We are applying for a variance request in order to upgrade their existing facilities. Comcast proposed to over lash approximately 151’ of aerial coaxial cable along the right of way of NE 8th St. Please see maps and drawings for more details. Comcast is requesting that the City of Renton approve this variance request based on the fact that the requirements for undergrounding this proposed over lash will not cause substantial adverse impacts to other persons or entities in the immediate area and will cause undue hardship. 1. Installation of undergrounding facilities will increase the total cost of construction roughly 15-25 times the amount of an aerial over lash on the existing Comcast strand. 2. Potential damage to underground facilities will be increased. 3. Over lash will not cause substantial adverse impact to other persons or entities in the immediate area. Over lashing the cable will be accomplished in a few days, and the residents will not notice any impact. Comcast will clean up the over lashed spans as necessary and identify and remove and existing dead cables along this route. 4. The variance is necessary to prevent any undue hardship due to the increased construction costs if forced to install the proposed extension underground. 5. The granting of the variance will not be materially detrimental to the public welfare because Comcast does agree to underground the cable system, but they are waiving the obligation into the future when all other utilities are underground to prevent an undue hardship against Comcast currently. Upon the granting of the Variance, Comcast will coordinate construction and traffic control as per your requirements. Comcast and their contractors want to cooperate at the highest level and agree to adhere to all provisions and requirements set forth by the City of Renton to insure safe installation and maintenance of the proposed facilities. Traffic Control Plan January 22, 2020 Michele Moore Prince Telecom LLC 13701 24th ST E BLD G Sumner WA, 98390 Via Email: michele.moore@princetelecom.com SUBJECT: Request for Undergrounding Exemption (JB33750, MFP19006526, 2918 NE 8th St) Dear Mr. Shackett: The City of Renton has reviewed your request to grant Comcast an exemption from Renton Municipal Code (RMC) 4-6-090(C) which states that all new electrical or communication facilities shall be required to be installed underground, pursuant to the standards of the section of RMC. Comcast proposes to have Prince Telecom rework approximately 151 lineal feet of new Coax cable to existing Puget Sound Energy (PSE) poles beginning at the existing pole at the northwest corner of 3009 NE 8th St and continuing for 151 lineal feet west and ending at the pole to the northwest corner of 3001 NE 8th St. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090. Ordinance 5720 grants Comcast, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right-of-way of Renton. Section 3.4 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles with other attached franchisee communication facilities and overlash to the existing Comcast aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, any existing obsolete cable will need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per the Comcast franchise agreement which allows new overhead facilities to be placed overhead provided at there are other similar providers overhead as well. Comcast Job JB33750 Page 2 of 2 January 22, 2020 DECISION: The requested exemption from underground utility installation requirements RMC4-6-090 (C) as requested by the applicant is approved with conditions subject to the conditions below as the request complies with the Comcast Franchise Agreement. Conditions of Approval: 1. Any existing height violations within the Project Reach must be resolved at the time of construction. New aerial lines within the Project Reach must have a minimum vertical clearance of 15’-6”. 2. Any abandoned or unused lines within the Project Reach must be removed at the time that construction is taking place. 3. A traffic control plan must be separately submitted to the City, and no construction may take place until the City has approved a traffic control plan. 4. The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at Comcast’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case Comcast shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or (3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and Economic Development Administrator or designee, from the first event triggering the requirement to underground the aerial lines. This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, February 5, 2020.
