HomeMy WebLinkAboutE 09121914 t THIS AGREEMENT, Bade this /,,, -rte day of A.D. 1914, by and between the PUGE'T SOUND ELECTRIC RAILWAY, a New Jersey corporation, hereinafter called "Railway", party of the first (i) part, and CITY OF RENTON, a municipal corporation, hereinafter call- ed "City", party of the second part, WITNESSETH: 1. The Railway hereby permits the City to construct and lay down a twelve (12) inch tile drain pipe across said Railway's fifty- five ( 55) foot right of way through the northeast quarter (NE9) of southwest quarter (Swk) of Section Seventeen (17) , Township Twenty- three North (23N) , Range five ( 5) East, W.R . , said pipe line loca- tion being more particularly described as follows: Beginning at the south boundary line of the said Rail- way's right of way at a point near the northwest corner of"`tract 43", Renton Co-operative Coal Company' s Acre Tracts in said Section; thence northeasterly one hundred seventy-two ( 172) feet more or less, to a point south of the aailway' s so called "brick yard spur"; thence north and at right angles to said tracks and underneath same, to the north boundary line of said Railway' s right of way, Subject to the following stipulations and conditions: 2 Said pipe line shall be laid by the City at least six (6) inches below the surface of the ground and in a manner so as to in no way damage or injure the conditions of the Railwas said right of way, tracks or road bed. All work done in connection with the laying of said pipe upon the right of way of the Railway shall be subject to .the approval of the C -,ief Engineer of the Railway, and shall be maintained by the City at all times so as to be free from leakage or other sources of damage. If at any time the Railway shall find that seid pipe line by reason of its location or method of construction or other causes, interferes with any of its struc- tures or other improvements of the Railway, now existing or here- after to be constructed on or near said premises, or with the opera- tion or maintenance of its electric railway upon said right of way, the 'Railway shall have the right to require the City from time to time to change the location of said pipe or to make any changes in said pipe, and thereupon the City shall forthwith make such changes r STONE & WEBSTER MANAGEMENT ASSOCIATION / GENERAL MANAGERS.
