HomeMy WebLinkAboutORD 5982CITYOFRENTON,WASHINGTONORDINANCENO.5922ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,EXTENDINGBYSIXMONTHSTHEMORATORIUMONLANDUSEAPPUCATIONSFORLARGERESIDENTIALPROJECTS(150UNITSORMOREINAPROJECT)WITHINTHESUNSETAREA;SETTINGFORTHFINDINGSOFFACTINSUPPORTOFSAIDSIX-MONTHEXTENSION;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,anylanduseactioninvolvingmorethan150dwellingunits(hereinafter“LargeResidentialProject”)isalargeprojectfortheCityofRenton,exceedingthescopeandscaleoftheCity’stypicallanduseprojectsandpotentiallyhavingsubstantialimpactinthevicinityofsuchprojectsandontheCitygenerally;andWHEREAS,onApril6,2020theCityCounciladoptedOrdinanceNo.5967declaringamoratoriumonlanduseapplications(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,andminormodifications)forLargeResidentialProjectswithintheSunsetArea;andWHEREAS,theCityCouncilheldapublichearingtoacceptpublictestimonyregardingthemoratoriumdeclaredbyOrdinanceNo.5967onJune1,2020;andWHEREAS,theCity’sCommunityandEconomicDevelopmentDepartment(CED)isundertakingseveralworkprogramstoupdateportionsoftheRentonMunicipalCodewhichwillapplytoLargeResidentialProjects,aimedatimprovingtheintegrationofLargeResidentialProjectsintotheirvicinityandtheCitygenerally;andWHEREAS,itisintheCity’sbestinterestthattheworkprogramsrelatedtoLargeResidentialProjectsbefurtherconsideredanddevelopedforanadditionalsixmonths,anditis1 ORDINANCENO.5982furtherinthebestinterestoftheCityanditsresidentstoextendthemoratoriumonalllanduseapplicationsrelatingtoLargeResidentialProjectsforthoseadditionalsixmonths;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedtoextendbysixmonthsthemoratoriumonacceptinganylanduseapplication(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,andminormodifications)involvingaLargeResidentialProjectwithinallzoningdistrictswithintheSunsetAreawhichareasfollows:CenterVillage(CV)Zone;Residential-14(R-14)Zone;andResidentialMulti-Family(RMF)Zone;andWHEREAS,theCityCouncilheldapublichearingonOctober5,2020toconsiderasix-monthextensionofthemoratoriumdeclaredbyOrdinanceNo.5967;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TherecitalsadoptedasfindingsoffactinOrdinanceNo.5967insupportofthemoratoriumonlanduseapplicationsforLargeResidentialProjectsintheSunsetAreaareherebyincorporatedbythisreference.SECTIONII.TherecitalsincorporatedbyreferenceinSECTIONIofthisordinanceandtheaboverecitalsareadoptedasfindingsoffactinsupportofthesix-monthextensionofthemoratoriumpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONIII.TheCityCouncilherebyextendsbysixmonthsthemoratoriumuponthesubmissionoracceptanceofanylanduseapplication(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,and2 ORDINANCENO.5982minormodifications)involvingaLargeResidentialProjects(asdefinedabove)withinthefollowingzones:CenterVillage(CV)zone;Residential-14(R-14);andResidentialMulti-Family(RMF)ZoneiflocatedwithintheSunsetAreawhichisdefinedforthepurposesofthismoratoriumasitisdefinedinRMC4-1-220.B.11(thegeographicalareadepictedintheEligibleAreasforMultiFamilyHousingIncentivesMap,theoriginalversionofwhichwasadoptedasAttachmentAtoOrdinanceNo.5760).SECTIONIV.ThemoratoriumextendedhereinshallbeineffectuntilApril6,2021,unlessearlierliftedorsubsequentlyextendedbyactionoftheCityCouncil.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVI.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis5thdayofOctober,2020.ia$th/3 ORDINANCENO.5982APPROVEDBYTHEMAYORthis5thdayofOctober,2020.Approvedastoform:AeyShaneMoloney,CityAttorneyDateofPublication:October9,2020(summary)ORD:2121:9/14/2020Pavone,Mayor4
