HomeMy WebLinkAboutORD 5940CITY OF RENTON, WASHINGTON ORDINANCE NO. 5940 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING CHAPTER 5-5 OF THE RENTON MUNICIPAL CODE, BY ADDING A NEW SECTION 5-5-7, REFUND OF LICENSE FEE, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Chapter 5-5 of the Renton Municipal Code is amended to add a new section 5-5-7, Refund of License Fee, to read as shown below. All other provisions in chapter 5-5 remain in effect and unchanged. 5-5-7 REFUND OF LICENSE FEE: A. Revocation: Upon revocation, suspension, or denial of any license as rovided in this chanter, no Dortion of the license fee shall be returned to the B. License Application Withdrawn: Upon a licensee's request to withdraw their initial aoDlication, the fee Daid shall be returned to the aaDlicant by the Ci together with notice that the application has been withdrawn; provided that, no refund shall be made where the aDDlicant has enRaRed in the business activitv for which the license was intended. or where inspection has been Derformed by an Citv department to review said license application. C. Overpayment: If, upon request by a licensee for a refund, and if it is determined by the Administrator that a fee has been paid in excess of that roperly due, the excess amount Daid shall be credited to the licensee's account 1 ORDINANCE NO. 5940 or shall be refunded to the licensee; however, no refund or credit shall be allowed for any payment made more than four (4) years before the date of such request. SECTION II. If any section, subsection, sentence, clause, phrase or work of this ordinance should be held to be invalid or unconstitutional by a court or competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. SECTION III. This ordinance shall be in full force and effect thirty (30) days after publication of a summary of this ordinance in the City's official newspaper.
