HomeMy WebLinkAboutAdden 5 LAG-01-006 , Adden #5-19 LAG-01-006 Addendum No. 5 Termination This Addendum No 5—Lease Termination is entered into December 7 , 2019 (Effective date) between The City of Renton, Washington, a Washington municipal corporation (Landlord/City) and King County Sexual Assault Resource Center, a registered charitable organization in Washington, (Tenant/KCSARC)—collectively referred to as the Parties. WHEREAS,the Parties entered into LAG-01-006 dated October 25, 2001 and amended on June 30,2004, October 15, 2009, February 27,2015 and December 13,2016-(collectively the "Lease")for offices located at 200 Mill Ave South, Renton,Washington 98057(the "Premises"). WHEREAS, on May 2, 2019 Tenant/KCSARC provided written notice that the Tenant would not be renewing the lease which terminates on February 29, 2020 and that they will be vacating the building on December 31, 2019; and WHEREAS, on July 23, 2019 the City provided confirmation and formal acceptance of KCSARC's non-renewal and termination of LAG-01-006 and all addendums. WHEREAS, the parties agree to amend the Expiration Date and terminate the lease on December 31, 2019. Now,therefore,the Parties agree to amend the lease as follows: 1. Expiration Date: Lease Section 1(g), entitled Expiration Date, as amended in the Third Amendment 3-15 is amended as follows: "Expiration Date" means December 31, 2019. This lease is terminated on December 31, 2019 without any early termination costs or fees for either party. 2. Security Deposit: A. Tenant agrees to vacate the Premises on or before December 31,2019 and shall leave the Premises in the condition required by the Lease, Section 37.Any item needed to restore the premises per this section may be deducted from tenant's Security Deposit, per Section 6 of the Lease. B. Subject to any Security deposit reductions authorized by Section 6 and Tenant's satisfying the terms and conditions of the Lease with respect to the return of its Security Deposit, Landlord agrees to return the remainder of Tenant's Security Deposit (all or a portion of S12,986.75),to Tenant within thirty(30)days following the Termination Date.
