5977CITYOFRENTON,WASHINGTONORDINANCENO.5977ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ADOPTINGTHENEWCOUNTYWIDEFLOODINSURANCESTUDY(FIS)ANDFLOODINSURANCERATEMAPS(FIRM);ADOPTINGAPPENDIXA,STANDARDSFORSHALLOWFLOODINGAREAS(AOZONES);REVISINGFLOODHAZARDREGULATIONSBYAMENDINGSUBSECTIONS4-3-050.D.3,4-3-050.G.4.c.i,4-3-050.G.4.c.vi,4-3-050.G.4.d,4-3-050.G.4.e,AND4-3-050JOFTHERENTONMUNICIPALCODE;AMENDINGANDADDINGNEWDEFINITIONSINSECTIONS4-11-010,4-11-020,4-11-060,4-11-080,4-11-130,4-11-180,AND4-11-190OFTHERENTONMUNICIPALCODE;PROVIDINGFORSEVERABILITY;ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityisrequiredtoadoptthenewcountywideFloodInsuranceStudy(FIS)andFloodInsuranceRateMaps(FIRMs)thatwillbecomeeffectiveforallcommunitiesinKingCountyonAugust19,2020;andWHEREAS,theCityisalsorequiredbytheFederalEmergencyManagementAgency(FEMA)toadopttheeffectivefloodplainmanagementstandardsin44CFR60.3,.4,and.5inTitleIV(Chapter3andChapter11)inordertoimplementmodificationsmadebythefloodmaprevisions;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onJuly2,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonJuly15,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;1 ORDINANCENO.5977NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-3-050.D.3oftheRentonMunicipalCodeisamendedasshownbelow.AllotherprovisionsinSubsection4-3-050.Dremainineffectandunchanged.0.ADMINISTRATIONANDINTERPRETATION:1.Interpretation:TheAdministratorshallhavethepowertorenderinterpretationsofthisSectionandtoadoptandenforcerulesandregulationssupplementaltothisSectionashe/shemaydeemnecessaryinordertoclarifytheapplicationoftheprovisionsofthiscode.Suchinterpretations,rulesandregulationsshallbeinconformitywiththeintentandpurposeofthisSection.ProvisionscontainedwithinthisSectionareconsideredtheminimumrequirementsandwillnotlimitorrepealotherprovisionsunderStatestatute.a.RelationshiptoOtherAgenciesandRegulations:i.ThesecriticalareasregulationsshallbeinadditiontozoningandotherregulationsadoptedbytheCity.Compliancewithotherregulationsdoesnotexempttheapplicantfromcriticalareasregulations.IntheeventofanyconflictbetweentheseregulationsandanyotherCityregulations,thoseregulationswhichprovidethegreaterprotectiontocriticalareasshallapply.ii.Anyindividualcriticalareaadjoinedbyanothertypeofcriticalareashallhavethebufferandmeettherequirementsthatprovidethemost2 ORDINANCENO.5977protectiontothecriticalareasinvolved.WhenanyprovisionofthisSectionoranyexistingregulation,oreasement,covenant,ordeedrestrictiongrantedtoanygovernmentalbodyconflictswiththisSection,thatwhichprovidesmoreprotectiontothecriticalareasshallapply.iii.CompliancewiththeprovisionsofthisSectiondoesnotconstitutecompliancewithotherFederal,State,andlocalregulationsandpermitrequirementsthatmayberequired(forexample,shorelinesubstantialdevelopmentorconditionalusepermits,shorelinevariances,theWashingtonStateDepartmentofFishandWildlifehydraulicprojectapproval(HPA),ArmyCorpsofEngineersSection404permits,DepartmentofEcology401WaterQualityCertificationsandNationalPollutionDischargeEliminationSystem(NPDES)permits).Theapplicantisresponsibleforcomplyingwiththeserequirements,apartfromtheprocessestablishedinthisSection.2.DutiesofAdministrator:TheAdministratorshallhavethepowerandauthoritytoissuedecisionsrelativetoandenforcetheprovisionsofthisSection.a.Compliance:TheCityshallnotgrantanyapprovalorpermitanyregulatedactivityinacriticalareaorassociatedbufferpriortofulfillingtherequirementsofthisSection.b.Review:TheAdministratorshallreviewalldevelopmentpermitstodeterminethattherequirementsofthisSectionhavebeensatisfied.c.FindingofConformanceRequired:Conformancewiththesecriticalarearegulationsshallbeafindinginanyapprovalofadevelopmentpermitor3 ORDINANCENO.5977aquiferprotectionareapermit,andsuchfindingshallbedocumentedinwritingintheprojectfile.3.FloodHazardAreas:3.FloodHazardAreas:a.DesignationoftheFloodplainAdministrator:TheAdministratorisherebyappointedtoadminister,implement,andenforcetheprovisionsofthissectionbygrantingordenyingdevelopmentpermitsinaccordancewithitsprovisions.TheFloodplainAdministratormaydelegateauthoritytoimplementtheseprovisions.b.Enforcement:Alldevelopmentwithinspecialfloodhazardareasissubjecttothetermsofthissectionandotherapplicableregulations.Thestandardsofthissectionarenotintendedtorepeal,abrogate,orimpairanyexistingeasements,covenants,ordeedrestrictions.However,wherethestandardsofthissectionandanyotherapplicableregulation,easement,covenant,ordeedrestrictionconflictoroverlap,whicheverimposesthemorestringentrestrictionsshallprevail.Theseregulations,andthevariouspartsthereof,areherebydeclaredtobeseverable.Shouldanystandardofthissectionbedeclaredbythecourtstobeunconstitutionalorinvalid,suchdecisionshallnotaffectthevalidityoftheordinanceasawhole,oranyportionthereof,otherthanthesectionsodeclaredtobeunconstitutionalorinvalid.c.BasisforEstablishingtheAreasofSpecialFloodHazard:ThespecialfloodhazardareasidentifiedbytheFederalInsuranceAdministratorinascientificandengineeringreportentitled“TheFloodInsuranceStudy(FIS)forKingCounty,4 ORDINANCENO.5977WashingtonandIncorporatedAreas”datedAugust19,2020,andanyrevisionsthereto,withaccompanyingFloodInsuranceRateMaps(FIRMs),andanyrevisionsthereto,areherebyadoptedbyreferenceanddeclaredtobeapartofthisordinance.TheFISandtheFIRMareonfileatCityofRenton,1055SouthGradyWay,Renton,WA98057.Thebestavailableinformationforfloodhazardareaidentificationasoutlinedinsubsection4-3-050.D.3.f.shallbethebasisforregulationuntilanewFIRMisissuedthatincorporatesdatautilizedundersubsection4-3-050.D.3.f.d.InformationtobeProvidedbyApplicant:TheapplicantshallprovidetheAdministratorthefollowinginformation:i.Theactualelevation,inrelationtomeansealevel,theNorthAmericanVerticalDatumof1988(NAVD88),ofthelowestfloor(includingbasement)ofallneworsubstantiallyimprovedstructures,andwhetherornotthestructurecontainsabasementwherebasefloodelevationdataisprovidedthroughthefloodinsurancestudyorrequired.ii.Forallneworsubstantiallyimprovedfloodproofedstructures:(a)Theapplicantshallverifyandhaverecordedtheactualelevationinrelationtomeansealevel,theNorthAmericanVerticalDatumof1988(NAVD88);and(b)FloodelevationcertificatesshallbesubmittedbyanapplicanttotheDevelopmentServicesDivisionpriortothebuilding’sfinishedfloorconstruction.Finishedfloorelevationshouldbeverifiedbyapreconstruction5 ORDINANCENO.5977elevationcertificateatthetimeofconstructionofasubstantialstructuralelementofthefinishedfloor(i.e.,foundationformfortheconcretefloor).Anas-builtelevationcertificatewillbeprovidedpriortoissuanceoffinaloccupancy.iii.Whereastructureistobefloodproofed,certificationbyaregisteredprofessionalengineerorarchitectthatthefloodproofingmethodsforanynonresidentialstructuremeetfloodproofingcriteriainsubsection4-3-050.G.4.d.iii.(b);iv.Descriptionoftheextenttowhichawatercoursewillbealteredorrelocatedasaresultofproposeddevelopment;v.WhereastructureisproposedinaV,V1-30,orVEzone,aV-zonedesigncertificate;vi.Wheredevelopmentisproposedinafloodway,anengineeringanalysisindicatingnoriseoftheBaseFloodElevation;andvii.AnyothersuchinformationthatmaybereasonablyrequiredbytheFloodplainAdministratorinordertoreviewtheapplication.e.InformationtobeObtainedandMaintained:i.WherebasefloodelevationdataisprovidedthroughtheElS,FIRM,orrequiredasinsubsection4-3-050.D.3.f.,obtainandmaintainarecordoftheactual(as-built)elevationfinrelationtomeansealevel)ofthelowestfloor(includingbasement)ofallneworsubstantiallyimprovedstructures,andwhetherornotthestructurecontainsabasement.6 ORDINANCENO.5977ii.ForallneworsubstantiallyimprovedfloodproofednonresidentialstructureswherebasefloodelevationdataisprovidedthroughtheFIS,FIRM,orasrequiredinsubsection4-3-050.D.3.f:(a)Obtainandmaintainarecordoftheelevation(inrelationtomeansealevel)towhichthestructurewasfloodproofed.(b)Maintainthefloodproofingcertificationsrequiredinsubsection4-3.050.G.4.d.iii.iii.Certificationrequiredbysubsection4-3-050.G.4.e.i.iv.Recordsofallvarianceactions,includingjustificationfortheirissuance.v.Improvementanddamagecalculations.vi.Maintainforpublicinspectionallrecordspertainingtotheprovisionsofthisordinance.f.UseofOtherBaseFloodData(InAandVZones):Whenbasefloodelevationdatahasnotbeenprovided(inAorVzones)inaccordancewithsubsection4-3-050.D.3.c,BasisforEstablishingtheAreasofSpecialFloodHazard,theFloodplainAdministratorshallobtain,review,andreasonablyutilizeanybasefloodelevationandfloodwaydataavailablefromafederal,state,orothersource,inordertoadministersubsection4-3-050.G.4.d,SpecificStandards,andsubsection4-3-050.G.4.e,AdditionalRestrictionswithinFloodways.4.WellheadProtectionAreas:7 ORDINANCENO.5977a.AnnualInspections:AllpermittedfacilitiesinaWeliheadProtectionAreawillbesubjecttoaminimumofoneinspectionperyearbyaDepartmentinspector.b.PotentialtoDegradeGroundwater—Zone2:i.PotentialforImpactsEqualtoFacilityinZone1:IftheAdministratordeterminesthatanexistingorproposedfacilitylocatedinZone2ofaWellheadProtectionAreahasapotentialtodegradegroundwaterqualitywhichequalsorexceedsthatofapermittedfacilityinZone1,thentheAdministratormayrequirethatfacilitytofullycomplywithrequirementsforZone1containedinRMC4-3-O5OC5cand4-3-050G$.ii.Criteria:CriteriausedtomakethedeterminationinthissubsectionD4shallincludebutnotbelimitedtothepresentandpastactivitiesconductedatthefacility;typesandquantitiesofhazardousmaterialsstored,handled,treated,usedorproduced;thepotentialfortheactivitiesorhazardousmaterialstodegradegroundwaterquality;historyofspillsatthesite,andpresenceofcontaminationonsite.c.FindingofConformanceRequired—WellheadProtectionAreas:NochangesinlanduseshallbeallowednorshallpermitsfordevelopmentbeissuediftheDepartmentfindsthattheproposedlanduse,activity,orbusinessislikelytoimpactthelong-term,short-termorcumulativequalityoftheaquifer.Thefindingshallbebasedonthepresentorpastactivitiesconductedatthesite;hazardousmaterialsthatwillbestored,handled,treated,usedorproduced;and8 ORDINANCENO.5977thepotentialforthelanduse,activity,orbusinesstodegradegroundwaterquality.5.ReviewAuthority:TheAdministratorshallhavetheauthoritytointerpret,apply,andenforcethisSectiontoaccomplishthestatedpurpose.Baseduponsite-specificreviewandanalysis,theCitymaywithhold,condition,ordenydevelopmentpermitsoractivityapprovalstoensurethattheproposedactionisconsistentwiththisSection.a.General:TheAdministratorisauthorizedtomakethefollowingadministrativeallowancesanddeterminations:i.Issueacriticalareaspermitforproposalsnototherwiserequiringadevelopmentpermit.ii.Issuewrittenlettersofexemption.iii.Allowtemporaryemergencyexemptions.iv.Interpretcriticalareasregulations.v.ApprovetheuseofalternatesinaccordancewithRMC4-9-250E.vi.Waivereportcontentorsubmittalrequirementsprovidedcriteriatowaivestudiesaremet.vii.GrantadministrativevariancestothosespecifiedcodesectionslistedinRMC4-9-250B.viii.Requiretestsforproofofcompliance.ix.GrantmodificationspursuanttoRMC4-9-250D.9 ORDINANCENO.5977b.ConditionsofApproval:TheAdministratorisauthorized,throughconditionsofapproval,tomodifytheproposal,including,butnotlimitedto,constructiontechniques,design,drainage,projectsize/configuration,orseasonalconstraintsondevelopment.Uponreviewofaspecialstudy,thedevelopmentpermitshallbeconditionedtomitigateadverseenvironmentalimpactsandtoassurethatthedevelopmentcanbesafelyaccommodatedonthesiteandisconsistentwiththepurposesofthisSection.AmitigationplanmayberequiredconsistentwithsubsectionLiofthisSection.c.GeologicallyHazardousAreas,HabitatConservationAreas,StreamsandLakes,andWetlands:TheAdministratorisauthorized,pursuanttosubsectionHofthisSection,entitledAlterationsToCriticalAreasAnd/OrBuffers—GeneralRequirements,tomakethefollowingadministrativeallowancesanddeterminations:i.GeologicallyHazardousAreas:(a)Waiveindependentreviewofgeotechnicalreports.(b)Increaseordecreaserequiredbufferforveryhighlandslidehazardareas.(c)Grantamodificationforcreatedslopes.ii.StreamsandLakes:(a)Approveproposalsforbufferwidthreductions.(b)Approveproposalsforbufferwidthaveraging.iii.WellheadProtectionAreas:10 ORDINANCENO.5977a.Classification:Floodhazardareasaredefinedasthelandinthefloodplainsubjecttoonepercent(1%)orgreaterchanceoffloodinginanygivenyear.DesignationonfloodmapsalwaysincludesthelettersAorV.b.DatatoBeUsedforExistingandFutureFlowConditions:TheCityshalldeterminethecomponentsofthefloodhazardareasafterobtaining,reviewingandutilizingbasefloodelevationsandavailablefloodplaindataforafloodhavingaonepercent(1%)chanceofbeingequaledorexceededinanygivenyear,oftenreferredtoasthe“onehundred(100)yearflood.”TheCitymayrequiteprojectionsoffutureflowconditionsforproposalsinunmappedpotentialfloodhazardareas.c.GeneralStandards:Inallfloodhazardareas,thefollowingstandardsarerequired:i.Anchoring—AllNewConstruction:Allnewconstructionandsubstantialimprovementsshallbeanchoredtopreventflotation,collapse,orlateralmovementofthestructureresultingfromhydrodynamicandhydrostaticloadsincludingtheeffectsofbuoyancy.iii.ConstructionMaterialsandMethods:(a)Allnewconstructionandsubstantialimprovementsshallbeconstructedwithmaterialsandutilityequipmentresistanttoflooddamage.(b)Allnewconstructionandsubstantialimprovementsshallbeconstructedusingmethods,statutes,codes,rules,regulationsandpracticesthatminimizeflooddamage.12 ORDINANCENO.5977(c)Electrical,heating,ventilation,plumbing,andair-conditioningequipmentandotherservicefacilitiesshallbedesignedand/orotherwiseelevatedorlocatedsoastopreventwaterfromenteringoraccumulatingwithinthecomponentsduringconditionsofflooding.iv.Utilities:(a)Allnewandreplacementwatersupplysystemsshallbedesignedtominimizeoreliminateinfiltrationoffloodwatersintothesystem.Aproposedwaterwellshallbelocatedonhighgroundthatisnotinthefloodway(WAC173-160-171).(b)Newandreplacementsanitarysewagesystemsshallbedesignedtominimizeoreliminateinfiltrationoffloodwatersintothesystemsanddischargefromthesystemsintofloodwaters.(c)On-sitewastedisposalsystemsshallbelocatedtoavoidimpairmenttothemorcontaminationfromthemduringflooding.v.SubdivisionProposals:(a)Allsubdivisionproposalsshallbeconsistentwiththeneedtominimizeflooddamage;(b)Allsubdivisionproposalsshallhavepublicutilitiesandfacilitiessuchassewer,gas,electrical,andwatersystemslocatedandconstructedtominimizeflooddamage;(c)Allsubdivisionproposalsshallhaveadequatedrainageprovidedtoreduceexposuretoflooddamage;and13 ORDINANCENO.5977(d)Allsubdivisionproposalsshallshowthefloodhazardareasinformationandboundaryonthesubdivisiondrawingincludingthenature,location,dimensions,andelevationsofthesubdividedarea.vi.ProjectReview:(a)Adevelopmentpermitshallbeobtainedbeforeconstructionordevelopmentbeginswithinanyareaofspecialfloodhazardestablishedinsubsection4-3-050.D.3.c.Thepermitshallbeforallstructuresincludingmanufacturedhomes,assetforthinRMC4-11,Definitions,andforalldevelopmentincludingfillandotheractivities,alsoassetforthintheRMC4-11,Definitions.(sb)WhereelevationdataisnotavailableLeitherthroughthefloodinsurancestudy(FIS),FloodInsuranceRateMap(FIRM),orfromanotherauthoritativesource,i.c.,subscctionDofthisScction(subsection4-3-050.D.3.f.),applicationsforbuildingpcrmitsfloodplaindevelopmentshallbereviewedtoassurethatproposedconstructionwillbereasonablysafefromflooding.Thetestofreasonablenessisalocaljudgmentandincludesuseofhistoricaldata,highwatermarks,photographsofpastflooding,etc.,whereavailable.Failuretoelevateatleasttwofeet(2’)abovegradethehighestadjacentgradeinthesezonesmayresultinhigherinsurancerates.(bc)Wherebasefloodelevationdatahasnotbeenprovidedorisnotavailablefromanotherauthoritativesource,itshallbegeneratedbytheapplicant.14 ORDINANCENO.5977(U)Reviewalldevelopmentpermitstodeterminethat:(1)Thepermitrequirementsofthisordinancehavebeensatisfied;(2)Allotherrequiredstateandfederalpermitshavebeenobtained;(3)Thesiteisreasonablysafefromflooding;(4)Theproposeddevelopmentisnotlocatedinthefloodway.Iflocatedinthefloodway,assuretheencroachmentprovisionsofsubsection4-3-050.G.4.e.i.aremet.(5)NotifyFEMAwhenannexationsoccurintheSpecialFloodHazardArea.U.SpecificStandards:Inallfloodhazardareas,thefollowingprovisionsarerequired:i.ResidentialConstruction:(a)InAEandA1-30zonesorotherAzonedareaswherethebasefloodelevationhasbeendeterminedorcanbereasonablyobtained,nNewconstructionandsubstantialimprovementofanyresidentialstructureshallhavethelowestfloor,includingbasement,elevatedaminimumofonefoot(1’)ormoreabovethebasefloodelevation.Mechanicalequipmentandutilitiesshallbewaterprooforelevatedleastonefoot(1’)abovethebasefloodelevation.(b)NewconstructionandsubstantialimprovementofanyresidentialstructureinanADzoneshallmeettherequirementsinAppendixA.15 ORDINANCENO.5977(c)NewconstructionandsubstantialimprovementofanyresidentialstructureinanUnnumberedAzone,forwhichabasefloodelevationisnotavailableandcannotbereasonablyobtained,shallbereasonablysafefromflooding,butinallcasesthelowestfloorshallbeatleasttwofeet(2’)abovetheHighestAdiacentGrade.(d)Ifbuildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.{b{Fullyenclosedareasbelowthelowestfloorthataresubjecttofloodingareprohibited,orshallbedesignedtoautomaticallyequalizehydrostaticfloodforcesonexteriorwallsbyallowingfortheentryandexitoffloodwatersfloodwaters.Designsformeetingthisrequirementmustcitherbecertifiedbyaregisteredprofessionalengineerorarchitectormustmeetorexceedthefollowingminimumcriteria:(1)HaveaA—minimumoftwo(2)openingshavingwithatotalnetareaofnotlessthanonejsquareinchforeverysquarefootofenclosedareasubjecttofloodingshallbeprovided;and(2)Thebottomofallopeningsshallbenohigherthanonefoot(1’)abovegrade;and(3)Openingsmaybeequippedwithscreens,louvers,valves,orothercoveringsordevicesprovided7thattheypermittheautomaticentryandexitoffloodwatersfloodwater;and16 ORDINANCENO.5977(4)Agarageattachedtoaresidentialstructure,constructedwiththegaragefloorslabbelowthebasefloodelevation,mustbedesignedtoallowfortheautomaticentryandexitoffloodwaters.Alternatively,aregisteredengineerorarchitectmaydesignandcertifyengineeredopenings.ii.ManufacturedHomes:(a)AllmanufacturedhomestobeplacedorsubstantiallyimprovedwithinZonesA1-A30,AH,andAEonthecommunity’sFloodInsuranceRateMap,shallbeelevatedonapermanentfoundationsuchthatthelowestfloorofthemanufacturedhomeiselevatedaminimumofonefoot(1’)abovethebasefloodelevationandbesecuredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapseandlateralmovement.(b)ManufacturedhomestobeplacedorsubstantiallyimprovedonsitesinanexistingmanufacturedhomeparkorsubdivisionwithinZonesA1-30,AH,andAEonthecommunity’sFloodInsuranceRateMapthatarenotsubjecttotheabovemanufacturedhomeprovisionsshallbeelevatedsothateitherthelowestfloorofthemanufacturedhomeiselevatedaminimumofonefoot(1)abovethebasefloodelevationorthemanufacturedhomechassisissupportedbyreinforcedpiersorotherfoundationelementsofatleastequivalentstrengththatarenolessthanthirtysixinches(36)inheightabovegradeandbesecuredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapse,andlateralmovement.‘7 ORDINANCENO.5977(c)Ifbuildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.iii.NonresidentialConstruction:Newconstructionorsubstantialimprovementofanycommercial,industrialorothernonresidentialstructureshallhavethelowestfloor,includingbasement,elevatedaminimumofonefoot(1’)abovethelevelofthebasefloodelevation,or,togetherwithattendantutilityandsanitaryfacilitics,shallmeettherequirementsofsubsection(a)or(b)below:(a)BefloodproofcdsothatbelowtheminimumelevationrequiredinthissubsectionGthestructureiswatertightwithwallssubstantiallyimpermeabletothepassageofwater;(b)Havestructuralcomponentscapableofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy;(c)Becertifiedbyaregisteredprofessionalengineerorarchitectsothatthedesignandmethodsofconstructionareinaccordancewithacceptedstandardsofpracticeformeetingprovisionsofthissubsectionbasedontheirdevelopmentand/orreviewofthestructuraldesign,specificationsandplans.SuchcertificationsshallbeprovidedtotheAdministrator;(U)Nonresidentialstructuresthatarcclevatcd,butnotfloodproofed,mustmeetthesamestandardsforspacebelowthelowestfloorasdescribedinthissubsectionG.18 ORDINANCENO.5977(a)Newconstructionorsubstantialimprovementofanycommercial,industrialorothernonresidentialstructureshallmeetallofthefollowingrequirements:(1)InAEandA1-30zonesorotherAzonedareaswherethebasefloodelevationhasbeendeterminedorcanbereasonablyobtained,newconstructionandsubstantialimprovementofanycommercial,industrial,orothernonresidentialstructureshallhavethelowestfloor,includingbasement,elevatedonefoot(1’)ormoreabovethebasefloodelevation,orelevatedasrequiredbyASCE24,whicheverisgreater.Mechanicalequipmentandutilitiesshallbewaterproofedorelevatedatleastonefoot(1’)abovethebasefloodelevation,orasrequiredbyASCE24,whicheverisgreater.(2)IflocatedinanAOzone,thestructureshallmeettherequirementsinAppendixA.(3)IflocatedinanUnnumberedAzoneforwhichaBEEisnotavailableandcannotbereasonablyobtained,thestructureshallbereasonablysafefromflooding,butinallcasesthelowestfloorshallbeatleasttwofeet(2’)abovetheHighestAdjacentGrade.(4)Ifbuildingsormanufacturedhomesareconstructedorsubstantiallyimprovedwithfullyenclosedareasbelowthelowestfloor,theareasshallbeusedsolelyforparkingofvehicles,buildingaccess,orstorage.(5)Fullyenclosedareasbelowthelowestfloorthataresubjecttofloodingareprohibited,orshallbedesignedtoautomaticallyequalize19 ORDINANCENO.5977hydrostaticfloodforcesonexteriorwallsbyallowingfortheentryandexitoffloodwaters.Designsformeetingthisrequirementmusteitherbecertifiedbyaregisteredprofessionalengineerorarchitectormustmeetorexceedthefollowingminimumcriteria:(A)Haveaminimumoftwo(2)openingswithatotalnetareaofnotlessthanone(1)squareinchforeverysquarefootofenclosedareasubjecttoflooding;and(B)Thebottomofallopeningsshallbenohigherthanonefoot(1’)abovegrade;and(C)Openingsmaybeequippedwithscreens,louvers,valves,orothercoveringsordevicesprovidedthattheypermittheautomaticentryandexitoffloodwater;and(D)Agarageattachedtoaresidentialstructure,constructedwiththegaragefloorslabbelowtheBFE,mustbedesignedtoallowfortheautomaticentryandexitoffloodwaters.Alternatively,aregisteredengineerorarchitectmaydesignandcertifyengineeredopenings.Ib)litherequirementsofsubsection(a)arenotmet,thennewconstructionandsubstantialimprovementofanycommercial,industrialorothernonresidentialstructureshallmeetallofthefollowingrequirements:(1)Bedryfloodproofedsothatbelowonefoot(1’)ormoreabovethebasefloodlevelthestructureiswatertightwithwallssubstantially20 ORDINANCENO.5977impermeabletothepassageofwaterordryfloodproofedtotheelevationrequiredbyASCE24,whicheverisgreater;and(2)Havestructuralcomponentscapableofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy;and(3)Becertifiedbyaregisteredprofessionalengineerorarchitectthatthedesignandmethodsofconstructionareinaccordancewithacceptedstandardsofpracticeformeetingprovisionsofthissubsectionbasedontheirdevelopmentand/orreviewofthestructuraldesign,specificationsandplans.Suchcertificationsshallbeprovidedtotheofficialassetforthinsubsection4-3-050.D.3.a;and(4)Nonresidentialstructuresthatareelevated,notfloodproofed,mustmeetthesamestandardsforspacebelowthelowestfloorasdescribedinsubsection4-3-050.G.4.d.iii.(a)(5);and(c)Applicantswhoarefloodproofingnonresidentialbuildingsshallbenotifiedthatfloodinsurancepremiumswillbebasedonratesthatareonefoot(1’)belowthefloodproofedlevel(e.g.abuildingfloodproofedtothebasefloodlevelwillberatedasonefoot(1’)below).Floodproofingthebuildinganadditionalfootwillreduceinsurancepremiums.iv.RecreationalVehicles:RecreationalvehiclesplacedonsiteswithinZonesA1-30,AH,andAEonthecommunity’sFloodInsuranceRateMapnotincludingrecreationalvehiclestoragelotsshalleither:21 ORDINANCENO.5977(a)Beonthesiteforfewerthanonehundredeighty(180)consecutivedays;(b)Befullylicensedandreadyforhighwayuse,onitswheelsorjackingsystem,attachedtothesiteonlybyquickdisconnecttypeutilitiesandsecuritydevices,andhavenopermanentlyattachedadditions;or(c)MeettherequirementsofthissubsectionGandtheelevationandanchoringrequirementsformanufacturedhomes.e.AdditionalRestrictionswithinFloodways:Floodways,definedinRMC4-11-060,arelocatedwithinfloodhazardareasestablishedinsubsectionDofthisSection.Sincethefloodwayisanextremelyhazardousareaduetothevelocityoffloodwaterswhichcarrydebris,potentialprojectiles,anderosionpotential,thefollowingprovisionsapply:i.IncreaseinFloodLevelsProhibited:Encroachments,includingfill,newconstruction,substantialimprovements,andotherdevelopmentareprohibitedunlesscertificationbyaregisteredprofessionalengineerdemonstratesthroughhydrologicandhydraulicanalysesperformedinaccordancewithstandardengineeringpracticethat:(a)Encroachmentsshallnotresultinanyincreaseinfloodlevelsduringtheoccurrenceofthebaseflooddischarge;and(b)Therearenoadverseimpactstothesubjectpropertyorabuttingoradjacentproperties;and(c)Therearenohigherfloodelevationsupstream;and22 ORDINANCENO.5977(U)Theimpactduetofloodwayencroachmentshallbeanalyzedusingfuturelanduseconditionflows.ii.ResidentialConstructioninFloodways:Constructionorreconstructionofresidentialstructuresisprohibitedwithindesignatedfloodways,exceptfor:(a)Repairs,reconstruction,orimprovementstoastructurewhichdonotincreasethegroundfloorarea;and(b)Repairs,reconstructionorimprovementstoastructure,thecostofwhichdoesnotexceedfiftypercent(50%)ofthemarketvalueofthestructureeither:(1)beforetherepair,reconstruction,orimprovementisstarted;or(2)ifthestructurehasbeendamaged,andisbeingrestored,beforethedamageoccurred.Workdoneonstructurestocomplywithexistinghealth,sanitary,orsafetycodesortostructuresidentifiedashistoricplacesmaybeexcludedinthefiftypercent(50%).iii.ComplianceRequirements:IfthissubsectionGissatisfied,allnewconstructionandsubstantialimprovementsshallcomplywithallapplicablefloodhazardareasreductionprovisionsofthisSection.iv.BridgesCrossingFloodways:Inmappedorunmappedfloodhazardareas,futureflowconditionsshallbeconsideredforproposedbridgeproposalscrossingfloodways.v.AdditionalProvisionswithinAOZones:ShallowfloodingareasappearonFIRMsasAOzoneswithdepthdesignations.Thebaseflooddepthsin23 ORDINANCENO.5977thesezonesrangefromonetothreefeet(1to3’)abovegroundwhereaclearlydefinedchanneldoesnotexist,orwherethepathoffloodingisunpredictableandwherevelocityflowmaybeevident.Suchfloodingisusuallycharacterizedassheetflow.Inadditiontootherprovisionsinthiscode,thefollowingadditionalprovisionsalsoapplyinAOzones:(a)NewconstructionandsubstantialimprovementsofresidentialstructuresandmanufacturedhomeswithinAOzonesshallhavethelowestfloor(includingbasementandmechanicalequipment)elevatedabovethehighestadjacentgradetothestructure,onefoot(1’)ormoreabovethedepthnumberspecifiedinfeetonthecommunity’sFIRM(atleasttwofeet(2’)abovethehighestadjacentgradetothestructureifnodepthnumberisspecified).(b)NewconstructionandsubstantialimprovementsofnonresidentialstructureswithinAOzonesshalleither:(1)Havethelowestfloor(includingbasement)elevatedabovethehighestadjacentgradeofthebuildingsite,onefoot(1’)ormoreabovethedepthnumberspecifiedontheFIRMtatleasttwofeet(2’)ifnodepthnumberisspecified);or(2)Togetherwithattendantutilityandsanitaryfacilities,becompletelyfloodproofedtoorabovethatlevelsothatanyspacebelowthatleveliswatertightwithwallssubstantiallyimpermeabletothepassageofwaterandwithstructuralcomponentshavingthecapabilityofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy.Ifthismethodisused,compliance24 ORDINANCENO.5977shallbecertifiedbyaregisteredprofessionalengineer,orarchitectasinSubsection4-3-050.G.4.d.iii.(b)(3).(c)Requireadequatedrainagepathsaroundstructuresonslopestoguidefloodwatersaroundandawayfromproposedstructures.(d)RecreationalvehiclesplacedonsiteswithinADzonesonthecommunity’sFIRMeither:(1)Beonthesiteforfewerthanonehundredeighty(180)consecutivedays,or(2)Befullylicensedandreadyforhighwayuse,onitswheelsorjackingsystem,isattachedtothesiteonlybyquickdisconnecttypeutilitiesandsecuritydevices,andhasnopermanentlyattachedadditions;or(3)Meettherequirementsofsubsections(a)andtb)aboveandtheanchoringrequirementsformanufacturedhomes(subsection4-3-050G.4.d.ii).vi.AEandAl-3DZoneswithBaseFloodElevationsbutNoFloodways:InareaswithBFEs(whenaregulatoryfloodwayhasnotbeendesignated),nonewconstruction,substantialimprovements,orotherdevelopment(includingfill)shallbepermittedwithinzonesA1-30andAEonthecommunity’sFIRM,unlessitisdemonstratedthatthecumulativeeffectoftheproposeddevelopment,whencombinedwithallotherexistingandanticipateddevelopment,willnotincreasethewatersurfaceelevationofthebasefloodmorethanonefoot(1’)atanypointwithinthecommunity.25 ORDINANCENO.5977f.CriticalFacility:Constructionofnewcriticalfacilities,asdefinedinRMC4-11-030,shallbe,totheextentpossible,locatedoutsidethelimitsoffloodhazardareas(onehundred(100)year)floodplain.Constructionofnewcriticalfacilitiesshallbepermissiblewithinfloodhazardareasifnofeasiblealternativesiteisavailable.Criticalfacilitiesconstructedwithinfloodhazardareasshallhavethelowestfloorelevatedthreefeet(3’)ormoreabovethelevelofthebasefloodelevation(onehundred(100)year)atthesite.Floodproofingandsealingmeasuresmustbetakentoensurethattoxicsubstanceswillnotbedisplacedbyorreleasedintofloodwaters.Accessrouteselevatedtoorabovethelevelofthebasefloodelevationshallbeprovidedtoallcriticalfacilitiestotheextentpossible.g.CompensatoryStorage:i.CompensatoryStorageRequired:Developmentproposalsandotheralterationsshallnotreducetheeffectivebasefloodstoragevolumeofthefloodplain.Ifgradingorotheractivitywillreducetheeffectivestoragevolume,compensatorystorageshallbecreatedonthesiteoroffthesiteiflegalarrangementscanbemadetoassurethattheeffectivecompensatorystoragevolumewillbepreservedovertime.Compensatorystorageshallbeconfiguredsoasnottotraporstrandsalmonidsafterfloodwatersrecedeandmaybeconfiguredtoprovidesalmonidhabitatorhighflowrefugewheneversuitablesiteconditionsexistandtheconfigurationdoesnotadverselyaffectbankstabilityorexistinghabitat.Effectivebasefloodstoragevolumeshallbebasedontheelevationsshowninthefloodhazardareasmap,identifiedinsubsectionE3ofthis26 ORDINANCENO.5977Sectionorasdeterminedthroughastudywherenobasefloodevaluationinformationexists.ii.DeterminingFinishedFloorElevationsAccordingtoFEMA:TheFEMAonehundred(100)yearfloodplainelevationsshallbeusedtoestablishbuildingfinishedfloorelevationstocomplywithotherNationalFloodInsuranceProgramrequirements.SECTIONIV.Subsection4-3-050.JoftheRentonMunicipalCodeisamendedbyaddinganewsubsection5,entitled“ChangestoSpecialFloodHazardArea,”asshownbelow.AllotherprovisionsinSubsection4-3-050.Jremainineffectandunchanged.i.ALTERATIONSTOCRITICALAREAS:1.CriteriaforModifyingGeologicallyHazardousAreaStandards:a.AnapplicantmayrequestthattheAdministratorgrantamodificationtoallow:i.Regradingofanyslopewhichwascreatedthroughpreviousmineralandnaturalresourcerecoveryactivitiesorwascreatedpriortoadoptionofapplicablemineralandnaturalresourcerecoveryregulationsorthroughpublicorprivateroadinstallationorwideningandrelatedtransportationimprovements,railroadtrackinstallationorimprovement,orpublicorprivateutilityinstallationactivities;and/orii.Fillingagainstthetoeofanaturalrockwallorrockwallcreatedthroughmineralandnaturalresourcerecoveryactivitiesorthroughpublicorprivateroadinstallationorwideningandrelatedtransportationimprovements,27 ORDINANCENO.5977railroadtrackinstallationorimprovementorpublicorprivateutilityinstallationactivities;b.Process:Thefollowingproceduresshallapplytoanyoftheaboveactivities:i.Theapplicantshallsubmitageotechnicalreportdescribinganypotentialimpactsoftheproposedmodificationandanynecessarymitigationmeasures;ii.AllsubmittedreportsshallbeindependentlyreviewedbyqualifiedspecialistsselectedbytheCityattheapplicant’sexpense;iii.TheAdministratormaygrant,condition,ordenytherequestbasedupontheproposal’scompliancewiththeapplicablemodificationcriteriaofRMC4-9-250D;andiv.Anyslopewhichremainsfortypercent(40%)orsteeperfollowingsitedevelopmentshallbesubjecttoallapplicablegeologichazardregulationsforsteepslopesandlandslidehazards,inthisSection;andv.InadditiontothecriteriaofRMC4-9-250D,ModificationProcedures,thefollowingcriteriashallapply:TheproposedmodificationisbasedonconsiderationofthebestavailablescienceasdescribedinWAC365-195-905.2.AlterationsWithinStreamsandLakesorAssociatedBuffers.a.CriteriaforAdministrativeApprovalofTransportationCrossingsinStream/LakeorBufferAreas:Constructionofvehicularornon-vehicular28 ORDINANCENO.5977transportationcrossingsmaybepermittedinaccordancewithanapprovedstream/lakestudysubjecttothefollowingcriteria:i.Theproposedrouteisdeterminedtohavetheleastimpactontheenvironment,whilemeetingCityComprehensivePlanTransportationElementrequirementsandstandardsinRMC4-6-060;andii.Thecrossingminimizesinterruptionofdownstreammovementofwoodandgravel;andiii.Transportationfacilitiesinbufferareasshallnotrunparalleltothewaterbody;andiv.Crossingsoccurasneartoperpendicularwiththewaterbodyaspossible;andv.CrossingsaredesignedaccordingtotheWashingtonDepartmentofFishandWildlifeFishWaterCrossingDesignGuidelines,2013,andtheNationalMarineFisheriesServiceGuidelinesforSalmonidPassageatStreamCrossings,2000,asmaybeupdated,orequivalentmanualsasdeterminedbytheAdministrator;andvi.Seasonalworkwindowsaredeterminedandmadeaconditionofapproval;andvii.MitigationcriteriaofsubsectionLofthisSectionaremet.b.CriteriaforAdministrativeApprovalofUtilitiesinStream/LakeorBuffer:Newutilitylinesandfacilitiesmaybepermittedtocrosswaterbodiesin29 ORDINANCENO.5977accordancewithanapprovedstream/lakestudy,iftheycomplywiththefollowingcriteria:i.Fishandwildlifehabitatareasshallbeavoidedtothemaximumextentpossible;andii.Theutilityisdesignedconsistentwithoneormoreofthefollowingmethods:(a)Installationshallbeaccomplishedbyboringbeneaththescourdepthandhyporheiczoneofthewaterbodyandchannelmigrationzone;or(b)Theutilitiesshallcrossatananglegreaterthansixty(60)degreestothecenterlineofthechannelinstreamsorperpendiculartothechannelcenterline;or(c)Crossingsshallbecontainedwithinthefootprintofanexistingroadorutilitycrossing;andiii.Newutilityroutesshallavoidparallelingthestreamorfollowingadown-valleycoursenearthechannel;andiv.Theutilityinstallationshallnotincreaseordecreasethenaturalrateofshoremigrationorchannelmigration;andv.Seasonalworkwindowsaredeterminedandmadeaconditionofapproval;andvi.MitigationcriteriaofsubsectionLofthisSectionaremet.30 ORDINANCENO.5977c.AdministrativeApprovalofIn-WaterStructuresorIn-WaterWork:Inaccordancewithanapprovedstreamorlakestudy,in-waterstructuresorworkmaybepermitted,subjecttothefollowing:In-streamstructures,suchas,butnotlimitedto,in-streamponds,retentionanddetentionfacilities,tidegates,dams,andweirs,shallbeallowedaspartofanapprovedwatershedbasinrestorationprojectapprovedbytheCityofRenton,andinaccordancewithmitigationcriteriaofsubsectionLofthisSection.TheapplicantwillobtainandcomplywithStateorFederalpermitsandrequirements.U.AdministrativeApprovalofDredging:Dredgingmaybepermittedonlywhen:i.Dredgingisnecessaryforfloodhazardareasreductionpurposes,ifadefinitefloodhazardareawouldexistunlessdredgingwerepermitted;orii.Dredgingisnecessarytocorrectproblemsofmaterialdistributionandwaterquality,whensuchproblemsareadverselyaffectingaquaticlife;oriii.DredgingisassociatedwithastreamhabitatenhancementorcreationprojectnototherwiseexemptinsubsectionCofthisSection;oriv.Dredgingisnecessarytoprotectpublicfacilities;orv.Dredgingisrequiredasamaintenanceandoperationconditionofafederallyfundedfloodhazardareasreductionprojectorahazardmitigationproject;and31 ORDINANCENO.5977vi.DredgingisdonesoastomeetapplicablemitigationcriteriaofsubsectionLofthisSection.e.AdministrativeApprovalofStreamRelocation:Streamrelocationmaybeallowedwhenanalyzedinanacceptedstreamorlakeassessment,andwhenthefollowingcriteriaandconditionsaremet:i.Streamrelocationmayonlybepermittedifassociatedwith:(a)Apublicfloodhazardareasreduction/habitatenhancementprojectapprovedbyappropriatestateand/orfederalagencies;or(b)Expansionofpublicroadorotherpublicfacilityimprovementswherenofeasiblealternativeexists;or(c)Apublicorprivateproposalrestoringawaterbodyandresultinginanetbenefittoon-oroff-sitehabitatandspecies.ii.Thefollowingconditionsalsoapplytoanystreamrelocationproposalmeetingoneormoreoftheabovecriteria:(a)Bufferwidthsshallbebaseduponthenewstreamlocation;provided,thatthebufferwidthsmaybereducedoraveragedifmeetingcriteriaofsubsectionIor]ofthisSection.Whereminimumrequiredbuffetwidthsarenotfeasibleforstreamrelocationproposalsthataretheresultofactivitiespursuanttocriteriainthissubsection],otherequivalenton-oroff-sitecompensationtoachievenonetlossofriparianfunctionisprovided.(b)WhenTypeNsstreams,asdefinedinsubsectionG7ofthisSection,areproposedforrelocationduetoexpansionsofpublicroadsorother32 ORDINANCENO.5977publicfacilityimprovementspursuanttothissubsection1,thebufferareabetweenthefacilityandtherelocatedstreamshallnotbelessthanthewidthpriortotherelocation.Theprovidedbufferbetweenthefacilityandtherelocatedstreamshallbeenhancedorimprovedtoprovideappropriatefunctionsgiventheclassandconditionofthestream;orifthereisnobuffercurrently,otherequivalenton-oroff-sitecompensationtoachievenonetlossofriparianfunctionsisprovided.(c)ApplicablemitigationcriteriaofsubsectionLofthisSectionmustbemet.(d)PropernotificationtotheCitymustbemadeandrecordsprovidedtotheCityofstreamrelocations,pursuanttosubsectionDofthisSection,incaseswherethestream/lakeissubjecttofloodhazardarearegulationsofthisSection.3.CriteriaforModifyingWellheadProtectionAreaStandards:TheDepartmentwillconsidermodificationapplicationsinthefollowingcases:a.Therequestistofindthatastandardisinapplicabletothatactivity,facility,ordevelopmentpermitduetotheapplicant’sproposedmethodsorlocation;orb.Therequestistomodifyaspecificstandardorregulationduetopracticaldifficulties;andc.TherequestmeetstheintentandpurposeoftheWellheadProtectionArearegulations.33 ORDINANCENO.5977BaseduponapplicationofthetestsinsubsectionsJ3a,b,andcofthisSection,applicationswhichareconsideredappropriateforreviewasmodificationsaresubjecttotheproceduresandcriteriainRMC4-9-250D,ModificationProcedures.Requeststomodifyregulationsorstandardswhichdonotmeettheabovetestsshallbeprocessedasvariances.U.Therequest,inadditiontomeetingthecriteriaofRMC4-9-250D,ModificationProcedures,mustbebasedonconsiderationofthebestavailablescienceasdescribedinWAC365-195-905;orwherethereisanabsenceofvalidscientificinformation,thestepsinRMC4-9-250Farefollowed.4.CriteriaforApprovingWetlandAlterations:WetlandalterationsmayonlybeauthorizedaftertheCitymakesawrittenfindingthattheproposalisconsistentwiththefollowingcriteria:a.NoNetLoss:Activitiesthatadverselyaffectwetlandsand/orwetlandbuffersshallincludemitigationsufficienttoachievenonetlossofwetlandfunctionandacreageandtoachieve,wherepracticable,anetresourcegaininwetlandsoverpresentconditions.Theconceptof“nonetloss”meanstocreate,restoreand/orenhanceawetlandsothatthereisnoreductiontototalwetlandacreageand/orfunction.b.Compensationforwetlandalterationsshalloccurinthefollowingorderofpreference:i.Re-establishingwetlandsonuplandsitesthatwereformerlywetlands.34
