EASEMENT

For and in consideration of the awn of One Dollar ( 1.00),
receipt whereof is hereby acknowledged, the CITY C : .:;TON, a Municipal
corporation of the State of Washinc;ton, hereby grants an easement unto
T L PACIFIC .LLliPHONE AND TELEGRAPH COMPANY, a California Corporation,
with the right to place, construct, naintain, inspect, replace, repair
and reconstruct and keep clear poles, anchors and overhead cable, with
wires, fixtures and appurtenances attached thereto, upon, across, over
and/or under the followingg, described property situated in King County,
State of arashiinton, tc-;nit ;
That portion of the Cedar River Park located in
the Southeast ',quarter and the Southwest Quarter of Section
17, Township 23 :worth, Fianna 5 East W,M, , described ea fol-
lows:
Beginninc' at the center section corner of Section
17; thence South 31°4613Q East 165.14 feet; thence South
27°47130" East, 4..0 feet to en a ole point of the neater
line of a 10 foot easement tr' true point of beginning;
thence North 66°2`!'o9" East, 21 feet; thence North 86°31023"
East, 253.feet; thence North 47°11109" Last 270 feet to a
point of intersection with the F:aple Valley Hif hway right of
way line, this forming the most ntr theasterly limit of acid
10 foot wide pole and line easement; then beginning again
at the true point of >eeinning; thence South 87°00100' Wiest
468.5 feet; thence North 72°24130" West 227 feet, end ter-
minating at existing telephone pole.
PROVIDED, 710,;%J:ER, that the poles to be erected by above grantee shall
not exceed five in number; further providing that in the event the
City's premises, subject to the aforementioned easenent,are needed or
required by the City for the construction of l iproverents or the devel-
opment of vital `lu nI c i p 1 functions, them and in any :Lich event, grantee
agrees, at its cost and expense, to remove said poles and overhead cable
within a reasonable time after beinw so notified by the City,
Grantee shall at all times, while this easement is in full force
and effect, have the richt of full ingressta

for the aforementioned purposes and to remove at any time any or all of
the poles, anchors and overhead cable and/or wires, cables, fixtures
and appurtenances from the sad rroperty, but grantee shall be respon-
sible unto the City for all damages or injuries incurred by it and
arising out of the exercise of grantee's rights and privileges herein
granted.

they were authorized to execute said instrument and that the seal affixed
