ORDINANCENO.5981(U)Theimportanceoftheservicesprovidedbytheproposedfacilitytothecommunity;(e)Thenecessitytothefacilityofawaterfrontlocation,whereapplicable;(f)Theavailabilityofalternativelocationsfortheproposedusewhicharenotsubjecttofloodingorerosiondamage;(g)Thecompatibilityoftheproposedusewithexistingandanticipateddevelopment;(h)Therelationshipoftheproposedusetothecomprehensiveplanandfloodplainmanagementprogramforthatarea;fi)Thesafetyofaccesstothepropertyintimesoffloodforordinaryandemergencyvehicles;(j)Theexpectedheights,velocity,duration,rateofrise,andsedimenttransportofthefloodwatersandtheeffectsofwaveaction,ifapplicable,expectedatthesite;and(k)Thecostsofprovidinggovernmentalservicesduringandafterfloodconditions,includingmaintenanceandrepairofpublicutilitiesandfacilitiessuchassewer,gas,electrical,andwatersystems,andstreetsandbridges.ii.Generally,theonlyconditionunderwhichavariancefromtheelevationstandardmaybeissuedisfornewconstructionandsubstantialimprovementstobeerectedonalotofone-half(1/2)acreorlessinsizecontiguoustoandsurroundedbylotswithexistingstructuresconstructedbelow25 ORDINANCENO.5981thebasefloodlevel,providedcriteriainsubsectionB9bfi)ofthisSectionhavebeenfullyconsidered.Asthelotsizeincreases,thetechnicaljustificationrequiredforissuingthevarianceincreases.iii.Variancesmaybeissuedfornonresidentialbuildingsinverylimitedcircumstancestoallowalesserdegreeoffloodproofingthanwatertightordryfloodproofing,whereitcanbedeterminedthatsuchactionwillhavelowdamagepotential,complieswithallothervariancecriteriaexceptsubsectionsB9b(ii),(iii)or(iv)ofthisSection,andotherwisecomplieswithRMC4-3-050l2aandl2bofthegeneralstandards.iv.Variancesmaybeissuedforthereconstruction,rehabilitation,orrestorationofstructureslistedintheNationalRegisterofHistoricPlacesortheStateInventoryofHistoricPlaces,withoutregardtotheproceduressetforthinthisSection.v.Variancesshallnotbeissuedwithinadesignatedfloodwayifanyincreaseinfloodlevelsduringthebaseflooddischargewouldresult.vi.Variancesshallonlybeissuedupon:(a)Ashowingofgoodandsufficientcause;(b)Adeterminationthatfailuretograntthevariancewouldresultinexceptionalhardshiptotheapplicant;(c)Adeterminationthatthegrantingofavariancewillnotresultinincreasedfloodheights,additionalthreatstopublicsafety,extraordinary26
