HomeMy WebLinkAboutORD 5973CITYOFRENTON,WASHINGTONORDINANCENO.5973ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGAMORATORIUMONAPPLICATIONSFORWAIVEDFEES(RMC4-1-210)DUETOECONOMICCONSIDERATIONSRELATEDTOTHECOVID-19PANDEMIC;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,theCityCounciladoptedOrdinance5967onApril6,2020,whereintheCitydeclaredamoratoriumon,amongotherthings,applicationsfromLargeResidentialProjects(definedas150dwellingunitsormoreinaproject)forthewaivedfeesprovisionsofRentonMunicipalCode(RMC)4-1-210;andWHEREAS,Ordinance5967didnotaddresswaivedfeesapplicationsforanyprojectsotherthanLargeResidentialProjects,thusallowingallotherprojectstoapplyforwaivedfeesnotwithstandingthemoratorium;andWHEREAS,Ordinance5967’smoratoriumonapplicationsforwaivedfeesforLargeResidentialProjectsanticipatedallowingtheCitytimetoevaluateandrespondtothesignificantandpotentiallydetrimentaleffectsofwaivingfeesforLargeResidentialProjects;andWHEREAS,RCW82.02.060allowstheCitytowaiveupto80%ofthetransportation,parks,andfireimpactmitigationfeesforeligibleaffordablehousingprojects.ThecurrentwaivedfeesprovisionsofRMC4-1-210allow100%ofalleligiblefeestobewaived;thismeansthattheCitypaysthe20%differenceabovethe80%statutorylimitfortransportation,parks,andfireimpactmitigationfees;andWHEREAS,the20%paymentbytheCityforthecombinedtransportation,parks,andfireimpactmitigationfeescanbesubstantial.Forexample,forthemostrecentwaivedfees1
ORDINANCENO.5973approvedearlierthisyearfortheHabitatforHumanityofSeattle/KingCounty’sLaFortunaPhaseIfprojectwith12units,theCity’sprojected20%paymentfortransportation,parks,andfireimpactmitigationfeestotaled$18,494(ormorethan$1,500perhousingunit);andWHEREAS,sinceOrdinance5967wasadopted,theCity’sCommunityandEconomicDevelopmentDepartment(CED)hasbeenundertakingaworkprogramtoproposeamendmentstothewaivedfeesprovisions,includingamendmentsthatwouldcapfeewaiversforimpactmitigationfeesatthe80%statutorylimit.ThiscapwouldsavetheCityfromfutureinstancesofpayingthe20%differencefora100%feewaiverfortheimpactmitigationfees;andWHEREAS,CEDstaffhavebriefedthePlanningCommissionregardingtheseproposedamendmentstothewaivedfeesprovisions.OnJune3,2020,thePlanningCommissionopenedapublichearingregardingthematter.Asofthedateofthisordinance,thepublicheatingremainsopen,isnotanticipatedtocloseuntilJuly15,2020,andwillbefollowedbyaPlanningCommissionrecommendationtotheCityCouncil.Underthisschedule,reviewandactionbytheCityCouncilwilloccurnosoonerthanAugust2020;andWHEREAS,theCityisnowprojectingsubstantialrevenuelossesthisyearrelatedtotheCOVID-19pandemic;andWHEREAS,theCityurgentlyneedsanopportunitytofinishitsevaluationofandtoactonamendingthewaivedfeeprovisionsbeforeanynewwaivedfeesapplicationsarereceivedtoavoidfurtherrevenueimpacts,suchthattheexistingbaronwaivedfeesapplicationsforLargeResidentialProjectsshouldbeexpandedtoabaronwaivedfeesapplicationsforallprojects;andWHEREAS,accordingly,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganyapplicationsforwaivedfees(RMC4-1-210);and2
ORDINANCENO.5973WHEREAS,theCityCouncilfindsthatthesubjectofthisordinancecomplieswiththeGovernor’sProclamation20-28,asamended,relatingtomeetingsduringtheCOVID-19crisis;andWHEREAS,theCityCouncilwillholdapublichearingwithinsixty(60)daysofthepassageofthisordinance;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthemoratoriumadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.TheCityCouncilherebydeclaresamoratoriumonthesubmission,acceptance,processingorapprovalofanyapplicationsforwaivedfees(RMC4-1-210).SECTIONIII.ThemoratoriumimposedhereinshallbeineffectuntilDecember22,2020,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.SECTIONIV.Apublichearingwillbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.3

SECTION VI. The City Council declares an emergency for the protection of the public
welfare and to enable the purpose and intent of this ordinance to be accomplished. This
ordinance shall take effect immediately when passed by the City Council. The City Clerk shall
cause to be published a summary of this ordinance in the City's official newspaper. The summary
shall consist of this ordinance's title.
