ORDINANCENO.5996NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.ThestatementssetforthinAttachmentBareadoptedasfindingsoffactinsupportofthisinterimzoningcontrolordinanceadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390andinterpretativeandapplicablejudicialdecisions,andarefoundtobetrueandcorrectinallrespects.SECTIONII.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONIII.Subsections4-2-050.A,4-2-050.C.4,4-2-050.C.5,and4-2-050.C.6oftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-2-050remainineffectandunchanged.4-2-050PERMITTEDLANDUSESESTABLISHED:A.CATEGORIESOFUSESESTABLISHED:ThisSectionestablishespermitted,conditional,accessoryandprohibiteduses,byzone,forallpropertieswithintheRentonCityLimits.Allusesinagivenzoneareoneofsix(6)types:PERMITTEDUSES:Landusesallowedoutrightwithinazoneasaprincipaluse.PermittedusesaredistinctfromotheruseslistedseparatelyinRMC4-2-060,ZoningUseTable—UsesAllowedinZoningDesignationsand/orasdefined.CONDITIONALUSES(ADMINISTRATIVE):LanduseswhichmaybepermittedasaprincipalusewithinazoningdistrictfollowingreviewbytheDcvclopmcnt2 ORDINANCENO.5996ServicesDivisionDirectorAdministratortoestablishconditionsmitigatingimpactsoftheuseandtoassurecompatibilitywithotherusesinthedistrict.CONDITIONALUSES(HEARINGEXAMINER):Landu3dseswithspecialcharacteristicsthatmaynotgenerallybeappropriatewithinazoningdistrict,butmaybepermittedasaprincipalusesubjecttoreviewbytheHearingExaminertoestablishconditionstoprotectpublichealth,safetyandwelfare.ACCESSORYUSES:Usescustomarilyincidentalandsubordinatetothe—aprincipaluseandlocatedwithinthesamestructureastheprincipaluseorotherwiseuponthesamelet—siteoccupiedbythe—aprincipaluseoronanabutting/adjacentlotthatisunderthesameownership.astheprincipallot.Someaccessoryusesarespecificallylisted,particularlywhereauseisonlyallowedinanaccessoryform,whereasotheraccessoryusesaredeterminedbytheDevelopmentServicesDivisionAdministratoronacase-by-casebasisperRMC4-2-050C4andC6,AccessoryUseInterpretationsandUnclassifiedUses.PROHIBITEDUSES:AnyusewhichisnotspecificallyenumeratedorinterpretedbytheCityasallowableinthatdistrict.Anyusenotspecificallylistedasapermitted,conditional,oraccessoryuseisprohibited,exceptthoseusesdeterminedtobeunclassifiedandpermittedbytheDevelopmentServicesDivisionDirectorAdministratorpursuanttoRMC‘120404-2-050C6.AnyprohibiteduseisillegalandisamisdemeanorpunishableunderRMC1-3-iLPenalties.3 ORDINANCENO.5996subsectionC3ofthisSection.TheAquiferProtectionRegulationsofRMC4-3-050,CriticalAreasRegulations,furtherrestrictusageofthosepropertieslocatedwithintheAquiferProtectionAreaBoundaryshowninRMC4-3-0500.,Maps.3.AdditionalUse-RelatedConditions:Ifanumberalsoappearsattheintersectionofthecolumnandtherow,theuseisalsosubjecttotheadditionalrequirementsaslistedimmediatelyfollowingtheusetableinRMC4-2-080,ConditionsAssociatedwithZoningUseTables.AllapplicablerequirementsshallgovernausewhetherspecificallyidentifiedinthisChapterornot.4.AccessoryUseInterpretations:TheDcvclopmentServicesDivisionDirectorAdministratorm-ashalldetermineifanunclassifieduseoraclassifieduse,evenifnotspecificallylistedasaccessory(AC),ispermittedasanaccessoryuseinazone.Uponinquirywrittenapplicationbyanapplicant,anadministrativeinterpretationshallbemadebytheDevelopmentServicesDivisionDirectorAdministratortodetermineifaproposeduseisallowedasanaccessoryuseutilizingtherulesofinterpretationinsubsectionC4aofthisSection.Iftheapplicantdoesnotconcurwiththeinterpretationofwhetherauseisaccessoryorwiththepermittypeappliedtoause,appealmaybemadepursuanttoRMC4-8-110,Appeals.InterpretationsmadebytheDevelopmentServicesDivisionDirectorAdministratorshallbedocumented,andupdatestoTitle4,whenconsistentwiththetitleformatandlevelofdetail,shallincorporate“accessoryuse”interpretationsuponapprovalbythelegislativeauthority.5 ORDINANCENO.5996a.RulesofInterpretationforAccessoryUses:Todeterminewhetherauseispermittedasaccessory,theDevelopmentServicesDivisionDirectorAdministratorshallutilizethefollowingrulesofinterpretation:i.Ifauseisallowedorconditionallyallowedinazoneasa“permitted”use,accessoryusesassociatedwiththeprimaryusethataredeterminedtobeincidental,necessaryandcommonlyfoundwiththepermittedusemaybeallowedwiththesamepermittypeastheprimaryuse,unlessspecificallystatedotherwise.ii.Ifauseispermittedorconditionallypermittedasaprimaryuse,subjecttolocationrestrictions,thelisteduse,evenasanaccessoryuse,isalsosubjecttothesamelocationrestrictionsastheprimaryuse,unlessspecificallystatedotherwise.Forexample,ifauseisrestrictedtoalocationwithintheEmploymentAreafEA)landusedesignation,thentheaccessoryformoftheuseisonlypermittedintheEA,unlessspecificallystatedotherwise.iii.Requiredparking,requiredsiteutilities/facilities,andotherdevelopmentstandardsrequitedinordertoestablishoroperateauseonasiteaccordingtotheRMCareconsideredaccessory.5.ProhibitedUses:Ifnosymbolappearsintheboxattheintersectionofthecolumnandtherow,theuseisprohibitedinthatdistrictunlessotherwisedeterminedbytheDevelopmentServicesDivisionDirectorAdministra,pursuanttoth4subsectionC6ofthisSection,UnclassifiedUses,orsubsectionC4,AccessoryUseInterpretations.6 ORDINANCENO.59966.UnclassifiedUses:Uponinguirywrittenapplicationbyanapplicant,anadministrativeinterpretationshallbemadebytheDevelopmentScrvicesDivisionDirectorAdministratortodetermineifaproposeduseLnotspecificallylistedLisallowedutilizingthecriteriainsubsectionC6aofthisSection.Shouldinterpretationbemadethataproposed,unlistedusenotbeallowedinaspecificzoningdistrict,theDirectorAdministratorshallindicatewhichzones,ifany,dopermittheusesubjecttolocationalrestrictionsanddevelopmentstandards.IftheDevelopmentServicesDivisionDirector’sAdministrator’sinterpretationindicatesthatanunlisteduseisnotconsistentwiththepermitted,conditionaloraccessoryusesinanydistrict,orifapartydoesnotconcurwiththepermittypeappliedtoause,appealmaybemadetotheCity’sHearingExaminerpursuanttoRMC4-8-110,Appeals.InterpretationsmadebytheDevelopmentServicesDivisionDirectorAdministratorshallbedocumented,andupdatestoTitle4shallbeupdated,whenconsistentwiththetitleformatandlevelofdetail,shalltoincorporaterespondto“unclassifieduse”interpretationsuponapprovalbythelegislativeauthoritymadebytheAdministrator.a.CriteriaforUnclassifiedUses:Inordertomakeadeterminationthatanunclassifieduseispermitted,conditionallypermittedoraccessory,theDevelopmentServicesDivisionDirectorAdministratormustfindthattheuseis:I.Inkeepingwiththepurposeandintentofthezone,andconsistentwiththeRentonComprehensivePlanpoliciesandotheradoptedplansasmaybeapplicable;and7 ORDINANCENO.5996ii.Similarinnatureto,andnomoreintensethan,aspecificallylistedpermitted,conditionaloraccessoryuse;andiii.ConsistentwithsubsectionC4ofthisSection,ifdeterminedtobepermissibleasanaccessoryuse.7.UseTableConflicts:IntheeventofaconflictbetweenRMC4-2-060,theMasterZoningUseTableandanyotherindividualzoningusetables,RMC4-2-070Athrough4-2-0705,theprovisionsofRMC4-2-060shallhavepriority.8.ExistingLegalNonconformingUses:Wheretheterm“existing”followsalistedusetypewithinthetable(s)(e.g.,horticulturenurseries,existing),thenthosewhocandocumentthattheirnonconforminguseswerelegalatthetimethenonconforminguseswereestablishedwillbepermittedtocontinuethosenonconformingusesandgivenalltherightsofotherpermitteduseswithinthedistrict.Inaddition,theseusesmayberebuilt“asis,whereis”shouldtheysufferdamage.Theseusesmayberemodeledwithoutlimitationonvalueandmaybeenlargedsubjecttocurrentcoderequirements(e.g.,heightlimits,lotcoverage,densitylimits,setbacks,parking,etc.),unlessotherwisespecificallyconditionedinRMC4-2-080.SECTIONIV.Subsection4-2-060.GoftheRentonMunicipalCodeisamendedbymodifyingonerowandaddingtworows,and4-2-060.KoftheRentonMunicipalCodeisamendedbyaddingonerow,allasshowninAttachmentA.Allotherprovisionsin4-2-060remainineffectandunchanged.8 ORDINANCENO.5996SECTIONV.Subsections4-2-080.A.71and4-2-080.A.101oftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-2-080.Aremainineffectandunchanged.71.Specifieduse(s)areonlyallowedsouthof1-405.Diversionfacilitiesshallbelimitedtoservingnomorethanonehundred(100)individualsatanytime.101.Rcscrvcd.Asmanyasone(1)COVID-19deintensificationsheltermayoperatewithintheCityofRentonwithoutobtainingaconditionalusepermittooperateasaHomelessServicesUse.ThefollowingappliestoaCOVID-19deintensificationshelteroperatingpursuanttothisexemptionfromtheconditionalusepermitrequirementsthatwouldotherwiseapplytoaHomelessServicesUse:a.AfterJune1,2021,theCOVID-19deintensificationsheltershallnotservemorethanonehundredtwenty-five(125)personsatanytime;andb.TheCOVID-19deintensificationsheltershallceaseoperationsnolaterthanJanuary1,2022,afterwhichdatetheCOVID-19deintensificationshelterwillbeunlawfullyoperatingifitdoesnotholdavalidconditionalusepermitforaHomelessServicesUseandisnotoperatinginalocationinwhichHomelessServicesUsesareallowed.SECTIONVI.Chapter4-4RMCoftheRentonMunicipalCodeisamendedtoaddSection4-4-045,HomelessServicesUse,toreadasshownbelow.4-4-045HOMELESSSERVICESUSE:A.PURPOSE:ThepurposeofthisSectionistoprovidezoningandlanduseregulationsforhomelessservicesusesthatareproposedtoorthatdoprimarilyprovideshelter9 ORDINANCENO.5996tooneormorepopulationsofpeopleexperiencingortransitioningfromhomelessness.B.APPLICABILITY:ThisSectionappliestoallhomelessservicesuses,exceptasexpresslysetforthinthisSection.ThisSectiondoesnotapplyto:1.UsesallowedunderaTemporaryUsePermitissuedpursuanttothetermsofRMC4-9-240,TemporaryUsePermits;andusestemporarilyallowedpursuanttoRMC4-2-060.Gand4-2-080.A.101(includingaCOVID-19deintensificationshelter);2.ReligiousorganizationshostingthehomelesswithinbuildingsontheirpropertyunderthetermsofRCW35A.21.360(Hostingthehomelessbyreligiousorganizations—Whenauthorized—Requirements—Prohibitionsonlocalactions);3.Socialserviceorganizations;4.Unrelatedindividualslivingtogetherasa“family”pursuanttothedefinitioncontainedinRMC4-11-060;and5.HousingforwhichthetenantsfallundertheprotectionsofChapter59.18RCW.C.DEFINITIONS:1.DefinitionsApplicabletoTerminologyUsedinThisSection:SeealsoDefinitionsinRMCchapter4-11.a.“Codeofconduct”isanagreementonrulesofbehaviorbetween•occupantsofahomelessservicesuseandoperatorsandprovidersofferinga10 ORDINANCENO.5996homelessservicesuseataspecificlocation.Thecodeofconductisintendedtoprotectthehealth,safety,andwelfareoftheoccupantsandemployeesofthehomelessservicesuse,andthesurroundingresidentsandbusinesses.b.“Funder”meansanyperson,partnership,corporation,orotherorganizationofanykindthatprovidesfundingtoestablish,construct,oroperateahomelessservicesuse.c.“GoodneighboragreementtGNA).”Reserved.d.“Homelessservicesuse.”SeedefinitioninRMC4-11-080.e.“Homelessness”referstothestateofapersonorgroupofpersonswholacksafixed,regular,andadequatenighttimeresidence,meaning:(i)Hasaprimarynighttimeresidencethatisapublicorprivateplacenotmeantforhumanhabitation;(ii)Islivinginapubliclyorprivatelyoperatedshelterdesignatedtoprovidetemporarylivingarrangements(includingcongregateshelters,transitionalhousing,andhotelsandmotelspaidforbycharitableorganizationsorbyfederal,state,andlocalgovernmentprograms);or(iii)Isexitinganinstitutionwhere(s)he/ithasresidedforninety(90)daysorlessandwhoresidedinanemergencyshelterorplacenotmeantforhumanhabitationimmediatelybeforeenteringthatinstitution.f.“Operator”meansanyperson,partnership,business,corporation,orotherorganizationofanykindthatproposestositeandoperateordoesoperateahomelessservicesuseintheCity.11 ORDINANCENO.5996g.“Provider”meansanyperson,partnership,business,corporation,orotherorganizationofanykindthatprovidessupportiveservicestoahomelesspopulationaccessingahomelessservicesuse.h.“Safetyandsecurityplan”referstoaplandevelopedbytheoperatorandupdatedtoreflectinputprovidedbytheRentonPoliceDepartmenttoaddresssecurityconcernsregardingahomelessservicesusethatisproposedataspecificlocation.i.“Standardoperatingprocedures”refertoaplandevelopedbytheoperatorthataddressestheelementsrequiredbysubsectionF.2.eofthisSection.j.“Supportiveservices”arethoseprovidedtooccupantsofahomelessservicesuseforthepurposeoffacilitatingtheirindependenceandinclude,butarenotlimitedto,servicessuchascasemanagement,foodormeals,medicaltreatment,psychologicalcounseling,childcare,transportation,andjobtraining.D.APPROVALPROCESSREQUIRED:Ahomelessservicesuserequiresaconditionalusepermit,approvedbyaHearingExaminerandprocessedpursuanttotheprovisionsofRMC4-9-030andtheprovisionsofthisSection.E.PREAPPLICATIONPROCESS:1.PreapplicationMaterials:AneighborhoodmeetingisrecommendedbutnotrequiredpursuanttoRMC4-8-100.Apriortosubmittalofanapplicationforaconditionalusepermitforahomelessservicesuse.2.PreapplicationNeighborhoodMeeting:Reserved3.PreapplicationSiteInspectionbytheCity:Reserved.12 ORDINANCENO.5996F.SUBMITTALREQUIREMENTS:1.AnapplicantseekingtoestablishahomelessservicesuseisrequiredtosubmitapplicationmaterialsthatmeetthesubmittalrequirementsforaconditionalusepermitasrequiredbyRMC4-8-120.2.InadditiontotheapplicableconditionalusepermitsubmittalrequirementsidentifiedinsubsectionF.1ofthisSection,informationidentifiedinthissubsectionshallalsobeincludedwiththepermitapplication.Anapplicationthatdoesnotcontaintheinformationlistedinthissubsectionshallnotbeconsideredcomplete.Allapplicationsforhomelessservicesuseshallincludethefollowing:a.Adescriptionofthehomelesspopulationtobeservedbytheproposedhomelessservicesuse,datesandtimesofoperation,andassociatedoccupancytargets.b.Astatementoftheoperator’sexperienceatprovidinghomelessservices,includingexamplesofsimilarfacilitiesmanagedbytheoperator.c.Reserved.d.Reserved.e.Astandardoperatingproceduresplanincluding,butnotlimitedto:I.Adescriptionofhowtheproposedhomelessservicesusewillservethehomelesspopulationthatwillbeaccommodatedbytheuse;13 ORDINANCENO.5996asaCOVID-19deintensificationshelterforpersonsexperiencinghomelessness(the“COVID-19Shelter”).DESCbeganusingtheCOVID-19SheltertotemporarilyhouseindividualspreviouslyhousedatitsdowntownSeattleMainShelter,locatedatTheMorrisonHotel.DESCandKingCountydecidedtohousetheseindividualsinprivaterooms,ratherthancongregatehousing,whereCOVID-19couldspreadmorerapidly.DESCdidsowithoutcoordinatingwithCityofficialsorCitystaff,andwithoutobtainingCitypermitsorobtainingaCitybusinesslicense.OperationsoftheCOVID-19ShelterandCityLandUse,Zoning,andBusinessLicensingLaws7.AsdescribedbyDESC,theCOVID-19Shelteroperatesasa24-hourshelterforDESC’sclientsexperiencinghomelessness,withawiderangeofservicesincludingtheprovisionofmeals,casemanagement,andcrisisintervention.8.KingCountyhasrepresentedthatthemaximumnumberofresidentsoftheCOVID-19Shelterhasbeen235individuals.9.DESChasbeencontinuouslyoperatingtheCOVID-19SheltersinceonoraboutApril9,2020,inconcertwithKingCounty,incontraventionofCityzoningandwithoutCitylanduseorbuildingpermitsoraCitybusinesslicense.10.SincetheCOVID-19ShelterbeganoperatingattheRedLionSite,firstrespondersfromtheRentonPoliceDepartmentandtheRentonRegionalFireAuthority(RRFA)haveexperiencedamarkedincreaseinthenumbersofcallsforservicetotheRedLionSiteanditsvicinity,causingadverseimpactsintheCityofRenton.11.CitystaffimmediatelymadethefollowinglanduseandzoningdeterminationsregardingDESC’suseoftheRedLionSitetodeintensifycongregatehomelessshelters:(1)theonlylanduselawfullyestablishedontheRedLionSiteisa“Hotel”landuse;(2)theCOVID-1931 ORDINANCENO.5996EnforcementProceedingsandHearingExaminerDecision14.OnJune30,2020,whentheMOUnegotiationshaddissolvedwithnocommitmentonthepartofKingCountyorDESCtorelocatingtheCOVID-19SheltertoalocationallowedbytheRentonMunicipalCode,theCityhadrunoutofalternativestoengagingincodeenforcementproceedingsregardingtheCOVID-19Shelter.Thus,onthatdate,theCityissuedatwo-countFindingofViolationtoKingCounty,DESC,andRHIundercodeenforcementcasenumberCODE2O-000321findingthat(1)theCOVID-19Shelterisa“landusenotallowedinzoningdesignation”(Violation1),and(2)theCOVID-19Shelterwas“operatingwithoutaCityofRentonbusinesslicense”(Violation2).Hereinafter,theFindingofViolationisthe“FOV.”15.KingCountyandRHIbothtimelyrequestedahearingtochallengetheFOV,andtherequestedhearingregardingtheFOVwasheldbeforetheCity’sHearingExamineronAugust14,2020,withDESCalsoparticipatinginthehearing.16.InfrontoftheHearingExaminer,KingCounty,RHI,andDESCtookthepositionthatthetemporaryuseoftheRedLionSiteforshelterdeintensificationmeetstheRMCdefinitionofa“Hotel”landuse.TheyalsotookthepositionthateveniftheshelterdeintensificationuseoftheRedLionSitedidnotmeetthedefinitionofa“Hotel”landuse,theLocalHealthOfficer’sauthorityunderWashingtonlawtoprotectthepublicfromcontagiousdiseasestakeslegalprecedenceoverandpreemptsRenton’szoningandpermittinglaws.17.Foritspart,infrontoftheHearingExaminer,theCitytookthepositionsthat(1)thedeintensificationuseoftheRedLionSitedoesnotmeettheRMCdefinitionofa“Hotel”landuse,(2)theuseappearedtomostcloselyalignwiththeRMCdefinitionsforthe“diversionfacility/diversioninterimservicefacility”landuseorthe“congregateresidence”landuse,(3)neitherthe33 ORDINANCENO.5996“diversionfacility/diversioninterimservicefacility”landusenorthe“congregateresidence”landuseisallowedwithintheCAzoningdesignation(whichistheRedLionSite’szoningdesignation),and(4)thepandemicandCountyHealthOrderdidnotpreempttheCity’szoningandlanduselaws;indeed,theCountyHealthOrderexpresslyrestrictedKingCountytousing“legallyavailable”resourcesandforbadeusing“illegalmeansorbehavior,”whichwouldincludetheCityofRenton’slegallyadoptedandenforcedzoning,landuse,andbusinesslicensinglaws.18.BywrittendecisionsdatedAugust31,2020andOctober2,2020,theHearingExaminerruledontheFOV(collectively,the“HearingExaminer’sFOVDecision”).19.TheHearingExaminer’sFOVDecisiondirectedKingCountyandDESCtochooseeithertovacatetheRedLionSitewithin60daysortoapplytotheCityforan“unclassifieduse”interpretationinwhichtheDepartmentofCommunity&EconomicDevelopment(“CED”)woulddetermineiftheCOVID-19ShelterisallowedutilizingthecriteriainRMC4-2-050.C.6.a.20.AlthoughtheOctober2,2020portionoftheHearingExaminer’sFOVDecisionconfirmsthatthe“unclassifieduseanalysis...decisionislefttoCitystaffasgovernedbyCitycode,”theHeatingExaminer’sFOVDecisionneverthelessprojectsthattheoutcomeofCED’sunclassifieduseinterpretationwillbetodeemtheCOVID-19Sheltera“Hotel”landuse,a“SocialServiceOrganizations”landuse,oracombinationofthetwo.21.TheHearingExaminer’sFOVDecision’sprojectionsthatanunclassifieduseinterpretationwouldresultina“Hotel”and/or“SocialServiceOrganizations”landusedeterminationwerebased,inpart,onthefollowingassumptionsregardingtheintentoftheCityCouncil:34 ORDINANCENO.5996•Regardingthe“Hotel”landuse,theHearingExaminer’sFOVDecisionstates:“TheCityhastakenthestrongpositionthattherequirementinthehoteldefinitionthatgueststaysbe“transient”meansthatstaysmustbe30daysorless.Althoughthevastmajorityofhotelusemayverywellbe30daysorless,thereisnobasistoconcludethathotelsstayswillnotsometimesbelongerduetoexceptionalcircumstancessuchasnaturaldisastersandpandemics.ThemostcompellingreasontodisagreewiththeCity’s30-dayinterpretationissimplythattheRentonCityCouncildidn’texpresslyadopta30-daylimitforhotelstays.IftheCouncilwantedahardandfastruleonthelengthoftimethatsomeonecouldstayinahotelroom,itwouldhavebeenexceptionallyeasyandcleartothrowthatintothedefinitionofhotelortransient.”Cite:HearingExaminer’sAugust31,2020decision,page11,lines22-29(emphasisadded).•Regardingthe“SocialServicesOrganizations”landuse,theHearingExaminer’sFOVDecisionstates:“Thereistheargumenttobemadethataddednightshelteruse[toa“SocialServicesOrganizations”usewhichonlyexpresslyallows“dayshelter”use]couldreducetheimpactsofadayshelterandtherebymakeaconditionalusepermitunnecessary.Adaysheltercausesdisplacementofahomelesspopulationeveryeveningitshutsdownwhereasa24-hourshelterdoesnot.However,itistooimplausibletoconcludethat’swhythesocialservicesorganizationexpresslyauthorizesjustdaysheltersanddoesn’tmentionnightshelters.IftheCouncilconsideredanightshelteramorebenignusethanadayshelter,itwouldhaveexpresslyauthorizeditasapermitteduseelsewhereintheusetable.”Cite:HearingExaminer’sAugust31,2020decision,page11,lines11-12(emphasisadded).22.TheHearingExaminer’sFOVDecision’sprojectionsthatanunclassifieduseinterpretationwouldresultina“Hotel”and/or“SocialServiceOrganizations”landusecaused,inpart,theHearingExaminertoconcludethattheCOVID-19Shelterwasnotmostsimilartoa“DiversionFacility/DiversionInterimServiceFacility”landuse.35 ORDINANCENO.5996UnclassifiedUseApplicationandCommencementofLitigationinKingCountySuperiorCourt23.OnoraboutOctober15,2020,KingCounty,DESC,andRHIjointlyappliedforanunclassifieduseinterpretationfortheCOVID-19Shelter,asprovidedforintheHearingExaminer’sFOVDecision(the“UnclassifiedUseRequest”).24.Anunclassifieduseinterpretationapplicationisnotapermitapplicationtypethatvestsuponsubmittalofacompleteapplication(SeeRMC4-1-045“Vesting”).25.OnoraboutOctober23,2020,KingCounty,DESC,andRHIjointlycommencedalawsuitinKingCountySuperiorCourt,underCauseNo.20-2-15681-7KNT,challengingtheHearingExaminer’sFOVDecision(hereinafter,the“RentonShelterLawsuit”).26.PursuanttoastipulationofallpartiestotheRentonShelterLawsuit,theRentonShelterLawsuit’scaseschedulewasextendedby90dayswiththefirstdeadlineintheactionnowpostponeduntilJanuary28,2021.CompatibilityandComplianceConcerns27.ImpactsfromtheCOVID-19ShelterattheRedLionSitehavecreatedconcernsandidentifiedimpactsfromneighboringpropertyowners,businessowners,residents,tenants,andvisitorsregardingthecompatibilitybetweentheCOVID-19Shelterandlanduseswithinitsvicinity.28.ThisincompatibilitybecameimmediatelyapparentupontheCOVID-19Shelter’sopeningwhenitsoperatorsenclosedthebuildinginsecurityfencingasameasureitassertedwasnecessary,makingahotelbuildinglocatedataprimaryentrancetotheCity’scoretoappeartobeavacantand/orcordonedoffbuilding.36 ORDINANCENO.599629.TheCOVID-19ShelterhascreatedandcontinuestocreatesignificantpublicsafetyandwelfareconcernsfortheresidentsoftheCOVID-19Shelteranditsvicinity.Thesepublicsafetyandwelfareconcernsinclude,butarenotlimitedto,documentedsignificantincreasesincriminalactivity,violationsofbuildingandfirecodes,documentedsignificantincreasesin9-1-1callsforemergencyservices,andinstancesofthreatstofirstresponderswhorespondto9-1-1callstotheCOVID-19Shelter.InstancesofthreatstoRRFApersonnelresultedintheRRFArequestingpolicesafetyescortstoallcallsforservicetotheCOVID-19Shelter.30.BymemorandumdatedDecember9,2020,theRRFAFireChiefandFireMarshalissuedanoticetotheCOVID-19ShelteroperatorsthatseveralsafetyconcernsregardingtheCOVID-19Shelter’soperationshadcausedtheRRFAtodeemtheCOVID-19Shelteranassistedlivingfacilityand/orinstitutionaloccupancyforfirecodepurposes.31.TheCOVID-19Shelteroperatesasalow-barriershelterforresidentswithhighneeds,includingpersonsstrugglingwithhistoriesofinterpersonalconflict,ruleviolations,and/orillegalsubstanceusethathavecausedothershelterstodenythemservices.32.TheCOVID-19Shelteroperatorsassertthattheincidenceofsuchconflictshasreducedasaresultofdeintensifyingthedistancefromwhichtheresidentsliveandinteractwitheachother,butthenumberof9-1-1callsforservicetotheCOVID-19ShelterhasnottrendeddownsincetheCOVID-19Shelterbeganitsoperations.33.Incidentsofinterpersonalconflict,arson,andthreatsofarsonattheCOVID-19ShelterhavecontinuedtooccurattheCOVID-19Shelter.34.NumbersofincidentsofinterpersonalconflictandarsonorthreatenedarsonarelikelytobereducedbyreducingthenumberoftheCOVID-19Shelter’sresidents.37 ORDINANCENO.599635.ReducingthenumberoftheCOVID-19Shelter’sresidentsislikelytoimprovethesafetyandwelfareofshelterresidents,staff,visitors,firstresponders,andthoseworking,living,andvisitingthesurroundingvicinity.ClarificationandConfirmationofLandUseDefinitionsandProcesses36.InresponsetotheHearingExaminer’sFOVDecision,theCityCouncilwishestolegislativelyclarifyandconfirmitspolicyandinterpretationregarding“Hotel,”“SocialServiceOrganizations,”and“DivisionFacility/DiversionInterimServiceFacility”landuses,toapplycitywide.37.TheCityCouncilfindsthattheamendedandclarifieddefinitionof“Hotel,”assetforthinthisordinance,clarifiesandcodifiesCityCouncilintent,includingaddingtheWAC458-20-166(3)definitionof“transient”tothedefinitionof“Hotel”tomean“forlessthanonemonth,orlessthanthirtycontinuousdaysiftherentalperioddoesnotbeginonthefirstdayofthemonth.”38.TheCityCouncilfurtherfindsthataddingadefinitionfor“Hotel,ExtendedStay,”assetforththisordinance,furtherclarifiesandcodifiestheintentoftheCityCouncil.39.TheCityCouncilfurtherfindsthattheamendeddefinitionof“SocialServicesOrganizations,”assetforthinthisordinance,clarifiesandcodifiesCityCouncilintent,includingconfirmingthat“nightshelter”operationsarenotanallowedcomponentofaSocialServiceOrganizationslanduse.40.TheCityCouncilfurtherfindsthattheamendeddefinitionof“DiversionFacility”andtheremovalofthedefinitionof“DiversionInterimServiceFacility,”assetforthininthisordinance,clarifiesandcodifiesCityCouncilintent.38 ORDINANCENO.599641.TheCityCouncilalsofindsthatthereisaneedtoadoptcertainrelatedclarificationstotheRentonMunicipalCoderegardingtheunclassifieduseinterpretationprocess,thedistinctionsbetween“principal”and“accessory”uses,andthetitleofpositionswithinCED.ConversionofCOVID-19DeintensificationShelterUsefromanIllegalUsetoaLegalUse42.TheRentonMunicipalCodedoesnotcurrentlyallowtheCOVID-19SheltertooperatewithintheCity’sCommercialArterial(CA)zoningdistrict.43.TheCityCouncilhaslegislativelydeterminedthatitwillamendtheRentonMunicipalCodetoaddadefinitionfora“COVID-19deintensificationshelter”landuseandtoallowasinglesuchlandusewithinspecifiedzoningdesignationsintheCitywithoutneedforaconditionalusepermit,onatemporarybasisandsubjecttoadditionalstandardsandregulationsestablishedinthisordinance.44.CitystaffhasconcludedthatthereareavailablepropertiesintheCityofRentoninthefollowingzoningdesignationsuponwhichaCOVID-19deintensificationsheltercouldbelocatedafterthecompletionoftenantimprovementstotheshelteroperator’ssatisfaction:CommercialOffice(CO),CenterVillage(CV),LightIndustrial(IL),MediumIndustrial(IM),andHeavyIndustrial(IH).45.CitystaffhasnotbeenadvisedandisunawarethatKingCounty,DESC,orRHIhasinquiredintoorotherwisedeterminedwhetheraCOVID-19deintensificationsheltercouldbelocatedonanypropertywithintheCitythatiszonedCO.CV,IL,IM,orIH(eitherwithorwithouttenantimprovements).KingCounty’sidentificationandacquisitionofoneormoresuchpropertiescouldallowtheCOVID-19deintensificationsheltertorelocateandoperatelawfullyinanappropriatezonewithappropriateconditionsandthusresolvetheissuesinthepending39 ORDINANCENO.5996RentonShelterLawsuitandissuesoveruseoftheRedLionSiteasaCOVID-19deintensificationshelter.IntenttoExpresslyAllowHomelessServicesUsesintheCityofRenton46.TheCityCouncilrecognizesthatthehomelessnesscrisisinKingCountyisaseriousregionalchallengebutthatitisaregionalchallengethatpredatestheCOVID-19pandemic.47.TheCityCouncilfindsthatoneofthewaysthattheCitycanhelpcombatthehomelessnesscrisisthatpredatedtheCOVID-19pandemicistoexpresslyallowforhomelessserviceslandusesforshort-term-stayshelters(daysheltersandovernightshelters)withintheCityandtoprovideforreasonableregulationofsuchuses.48.Inresponse,theCityCouncilhasdeterminedto,onanemergencyandinterimbasis,define“homelessservicesuse”landuses,statethezoningdesignationsinwhichsuchlandusesareallowed,andestablishregulationstobeappliedtosuchuses.ThisOrdinanceRespondstoan“Emergency”asthatTermisUsedunderStateLaw49.TheCityCouncilfindsthatthereisaneedtoadoptthisordinanceasaninterimzoningcontrolordinanceonanemergencybasis.50.PursuanttoWAC197-11-880,theadoptionofthisinterimzoningordinanceisexemptfromtherequirementsofathresholddeterminationundertheStateEnvironmentalPolicyAct(SEPA),andfuturepermanentzoningregulationsshallbereviewedinaccordancewithSEPArequirements.ProceduralandSubstantiveIssues51.TheCityCouncilexpresslyintendsthatthisordinancebealegislativepolicyactionwhichisnotasite-specificorquasi-judicialaction,andtheCityCouncilfurtherrecognizesand40 ORDINANCENO.5996intendsthatsuchlegislativeactionhastheeffectofmootingtheUnclassifiedUseRequestbyKingCounty,RHI,andDESCandmootingtheRentonShelterLawsuitbycreatinganallowedusefortheCOVID-19ShelterthatmootstheHearingExaminer’sFOVDecision.52.TheCityCouncilexpresslyintendsthatproceduralandsubstantivedueprocessrightsbemetinthesubstanceandcontentsofandprocessofadoptingthisordinance.53.TheCityCouncilheldapublichearingonNovember23,2020,regardingthesubjectmatterofthisordinance,andheardoraltestimonyonthematterandconsideredwrittencommentsreceivedpriortothepublichearing.54.TheCityCouncilencouragedfurtherpublicinputonthesubjectmatterofthisordinanceby,amongotherthings,keepingthepublichearingopenuntilDecember1,2020at5:00PMforthepurposeofreceivingadditionalwrittencomment.55.Inadditiontooralpubliccommentandtestimony,theCityCouncilreceivedandconsiderednumerouswrittencommentsandtestimonysubmittedbymembersofthepublicbeforethehearing,duringthehearing,andfollowingthehearing.56.Inresponsetopubliccommentandtestimony,theCityCouncilwishestoclarifythat,asdescribedinthewrittenpresentationmaterialsincludedintheCityCouncil’sNovember23,2020agendapacket,theCity’sintentionregardingthetimingofthisordinancehasbeenasfollows:•November23,2020:Publichearing;•December7,2020:Firstreadingoftheordinancewithrevisionsthatincorporatefeedbackfrompubliccomments;and41 ORDINANCENO.5996•December14,2020:Secondreadingoftheordinance(withrevisionsthatincorporatefurtherfeedbackfrompubliccomments),CityCouncilactionontheordinance,andeffectivedateoftheordinance.42
