AMENDMENT NO. 1 TO AGREEMENT FOR CAG-19-257
THIS AMENDMENT, dated February 24, 2020,
a Washington municipal corporation, and Kirk Seese . The City and the Consultant are
referred to collectively in this Amendment
this Amendment is effective as of the last date signed by both parties.
Whereas, the City engaged the services of the Consultant under Agreement CAG-19-257, dated
July 26, 2019, to provide necessary services for the design, fabrication, permitting and installation
of a public art for Sunset Community Park and
Whereas, the design concept has changed and the Parties agree that it is in the interest of both
parties to confirm the design concept change and reconfirm that the final design will be unique
to Renton; and
Whereas, accordingly, the Parties wish to amend the Agreement to remove Exhibit A-2 (the
former design) and add Exhibit A-3 (the final design).
NOW THEREFORE, It is mutually agreed upon that CAG-19-257 is amended as follows:
1. Exhibit A-2 (the former design) is hereby removed from the Agreement and is of no
further force or effect. Attached Exhibit A-3 (the final design) hereby replaces Exhibit A-
2. All prior references in the Agreement to Exhibit A-2 and the Exhibit A-2 design are
hereinafter intended to apply to the design concept reflected in Exhibit A-3.
2. The Parties reconfirm their mutual desire that the final design be unique to the City of
Renton, and Artist recommits to the same.
3. All terms of the Agreement not explicitly modified herein shall remain in full force and
effect and such terms shall apply to Work performed according to this Amendment as if
fully set forth herein.
IN WITNESS WHEREOF, the Parties have voluntarily entered into this Amendment as of the date
last signed by the Parties below.
