4403CITYOFRENTON,WASHINGTONRESOLUTIONNO.4403ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON,AUTHORIZINGTHESALEOFAPORTIONOFCITY-OWNEDPROPERTY,GRANTOFTWOTEMPORARYEASEMENTSOVERPORTIONSOFCITY-OWNEDPROPERTY,ANDGRANTOFANACCESSEASEMENTOVERAPORTIONOFCITY-OWNEDPROPERTY,TOTHESTATEOFWASHINGTONDEPARTMENTOFTRANSPORTATION(“WSDOT”),INRELATIONTOWSDOT’S1-405RENTONTOBELLEVUEWIDENINGANDEXPRESSTOLLLANESPROJECT,ANDAUTHORIZINGTHEMAYORTOSIGNTHENECESSARYDOCUMENTSANDTAKETHENECESSARYACTIONSTOTRANSFERTITLEANDGRANTTHEEASEMENTS.WHEREAS,asapartoftheoverall1-405RentontoBellevueWideningandExpressTollLanesProject(the“Project”),theStateofWashingtonDepartmentofTransportation(“WSDOT”)needstoacquire20,978squarefeetofcertainpropertylocatedbetweenHouserWayNandtheexisting1-405ownedbytheCityforWSDOTright-of-way,suchpropertytobeacquiredbeinglegallydescribedinExhibitAattachedheretoandincorporatedbyreferenceasiffullysetforth(the“Right-of-WayProperty”);andWHEREAS,asapartoftheProject,WSDOTneedstoacquirea326squarefeettemporaryeasement,over,upon,andacrossacertainportionofpropertyownedbytheCityforWSDOT’suseduringconstructionofitsProject,suchportionofpropertybeinglegallydescribedinExhibitB,attachedheretoandincorporatedbyreferenceasiffullysetforth(“TemporaryEasement1”);andWHEREAS,asapartoftheProject,WSDOTneedstoacquirea5,040squarefeettemporaryeasement,over,upon,andacrossacertainportionofpropertyownedbytheCityforWSDOT’suseduringconstructionofitsProject,suchportionofpropertybeinglegallydescribed1 RESOLUTIONNO.4403inExhibitC,attachedheretoandincorporatedbyreferenceasiffullysetforth(“TemporaryEasement2”);andWHEREAS,asapartoftheProject,WSDOTneedstoacquirea729squarefeetaccesseasementover,under,upon,andacrossacertainportionofpropertyownedbytheCity,foraccessbyWSDOTtoitsstormwaterdetentionarea,suchportionofpropertybeinglegallydescribedinExhibitD,attachedheretoandincorporatedbyreferenceasiffullysetforth(the“AccessEasement”);andWHEREAS,WSDOTinformedtheCityofitsintenttoacquiretheRight-of-WayProperty,TemporaryEasement1,TemporaryEasement2,andtheAccessEasementundertheimminentthreatofWSDOT’sexerciseofeminentdomain;WHEREAS,theRight-of-WayPropertywasappraisedandWSDOTofferedtheCityapurchasepriceof$6,300commensuratewiththeappraisalvalue;andWHEREAS,theTemporaryEasement1rightswereappraisedandWSDOTofferedtheCityapriceof$50commensuratewiththeappraisalvalue;andWHEREAS,theTemporaryEasement2rightswereappraisedandWSDOTofferedtheCityapriceof$850commensuratewiththeappraisalvalue;andWHEREAS,theAccessEasementrightswereappraisedandWSDOTofferedtheCityapriceof$10,900commensuratewiththeappraisalvalue;andWHEREAS,theCityafteranewsreleaseandpublicationofapublicnoticeforpublichearing,didholdonthe16thdayofMarch,2020,apublichearingtoconsiderauthorizingthesaleoftheRight-of-WayPropertyandthegrantofTemporaryEasement1,TemporaryEasement2
