5992CITYOFRENTON,WASHINGTONORDINANCENO.5992ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTION5-1-1OFTHERENTONMUNICIPALCODEBYADDINGADEFINITIONOF“PERSON,”ALPHABETIZINGDEFINITIONS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Section5-1-1oftheRentonMunicipalCodeisamendedasfollows:5-1-1DEFINITIONSFORTITLEV:A.“AdministrativeServicesAdministrator”shallmeantheAdministrativeServicesAdministratorordesignee.B.“Administrator”shallmeantheAdministrativeServicesAdministratorordesignee.C.“Businessentity”shallmeananypersonorpersonsengagedinactivitiesforprofitincluding,butnotlimitedto,anybusiness,businessenterprise,company,corporation,partnership,soleproprietorshiprequiredtobelicensedand/orregisteredintheStateofWashingtonoranyotherstate.D.“Full-timeequivalentemployee”shallmeananemployeeworkingmorethanonethousandninehundredtwenty(1,920)workerhourseachyear,includinglegalholidaysandvacationtime,duringthetwelve(12)monthperioduponwhichthelicensefeeiscomputed.1 ORDINANCENO.5992E.“Independentcontractor”shallmeanthosepersonswhoareprimarilyengagedinthebusinessofrenderinganytypeofserviceincluding,butnotlimitedto,thefollowing:doctorofmedicine;otherhealingartorscience;dentistordentaltechnician;attorneyatlaw;licensedorregisteredengineer;surveyor;certifiedorlicensedpublicaccountant;bookkeeper;taxorbusinessconsultingservice;realestatebrokeroragency;insurancebroker,agentorrepresentativeandotherbrokeragebusinesses;funeraldirectorormortuary;optometrist;architectordesigner;optician;ophthalmologist;pharmacist;operator,manageroranyotherbusinessenterpriseconductinganystateornationalbank,buildingandloanassociation,savingsandloanassociation,andanyotherfinancialinstitutionrenderingaspecialormultipletypeofprofessionalorsemiprofessionalservicetothegeneralpublic;specializedprivatetrainingschoolsinaviation,salesmanshipandmusicwhenconductedinaseparateplaceofbusinessandhavinganaverageoftwenty(20)ormorestudentsperweek;orotherspecializedtrainingschoolsteachingorinstructinginspecialskillsortrades;oranyothersimilaractivityconductedby,supervisedoroperatedbyabusinessenterprisewhichofferstomembersofthepublicthebusinessofrenderinganytypeofservice.Additionally,forgeneralbusinesslicensepurposes,theyareconsideredindividualbusinessesandarerequiredtoobtainaseparatelicenseinadditiontotheirplaceofbusinesslicense.F.“Licenseholder”shallmeanthepersonorpersonswhoappliedforageneralbusinesslicenseoranyotherbusinesslicenseandeachowner,2 ORDINANCENO.5992shareholder,partner,principal,managerorpersonresponsibleforthebusinessenterprise.A“licenseholder”isalsoreferredtointhisTitleasa“licensee.”G.“Quarterly”shallmean,inthecontextoftaxes,feesorpayments,January1untilMarch31(1stquarter),April1untilJune30(2ndquarter),July1untilScptcmbcr30(3rdquarter)andOctober1untilDecember31(4thquarter).G#.“Materiallyfalsestatement”or“materialmisrepresentation”meansanyfalsestatementormisrepresentation,oralorwritten,regardlessofitsadmissibilityundertherulesofevidence,whichcouldhaveaffectedthecourseoroutcomeofthelicenseapplication,renewalapplication,inspection,audit,orreviewofrecords.H.“Person”shallmeananyindividual,receiver,administrator,executor,assignee,trusteeinbankruptcy,trust,estate,firm,co-partnership,jointventure,club,company,jointstockcompany,businesstrust,municipalcorporation,politicalsubdivisionoftheStateofWashington,corporation,limitedliabilitycompany,association,society,oranygroupofindividualsactingasaunit,whethermutual,cooperative,fraternal,non-profit,orotherwiseandtheUnitedStatesofAmericaoranyofitsinstrumentalities.I.“Quarterly”shallmean,inthecontextoftaxes,feesorpayments,January1untilMarch31(1stquarter),April1untilJune30(2ndquarter),July1untilSeptember30(3rdquarter)andOctober1untilDecember31(4thquarter).i1.“Records”shallmeanandincludebutnotbelimitedtobooks,revenues,receipts,taxorregulatory/informationalreturns/filings,bankdepositsand3 ORDINANCENO.5992disbursements,invoices,accountsreceivableandpayable,recordsofallcustomeraccounts,billingunits,andfeeschargedtogetherwithdatesandrelatedfinancialstatements,subscriberrecords,plans,and/ordatamaintained,storedorkeptinelectronicoranyotherformat.SECTIONIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIV.Thisordinanceshallbeinfullforceandeffectthirty(30)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis16thdayofNovember,2020.4%tJasoA.Seth,iClerkAPPROVEDBYTHEMAYORthis16thdayofNovember,2020.Ar’Pavone,Mayor4
