HomeMy WebLinkAboutORD 5999CITYOFRENTON,WASHINGTONORDINANCENO.5999ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ADDINGREGULATIONSFORSTANDALONESOLARENERGYSTRUCTURESBYAMENDINGSUBSECTION4-2-060.0OFTHERENTONMUNICIPALCODE,AMENDINGCHAPTER4-4OFTHERENTONMUNICIPALCODEBYADDINGANEWSECTION4-4-105“SOLARENERGYSYSTEMS,”ANDADDINGNEWDEFINITIONSOF“SOLARENERGYSYSTEM”AND“SOLARENERGYSYSTEM,GROUNDMOUNTED,SMALLSCALE”TOSECTION4-11-190OFTHERENTONMUNICIPALCODE,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonSeptember16,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onOctober6,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-2-060.0oftheRentonMunicipalCodeisamendedasshownonAttachmentA.Allotherprovisionsin4-2-060remainineffectandunchanged.SECTIONIII.Chapter4-4oftheRentonMunicipalCodeisamendedtoaddanewsection4-4-105“SolarEnergySystems”toreadasshownbelow.Allotherprovisionsin4-4remainineffectandunchanged.1
ORDINANCENO.59994-4-105SOLARENERGYSYSTEMS:A.PURPOSE:ThepurposeofthisSectionistoprovidestandardsforcertainSolarEnergySystemstoreduceimpactsrelatedtovisibilitywhilepromotingtheuseofalternativeenergysourcesforusers.B.APPLICABILITY:TheSectionshallapplyto:1.NeworReplacementEquipment/Activity:AllproposalsforneworreplacementSolarEnergySystems.2.EnlargementorExteriorModificationsofExistingStructures:SolarEnergySystemsthatarenotinconformancewiththisSectionshallberequiredtoconformtotherequirementsofthisSectionifenlargedoralteredwhenthecostofthealterationsexceedsfiftypercent(50%)ofthevalueoftheexistingSolarEnergySystem.C.AUTHORITY:TheAdministratorshalldeterminecompliancewiththesestandardsconcurrentlywithanydevelopmentpermitreview,orinassociationwithanycodecomplianceissue.D.SOLARENERGYSYSTEM,GROUNDMOUNTEDEQUIPMENT,SMALL-SCALE:1.Height:Noportionofthestructureshallexceedthemaximumallowedwall-plateheighticrdetachedaccessor’’buildingsinthesubjectzoneas2
ORDINANCENO.5999establishedinRMC4-2-11DB,DevelopmentStandardsforResidentialDevelopment(DetachedAccessoryBuildings).2.Setbacks:ThestructureshallbesubjecttosetbackrequirementsfordetachedaccessorybuildingsinthesubiectzoneasestablishedinRMC4-2-11DB,DevelopmentStandardsforResidentialDevelopment(DetachedAccessoryBulldings).3.Location:Thestructureshallnotbesitedcloserthansixfeet(6’)fromaresidentialstructureandshallnotbelocatedbetweentheprimarystructureandastreet.4.ImperviousSurface/BuildingCoverage:StructureswithgrassoranalternativepervioussurfaceundertheassociatedpanelsareexcludedfrommaximumbuildingcoverageormaximumimpervioussurfacearearequirementsestablishedinRMC4-2-OA,DevelopmentStandardsforResidentialZoningDesignations(PrimaryStructures).Ifpavementorotherimpervioussurfacesareutilizedaroundthebaseofthestructureorunderthesolarpanels,thestructurewouldbenotbeeligiblefortheexemption.E.VARIANCES:AvariancetostandardsmaybesoughtpursuanttoRMC4-9-250.SECTIONIV.Section4-11-190oftheRentonMunicipalCodeisamendedtoaddnewdefinitionsinalphabeticalorderofuSolarEnergySystem”and“SolarEnergySystem,GroundMounted,SmaWScale”toreadasshownbelow.Allotherdefinitionsin4-11-190remainineffectandunchanged.3
ORDINANCENO.5999SOLARENERGYSYSTEM:Adeviceorstructuraldesignfeature,asubstantialpurposeofwhichistoprovideforinteriorlightingorprovideforthecollection,storage,anddistributionofsolarenergyforspaceheatingorcooling,electricitygeneration,orwaterheating.SOLARENERGYSYSTEM,GROUNDMOUNTED,SMALL-SCALE:ASolarEnergySystemthatisstructurallymountedtothegroundandtypicallyasizethatwouldserviceahouse,smallbusinesses,orsmallmunicipalbuilding.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVI.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofDecember,2020./%/Jason/.Seth,CilerkAPPROVEDBYTHEMAYORthis14thdayofDecember,ArodoPavone,Mayor4
