessary for the period of such emergency. 5. It is understood and agreed that the Grantee will construct, in- stall, maintain and use the pumphouse, water mains, and electrical con- duits in a workmanlike ,canner and shall protect the Grantor from any and all liability which may arise from such work or the use of this easement and property. A 3 .; t, _1 1.„ -) Notary Public in and for the $tate of Washington, residing at Seettle. - r4G LA4L.`� ,i?(III .2. • Y • • EXTENSION OF EASEMENT WHEREAS the COMMERCIAL WATERWAY DISTRICT NO. 2, King County, a municipal corporation of the State of Washington, as Grantor, and the BOEING AIRPLANE COMPANY, a Delaware Corporation, entered into and executed a certain Easement under date of July 1, 1956 which Easement is now in full force and effect but is expiring by its terms on June 30, 1959, and WHEREAS, COMMERCIAL WATERWAY DISTRICT NO. 2, King County, has heretofore been dissolved by order of the Superior Court in and for the County of King, and all its assets and properties have been transferred to androested in the City of Renton, a municipal corporation, which City has been and is now the legal successor in interest to said Waterway District, and WHEREAS, above Grantee has requested an extension of the aforespecified easement for a period of three (3) years, NOW, THEREFORE, the parties hereby agree and covenant as follows: 1. The City of Renton, a municipal corporation, hereinafter referred to as Grantor, does hereby grant and convey unto the above Grantee, its successors and assigns an extension of the aforespecified easement which extension shall commence on the 1st day of July, 1959 and expire midnight, June 30, 1962. 2. The parties hereby make reference to that certain easement agreement dated July 1, 1956 and hereby incorporate all its terms,provisions and conditions into this instrument as if same had been fully set forth herein, and said terms, provisions and conditions to remain in full force and effect during the aforesaid extension period.
