SPECIAL Linda Herzog,Interim Assistant to the CAO,reported that the franchise with PRESENTATIONS Comcast Cable expires in 2008, and introduced Mike Bradley of Bradley and City Clerk: Cable Television Guzzetta who has been retained by the City to assist with the franchise renewal Franchise Renewal,Bradley process. Mr. Bradley explained that cable operators are required to have a and Guzzetta franchise with a city before they can provide cable services. He noted that cable operators occupy public rights-of-way, which is a valuable right. Mr. Bradley stated that the cable franchise renewal process is an opportunity for the City to reflect back on the past performance of the cable operator, and to assess the community's needs. He pointed out that some of the issues the City will address are as follows: the ability to manage and to receive fees for the public rights-of-way; the ability to regulate cable rates and programming; construction; institutional networks;public educational and governmental access; and customer service standards. Continuing, Mr. Bradley discussed the work plan, which includes reviewing the current cable franchise compliance;conducting a needs assessment; drafting a needs assessment report, franchise agreement, staff report,and request for renewal proposals (RFRP);presenting the reports to Council; issuing the RFRP; and receiving the formal renewal proposal from Comcast. In conclusion, Mr.Bradley stressed that the more the City prepares,the more successful the cable franchise renewal process will be. In response to the inquiries of Mayor Pro Tern Corman and Councilmember Clawson,Mr. Bradley said the renewal process will take approximately one and one-half years, and the issues expected to arise during negotiations include the franchise fee, definition of gross revenue, funding for governmental and public access television, and customer service. Councilman Law commented on the frustration in dealing with a monopoly. He noted the lengthy and expensive renewal process, and the possibility of teaming up with other jurisdictions. Responding to Councilman Law's inquiry,Ms. Herzog stated that depending on the length of the franchise renewal process,the cost of the consultant contract can range from$58,000 to$150,000 or more for the entire renewal process(2006-2008), with$102,500 budgeted for 2006. March 13,2006 Renton City Council Minutes Page 64 Councilman Persson noted that the cable franchise fees the City receives are funding the renewal process. Community Services: 2006 Daniel Johnson, President/CEO of Boys &Girls Clubs of King County, State Youth of the Year,Boys reported that last Tuesday at the Governors mansion, Governor Gregoire &Girls Club announced that 2006 King County Youth of the Year Kelly Barefield was selected as the 2006 State Youth of the Year for the Boys &Girls Clubs. He stated that Ms. Barefield competed against 20 organizations around the State, and will go on to compete at the regional level. Mr. Johnson introduced Ms. Barefield, saying that she is a senior at Renton High School, is involved in many activities, and is a volunteer and active member of the Renton/Skyway Boys &Girls Club. Ms. Barefield described the obstacles she and her family have overcome, and she credited the Boys and Girls Club for helping her realize her self-worth and potential. ADMINISTRATIVE Chief Administrative Officer Jay Covington reviewed a written administrative REPORT report summarizing the City's recent progress towards goals and work programs adopted as part of its business plan for 2006 and beyond. Items noted included: * The Washington State Department of Transportation will hold a public hearing on March 22nd at the Renton Senior Activity Center to receive comments on a recently issued Environmental Assessment of the planned I- 405 Renton to Bellevue project, which includes safety and congestion relief improvements along I-405 from SR-169 to I-90. * The Recreation Division's Special Olympic Basketball Teams, a total of 32 athletes,recently participated in the State tournament in Wenatchee. SEATTLE METROPOLITAN CREDIT UNION Presents King County Youth of the Year Kelly Barefield Benaroya Hall, Seattle, February 2°d. This afternoon, Kelly Barefield of Renton/ Skyway was selected, among 13 candidates, for the distinction of 2006 King County Youth of the Year. The award is part of Boys& Girls Clubs of America's premier youth recognition program. A panel of judges interviewed Barefield and the other candidates, and each honoree gave a speech before a gathering of community and business leaders, family, and friends. Kelly Barefield, is a senior at Renton High School, has been a member of the Renton/ Skyway Boys& Girls Club for two years and is now a staff member at the Club. At today's award luncheon, the 17 year old Barefield captured the audience as she talked about what the Club means to her, as a home and a place of comfort. "It's the one place where I always feel welcomed and open to be myself, a place to come whenever I need someone to talk to or lean on, to always feel appreciated. Looking back, "I have learned how to overcome painful challenges and deal with adversity. I have gained strength and perseverance, learning to keep going no matter how hard life treat's you." She is now the President of the Renton/Skyway Keystone Club,teaches Dance Club, and is a positive influence with all the teens. Kelly Barefield will now compete for the title of Washington State Youth of the Year, held at the Governors mansion, with the chance to advance to regional and national levels. The program recognizes scholastics, moral character, life goals,and service to family and communit\. Barefield will receive a$2,500 scholarship, made possible by the Arlene Brooks-Bull Scholarship Fund and a Nintendo Game cube. This year's other youth honorees were Carl Herman (Bainbridge Island), Louie Grill (Federal Way), Asmara Andom (Southwest), Lora Mednick(Mercer Island), Addie Morton (Wallingford), Suzanne Hall (Ballard), Amber Rogers (Kirkland), Melina Bobbitt (Rainier Vista), Erick Cable(Redmond/Sammamish), Marques Camp(North Seattle), Zach Teshome (Rotary), and Toreasia Woods (IWASIL). This year's judges were: Bob Harvey CEO, Seattle Metropolitan Credit Union; Brad Chase, formerly from Microsoft;John Miller, Cushman & Wakefield; Dr Constance Rice, Casey Family Programs; John Joly, Seattle Post Intelligencer; and Rich White, The Boeing Company. The hearing will be conducted from 4:00 to 7:00 p.m. at the Renton Senior Activity Center, located at 211 Burnett Avenue North, in an informal, open-house format allowing for one-on-one discussion with project staff. Comments also may be submitted in writing to Allison Ray, I-405 Project Environmental Manager, at 600 108th Avenue NE, Suite 405, Bellevue, WA 98004, or by email at Allison.ray@i405.wa.gov. Written comments received or postmarked by April 14th will be included in the formal project record. Administrative Report March 13,2006 Page 2 COMMUNITY SERVICES DEPARTMENT • The Recreation Division's Special Olympic Basketball Teams participated at the State Tournament in Wenatchee on March 3rd, 4th, and 5th. A total of 32 athletes attended the tournament. One Renton team won the gold medal, another won the silver, and another the bronze. For individual skills, Patti Zvarich won the gold and Christ Strano won the silver. • The Missoula Children's Theater is coming to Renton with a production of"Robin Hood." Auditions for grades kindergarten through 12 will be held at the Renton Community Center on Monday, March 27th, at 4:30 p.m. Pre-registration is required. Robin Hood will be performed at Carco Theatre at 3:00 and 7:00 p.m. on Saturday, April 1st. For more information, call 425- 430-6700. • Thank you to the City of Renton Fire Department for donating 72 smoke detectors to the Renton Housing Repair Assistance Program. The program installs smoke detectors, carbon monoxide detectors, and earthquake straps for hot water tanks in every home assessed. PLANNINGBUILDING/PUBLIC WORKS DEPARTMENT • The Washington State Department of Transportation is in the process of installing an all-way stop for the northbound on- and off-ramps at the NE 44th/I-405 interchange. The intersection is being re-striped to accommodate the all-way stop. These revisions will help to address safety problems at the intersection that have been pointed out by citizens and City Councilmembers. That is, the parties intend that, if approved, such early dedication would not result in additional cost to or dislocation of Renton Plant Operations. 4.1.6.2 Should there be Owner buildings located in the rights of way, it shall be the responsibility of Owner to, at such time as the road needs to be constructed, and upon Renton's request, (a) demolish such buildings and(b) cap and abandon any underground facilities that would interfere with Renton's use of the dedicated property for right of way purposes. 4.1.6.3 Park Avenue is constructed asymmetrically within the current right of way. Expansion of Park Avenue anticipates use of the existing road. Some additional realignment may be necessary to connect Park Avenue to Logan. Owner will dedicate the necessary right of way to realign Park Avenue to provide symmetrical right of way and as anticipated for expansion under Exhibit 2. Renton will vacate any excess right of way created by such realignment, at no expense to Owner. Should Owner have a building occupying property that would need to be dedicated to Renton for right of way, then Owner shall grant the right of way, except for the portion occupied by the building. RECOMMENDATION: Adopt a list of urban planning consultants qualified to assist staff in various community design, urban planning, and economic development projects. BACKGROUND SUMMARY: The City currently does not have an appropriate consultant roster from which to select consultants to respond to various tasks that are periodically required for City projects, since our last roster expired in December 2005. Consultants responded to a"Statement of Qualifications" advertisement issued by the City in January. After reviewing the responses, City staff made a list, noted their areas of expertise indicated, and whether the City has used their services previously. The recommended roster is attached. The list will be valid for three years following adoption. DISCUSSION: The City of Renton is facing unprecedented opportunities and challenges in the area of transportation. Not only will approximately$300 million in improvements along the I- 405 corridor in Renton be constructed by the State Department of Transportation over the next several years, but also other major regional transportation issues such as RTID and Sound Transit 2 may be brought before the public in the form of multi-billion dollar ballot initiatives. Renton's opportunity and challenge will be to position itself to obtain h:\division.s\admin\gregg\deputyadmin.doc Reorganization P/B/PW Page 2 of 3 March 6,2006 both roadway and transit system improvements that will reduce congestion, provide modal options, and provide improved connectivity to the regional transportation system. In addition, Renton has adopted a transportation capital improvement plan of unprecedented size for the year 2006. This $33 million program will include five major construction projects: SW 27th/Strander Blvd. Segment 1; South Lake Washington Road Improvements (the Landing); Duvall Ave. improvements; SR 169 improvements; and the Sunset/Duvall Intersection improvements. Design will be performed for the Rainier/Hardie Transit/Multi-modal project as well. Renton will have only the opportunity currently before us to improve and optimize these major transportation initiatives. Plans that get approved and infrastructure that gets built will be with us for many years to come. These projects will support our collective efforts to move Renton to the next level as a vibrant urban destination at the south end of Lake Washington. It is critical that these projects and planning efforts be managed with a high degree of insight and professionalism. This requires visionary leadership and capable management from the individual that Renton hires to lead the efforts of the Transportation Systems Division. After three of the five Transportation Systems Division managers left the City in the beginning of 2006, we were fortunate to procure the services of two seasoned and talented transportation professionals on an interim basis to help us through this difficult transition period. These two individuals, Peter Hahn serving as interim Transportation Systems Director, and Rich Perteet serving as interim Transportation Engineering Supervisor, have used their considerable background, skills and insight to keep us on track as we move forward under these challenging circumstances. Meanwhile we have advertised the open Transportation Planning Supervisor and Transportation Engineering Supervisor positions in an attempt to fill them with permanent staff After a two-month search involving several application deadline extensions, we have received few applications for the Transportation Engineering Supervisor position and not many more for the Planning Supervisor position. This experience has tended to confirm what we suspected would be the case. With the approval of the WSDOT Nickel and Transportation Partnerships transportation packages, engineering consultant firms are gearing up to meet the heavy work demand load by hiring the best available talent in the areas of transportation planning and engineering. Just when Renton needs the top professionals in the transportation field to help us take advantage of our opportunities, candidates with these qualifications are in high demand and are hard to come by. Consultants are hiring engineers and planners with salary and in some cases bonus offers that cities cannot match. Previous Transportation Engineering Supervisor Leslie Lahndt was one such professional recently hired by a consulting firm. These circumstances, along with recognition of the growing need to provide transportation infrastructure improvements in order to further the City's Business Plan goals, have led us to conclude that in order to attract a transportation leader of the caliber we will need to achieve success, a re-organization of the Planning/Building/Public Works Department is in order. The proposal before you promotes the Transportation Systems Director position, currently at pay grade m38, to a Deputy Administrator position at pay h:\division.s\admin\gregg\deputyadmin.doc Reorganization P/B/PW Page 3 of 3 March 6,2006 grade m45 —the same grade as the deputy Police and Fire Chief positions. This promoted position will continue to lead the Transportation Systems Division and will remain focused on transportation issues. Peter Hahn, as his attached resume shows, is a talented and seasoned transportation professional who directed 650 employees during his 13 year tenure as Snohomish County's Public Works Director. For the preceding 8 years he served as the City of Edmond's Community Services Director, managing a staff of 230 employees. Peter, who holds Masters degrees from Harvard University and USC, is a well-known and widely respected transportation leader in the Puget Sound region. He has a much-deserved reputation as a problem solver and innovative thinker, and his opinions are valued and influential among his peers. He is both forceful and persuasive: qualities very much needed in a regionally competitive environment like transportation. After experiencing and being intrigued by the Renton's opportunities, Peter has expressed his interest in accepting a permanent position with the City as long as a position and salary package commensurate with his qualifications can be offered. He has indicated that he would accept a permanent position as Deputy Administrator—Transportation at Step E of the m45 grade. Mr. Hahn will also be provided initial sick leave and vacation balances in recognition of his experience and tenure. CONCLUSION: It is our opinion that a reorganization and reclassification of the Transportation Systems Division Director position to the level of Deputy Administrator is needed in order to attract an individual with the qualifications needed to assist us to succeed with our unprecedented transportation opportunities and challenges. It is also our opinion that we will not be able to find an individual more suited by background, skills, abilities, and regional prestige to fill this position than Peter Hahn. Therefore we are recommending that the City Council approve a reorganization of the Planning/Building/Public Works Department such that the Transportation Systems Division Director is reclassified to a Deputy Administrator—Transportation at pay grade m45. In addition, the Program allows the City to request reimbursement for travel and representation for expenses incurred by staff serving on Program committees. Currently, both Mayor Kathy Keolker and Linda Knight, Solid Waste Coordinator, serve on Program committees. In 2003, the City of Renton entered into an agreement with the Program that defined roles and responsibilities of each party and enabled the City's Solid Waste Utility to receive Program funding for implementation of hazardous waste programs that support Program Council/2006 LHWMP Grant February 23,2006 Page 2 of 2 goals. The Washington State Department of Ecology in accordance with RCW 70.105.220 subsequently approved the Plan. The City is an active and valued partner in the regional Local Hazardous Waste Management Program(hereafter referred to as the"Program"). The City will also provide a minimum of 25 hazardous waste reduction workshops to grades 1-6 and organically manage the Integrated Pest Management Model Garden. Travel and related expenses incurred for one city member to attend LHWMP meetings and events will be reimbursed. Responsibilities of the Parties The responsibilities of the parties to this Contract shall be as follows: A. The City 1. The City shall develop and submit project proposals and budget requests to the Program's Contract Administrator. Funds provided to the City by the Local Hazardous Waste Management Program pursuant to this Contract shall be used to implement hazardous waste programs and/or services as approved by the MCC. 2. For reimbursement the City shall submit the following to the Contract Administrator: a) An invoice(see Exhibit II). Invoices should be sent to the Contract Administrator for approval and payment. b) A brief description of activity accomplished and funds expended in accordance with the scope of work. c) Copies of invoices for expenditures or a financial statement prepared by the City's finance department. The fmancial statements should include vendor names,a description of services provided,date paid and a check or warrant number. 3. The City shall notify the Contract Administrator no later than December 15t regarding the amount of outstanding expenditures for which the City has not yet submitted a reimbursement request. • 4. It is the responsibility of the City to comply with all applicable county, state and/or federal reporting requirements with respect to the collection and transfer of moderate risk wastes. The City shall report to the Contract Administrator the quantity,by type,of moderate risk waste collected using Program funds. The City shall also provide the Contract Administrator with copies of EPA's Non- Hazardous Waste Manifest or similar form, associated with the transport of moderate risk waste collected through Program-funded events. 5. The City is solely responsible for any and all spills,leaks or other emergencies arising at the facilities associated with the City's events or in any other way associated with activities conducted within the scope of this Contract. In the event of a spill or other emergency,the City is responsible for complying with all applicable laws and regulations. 6. The City agrees to appropriately acknowledge the Program in all media produced—in part or in whole—with Program funds. The intent of this provision is to further strengthen this regional partnership in the public's mind. 7. The City agrees to provide the Program with copies of all media material produced for local hazardous waste management events or activities that have been funded by the Program. The City also agrees to allow the Program to reproduce media materials created with Program money provided that the Program credits the City as the originator of that material. 8. BACKGROUND SUMMARY: King County Solid Waste Division(KCSWD) established a Waste Reduction and Recycling Grant Program for cities that participate in the King County Comprehensive Solid Waste Management Plan. This grant provides funding to further the development and enhancement of local waste reduction and recycling projects and for broader resource conservation projects that integrate with waste reduction and recycling programs. In an effort to reduce unnecessary paperwork and staff time, and to increase program efficiency, the County combined two former grant programs, including the City Optional Program and the WR/R Program into one grant, now referred to as the Waste Reduction and Recycling Grant. The Waste Reduction and Recycling Grant offers cities more flexibility in the allocation of funding to projects that more closely align with cities' priorities for waste reduction/recycling and resource conservation projects. Projects of past grant programs provided by KCSWD were more narrowly defined. This new grant also authorizes the distribution of 2006 and 2007 funds, without requiring an amendment 3 Council\2006-2007 WRR Grant February 22,2006 Page 2 of 3 for 2007 funds. However, 2007 funds are not available until January 1, 2007, and only after the County Council passes their 2007 Budget. The Projects Renton's Solid Waste Utility began implementation of the Business Recycling Program in 1993 with funding from the Department of Ecology. The program continued through 2003 with funding from the King County City Optional Program and the Waste Reduction and Recycling Grant. The Business Recycling Program seeks to increase business and institution recycling, waste reduction and buy recycled activities through technical assistance. Contact with the business community through the Business Recycling Program has been very positive. Research has shown that commercial recycling rates fall when attention and technical assistance to business recycling declines. The City's sustained emphasis of the Business Recycling Program will continue to reinforce the positive waste reduction and recycling strategies that place Renton among the top commercial recycling performers. The Special Recycling Events (Recycling Days) have grown in popularity and the volume of materials recycled since their inception in 1990. These events serve over a thousand households each year. Recycling Days serve the community well and provide an opportunity for Renton residents to recycle a higher volume of materials while improving the appearance of their neighborhoods through the process of a general clean- up/recycle event. In 2003/2004, the County provided additional funding to Renton to expand the Recycling Days to unincorporated county customers who live just outside the Renton City limits. While we've never discriminated between city and unincorporated county customers, this additional funding allows us to recover all costs associated with serving this population. The additional allocation is applied directly to the Recycling Days, providing for increased per-dollar efficiency of the events while allowing the Solid Waste Utility the flexibility to fund other areas of need. The ReUse It! Renton (Stop & Swap) was piloted in 2005 under the Clean Sweep umbrella of projects aimed at neighborhood improvement. This popular program provided a venue for residents to bring unwanted but still useable household goods and construction materials. Residents in need of materials were invited to come and take useable materials home. This program not only diverted materials from the landfill but also fulfilled a need of some of our community's most vulnerable populations. Through the Waste Reduction and Recycling Grant Program, the Solid Waste Utility continues its Natural Yard Care Program. Piloted in 2001, this program worked directly with residents of recruited Renton neighborhoods to teach them alternative yard care management strategies and provided them with appropriate tools to be successful. The goal of this program is to find an effective and sustainable method to teach Renton residents how to reduce their reliance on chemicals in the maintenance of their yards. Evaluation of the program has indicated residents' adoption of many of the strategies taught, leading ultimately to healthier landscapes. The 2006 strategy for the Natural Yard Care Program expands our outreach to residents through four(4) seasonally-targeted workshops available to any resident. In addition, staff will begin researching residential utilization of small landscape businesses and their management strategies. This Agreement has been authorized by the legislative body of each party as designated below: King County Ordinance No. 2003-0462 City PREAMBLE King County and the City of Renton adopted the 2001 King County Comprehensive Solid Waste Management Plan, which includes waste reduction and recycling goals. In order to help meet these goals, the King County Solid Waste Division has established a waste reduction and recycling grant program for the cities that operate under the King County Comprehensive Solid Waste Management Plan. This program provides funding to further the development and/or enhancement of local waste reduction and recycling projects and for broader resource conservation projects that integrate with waste reduction and recycling programs and direction. This grant program does not fund household hazardous waste collection activities. Program eligibility and grant administration terms are discussed in the Grant Guidelines, attached to this agreement as Exhibit B. Grant funding for this program is subject to the yearly budget approval process of the King County Council. Grant funding approved by the King County Council is available to all King County cities that operate under the King County Comprehensive Solid Waste Management Plan. The City will spend its grant funds to fulfill the terms and conditions set forth in the scope of work which is attached hereto as Exhibit A and incorporated herein by reference. The County expects that any information and/or experience gained through the grant program by the City will be generously shared with the County and other King County cities. I. PURPOSE The purpose of this Agreement is to define the terms and conditions for funding to be provided to the City of Renton by the County for waste reduction and recycling programs and/or services as outlined in the scope of work and budget attached as Exhibit A. 1 II. RESPONSIBILITIES OF THE PARTIES The responsibilities of the parties to this Agreement shall be as follows: A. The City 1. Funds provided to the City by the County pursuant to this Agreement shall be used to provide waste reduction and recycling programs and/or services as outlined in Exhibit A. The total amount of funds available from this grant in 2006 shall not exceed$102,274. The City understands that even though this agreement is two years in duration, funding for this program is subject to the yearly budget approval process of the King County Council. 2. This agreement provides for distribution of 2006 and 2007 grant funds to the City. However, 2007 funds are not available until January 1, 2007, and 2007 funding is contingent upon King County Council approval of the 2007 King County budget. 3. During the two year grant program, the City will submit a minimum of two,but no more than eight, progress reports to the County in a form approved by the County. Reports must be signed by a city official. These reports will include: a) a description of each activity accomplished pertaining to the scope of work; and b) reimbursement requests with either copies of invoices for each expenditure for which reimbursement is requested or a financial statement,prepared by the city's finance department,that includes vendor name, description of service, date of service,date paid and check number. If the City chooses to submit up to the maximum of eight (8) progress reports and requests for reimbursement during the two year grant program, they shall be due to the County on the last day of the month following the end of each quarter- April 30,July 30, October 31, January 31 - except for the final progress report and request for reimbursement which shall be due by March 31, 2008. If the City chooses to submit the minimum of two progress reports and requests for reimbursement during the two year grant program, they shall be due to the County on January 31, 2007 and March 31, 2008. Regardless of the number of progress reports the City chooses to submit, in order to secure reimbursement, the City must provide in writing to the County by the 5th working day of January 2007 and January 2008, the dollar amount of outstanding expenditures for which the City has not yet submitted a reimbursement request. 3. The City shall submit a final report to the County which summarizes the work completed under the grant program and evaluates the effectiveness of the projects for which grant funds were utilized, according to the evaluation methods specified in the scope of work. The final report is due within six months of completion of the project(s) outlined in the scope of work, but no later than June 30, 2008. 2 4. If the City accepts funding through this grant program for the provision of Waste Reduction and Recycling programs and projects for other incorporated areas of King County, the City shall explain the relationship with the affected adjacent city or cities that allows for acceptance of this funding and the specifics of the proposed programs and projects within the scope of work document related thereto. 5. The City shall be responsible for following all applicable Federal, State and local laws, ordinances, rules and regulations in the performance of work described herein. The City assures that its procedures are consistent with laws relating to public contract bidding procedures, and the County neither incurs nor assumes any responsibility for the City's bid, award or contracting process. 6. During the performance of this Agreement, neither the City nor any party subcontracting under the authority of this Agreement shall discriminate on the basis of race, color, sex, religion, nationality, creed, marital status, sexual orientation, age, or presence of any sensory, mental, or physical handicap in the employment or application for employment or in the administration or delivery of or access to services or any other benefits under this Agreement as defined by King County Code, Chapter 12.16. 7. During the performance of this Agreement, neither the City nor any party subcontracting under the authority of this Agreement shall engage in unfair employment practices as defined by King County Code, Chapter 12.18. The City shall comply fully with all applicable federal, state and local laws, ordinances, executive orders and regulations that prohibit such discrimination. These laws include, but are not limited to, RCW Chapter 49.60 and Titles VI and VII of the Civil Rights Act of 1964. 8. The City shall use recycled paper for the production of all printed and photocopied documents related to the fulfillment of this Agreement. The City shall use both sides of paper sheets for copying and printing and shall use recycled/recyclable products wherever practical. 9. The City shall maintain accounts and records, including personnel, financial, and programmatic records, and other such records as may be deemed necessary by the County, to ensure proper accounting for all project funds and compliance with this Agreement. All such records shall sufficiently and properly reflect all direct and indirect costs of any nature expended and service provided in the performance of this Agreement. These records shall be maintained for a period of six (6) years after termination hereof unless permission to destroy them is granted by the Office of the State Archivist in accordance with RCW Chapter 40.14. These accounts shall be subject to inspection, review or audit by the County and/or by federal or state officials as so authorized by law. 10. The City shall maintain a record of the use of any equipment that costs more than $1,000 and is purchased with grant funds from King County for a total period of three (3) years. The records shall be compiled into a yearly evaluation report, a copy of which shall be submitted to King County by March 31 of each year through the year 2010. 3 11. The City agrees to credit King County on all printed materials provided by the County, which the City is duplicating, for distribution. Either King County's name and logo must appear on King County materials (including fact sheets, case studies,etc.),or, at a minimum, the City will credit King County for artwork or text provided by the County as follows: "artwork provided courtesy of King County Solid Waste Division" and/or"text provided courtesy of King County Solid Waste Division." 12. The City agrees to submit to the County copies of all written materials which it produces and/or duplicates for local waste reduction and recycling projects which have been funded through the waste reduction and recycling grant program. Upon request, the City agrees to provide the County with a reproducible copy of any such written materials and authorizes the County to duplicate and distribute any written materials so produced, provided that the County credits the City for the piece. 13. If the City accepts funding through this grant program for the provision of recycling collection events for adjacent areas of unincorporated King County, the City shall send announcements of the events to all residences listed in the carrier routes provided by King County. The announcements and all other printed materials related to these events shall acknowledge King County as the funding source. 14. The City understands that funding for recycling collection events for adjacent areas of unincorporated King County will be allocated on a yearly basis subject to the King County Council's yearly budget approval process and that provision of funds for these events is not guaranteed for the second year of the grant program. 15. This project shall be administered by Linda Knight, Solid Waste Coordinator; City of Renton; 1055 South Grady Way, 5th Floor, Renton, WA 98055;425-430-7397; lknight@ci.renton.wa.us, or designee. B. The County: 1. The County shall administer funding for the waste reduction and recycling grant program. Funding is designated by city and is subject to the King County Council's yearly budget approval process. Provided that the funds are allocated through the King County Council's yearly budget approval process, grant funding to the City will include a base allocation of$5,000 per year with the balance of funds to be allocated according to the city's percentage of King County's residential and employment population. However, if this population based allocation formula calculation would result in a city receiving less than$10,000 per year, that city shall receive an additional allocation that would raise their total grant funding to$10,000 per year. The City of Renton's budgeted grant funds for 2006 are $102,274. This includes $38,114 for providing Recycling Collection Events to residents of unincorporated King County that are included in the carrier routes as provided to the City by the County. Unspent 2006 funds may be carried over to 2007, but 2007 funds will not carry over to 2008. 4 The City of Renton`s estimated grant funds for 2007 are$102,274. 2007 funds are not available until January 1, 2007, and 2007 funding is contingent upon King County Council approval of the 2007 King County budget. Following approval of the 2007 King County budget, the County's grant program administrator will notify the city of the final 2007 grant funding. 2. Within forty-five (45) days of receiving a request for reimbursement from the City, the County shall either notify the City of any exceptions to the request which have been identified or shall process the request for payment. If any exceptions to the request are made, this shall be done by written notification to the City providing the reason for such exception. The County will not authorize payment for activities and/or expenditures which are not included in the scope of work and budget attached as Exhibit A, unless the scope has been amended according to Section V of this Agreement. King County retains the right to withhold all or partial payment if the City's report(s) and reimbursement request(s) are incomplete (i.e., do not include proper documentation of expenditures and/or adequate description of each activity described in the scope of work for which reimbursement is being requested), and/or are not consistent with the scope of work and budget attached as Exhibit A. 3. The County agrees to credit the City on all printed materials provided by the City to the County, which the County duplicates, for distribution. Either the City's name and logo will appear on such materials (including fact sheets, case studies, etc.), or, at a minimum, the County will credit the City for artwork or text provided by the City as follows: "artwork provided courtesy of the City of Renton" and/or"text provided courtesy of the City of Renton". 4. The County retains the right to share the written material(s)produced by the City which have been funded through this program with other King County cities for them to duplicate and distribute. In so doing, the County will encourage other cities to credit the City on any pieces that were produced by the City. 5. The waste reduction and recycling grant program shall be administered by Morgan John, a Project Manager, or designee, to be specified by the King County Solid Waste Division. III. DURATION OF AGREEMENT This Agreement shall become effective on either January 1, 2006 or the date of execution of the Agreement by both the County and the City, if executed after January 1, 2006 and shall terminate on December 31, 2007. However, if execution by either party does not occur until after January 1, 2006, this Agreement allows for disbursement of grant funds to the City for County-approved programs initiated between January 1, 2006 and the later execution of the Agreement provided that the City complies with the reporting requirements of Section II. A of the Agreement. IV. TERMINATION A. This Agreement may be terminated by King County, in whole or in part, for convenience without cause prior to the termination date specified in Section III, upon thirty (30) days advance written notice B. This Agreement may be terminated by either party, in whole or in part, for cause prior to the termination date specified in Section III, upon thirty (30) days advance written notice. Reasons for 5 termination for cause may include but not be limited to: nonperformance; misuse of funds; and/or failure to provide grant related reports/invoices/statements as specified in Section II.A.3. and Section II.A.4. C. If the Agreement is terminated as provided in this section: (1) the County will be liable only for payment in accordance with the terms of this Agreement for services rendered prior to the effective date of termination; and(2) the City shall be released from any obligation to provide further services pursuant to this Agreement. D. Nothing herein shall limit, waive, or extinguish any right or remedy provided by this Agreement or law that either party may have in the event that the obligations, terms and conditions set forth in this Agreement are breached by the other party. V. AMENDMENTS This Agreement may be amended only by written agreement of both parties. Amendments to scopes of work will only be approved if the proposed amendment is consistent with the most recently adopted King County Comprehensive Solid Waste Management Plan. Funds may be moved between tasks in the scope of work, attached as Exhibit A, only upon written or verbal request by the City and written or verbal approval by King County. Such requests will only be approved if the proposed change(s) is (are) consistent with and/or achieves the goals stated in the scope and falls within the activities described in the scope VI. HOLD HARMLESS AND INDEMNIFICATION The City shall protect,indemnify, and hold harmless the County, its officers, agents, and employees from and against any and all claims, costs, and/or issues whatsoever occurring from actions by the City and/or its subcontractors pursuant to this Agreement. The City shall defend at its own expense any and all claims, demands, suits, penalties, losses, damages, or costs of any kind whatsoever(hereinafter "claims") • brought against the County arising out of or incident to the City's execution of, performance of or failure to perform this Agreement. Claims shall include but not be limited to assertions that the use or transfer of any software, book, document, report, film, tape, or sound reproduction or material of any kind, delivered hereunder,constitutes an infringement of any copyright, patent, trademark, trade name, and/or otherwise results in unfair trade practice. 6 • VII. INSURANCE A. The City, at its own cost, shall procure by the date of execution of this Agreement and maintain for the duration of the Agreement, insurance against claims for injuries to persons or damages to property which may arise from or in connection with performance of work pursuant to this Agreement by the City, its agents, representatives, employees, and/or subcontractors. The minimum limits of this insurance shall be $1,000,000 general liability insurance combined single limit per occurrence for bodily injury, personal injury, and property damage. Any deductible or self-insured retentions shall be the sole responsibility of the City. Such insurance shall cover the County, its officers, officials, employees, and agents as additional insureds against liability arising out of activities performed by or on behalf of the City pursuant to this Agreement. A valid Certificate of Insurance is attached to this Agreement as Exhibit C, unless Section VII.B. applies. B. If the Agency is a Municipal Corporation or an agency of the State of Washington and is self-insured for any of the above insurance requirements, a written acknowledgement of self-insurance is attached to this Agreement as Exhibit C. VIII. ENTIRE CONTRACT/WAIVER OF DEFAULT This Agreement is the complete expression of the agreement of the County and City hereto, and any oral or written representations or understandings not incorporated herein are excluded. Waiver of any default shall not be deemed to be a waiver of any subsequent default. Waiver of breach of any provision of this Agreement shall not be deemed to be waiver of any other or subsequent breach and shall not be construed to be a modification of the terms of this Agreement unless stated to be such through written approval by the County, which shall be attached to the original Agreement. IX. TIME IS OF THE ESSENCE The County and City recognize that time is of the essence in the performance of this Agreement. X. SEVERABILITY • If any section, subsection, sentence, clause or phrase of this Agreement is, for any reason, found to be unconstitutional or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions. 7 XI. Program/Project Specifics 1) Background/History: The City of Renton, Washington began an ambitious commercial recycling program in 1993 in order to increase resource efficiency among its business community and meet King County's recycling goals of 65%by 2000. Because Renton recognizes the impact businesses can have to the overall waste reduction/recycling objective of the region, it has continued to focus efforts in this sector. While earlier efforts focussed on citywide canvassing of businesses, more recent efforts have focussed on specific industry types and the institutional sector. The City anticipates adding commercial recycling services to its contracted collection services in 2006. 2) Program/Project Description: Assuming the City is successful in adding a provision for commercial recycling services to its solid waste contract,the City will seek consultant proposals for its Business Recycling Program. The selected consultant will assist in promoting the new program to all Renton businesses and institutions. Technical assistance will be provided to businesses and institutions that have a desire to reduce waste, buy recycled and improve internal recycling collection systems. Focused assistance will continue with the Renton School District as we strive to persuade all schools and district facilities to implement strong waste reduction&recycling practices. New approaches to targeting and assisting businesses may be established. The City and its consultant will coordinate with other State and local agencies implementing aspects of business recycling programs. Examples include use of King County Solid Waste Division's CDL resource guide,and green building materials. Consultant staff will be encouraged to coordinate their efforts with County staff implementing Commercial Recycling outreach to increase effectiveness of the outreach. Goal: To increase residential awareness of yard care management strategies that improves the health of the landscape while decreasing reliance on the City's curbside yard waste collection program. e. Program/Project Specifics 1) Background/History: In 1995 and 1996 the City implemented a residential compost program targeting food waste. This program was successful in recruiting and teaching 250 residents in the proper methods of composting food waste with worm bins. An extensive evaluation of the program was conducted and indicated that the majority of the participants were successful in harvesting compost from their bins. Although the program was successful and fun to manage, staff realized how intensive worm bins can be for many residents. Staff also recognized that the amount of diversion realized from the program was small and that achievement of a higher diversion(from curbside) might only be realized by concentrating efforts to educate residents of the merits and methods of backyard, yard waste composting. In 1997 the City began educating residents on yard waste composting and delivery of backyard compost bins. In 2001, the City conducted a Natural Lawn care pilot program in the Kennydale neighborhood. Working with the residents,the City conducted 4 workshops in resident's homes, targeting specific messages to encourage residents to manage their lawns in an ecologically friendly manner. Workshops concentrated on grasscycling, backyard&food waste composting, water conservation,and organic fertilization. Specific tools were provided to aid residents in their efforts to change their behaviors. Through 2005 the City continued with this program in two distinct neighborhoods and broadened the message to incorporate natural"yard"care strategies similar to the 2001 pilot. Program Project Description While response to the program has been positive and has demonstrated behavior change in participants, the City will broaden its Natural Yard Care Program in 2006 to target a wider audience. The City will host a series of 4 seasonal Natural Yard Care workshops. The series will be open to the general public and will address Natural Yard care strategies. In addition, the City will begin research of Landscape/Garden professionals doing business in our community. The research will focus around English language learner landscape/garden professionals. Information gained through our research will be used to develop strategies to educate and promote Natural Yard care management strategies to these businesses. The event will be held at a central location in the City. It will provide an opportunity for residents of the greater Renton community to exchange materials that still have some useful life, but are no longer of value to the original owner. Residents will be able to drop off furniture, toys, household goods, sports equipment, doors, windows, and other materials approved by Renton staff. Residents may also come to the event to take home materials others have dropped off. Materials not claimed by the end of the event will be recycled or land filled. Because Renton recognizes the impact businesses can have to the overall waste reduction/recycling objective of the region, it has continued to focus efforts in this sector. While earlier efforts focussed on citywide canvassing of businesses, more recent efforts have focussed on specific industry types and the institutional sector. The City added commercial recycling services to its contracted collection services in 2006. 2) Program/Project Description: The City procured consultant proposals for its Business Recycling Program for 2006/07. The City will provide the County with a copy of the consultant contract for this program that outlines the tasks associated with program delivery,deliverables and evaluation measures. Technical assistance will be provided to businesses and institutions that have a desire to reduce waste, buy recycled and improve internal recycling collection systems. Focused assistance will continue with the Renton School District or other institutions as we strive to get all schools and district facilities to implement strong waste reduction &recycling practices.New approaches to targeting and assisting businesses may be established. The City and its consultant will coordinate with other State and local agencies implementing aspects of business recycling programs. Examples include use of King County Solid Waste Division's CDL resource guide,and Portland Metro's Job site Recycling case study fact sheets. Goal: To increase residential awareness of yard care management strategies that improves the health of the landscape while decreasing reliance on the City's curbside yard waste collection program. e. Program/Project Specifics 1) Background/History: In 1995 and 1996 the City implemented a residential compost program targeting food waste. This program was successful in recruiting and teaching 250 residents in the proper methods of composting food waste with worm bins. An extensive evaluation of the program was conducted and indicated that the majority of the participants were successful in harvesting compost from their bins. Although the program was successful and fun to manage, staff realized how intensive worm bins can be for many residents. Staff also recognized that the amount of diversion realized from the program was small and that achievement of a higher diversion(from curbside) might only be realized by concentrating efforts to educate residents of the merits and methods of backyard,yard waste composting. In 1997 the City began educating residents on yard waste composting and delivery of backyard compost bins. In 2001, the City conducted a Natural Lawn care pilot program in the Kennydale neighborhood. Working with the residents,the City conducted 4 workshops in resident's homes,targeting specific messages to encourage residents to manage their lawns in an ecologically friendly manner. Workshops concentrated on grasscycling, backyard&food waste composting, water conservation, and organic fertilization. Specific tools were provided to aid residents in their efforts to change their behaviors. Through 2005 the City continued with this program in two distinct neighborhoods and broadened the message to incorporate natural"yard"care strategies similar to the 2001 pilot. Program Project Description The City will continue to offer 4 seasonal Natural Yard Care workshops to the general public as initiated in 2006. Information offered in the 2007 workshops may be expanded to cover topics not covered in 2006. Information gained from the City's research of English language learner landscape/garden professionals will be used to develop strategies to educate and promote Natural Yard care management strategies to these businesses. However,cities may submit requests for reimbursement as frequently as quarterly.Quarterly requests should be submitted on April 30,July 31, Oct.31 and Jan 31 of each year,except for the final request for reimbursement, which is due no later than March 15,2008. The Budget • Summary Report Form(Attachment 4) must be used when submitting requests for reimbursement. By December 315`of each year of the grant cycle,cities must notify SWD of their total expenditures for work that has been completed to-date,but for which requests for reimbursement have not yet been submitted. Progress and Final Reports: Progress reports describing program activities, accomplishments and evaluation results need to accompany each request for reimbursement. A final report describing the outcome of grant- funded activities is due with the final request for reimbursement. If, however,the city does not have the results of its program evaluation by the end of the grant cycle,the final narrative report may be submitted no later than six months after the end of the grant cycle on June 30, 2008. (Note: The final request for reimbursement would still need to be submitted by March 15, 2008.) All Progress and Final Reports need to be signed by a city official. Signed reports may be submitted via facsimile. Amendments: Formal amendments to grant ILAs are not necessary unless the city wishes to make significant changes to its scope of work and/or budget. In general,a significant change would be one in which the city wishes to add or delete a task from their scope of work. A minor change, such as moving dollars between tasks, would only require written notification, which may be submitted via e-mail. (MIKE ROMANO, CENTURION DEVELOPMENT SVCS.; VAC 05-005) WHEREAS, a proper petition for vacating a portion of Jericho Avenue NE, south of NE 4th Street, was filed with the City Clerk on December 23, 2005, and that petition was signed by the owners representing more than two-thirds(2/3)of the property abutting upon the street or alley to be vacated; and WHEREAS, the City Council, by Resolution No. 3787, passed on January 9, 2006, set February 6, 2006, at 7:30 p.m. in the City Council Chambers of the City of Renton as the time and place for a public hearing on this matter; and the City Clerk having given proper notice of this hearing as provided by law, and all persons having been heard who appeared to testify in favor or in opposition on this matter, and the City Council having considered all information and arguments presented to it; and WHEREAS, the Administrator of the PlanningBuilding/Public Works Department has considered this petition for vacation, and has found it to be in the public interest and for the public benefit, and that no injury or damage to any person or properties will result from this vacation; NOW, 'THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I. The following described portion of Jericho Avenue NE, to wit: 1 ORDINANCE NO. (The West 5 feet of the East 10 feet of the South 286.45 feet of the North Half of the Northeast Quarter of the Northwest Quarter of the Northeast Quarter of Section 15, Township 23 North, Range 5 East, W.M., in the City of Renton, King County, Washington) See Exhibit "A" attached hereto and made a part hereof as if fully set forth herein is hereby vacated subject to a sidewalk, street lighting, and utility easement over, across, under and on all that part described above in favor of the City. This easement is for the purpose of constructing, reconstructing, installing, repairing, replacing, enlarging, operating and maintaining sidewalks, street lighting, utilities, and utility pipelines, including, but not limited to, water, sewer and storm drainage lines, together with the right of ingress and egress thereto. The City may also construct such additional facilities as it may require. This easement is subject to the following terms and conditions: That a utility easement be retained over the above-described right-of-way, with the understanding that the property may be developed fully if the existing utilities are relocated, with the City's approval, at the sole cost of the developer; and That this easement shall run with the land described herein, and shall be binding upon the parties, and their heirs and successors in interest and assigns. SECTION IL No compensation is required for this street vacation. SECTION ITL This ordinance shall be effective upon its passage, approval, and five days after its publication.
