4410CITYOFRENTON,WASHINGTONRESOLUTIONNO.4410ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON,PROVIDINGFORMEETINGSANDPUBLICHEARINGSOFTHECITYCOUNCIL,COUNCILCOMMITTEES,ALLCITYBOARDSANDCOMMISSIONS,ANDHEARINGEXAMINERHEARINGSTOBEHELDELECTRONICALLYDUETOTHECOVID-19PUBLICHEALTHEMERGENCY.WHEREAS,onJanuary21,2020thefirstreportedcaseofthecoronavirusdisease(COVID19)inWashingtonStateoccurredinSnohomishCountyandonFebruary28,2020,theSeattle/KingCountyPublicHealthannouncedthefirstKingCountyandUnitedStatesdeathduetoCOVID-19inKirkland,Washington;andWHEREAS,onJanuary30,2020,theInternationalHealthRegulationsEmergencyCommitteeoftheWorldHealthOrganizationdeclaredCOVID-19apublichealthemergencyofinternationalconcern;and,onJanuary31,2020,theU.S.DepartmentofHealthandHumanServicesdeclaredapublichealthemergencyforCOVID-19;andWHEREAS,COVID-19isarespiratorydiseasecausedbytheSARS-CoV-2virus,anewstrainofcoronavirusthathadnotbeenpreviouslyidentifiedinhumans,caneasilyspreadfrompersontoperson,andcanresultinseriousillnessordeath,andhasbeenclassifiedbytheWorldHealthOrganizationasaworldwidepandemic;andWHEREAS,onFebruary29,2020,theWashingtonStateGovernordeclaredaStateofEmergencyforallcountiesthroughoutthestateofWashingtonasaresultofCOVID-19pandemicandoutbreakandconfirmedperson-to-personspreadofCOVID-19inWashingtonState;and1 RESOLUTIONNO.4410WHEREAS,onMarch5,2020,theMayorissuedaProclamationofEmergencyduetotheCOVID-19pandemic,andonMarch16,2020,theCityCounciladoptedResolution4401whichratifiedtheEmergencyProclamation;andWHEREAS,asaresultofthecontinuedworldwidespreadofCOVID-19,itssignificantprogressioninWashingtonState,andthehighriskitposesinparticulartoourmostvulnerablepopulations,theGovernor,exercisinghisemergencypowersunderRCW43.06.220,hasissuedvariousProclamations(currently20-06through20-53)prohibitingcertainactivitiesandwaivingandsuspendingspecifiedlawsandregulations;andWHEREAS,onMarch23,2020,theGovernorissuedProclamation20-25(StayHome-StayHealthy)prohibitingresidentsfromleavingtheirplaceofresidenceandprohibitingallpublicgatheringsregardlessofthenumberofpeopleinvolved;andWHEREAS,onMarch24,2020,theGovernorissuedProclamation20-22,thatamongotherthings,issuedaprohibitiononconductingmeetingssubjecttotheOpenPublicMeetingsAct(OPMA),chapter42.30RCW,in-personandinsteaddirectingthatanymeetingsbeheldentirelyelectronicallyandbelimitedtoconsiderationofnecessaryandroutinemattersorthoserelatedtotheCOVID-19emergency;andWHEREAS,onMarch16,2020,inordertoprotectitscitizensandlimitthespreadofCOVID-19,theCityCouncilhelditsfirstremotetelephonic/electronicregularmeeting,andprovidingforattendanceinthesamefashiontothepublic,onJune1,2020theCityCouncilhelditsfirstpublichearingalongwiththeabilitytoprovidepubliccommentataregularmeeting,andcontinuestoconveneregularmeetingsinthismanner;and2 RESOLUTIONNO.4410WHEREAS,onApril29,2020,thePlanningCommissionhelditsfirstremote/electronicregularmeetingwithallcommissionersattendingremotelyandprovidingopportunityforthepublictobothattendandprovidecommentremotely;andWHEREAS,theCityCouncilandPlanningCommissionhavebeenconductingpublicmeetingsandhearingsinaccordancewithProclamation20-28,asamended,andconsistentwiththeCouncil’sandCommission’sRulesofProcedure;withthepublicbeingabletoprovidepubliccommentandtestimonyremotelyandvirtually;andthefirsthearingbeforetheHearingExaminerwasconducted,withthepublicbeingabletoattendandprovidetestimonyremotelyandvirtuallyonMay19,2020andcontinuestoconvenemeetingsinthismanner;andtheCity’sboards/commissionsheldpublicmeetingsinApril,May,andJune,2020,withthepublicbeingabletoattendandprovidepublictestimonyremotelyandvirtually,andcontinuetoconvenemeetingsinthismanner;andWHEREAS,Title35ARCW,chapter35A.12RCW,andRCW35A.12.110,and35A.12.120providetherequirementformeetingsoftheCityCouncilandrequirethattheCityCouncil“shallmeetregularly,atleastonceamonth,ataplaceandatsuchtimesasmaybedesignatedbythecitycouncil;”andmaycallspecialmeetingsbyprovidingthecouncilwithwrittennoticedeliveredtoeachmemberofthecouncil“atleasttwenty-fourhoursbeforethetimespecifiedfortheproposedmeeting”withnoticetothepublic“inaccordancewithRCW42.30.080,asnoworhereafteramended”;andRCW42.30.070providesthattheCityCouncilistoestablishthetimeforholdingregularmeetingsandalsoprovidesaprocedureformovingameetingsiteinanemergency”;and3 RESOLUTIONNO.4410WHEREAS,thereisnorequirementintheOPMAthatrequirestheCityCouncil,PlanningCommissionorotherboardsandcommissions,toholdmeetingsorpublichearingsinanyparticularplace.TheOPMAstatesthatthetimeandplaceofregularmeetingsistobedeterminedbytheapplicablebodyasreflectedinitsdulyadoptedrulesofproceduresorgeneralpractices;andWHEREAS,theOPMArequiresthatthepublicbepermittedtoattendameetingwithoutpreconditionsbeingplacedontheirattendance;andWHEREAS,theCityCouncilhasprovidedfortechnologythatallowselectronicmeetingsandhearingsandforthepublictoattendtheseelectronic‘virtual”meetingsoftheCityCouncil,aswellastheotherpublicmeetingsandhearingsoftheCity;andthistechnologyallowsthepublictoattendbycallinginbyphoneandIorwatchingorlisteningintealtimeaswellastoprovidepubliccommentandpublictestimony;andtheCityhasbeenconductingandthepublicattendingsuchvirtualmeetingsandhearingswhileProclamation20-28,asamended,hasbeenineffect;andWHEREAS,theCityCouncilhaspreviouslyestablishedthefollowinggeneralrulesandprocedureswithrespecttothelocationofregularCityCouncilMeetings:Resolution4363AmendingPolicies:800-02MeetingsoftheCityCounciland800-13RemoteAttendanceatCouncilMeetings;andPolicy800-02MeetingsoftheCityCouncil;andPolicy800-13RemoteAttendanceatCouncilMeetings;and4 RESOLUTIONNO.4410WHEREAS,Proclamation20-28,asamended,expiresonJune17,2020,andalthoughtheworldwideCOVID-19pandemic’sprogressioninWashingtonStatehascurrentlyslowed,itcontinuestothreatenthelifeandhealthofourpeople,andremainsanextremepublicemergencyaffectinglife,health,property,andpeace;andWHEREAS,duetotheongoingthreatCOVID-19posesandtherelatednecessaryprecautionsandrestrictions,theCityCouncilhasconcludedthatinordertocontinuetoprotectlife,healthandpropertyofitscitizensthatupontheexpirationofProclamation20-28,asamended,itisnecessarytocontinuetoholdelectroniconly“virtual”meetingsandhearings,andherebyalsodirectsthePlanningCommission,otherboardsandcommissions,andtheHearingExaminer,toonlyconductsuchelectronic“virtual”meetingsduringthispublichealthemergency;andWHEREAS,bythisResolutiontheCityCouncilisthereforetemporarilymovingthelocationforholdingregularmeetingsoftheCityCouncilandPlanningCommission,andallboardsandcommissionsandtheHearingExaminer,fromCityHallorotherphysicallocationstoatelephonic/electronic“virtual”locationviatelephoneandsupplementedwithotherelectronicmeansandallagendasandnoticesshallsoreflectthenewvirtualmeetingsitephonenumber,aswellasanexplanationofhowthepublicmayattendthevirtualmeetings;andWHEREAS,theCityCouncilhasthoroughlyconsideredallapplicableandrelevantfactorsinrelationshiptoCOVID-19,anddeemsthisactiontoprovidefortelephonic/electronic“virtual”meetingsandpublichearingsduringthisemergencyisinfurtheranceofthepublicinterest,andnecessarytoprotectthesafety,andwelfareofitscitizensandpropertyduringthisemergency;5 RESOLUTIONNO.4410NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.TheCityCouncilAuthorizesRemoteMeetingsandHearings.A.PursuanttoSection4.1ofCouncilPolicy800-02,theCouncilestablishesthe“otherlocation”forregularbusinessmeetingsoftheCityCouncilwherethepubliccanattendmeetingsasthefollowingphonenumberandmeetingidentificationnumber:1-253-215-8782andenter87006639675.Inadditiontosuchlocation,theCitywillpublishadditionalmeansofviewingandlisteningtothemeetingsinthemeetingagendas,whichmeansmayincludevideoteleconferencesandIorinternetstreaming.B.TheCityCouncilfurtherdirectsthePlanningCommissionandallotherboardsandCommissionsandtheHearingExaminertosuspendanyrulesorpracticesthatrequiresmeetingsorpublichearingstooccurinpersonatCityHallorotherphysicallocationsandtoholdalloftheirmeetingsvirtually.C.TheCityCouncil,PlanningCommission,allotherboardsandcommissions,andtheHearingExaminer,shallholdallmeetingsorpublichearingsvirtually,byphone/electronicmeans,andshallprovideforattendancebymembersofthepublic,inrealtime,thatwillallowthepublictolistentoorwatchthemeetingandhearallspeakers,and,ifapplicable,provideforpubliccommentortestimonyinaccordancewithanyapplicablestatelaworapplicableadoptedrules,asmodifiedherein.SECTIONII.RemoteMeetingsandHearingsProcedures.6 RESOLUTIONNO.4410A.TheProceduressetforthinExhibitA,areherebyadoptedasabaselinefortelephonic/virtualmeetings.TheCityClerkmaymodifyandprovideadditionalproceduresinaccordancewiththegeneralguidanceofthisResolution.B.ThePlanningCommission,otherboardsandcommissions,andtheHearingExaminermaytakeadditionalstepsandadoptoramendrulesorprocedures,ifnecessary,inaccordancewiththisResolutionandtheProceduresinExhibitA.C.NothinginthisResolutionprecludestheCityCouncil,PlanningCommission,otherboardsandcommissions,andtheHearingExaminerfromprovidinganadditionalopportunityforpublicparticipationinaparticularcase,providedthatisdoneremotely,ortheprovisionofadditionalorenhancednoticeoralternativemethodsofelectronicparticipation.SECTIONIII.AgendaandNotice.TheCityClerkortheclerkofanyCityboardorcommissionshallensuretheagendaforameetingorpublichearingandanyrequirednoticeunequivocallystatesthatthemeetingorhearingwillbeavirtualmeetingtobeheldelectronically.Thenoticeshallprovidedetailsforwatchingthemeetingorhearinginrealtimeandforprovidingoralorwrittenpubliccommentortestimonyatthemeetingorhearingthroughtheinternetortelephone.ThisnoticeshallbepostedontheCity’sWebsiteandattheusualandcustomaryCityHalllocationsutilizedforpostingsuchnotices.SECTIONIV.Severability.Ifanyoneormoresections,subsections,orsentencesofthisResolutionareheldtobeunconstitutionalorinvalid,suchdecisionshallnotaffectthevalidityoftheremainingportionof7
