HomeMy WebLinkAboutE 01091914 i • _ -%- jiik \�4 EASE"1 T. The grantor, Columbia & Puget Sound Railroad Company, a corporation, does hereby give and grant unto the City of. Renton, a municipal corporation of the State of Washin7ton situated in the County of King, the richt to construct, lay and maintain a sewer in, upon and across the following described property: The land owned and used by grantor herein as a right of way situate, lying and being in Block Vine (9 ) of the Original Plat of the Town, now a part of the City, of Renton, King County, State of Washington. The easement hereby granted being a perpetual easement which is granted upon the condition that the grantor herein shall not be liable for any loss or damages arising out of any accidents or injuries to persons in the employ of said City or property owned by the said City or to the property of persons in the employ of said City while upon said right of way; and the said City of Renton does hereby agree to indemnify and save and keep the said grantor harmless against any and all such liability and damages and all costs incident thereto; and upon the further condition that the said City shall bear and pay and be liable for the expense of said improvement and for the payment of any and all damages occasioned to the said grantor due to the construction, maintenance and operation of said sewer. And the said City does hereby agree and this easement is *ranted upon the express condition that the said sewer shall be placed so that the top of the same shall be at least two feet (2ft. ) below the bottom of the ties 'of the railroad under i ich said sewer is to be constructed; or if such is impracticable then the sewer pipe is to be placed in a concrete bed and completely and sub- stan dally covered, said concrete extending under the full length P ill - 0 of all ties affected, or passed under, and that should it become necessary to raise the railroad track known as "Woods Spur" under which said sewer is to pass, then the same shall not be raised to a great_r height than the surface of the railroad tracks of said grantor in Walla Walla Avenue at the point there Woods Spur connects with said Walla Walla Avenue; -nd should any portion of the tracks known as "Woods Spur" be raised by said City in the con- struction of said sewer then it agrees that the entire spur shall be so raised so that it will be level and so that it shall not be higher than the surface of the tracks in Walla Walla Avenue as aforesaid. Said work to be done to the satisfaction of the Chief Engineer of the grantor. The acceptance of this easement by the construction of said sewer shall operate as an acceptance of all of the terms hereof. IN WITNESS WHEREOF the grantor has caused this instrument to be executed by its duly authorized officers this 9th day of January, 1914.
