City Clerk reports bid opening on 11/19/2008 for CAG-08-166, City Hall Third Floor Remodel; 13 bids; engineer's estimate$455,000; and submits staff recommendation to award the contract to the low bidder,Apus Construction, Inc., in the amount of$348,800. Council concur. c. Community and Economic Development Department submits 60%Petition to Annex for the proposed Red Mill Annexation and recommends a public hearing be set on 1/12/2009 to consider the petition; approximately 224 acres located in the vicinity of 128th Ave. SE, SE Petrovitsky Rd., and SE 171st Way. Council concur. d. Community Services Department submits CAG-08-039, Community Center Gym Floor Replacement; and requests approval of the project, authorization for final pay estimate in the amount of$936, commencement of a 60-day lien period, and release of the retained amount of $10,485.95 to Greater Seattle Floors, contractor, if all required releases are obtained. Finance and Information Services Department recommends approval of Interlocal Agreement #42 with five fiber consortium partners to share City-owned underground conduit in exchange for fiber optic cabling. Utility Services Division requests approval of the annual roster of consultants chosen to provide various services in 2009,with the option of extending the roster annually in 2010 and 2011 upon department administrator approval. SUMMARY OF ACTION: The Council received a 60% Direct Petition to Annex on November 4, 2008, to annex approximately 224-acres of unincorporated King County located within Renton's Potential Annexation Area. The proponent's petition was certified on November 18, 2008 by King County as having signatures representing at least 60% of the area's assessed valuation. Under State law, the Council is required to hold a public hearing to consider the annexation petition and to provide proponents and opponents the opportunity to speak. Following the public hearing, Council may accept the annexation proposal for all or any portion of the area. The site is part of the 2008 Comprehensive Plan Amendments as M:04 Petrovitsky-Fairwood-Red Mill. Upon adoption of the Comprehensive Plan Amendments, the area will be designated Residential Low Density (RLD), Residential Single Family (RSF), Residential Medium Density (RMD) Residential Multi-Family (RMF), and Commercial Corridor (CC) on the City's Comprehensive Plan Land Use Map. The area has not been zoned, but will be zoned later in the annexation process. The Administration is also seeking authorization to forward the Notice of Intent Package to the Boundary Review Board if Council decides to accept the 60% Direct Petition. If the City Council accepts the 60% Direct Petition, the Administration should be directed to forward the Notice of Intent package for this annexation to the Boundary Review Board. RECOMMENDATION: • Council accept the 60% Direct Petition to Annex the 224-acre Red Mill Annexation site; • Council authorize the Administration to forward the Notice of Intent for the Red Mill Annexation to the Boundary Review Board for King County for their review. BACKGROUND SUMMARY: At its February 4, 2008, public meeting, Council accepted the 10% Notice of Intent to Commence Annexation petition and authorized the circulation of a 60% Direct Petition to Annex. City departments reviewed the annexation proposal and all staff reported that the annexation represents a logical extension of their respective services and systems. A more detailed discussion of this proposed annexation and review comments are contained `ir " in the Department's January 7, 2008, Red Mill Annexation 10% Notice of Intent issue paper. Red Mill Annexation—Acceptance of 60%Direct Petition Zoning The site is part of the 2008 Comprehensive Plan Amendments as M:04 Petrovitsky- Fairwood-Red Mill. Full-Time Employee (FTE) Need Created The table below summarizes by department an estimate of the need for full time employees the Red Mill Annexation may create (a more detailed listing of FTE's by section is attached). Each number indicates a fractional number of one full time employee. The cumulative column represents the need created by all 60% Direct Petitions to Annex received after November 2008. RCW 35A.14.231 and 35.02.155 place a limitation on annexation proposals such as this. The Red Mill annexation was proposed 90 days after the petition for the incorporation was filed and therefore this annexation is to "be held in abeyance". The proposed Red Mill Annexation may not proceed unless one of the following two events occurs: 1) the Boundary Review Board (BRB) modifies the boundary of the proposed Fairwood incorporation by removing the Red Mill area; 2) voters reject the proposed Fairwood incorporation. The Administration recommends that Council authorize a Notice of Intent to Annex the Red Mill area be forwarded to the King County BRB. At the time of the filing the City will also invoke jurisdiction so that a public hearing in the matter will be held by the BRB. At that meeting the proponents of the Red Mill annexation would be afforded the opportunity to be heard regarding their desire to be annexed by the City of Renton. If the BRB does not remove the proposed Red Mill Annexation area from the proposed Fairwood Incorporation area, the proposed Red Mill Annexation will await the outcome Page 2 of 3 r Red Mill Annexation—Acceptance of 60%Direct Petition of the Fairwood Incorporation vote. If the vote in the matter of Fairwood Incorporation is against incorporation, then the Red Mill annexation would be allowed to move forward in the manner typical for 60% Direct Petitions. CONCLUSION: The proposed Red Mill Annexation has been certified as having sufficient signatures representing at least 60% of the area's assessed value. It also has reasonable boundaries and appears to comply with BRB objectives. Reviewing staff raised no objections to this annexation. Staff feels that the proposed Red Mill Annexation furthers the City's Business Plan goals and is in the general welfare and interest of the City. The Administration recommends the Council accept the 60% Direct Petition and authorize staff to forward the Notice of Intent package to the BRB for King County. We hereby petition that such property be annexed to the City of Renton under the provisions of RCW 35A.14.120 et seq. The territory proposed to be annexed is within King County, Washington, and is contiguous to the City of Renton. A map(Exhibit 1)and legal description(Exhibit 2)are included as part of this petition. In response to a duly filed and considered"Notice of Intention"to commence annexation proceedings, the City Council of the City of Renton met with the initiating parties under RCW 35A.14.120 on February 4, 2008. The City Council then determined that the City would accept the proposed annexation. Further,pursuant to RCW 35A.14.120, the undersigned petitioners agree to: (1)Accept the City's Comprehensive Plan land use designation as it affects the subject property; and (2)Accept the City's simultaneous adoption of zoning regulations for the subject property consistent with the City's Comprehensive Plan. all as noted in the minutes of the Council meeting and contained in the electronic recording of such meeting. The property is located west of Meadow Avenue N and south of N 40th Street. An existing single family residence is proposed to be removed. The required front yard setback is 15 feet for the primary structure and 20 feet for an attached garage. The required rear yard setback is 20 feet. Proposed lot sizes are: Lot 1 at 5,376 sq. ft. and Lot 2 at 5,184 sq. ft. The proposal for two new lots would arrive at a density of 7,1 dwelling units per net acre (du/ac). The allowed density range in the R-8 zone is a minimum of 4.0 to a maximum of 8.0 dwelling units per acre and the proposed density is within the permitted density range. Access to the proposed lots would be provided via residential driveways off of Meadow Avenue N. The topography of the subject site is flat. There are no existing trees required to be preserved onsite. 2. Environmental Review Except when located on lands covered by water or sensitive areas, short plats are exempt from SEPA Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Single Family(RSF) on the Comprehensive Plan Land Use Map. Lands in the RSF designation are intended to be used for quality residential detached development organized into neighborhoods at urban densities. It is intended that larger subdivision, infill development, and rehabilitation of existing housing be carefully designed to enhance and improve the quality of single-family living environments. The proposal is consistent with the following Comprehensive Plan Land Use and Community Design Element policies: Policy LU-147. Net development densities should fall within a range of 4.0 to 8.0 dwelling units per acre in Residential Single Family neighborhoods. The proposed project for two lots would arrive at a net density of 7.2 dwelling units per net acre, Noise which is within the density range permitted. Policy LU-148. A minimum lot size of 5,000 square feet should be allowed on in-fill parcels of less than one acre (43,560 sq. ft.) in single-family designations. All of the proposed lots equal or exceed the minimum lot size of 5,000 square feet. Policy LU-152. Single-family lot size, lot width, setbacks, and impervious surface should be sufficient to allow private open space, landscaping to provide buffers/privacy without extensive fencing, and sufficient area for maintenance activities. The proposed new lots would meet the required lot size, width, and setbacks to create sufficient front, rear, and side yard areas. Policy LU-154. Interpret development standards to support new plats and infill project designs incorporating street locations, lot configurations, and building envelopes that address privacy and quality of life for existing residents. The proposed lots are rectangular in shape; each lot would be oriented such that all of the lots would have access to a public right-of-way. Approval of this application would not decrease the quality of life for residents in the immediate vicinity. Policy CD-12. Infill development, defined as new short plats of nine or fewer lots, should be encouraged in order to add variety, updated housing stock, and new vitality to neighborhoods. Net density is calculated after the deduction of sensitive areas, areas intended for public right-of-way, and private access easements. After the deduction of 420 square feet for the dedication of 5 feet of right-of-way along the frontage of the property, the proposal for two lots arrives at a net density of 7.1 dwelling units per acre, which is within the permitted density range for the R-8 zone. The allowed building lot coverage in the R-8 zone is 35 percent or 2,500 square feet whichever is greater for lots over 5,000 square feet in size. The lot coverage for the new lots would be verified at the time of building permit review. The required setbacks in the R-8 zone are as follows: front yard is 15 feet for the primary structure and 20 feet for an attached garage, side yard is 5 feet, side yard along a street is 15 feet for the primary structure and 20 feet for an attached garage and the rear yard is 20 feet. Based on the proposed subdivision, proposed Lot 1 would have its front yard oriented towards the south and Lot 2 would have it's front yard oriented to the east towards Meadow Avenue N. The setbacks for the new lots would be verified at the time of building permit review. The parking regulations require that detached or semi-attached dwellings provide a minimum of 2 off-street parking spaces. As proposed, each lot would have adequate area to provide two off- street parking spaces. Compliance with the parking requirements will be verified at the time of building permit review. The R-8 zone permits accessory structures only when associated with a primary structure located on the same parcel. c) Community Assets Ned The entire site is vegetated primarily with grass and ornamental landscaping. The regulations regarding tree protection and retention require that trees on lots being developed be maintained to the maximum extent feasible. The Development Services Director has made a Niter' determination that to comply with these requirements, 25 percent of all protected trees shall be retained or replaced. The project site has no significant trees that are required to be retained, and is therefore in compliance with this requirement. The City's landscaping regulations require the installation of landscaping within the public right-of- way. The minimum amount of landscaping required for sites abutting a non-arterial public street is 5 feet provided that if there is additional undeveloped right-of-way in excess of 5 feet, this shall also be landscaped. A determination has been made that if no additional area is available within the public right-of-way due to required improvements, the 5-foot landscaped strip may be located within private property abutting the public right-of-way. The landscaping proposed shall either consist of drought resistant vegetation or shall be irrigated appropriately. In addition, the applicant will be required to plant two ornamental trees, a minimum caliper of 1-1/2 inches (deciduous) or 6— 8 feet in height (conifer), within the 15-foot front yard setback area for the proposed lots. Existing landscaping may be used to augment the required landscaping. A conceptual landscape plan was submitted with the application. The proposal would include the installation of 5 feet of landscaping along Meadow Avenue N and two trees within the front yard areas of each of the lots. The vegetation proposed includes Yoshino Flowering Cherry trees and boxwoods. The proposed landscape plan appears to comply with the City's landscape requirements. A detailed landscape plan shall be submitted with the building permit applications. All landscaping shall be installed prior to the issuance of occupancy for the buildings. d) Compliance with Subdivision Regulations Streets: No new public streets would be created as part of the proposed short plat. Meadow Avenue N is classified as a Residential Access Street on the City's Arterial Street Map. There are no existing frontage improvements along the parcel's Meadow Avenue N street frontage. Street improvements including, but not limited to paving, sidewalks, curb, and gutter will be required along the site's Meadow Avenue N frontage. In addition, the existing right-of-way width of 40 feet, which is less than the City's minimum required width of 50 feet. Therefore, the dedication of 5 feet along the project's Meadow Avenue N street frontage is required. The proposed short plat is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, staff recommends a condition of approval be placed on the project requiring a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project. One new lot (credit given for the existing residence) is expected to generate approximately 9.57 new average weekday trips. The fee for the proposed short plat is estimated at $717.75 ($75.00 x 9.57 trips x 1 lot = $717.75) and is payable prior to the recording of the short plat. Blocks: No new blocks will be created as part of the proposed short plat. Lots: The size, shape, orientation, and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. Each lot is rectangular in shape, the front yard of proposed Lot 1 is oriented to the south and the front yard of proposed Lot 2 is oriented to the east towards Meadow Avenue N. Each of the proposed lots would have direct to a public street (Meadow Avenue N). The minimum lot size in the R-8 zone is 5,000 square feet. Lot area is calculated after the deduction of private access easements and pipestems from the gross lot area. After the deduction of the 1,620 square foot pipestem for Lot 1, the proposed lot sizes are 5,636 square feet for Lot 1, and 5,184 square feet for Lot 2. The proposed lot sizes meet the minimum lot size requirements. The minimum lot width required in the R-8 zone is 50 feet for interior lots. The proposed lots both have a lot width of 64 feet. The minimum lot depth required in the R-8 zone is 65 feet. Proposed Lot 1 has a lot depth of 84 feet and Lot 2 has a lot depth of 81 feet. The dimensions of the Nome proposed lots meet the minimum width and depth requirements and are compatible with other existing lots in this area under the same R-8 zoning classification. These requirements will be reviewed at the time of building permit application. e) Reasonableness of Proposed Boundaries Access: Each lot would have access to a public right-of-way(Meadow Avenue N) via single family residential driveways. Topography:The topography of the subject site is flat. Relationship to Existing Uses:The properties surrounding the subject site are single-family residences and are designated Residential —8 dwelling units per acre (R-8)on the City's zoning map. The proposal is similar to existing development patterns in the area and is consistent with the Comprehensive Plan and Zoning Code, which encourage residential infill development. f) Availability and Impact on Public Services (Timeliness) Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish services to the proposed development, subject to the condition that the applicant provide Code required improvements and fees. A Fire Mitigation Fee, based on $488.00 per new single-family lot with credit given for the existing single-family residence, is recommended in order to mitigate the proposal's potential impacts to City emergency services. The fee is estimated at $488.00 ($488.00 x 1 new lots = $488.00) and is payable prior to the recording of the short plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per single-family residential dwelling. Based on the student generation factor, the proposed short plat would result in 0.44 additional students (0.44 X 1 lot= 0.44) to the local schools. It is anticipated that the Renton School District can accommodate any additional students generated by this proposal. Storm Water:A Drainage Narrative prepared by the applicant has been submitted with the projec application. Staff from the City's Plan Review Section reviewed the submitted narrative and note that this project is exempt from detention and water quality per the 1990 KCSWM and that the project will be required to comply with the requirements of the 1990 KCSWM. The Surface Water System Development Charges are based on a rate of$759.00 per new single- family lot. Payment of this fee will be required prior to issuance of utility construction permit. A temporary erosion control plan will be required and shall be installed and maintained to the satisfaction of the representative of the Development Services Division for the duration of the project. The first order of business shall be installation of a silt fence along the perimeter of the site that is to be disturbed. The silt fence shall be in place before clearing and grading is initiated. This will be required during the construction of both off-site and on-site improvements as well as building construction. Due to the potential for erosion to occur during project construction, staff recommends as a condition of approval that the project be required to comply with the Department of Ecology's Erosion and Sediment Control Requirements as outlined in Volume ll of the current edition of the Stormwater Management Manual. Utilities:There is an existing 12-inch water main in Meadow Ave N. Derated fire flow in the vicinity is approximately 2,500 gpm. Water pressure in the area is approximately 80 psi. The proposed project is located in the 320 Water Pressure Zone and is outside an Aquifer Protection Zone. The required fire flow for single-family residences is 1,000 gpm, and a fire hydrant is required to be located within 300 feet of all single-family residences. If the building square footage (including garage area) exceeds 3,600 square feet in area, the minimum fire flow increases to a minimum of 1,500 gpm and requires 2 hydrants within 300 feet of the structure. Existing and new hydrants will be required to be retrofitted with Storz"quick disconnect"fittings if not existing. There are fire hydrants in the vicinity that may be counted towards the fire protection of this project, but are subject to verification for being within 300 feet of the nearest corner of all new buildings. New water service stubs to each lot must be installed prior to recording of the short plat. Water System Development Charges are based on a rate of$1,956 per new single-family lot. Payment of fees is required prior to issuance of utility construction permit. Payment of this fee will be required prior to issuance of utility construction permit. H. Findings: Having reviewed the written record in the matter, the City now enters the following: 1. Request:The applicant has requested Administrative Short Plat Approval for the Brewis Short Plat, File No. LUA-07-042, SHPL-A. 2. Application: The applicant's short plat application complies with the requirements for information for short plat review. The applicant's short plat plan and other project drawings are contained within the official land use file. 3. Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designations of the Residential Single Family(RSF) land use designation. 4. Zoning:The proposal as presented complies with the zoning requirements and development standards of the Residential Single Family- 8 (R-8) zoning designation, provided all advisory notes and conditions of approval are complied with. 5. An existing residence is proposed to be removed. The setbacks for the new residences would be verified at the time of building permit review. 8. BACKGROUND Several years ago the City joined the Fiber Consortium, a group of local government agencies comprised of local cities, hospitals, schools and utilities. The attached Fiber Optic Project Agreement (FOPA) supplements the original agreement by providing for the build of a fiber optic backbone from Seattle Public Utilities South Creston Substation to their Fairwood Control Works. As a result of this project, six consortium partners gain fiber strands in various amounts as detailed on the attached cost sharing matrix. There are no costs to the City for this project. Project Specifications and Scope of Work This project shall meet all the requirements of the City of Renton Public Works Department and the King County Public Works Department, i.e. traffic control plans, street use permits, waiver of existing underground ordinance, Renton Business License, etc. • Route Preparation • Work to be done during normal working hours: Segment A: Southeast FCB288 (SE-FCB288) 1. At the FCW adjacent to the SCL pole near the facility entrance on 132nd Place SE, provide and install a 2" schedule 80 PVC conduit in a 36" deep trench from the hand hole at the end of the building entrance conduit approximately 10 feet to the adjacent SCL pole. Sweep the conduit into a pole riser ending 3 feet below the cable attachment. Bed the underground conduit in 6" of rock free fill and backfill the trench. Restore all adjacent landscaping to the condition that existed prior to the start of work. 2. Inventory the SCL poles on the route from the SCL pole near the FCW facility entrance on 132nd Place SE to Talbot Rd. S and S 26th St. Inventory the PSE poles from Talbot Rd. S and S 26th St. to Benson Drive S. Obtain the required permits and permissions, make-ready any existing strands as needed, provide and install a new aerial cable strand with required support equipment according to PSE and SCL specifications and provide and lash a 1" aerial conduit to the strand. 3. Locate the existing 1 %" rigid galvanized steel (RGS) conduit adjacent to the PSE pole nearest the west side of Talbot Rd. S approximately 160' south of the intersection of Talbot Rd. S and S Puget Drive. Provide and install a new 25-TA vault over the conduit adjacent to the pole. Cut and sweep the 5 telemetry conduit into the new hand hole. Preserve the existing 6 strand copper telemetry cable in the conduit. 4. Provide and install a 2" schedule 80 PVC conduit in a 36" deep trench from the new hand hole to the adjacent PSE pole. Sweep the conduit into a pole riser ending 3 feet below the cable attachment. Bed the underground conduit in 6" of rock free fill and backfill the trench. Restore all adjacent landscaping to the condition that existed prior to the start of work. 5. Provide and install approximately 2,700' of pull-rope into the pole riser and through the conduit pathway to the NE corner of S Grady Way and Talbot Rd. S. Segment B: Central FCB288 (C-FCB288) 1. At the SE corner of S 3rd St. and Shattuck Ave. S. provide and install a new 25-TA splice vault. Provide and install 3" schedule 80 PVC conduits to the adjacent traffic signal type III hand hole and to the type I hand hole for the existing 3" Airport conduit system located approximately 15' south of the corner marked"LT". Replace the type I hand hole on the airport conduit. 2. Provide the vault with a non-skid lid with welded raised lettering that reads: "LT/ ITS". Replace sidewalk panels with 3,000 PSI concrete and finish to city specifications. 3. Provide and install approximately 1,900' of pull rope in the traffic signal telemetry conduit on the south side of S 3rd St. between Wells Ave. S and Shattuck Ave. S. New 4. Provide and install approximately 1,700' of pull-rope. Remove the existing 24 count single mode cable from the 2" conduit on the west side of Wells Ave. S between Grady Way S and S 3rd St. using the cable to pull-in the pull-rope. Temporarily store the fiber cable in the 25-TA on the SW corner of S 3r St. and Wells Ave. S. Segment C: Northwest FCB288 (NW-FCB288) 1. Inventory the SCL poles on the route from the SCL pole on 84th Ave. S just north of S 126th St. to the NE corner of Beacon Ave. S / 51st Ave S and S Leo St., obtain the required permits and permissions, make-ready any existing strands as needed, provide and install a new aerial cable strand with required support equipment according to SCL specifications and provide and lash a 1" aerial conduit to the strand. 2. Provide and install a new aerial strand from the SCL pole on the north side of S 126th St approximately 150' west of 84th Ave. S. to the new aerial strand on the west side of 84th Ave. S, intercept the span at approximately the midpoint between the poles to align the aerial pathway with S 126th St. and lash a 1" aerial conduit to the strand. 3. Locate the West Hill telemetry conduit adjacent to the SCL pole on the north side of S 126th St. approximately 150' west of 84th Ave. S. Provide and install a 25-TA vault between the conduit and the SCL pole. Avoid locating the vault over the existing, adjacent West Hill Reservoir water main. Expose the 444111110. existing conduit, cut and remove a segment sufficient to allow the installation 6 of 3"conduit sweeps with a radius of 24". Do not damaging the existing 12 strand SM fiber cable in the conduit. Move 50' of the existing 12 count SM cable from slack storage in the type II hand hole on the NW corner of S 126th St and 84th Ave. S. Provide and install 3" schedule 80 PVC sweeps with a radius of 24" and interconnect the West Hill Reservoir conduit into the new vault. Provide the vault with a non-skid lid with welded, raised lettering that reads: "City of Renton LT/ITS". 4. Provide and install a 2" schedule 80 PVC conduit in a 36" deep trench from the new hand hole to the adjacent SCL pole. Sweep the conduit into a pole riser ending 3 feet below the cable attachment. Bed the underground conduit in 6" of rock free fill and backfill the trench. Restore all adjacent landscaping to the condition that existed prior to the start of work. Replace damaged grass with live turf. Underground and Aerial Fiber Placement • Work to be done during normal working hours: Segment A: Southeast FCB288 (SE-FCB288) 1. Reel bare fiber test and provide test results of the customer-provided 288 count single mode(SM) fiber cable. 2. Install the 288 count SM fiber cable from the FCW MDF through the building entrance conduit, through the pole riser and through the aerial conduit route to the PSE pole on the west side of Talbot Rd. S approximately 160' south of S Puget Drive, continue down the pole riser and through the City of Renton telemetry conduit to the splice vault at S Grady Way and Wells Ave. S. Provide a 50' service loop in the MDF. Provide not less than 200' of slack storage for every 2,000' of pathway and 100' at each end of the pathway. 3. Provide at least 100' of slack storage at the following locations along the aerial route: a. 123rd Ave. SE just south of SE 160th St. where fiber to Tiffany Park Elementary school will be spliced, b. 116th Ave. SE at 160th St. where fiber to Nelsen Middle School will be spliced, c. S 23rd St. 275' west of Benson Drive S where fiber to Teasdale Park will be spliced. d. S 23rd St. at Morris Ave. S where fiber to Talbot Hill Elementary School will be spliced. 4. Provide at least 200' of slack storage in the new 25-TA vault adjacent to the pole riser at Talbot Rd. S 160' south of S Puget Drive. This slack will be used when the cable under the 1-405 project is relocated and spliced. 5. Attach a"002" tag and label to the 288 count SM fiber cable at each access point reading"NW-FCB288 —Contact City of Seattle Department of Information Technology, (206) 386-1212". 6. Provide and install toneable mule tape along fiber cable in the underground. 7 Now Segment B: Central FCB288 (C-FCB288) 1. Reel bare fiber test and provide test results of the customer-provided 288 count SM fiber cable. 2. Install a 288 count SM fiber cable from the splice vault on the NW corner of Wells Ave. S and S Grady Way to the SW corner of Wells Ave. S and S 3rd St. Loop the cable through the 25-TA adjacent to the traffic signal type III hand hole and store cable in the vault. Continue west on S 3rd to Shattuck Ave. S. through the signal telemetry conduit. In addition to the 288 count SM cable, install the existing 24 count SM cable stored in the hand hole on the NW corner of S 3rd St. Store 100' of the 24 count SM cable in the Wells Ave. S vault and store the remainder of the SM cable in the traffic hand hole on the SW corner of S 3rd St. and Whitworth Ave. S. At Shattuck Ave. S store slack 288 count SM fiber in the 25-TA vault, continue north on Shattuck Ave. S to S 2nd St. If the conduit interconnect to Renton High School is complete, store slack 288 count SM fiber in the vault that will be at this location. Continue west on S. 2nd St. to Lake Ave. S and north on Lake Ave. S to Airport Way, loop the fiber through the adjacent vault and store slack 288 count SM fiber in the vault. Continue west on Airport way and north on Perimeter Rd. west to the West Hill Pump house. Pass through the interconnecting 2" conduit to the West Hill telemetry conduit. Continue west across Rainier Ave. N into the Rainier Station shopping center. Store slack 288 count SM fiber in the existing 25-TA at the base of the hill. Continue west to the 25-TA on the 'fir northwest side of NW 6th St. Cul-de-sac, store slack 288 count SM fiber in the vault. Continue west on NW 6th St. to Taylor P1. NW, north to S 124th St. and west to the existing 25-TA in the westbound lane of S 124th St.just west of 84th Ave. S. Store slack 288 count SM fiber in the vault. Continue south on 84th Ave. S and west on S 126th St. to the new 25-TA vault. Store slack 288 count SM fiber in the vault. 3. Attach a label to the 288 count SM fiber cable at each access point reading "C-FCB288—City of Renton contact City of Renton Information Services Division". 4. Attach a label to the 24 count SM fiber cable at each access point reading "City of Renton Traffic Signal Department contact City of Renton Information Services Division". 5. Provide and install toneable mule tape along fiber cable in the underground. Segment C: Northwest FCB288 (NW-FCB288) 1. Reel bare fiber test and provide test results of the customer-provided 288 count SM fiber cable. 2. Install a 288 count SM fiber cable from the 25-TA vault on the north side of S 126th St. 150' west of 84th Ave. S up the pole riser and through the aerial pathway, west to 84th Ave. S, south to S 128th St., west to Beacon Ave. S, and northwest to the NE corner of Beacon Ave. S / 51st Ave S and S Leo St. where there is an existing SPU 144 count SM fiber. Provide not less than 200' of 8 slack storage for every 2,000' of pathway and 100' at each end of the pathway. 40010 3. Construction Cost Apportionment In consideration for the City of Renton allowing Renton School District, Seattle Public Utilities, Seattle City Light, City of Kirkland, City of Bellevue, and the University of Washington fiber to occupy certain portions of the City's conduit system, approximately 3 miles in length with an estimated value of$1,500,000 for the useful life of the fiber, as defined by the participating agencies, Renton School District, Seattle Public Utilities, Seattle City Light, City of Kirkland, City of Bellevue, and the University of Washington agree to pay for most costs such as but not limited to: fiber optic cable, conduit upgrades, splice enclosures, fiber patch panels, miscellaneous parts and supplies and labor to install, test and certify the fiber system. All upgrades to the conduit system on city property and in the city right of way will be owned and maintained by the City of Renton. Conduit on Seattle Public Utilities property will be owned and maintained by the Utility. At such time as all of the parties to this agreement shall determine that utilizing the fiber optic cable is no longer in their interest, the parties shall transfer ownership of the fiber to the City of Renton or remove the fiber from the city's conduit system, leaving the conduits in original condition. See attachment for an estimate and all agencies will be billed based on actual costs in proportion to their fiber ownership, not including spares. %rd 12 C. Maintenance Responsibilities and Costs, including Ongoing Maintenance and Responsibilities for Moves. Expected future maintenance has been broken down into the categories below. If a maintenance issue arises that is not listed below, those costs will be proportionately split based on fiber ownership in each fiber segment by the participating agencies as detailed in the attached table. Locates The City of Renton agrees to perform all locates required and requested through Underground Utilities Locate Center(UULC) for the fiber and conduit installed as a result of this agreement that is on property owned by the City of Renton or in the City of Renton right-of-way or in areas of King County immediately adjacent to City of Renton Water Department water mains. This includes all of the underground portions of this project as of December 31, 2008. Relocation Any and all relocations on Seattle City Light poles, Puget Sound Energy poles or City of Renton conduit will be proportionately split based on fiber ownership by the participating agencies. See attachment for the ownership percent of each fiber segment. Important Note: The Interstate 405 widening project, currently underway, will cause approximately 1,200' of conduit on Talbot Rd. S between Renton Village Place and S Puget Drive to be relocated sometime in 2009 or early 2010. The City of Renton will pay the State's contractor to install a new 4" conduit in the project area. This cost will be deducted from the 25%maintenance cost apportionment that the City if Renton is responsible for in this fiber segment for this fiber relocation only. Repairs/Breaks The City of Seattle DoIT shall contract with a competent and qualified vendor to provide 7x24x365, four hour response to any fiber breaks or outages that happen on the SE- FCB288 fiber segment. The City of Renton shall contract with a competent and qualified vendor to provide 7x24x365, four hour response to any fiber breaks or outages that happen on the C-FCB288 fiber segment. This service level agreement will require an annual premium, estimated to be$3,000.00, to ensure services are available when needed. The City of Seattle DoIT shall contract with a competent and qualified vendor to provide 7x24x365, four hour response to any fiber breaks or outages that happen on the NW- FCB288 fiber segment. 13 Annual Pole Attachment Fees Seattle City Light charges an annual attachment fee for each pole to which an aerial strand has been attached. This fee is currently$18.97 per attached pole per year. This project will attach aerial strands to 92 SCL poles. The associated annual fee is $1,745 per year. In consideration for the significant savings to Seattle City Light afforded by the joint construction of this fiber project, estimated to be $325,000, Seattle City Light hereby waives the pole attachment fees that would normally be assessed for the fiber segments associated with this and only this project. This waiver is specific to the fiber segments specified in this document and does not preclude Seattle City Light from collecting the usual pole attachment fees required by agreements with agencies participating in this project currently in force or that may be made in the future. IV. Apportionment of Liability During construction, the Contractor shall be responsible for the project work and the project site. In the event that the project work causes or contributes to any harm, damage, injury or loss to any person or property, whether during construction or after completion of the project, each party shall be responsible to the extent the party is found to be at fault. City of Seattle shall ensure that the City and all persons performing the Work, including without limitation the Utility's suppliers and subcontractors, maintain in effect at all times during the Work, coverage or insurance in accordance with the applicable laws relating to worker's compensation and employer's liability insurance (including, but not limited to, the Washington Industrial Insurance Act and the laws of the state in which any such person was hired), regardless of whether such coverage or insurance is mandatory or merely elective under the law. The Utility shall furnish to Participating Agencies such assurance and evidence of such coverage or insurance(such as copies of insurance policies and Certificates of Compliance issued by the Washington State Department of Labor and Industries) as Participating Agencies may request. City of Seattle shall maintain in full force and effect throughout the term of this Agreement, a minimum of One Million Dollars ($1,000,000) liability insurance for property damage and bodily injury. In satisfying the insurance requirements set forth in this section, the City may self-insure against such risks in such amounts as are consistent with good utility practice or shall obtain a coverage agreement through a Risk Pool authorized by Chapter 39.24 RCW which shall provide liability coverage to the City for the liabilities contractually assumed by the City in this Agreement. At the time of execution of this Agreement, and prior to commencement of performance of any of the Work, the City shall furnish Participating Agencies,upon request, with a Certificate of Insurance as evidence that policies providing insurance (or self-insurance)with such provisions, coverage's and limits are in full force and effect. 14 AIM V. The City's Emergency Management Plan must be reviewed, revised, adopted by Council, and submitted to the State of Washington every four years as a condition of the Emergency Management Performance Grant (EMPG). The City's Emergency Management Plan must be received by the State in January, 2009, in order to maintain eligibility for EMPG funding. Background All City departments participated in the review and revision of the draft version of the Emergency Management Plan. An executive summary of the plan was provided to Council at the October 27th Committee of the Whole meeting. Council was asked to review the plan and provide any comments to the Emergency Management Director prior to the first week of December so that the plan could be formally adopted and submitted to the State on schedule. RECOMMENDATION Staff recommends that the City of Renton Council concur and authorize the Mayor and City Clerk to sign and execute the resolution formally adopting the City of Renton's Emergency Management Plan, as well as sign the Emergency Management Plan prior to submittal to the State. The roster will be valid for the period from January 2009 to January 2010, with the option of extending the roster annually in 2010 and 2011. WHEREAS, pursuant to Chapter 38.52 RCW, each political subdivision of the state is authorized and directed to establish a local organization for emergency services in accordance with the State Emergency Services Plan and Program; and WHEREAS, pursuant to RCW 38.52.070, each such political subdivision must adopt a plan for the operation of its emergency services organization; and WHEREAS, the City of Renton Fire and Emergency Services Department has prepared an Emergency Management Plan; and WHEREAS, the City of Renton City Council, by Resolution No. 3411, authorized the adoption of an Emergency Response Plan, now called Emergency Management Plan; and WHEREAS, the Emergency Management Plan has been updated and expanded; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS: SECTION I. The above recitals are found to be true and correct in all respects. SECTION II.
