Also, GRANTOR requests the Assessor and Treasurer of said County set over to the remainder of the hereinafter described parcel, the lien of all unpaid taxes, if any, affecting the real estate herein conveyed, as provided for by RCW 84.60.070. Page 1 of 17 pages � i The GRANTEE acknowledges that the GRANTOR has disclosed to the GRANTEE that the Property is not a legal lot for purposes of applicable law. GRANTEE represents that, as a municipality that has power of condemnation and that it has notified the GRANTOR in writing and also hereby notifies the GRANTOR of the GRANTEE's intent to exercise its power of eminent domain with respect to the Property and that it can acquire the Property without segregating the Property into a legal lot, and that, upon recording of this Quitclaim Deed, the County having jurisdiction over the Property shall revise its parcel maps to reflect the Property as a separate tract. The GRANTEE further represents to the GRANTOR that no real estate transfer excise tax shall be payable in connection with the conveyance effected by the delivery of this Quitclaim Deed, and GRANTEE covenants that if such tax shall be payable it shall be paid in full by the GRANTEE. Provided that nothing in the following list of restrictions shall ever in any way, whatsoever, restrict, limit, or encumber the ability of GRANTEE or its successors and assigns to use the Property for rail-road operations (including, without limitation, ' constructing, operating, reconstructing and maintaining rail tracks, rail communications facilities and towers, fiber optic line facilities, depots, and any and all other rail operation related uses), and further provided that nothing herein shall be deemed a waiver or � limitation of the preemptive effect of federal or state law related to rail operations, and also provided that nothing in the following list of restrictions shall ever in any way, whatsoever, restrict, limit, or encumber the ability of GRANTEE or its successors and assigns to use the Property as a roadway, including for transport of any legal load. By executing this Quitclaim Deed, the GRANTEE hereby accepts the Property, and agrees � for itself and its successors in title to the Property and for all tenants, licensees, and occupants of the Property farever that: 1. No sensitive uses shall be permitted on any portion of the Property, including: residential, school, daycare, hospital, assisted living, medical office, and extended-stay hotel. 2. No agricultural or farming use shall be permitted on the Property. 3. No drinking water production wells shall be placed on the Property and there shall be no consumption or other use of groundwater under the Property. 4. No "heavy" industrial uses shall be permitted on the Property. 5. No environmental remediation facilities shall be permitted on the Property. Page 2 of 17 pages j (. No manufacture,refining, storage or distribution of butane,propane, gasoline or other fuels shall occur at the Property. 7. No bulk storage of paint or varnish (e.g., in excess of 500 gallons in a single container) shall be permitted at the Property. � 8. No facilities for manufacturing involving drop forge industries, smelting ar metal plating or compounding,processing or treatment of acids, detergents, disinfectants,dyes or lubricating oils shall be permitted at the Property. 9. No facilities for disposal or treatment, recycling or storage of garbage, refuse, or hazardous or toxic materials or substances shall be permitted at the Property. 10. No facilities for recycling of plastics, metals or other materials shall be permitted at the Property. 11. No repairing or rewinding of transformers or generators, outdoor storage ofpaving materials or outdoor building materials storage, wrecking yard,junk yard or welding shop shall be permitted at the Property(with the exception of ancillary welding activity necessary to support normal business operations at the Property). 12. No use(s) shall be permitted at the Property as to which heightened or special environmental requirements or standards may apply from time to time under applicable environmental laws or regulations,beyond the remediation levels or environmental standards required for a commercial or industrial use of the Property. The GRANTOR and the GRANTEE each agrees and acknowledges that each of the foregoing covenants touches and concerns the Property and agrees that the burden of each such covenant is intended by the parties to run with the land and to burden all owners, lessees, licensees, and occupants of the Property from time to time. The GRANTOR and the GRANTEE each agrees that the foregoing covenants are for the benefit of the GRANTOR as the owner of the land described in Exhibit C (the "Retained Property") and that the benefit of each such covenant is intended by the parties to run with the land and to benefit the owner of the Retained Property from time to time. The GRANTOR and the GRANTEE each agrees that the harm that may result to the GRANTOR upon a breach of any of the foregoing covenants would be difficult or impossible to compensate through the payment of money damages and that therefore Page 3 of 17 pages � upon a breach of any of the foregoing covenants the GRANTOR or its successors in title to the Retained Property may obtain equitable relief with respect to any such breach.
