4422CITYOFRENTON,WASHINGTONRESOLUTIONNO.4422ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON;ADOPTINGREDUCEDTRANSPORTATIONIMPACTFEESFORDAYCARECENTERS;ADOPTINGREDUCEDUTILITYSYSTEMDEVELOPMENTCHARGES(ALSOKNOWNASUTILITYHOOKUPFEES)ANDWAIVEDDEVELOPMENTFEES,INCLUDINGTRANSPORTATION,PARKS,FIRE,ANDSCHOOLIMPACTFEES,ANDBUILDINGFEES,FORNEWACCESSORYDWELLINGUNITS(ADUs),WHICHWILLSUNSETONDECEMBER31,2022;INCORPORATINGSAIDFEEREDUCTIONSINTOTHEFEESCHEDULE;ANDAMENDINGTHECITYOFRENTONFEESCHEDULEFORTHEYEARS2021AND2022.WHEREAS,intheRevisedCodeofWashington(“RCW”)82.02.050(1)thelegislaturehasstatedthatitsintentistoallowcitiestorequirenewgrowthanddevelopmentwithintheirboundariestopayaproportionateshareofthecostofsystemimprovementstoservesuchnewdevelopmentactivitythroughouttheassessmentofimpactfees;andWHEREAS,theCityadoptedimpactfeesfortransportation,parks,andfireprotectionin2011andthosefeeswerebasedonextensiveresearchdocumentingtheproceduresformeasuringimpactofnewgrowthanddevelopmentonpublicfacilities.Thatresearchwasreflectedinthe“RateStudyforImpactFeesforTransportation,Parks,andFireProtection,”CityofRenton,datedAugust26,2011,incorporatedbyreferenceintoRMC4-1-190.CbyandattachedasExhibit1toOrdinanceNo.5670onOctober8,2012;andWHEREAS,theCityagainconductedextensiveresearchmeasuringtheimpactofnewgrowthanddevelopmentontransportationpublicfacilitiesandthatresearchisreflectedina“RateStudyforImpactFeesforTransportation,”CityofRentondatedJuly5,2016;andWHEREAS,theCityCounciloftheCityofRentonadoptedthe“RateStudyforImpactFeesforTransportation,”byResolutionNo.4299onNovember21,2016;and1 RESOLUTIONNO.4422WHEREAS,thestudyestablishednewimpactfeeratesforfrequentlyusedlandusecategories,andaddednewlandusecategories,includingdaycarecenters;andWHEREAS,thestudyestablishedpricepersquarefootastheunitofmeasureforcalculatingtheimposedtransportationimpactfeeamountondaycarecenterdevelopmentattherateof$97.76persquarefoot;andWHEREAS,thenewlyestablishedtransportationimpactfeeratesweresimultaneouslyadoptedandlistedinthe2017-2018CityofRentonFeeSchedulebyResolutionNo.4300passedNovember21,2016;andWHEREAS,thenewlyadoptedimpactfeerateswerephasedinoverafour-yearbudgetcyclebeginningin2017;andWHEREAS,theresultingtransportationimpactfeeratesfordaycarecenterswerechargedat$42.88persquarefootin2017and201$,$70.39persquarefootin2019and2020,andthefullrateisscheduledtobeimplementedat$97.76persquarefootin2021;andWHEREAS,Citystaffreceivedfeedbackfromdaycarecenteroperatorsthattheratesimposedweresignificantlycostprohibitive;andWHEREAS,theCitywishestoencourageincreaseddevelopmentofaffordabledaycareoptionsforRentonfamilies;andWHEREAS,theCitychoosestoreducetherateatwhichtransportationimpactfeesareimposedondaycarecenters,reducingtheimpactfeerateby50%ofthefullamount,or$48.88persquarefoot;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,thematterwasconsideredbythePlanningCommission;and2 RESOLU11ONNO.4422WHEREAS,theCityheldapublichearingonthematterofdaycarecenterfeesonSeptember16,2020;andWHEREAS,thePlanningCommissionhasmadecertainfindingsandrecommendationstotheCouncilinsupportofthetransportationimpactfeereductionfordaycarecenters;andWHEREAS,theCitychargesbuildingfees;useofpublicworksfacilitiesfees,whichincludessystemdevelopmentcharges;andtransportation,parks,fire,andschoolimpactfeesbasedonadoptedratestudiesonnewADU5;andWHEREAS,theCityofRentonstrivestofacilitatethecreationandpreservationofanaffordableanddiversehousingstock;andWHEREAS,provisionswereadoptedin2010allowingtheestablishmentofAccessoryDwellingUnits(ADUs)asaformofaffordablemarket-ratehousingintheCity,buttheCity’srecordsindicatedADUdevelopmenthadbeenminimal;andWHEREAS,onOctober16,2017byResolutionNo.4318theCityCounciladoptedreducedlandusereviewfees;buildingfees;useofpublicworksfacilitiesfees,whichincludesystemdevelopmentcharges;andimpactfeesfortransportation,parks,fire,andschools;applicabletoallADUsbyhalf;andwaivedallsuchfeesforeverythirdADUcreatedwithinanewsubdivisionof(10)ormotelotstoencouragetheircreationforatrialperiodsunsettingonDecember31,2018;andWHEREAS,onNovember19,2018byResolutionNo.4359theCityCouncilextendedthereducedADUfeesforanewperiodsunsettingonDecember31,2020;andWHEREAS,theCityCouncilfindsthatthepublicbenefitofencouragingADUswarrantsatemporaryfeereductionoffifty-percent(50%)fortheuseofpublicworksfacilities,whichinclude3 RESOLUTIONNO.4422systemdevelopmentcharges;andfullwaiverofADUfeesrelatedtobuilding,andimpactfeesfortransportation,parks,fire,andschools;applicabletoallnewADU5withintheCityforaperiodsunsettingonDecember31,2022;andWHEREAS,onNovember23,2009,theCounciladoptedOrdinanceNo.5509,whichremovedmanyfeesfromtheRentonMunicipalCodeandconsolidatedthemintotheCityofRentonFeeSchedulebrochure(“FeeSchedule”);andWHEREAS,theFeeSchedulehasbeenamendedseveraltimessince2009;andWHEREAS,itisnecessarytoapproveanamendedFeeScheduleforyears2021and2022;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.Transportationimpactfeesfordaycarecentersshallbereducedfrom$97.76persquarefootto$48.28persquarefootandshallremainatthisrateindefinitelyunlesstheCityCounciltakesactiontothecontraryoruntilafollow-upimpactfeestudyisconducted.SECTIONII.Thefollowingutilitysystemdevelopmentcharges,alsoknownasutilityhookupfees,arereducedbyhalf(50%)fornewADUs:•Waterserviceandwastewatersystemdevelopmentcharges(excludingfireservicefees);and•Stormwatersystemdevelopmentchargesfornewsinglefamilyresidences.SECTIONIII.ThefollowingdevelopmentfeesarewaivedfornewADUs:•Buildingpermitfees;•Combinationbuildingpermitfees;•Buildingplancheckfee;4 RESOLUTIONNO.4422•Electricalpermitfeesforsingle-familyandduplex,newservice;•Mechanicalpermitfees;•Plumbingpermitfees;•Waterconstructionpermitfees;•Wastewaterandsurfacewaterconstructionpermitfees;and•Transportation,parks,fire,andschoolimpactfeesforADUs.SECTIONIV.ThefeesmodifiedpursuanttoSECTIONIIandSECTIONIIIofthisresolutionshallremainmodifiedthroughDecember31,2022,uponwhichdatethefeesmodificationsshallsunsetunlesstheCityCounciltakesactiontothecontrary.SECTIONV.EffectiveJanuary1,2021,theFeeScheduleisamendedandreplacedwiththe2021-2022CityofRentonFeeSchedulebrochure,whichisattachedheretoandadoptedbythisreference.AnupdatedcopyoftheFeeScheduleshallatalltimesbefiledwiththeCityClerkasrequiredbyOrdinanceNo.5509.SECTIONVI.TheamendedFeeScheduleadoptedbySectionVofthisresolutionshallbeeffectiveonJanuary1,2021,andthereafteractastheCityofRenton’sFeeScheduleforallfeesorchargesreferencedtherein.TheFeeScheduleshallremainineffectuntilamendedorotherwisereplacedbytheCityCouncil.IntheeventtheFeeScheduleisnotamendedpriortotheyear2023,thefeesspecifiedfortheyear2022shallcontinuetoapplyintoandbeyond2023untilamendedbytheCityCouncil,exceptasotherwisespecifiedherein.5
