5974CITYOFRENTON,WASHINGTONORDINANCENO.5974ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ADOPTINGANINTERIMZONINGCONTROLINRESPONSETOTHEPHASEDOPENINGOFBUSINESSESFOLLOWINGTHECOVID-19DECLAREDPUBLICHEALTHEMERGENCY;TEMPORARILYESTABLISHINGAPERMITTOBEKNOWNASAN“ECONOMICRECOVERYREVOCABLERIGHT-OF-WAYPERMIT”FORBUSINESSES;TEMPORARILYALLOWING“ECONOMICRECOVERYSIGNS”FORBUSINESSES;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,earlierthisyear,theWorldHealthOrganizationannouncednovelcoronavirusfCOVID-19)isofficiallyaglobalpandemic;andWHEREAS,onJanuary31,2020,theUnitedStatesDepartmentofHealthandHumanServicesSecretaryAlexAzardeclaredapublichealthemergencybecauseofCOVID-19;andWHEREAS,theWashingtonGovernoralsodeclaredaStateofEmergencyduetoCOVID19;andWHEREAS,onMarch6,2020,theMayorproclaimedalocalemergencyduetoCOVID-19;andWHEREAS,followingrecommendedpublichealthbestpractices,includingsocialdistancing,ishavingsignificantnegativeeconomiceffectsonthenational,regional,andlocaleconomy,includingbusinessesandworkersintheRentonareawhocannotworkremotely,includingthoserelatedtorestaurantsandotherbusinessesthatprovideorcouldprovideoperationsonright-of-wayareasfrontingsuchbusinesses;andWHEREAS,asthebusiness-relatedrestrictionsarerelaxedbytheStateofWashingtoninphases,includingopeningofrestaurantsandotherbusinesseswithreducedcapacities,flexibility1 ORDINANCENO.5974inallowinguseofoutdoorareas,includingsomeCityrights-of-way,couldhelpsomebusinessesduringthesechallengingtimes;andWHEREAS,theRentonMunicipalCode(TRMC”)includesseveralprovisionsidentifyingdifferenttypesofright-of-waypermits,includingRMCSection4-8-120,RMCChapter9-2,andRMCChapter9-17,whichapplytotheuseofright-of-wayforbusinessoperationssuchassidewalksales,sidewalkpick-up,andoutdoorrestaurantseating;andWHEREAS,establishinganewtypeofright-of-waypermittobeknownasan“EconomicRecoveryRevocableRight-of-WayPermit”whichissimilartoexistingright-of-waypermitsbutdoesnotcarryapermitfeecouldassistbusinessesthatareabletousepublicright-of-wayand/ortheirprivateparkinglotareasinordertoexpandtheareawithinwhichcustomerscouldbeserved—inkeepingwithappropriatesocialdistancingstandardsandotherpublichealthguidelines—couldhelpstrugglingbusinessesincludingrestaurantssurviveandhelpkeeptheemployeeswhodependonthejobsthathavebeenimpactedandjeopardizedbythecoronavirusshut-downsemployed;andWHEREAS,toassistintherecoveryofbusinessesincludingrestaurant-relatedbusinesses,itisreasonablethatthisnewEconomicRecoveryRevocableRight-of-WayPermitbeavailabletobusinessesforatemporaryperiod,throughDecember31,2020orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccursfirst;andWHEREAS,somebusinessesarerelyingonspecialeventssuchasgrandre-openingsandthesignageassociatedwithcommunicatingthatthebusinesshasreopened;and2 ORDINANCENO.5974WHEREAS,toassistintherecoveryofsuchbusinesses,itisalsoreasonablefortheCitytotemporarilyallowsignstobeknownas“EconomicRecoverySigns”intheformofA-FrameSignsandEventSigns,asfurtherspecifiedinthisordinance,throughDecember31,2020;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforaninterimzoningcontrolordinancetoestablishtheEconomicRecoveryRevocableRight-ofWayPermitandtoestablishandallowEconomicRecoverySigns;andWHEREAS,theCityCouncilfindsthatthesubjectofthisordinancecomplieswiththeGovernor’sProclamation20-28,asamended;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINasfollows:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportoftheinterimcontrolsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.Asaninterimzoningcontrol,CouncilherebytemporarilyestablishesanewpermittobeknownasanEconomicRecoveryRevocableRight-ofWayPermitintheCityofRenton.EconomicRecoveryRevocableRight-of-WayPermitsshallbe:(1)Availabletobusinessesseekingtousethepublicright-of-wayfrontingtheirbusinessesand/ortheirprivateparkinglotsabuttingtheirbusinessestoexpandtheareawithinwhichcustomersareserved,suchasforsidewalksales,sidewalkpick-up,and/oroutdoorrestaurantseating.ObtaininganEconomicRecoveryRevocableRight-of-WayPermitforsuchusesshallnotexcuseabusinessfromcomplyingwithapplicablepublichealthrequirementsandguidelines,includingsocialdistancing;and3 ORDINANCENO.5974(2)IneffectfromthedateofissuancethroughDecember31,2020orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccursfirst;and(3)Subjecttothesameapplicationandreviewprocessasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2,exceptthatnoapplicationfeeorpermitfeeshallberequired;and(4)Subjecttoleaseholdexcisetaxtothesameextentasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2.SECTIONIII.Asaninterimzoningcontrol,CouncilherebytemporarilyestablishesanewsigntypetobeknownasanEconomicRecoverySignintheCityofRenton.EconomicRecoverySignsshallbe:(1)Allowedforbusinessestoadvertiseeconomicrecovery-relatedeventssuchasgrandre-openingsorexpandedservicesorcapacities;and(2)AllowedintheformofA-FrameSignsandEventSigns,asfurtherspecifiedbelow;and(3)IfanA-FrameSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100.J.5:a.Number:i.WithinCityCenterSignRegulationArea:Onlyoneofthesesignsispermittedperbusinessperstreetfrontage.ii.ElsewhereintheCity:Oneofthesesignsispermittedperbusinessperstreetfrontageand,inaddition,anadditionalsignispermittedtobelocatedabuttingthebusinessandbuildingtowhichthesignrelates.b.LocationRequirements:4 ORDINANCENO.5974i.PermittedLocation:(1)WithinCityCenterSignRegulationArea:A-framesignsmustbeplacedagainstthebuildingandbusinesstowhichthesignrelates.(2)ElsewhereintheCity:A-framesignsmaybelocatedonthepublicsidewalkabuttingthebusinesssiteand/orwithinthelandscapingareaonorabuttingthebusinesssite,however,A-framesignscannotbeplacedinthelandscapestripbetweenthecurbandouteredgeofthepublicsidewalk.Additionally,forbusinesseslocatedwithinshoppingcenters,anadditionalA-framesignmaybeplacedagainstthebuildingandbusinesstowhichthesignrelates.ii.PedestrianClearance:Aminimumoffourfeet(4)ofunobstructedsidewalkareabetweentheouteredgeofthesignandthestreetcurbisrequired.iii.ClearVisionArea:NosignshallbelocatedastoposeadangerandviolatetheclearvisionareaspecifiedinsubsectionRMC4-4-100.C.6,ProhibitedSigns.Whereatrafficvisionhazardiscreated,theCitymayrequireamodificationtotheheightorlocationofasigntothedegreenecessarytoeliminatethehazard.c.Size:Signsshallbenolargerthanthirty-twoinches(32”)wideandthirty-sixinches(36”)tall.5 ORDINANCENO.5974U.ConstructionSpecificationsandMaterials:Thesignmustbeprofessionallymanufacturedofdurablematerial(s).Nolightingorattachments,suchasballoonsarepermitted.e.MaintenanceandAppearance:SignsmustbemaintainedinaccordancewiththeprovisionsofRMC4-4-100.D.3,SignMaintenanceRequired,andsubsectionRMC4-4-100.D.4,AppearanceofSigns.f.AlterationofLandscapingProhibited:NolandscapingmaybedamagedormodifiedtoaccommodateanA-framesign.TheCitymayrequirereplacementofanydamagedlandscapingpursuanttoRMC4-4-070.0,DamagedLandscaping.g.RemovaluponCloseofBusinessRequired:A-framesignsshallnotbedisplayedduringnonbusinesshours.h.ProofofInsuranceandHoldHarmlessAgreementforSignsonPublicRight-of-Way:BeforeplacinganysuchA-Framesign,thebusinessmustprovidetheCommunity&EconomicDevelopmentDepartment’sDevelopmentServicesDivisionwith(1)proofofgeneralcommercialliabilityinsurance(certificateofliabilityinsurance)meetingtherequirementsofRMC4-4-100.L.4and(2)asignedholdharmlessagreementthatspecifiesthattheownerofthesignwilldefend,indemnify,andholdtheCityharmlessforanyloss,injuries,damage,claimsorlawsuit,includingattorney’sfeesthatarisefromthesign.i.ConfiscationofSigns:SignsthatdonotcomplywiththeseprovisionsmaybeconfiscatedbytheCity;and6 ORDINANCENO.5974(4)IfanEventSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100.J.6:a.[Intentionallyomitted.]b.TypesofEventSignageAllowed:Anycombinationofthefollowingtypesofsignagearepermitted:balloons,pole/wallstrungandwall-hungbannersnotexceedingonehundred(100)squarefeeteachinsize,pole-hungbannersnotexceedingtwenty(20)squarefeeteachinsize,flags,inflatablestatuary,pennants/streamers,searchlights,windanimatedobjects,andothersimilaradvertisingdevicesapprovedbytheDevelopmentServicesDivision.Rigidportablesignsarealsoallowedprovidedthesignisamaximumofthirty-two(32)squarefeetinareaononefacepersignnotexceedingsixfeet(6’)inheight.RigidportablesignsarelimitedtooneperstreetfrontageoutsidetheAutomall.c.[Intentionallyomitted.]U.[Intentionallyomitted.]e.PlacementLimitationsforEventSigns:i.Roof:Nosignoradvertisingdeviceshallbeplacedontopofarooforextendverticallyabovethefasciaofthebuilding.ii.PerimeterStreetLandscaping:Eventsignageshallnotbelocatedwithinrequiredperimeterstreetlandscaping;and(5)AllowedwithoutapermitandwithoutafeethroughDecember31,2020.SECTIONIV.TheMayororhisdesigneeisauthorizedtoimplementanyandalladministrativeproceduresnecessarytocarryoutthedirectivesofthislegislation.7 ORDINANCENO.5974SECTIONV.Apublichearingwillbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONVI.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis13thdayofJuly,2020.Jaso1A.eth,CilerkAPPROVEDBYTHEMAYORthis13thdayofJuly,2020.oPavone,Mayor8
