1THISAMENDMENT,datedMarch6,2020,isbyandbetweentheCityofRenton(the“City”),aWashingtonmunicipalcorporation,andWatershedScienceandEngineering,Inc.(“Consultant”),aWashingtonCorporation.TheCityandtheConsultantarereferredtocollectivelyinthisAmendmentasthe“Parties.”OncefullyexecutedbytheParties,thisAmendmentiseffectiveasofthelastdatesignedbybothparties.Whereas,theCityengagedtheservicesoftheConsultantunderAgreementCAG-i8-085,datedMay1,2018,toprovidenecessaryservicesfortheMadsenCreekImprovementProject(referredtohereinasthe“Agreement”);Whereas,thePartieswishtoamendtheAgreementtochangethescopeofwork,changethetimeforperformance,andchangethecompensationinordertocompletetheMadsenCreekImprovementProjectPhase1forfinaldesign,providingconstructionsupportservices,additionalpermitting,andeasementacquisitionsupportservices.NOWTHEREFORE,ItismutuallyagreeduponthatCAG-i8-085isamendedasfollows:1.ScopeofWork:Section1,ScopeofWork,isamendedtoaddworkasspecifiedinExhibitA-i,whichisattachedandincorporatedherein.2.TimeofPerformance:Section3,TimeofPerformance,isamendedpursuanttotheschedule(s)setforthinExhibitC-i.AllWorkshallbeperformedbynolaterthanDecember31,2021.3.Compensation:Section4,Compensation,isamendedsothatthemaximumamountofcompensationpayabletoConsultantisincreasedby$99,903from$466,098to$566,001,plusanyapplicablestateandlocalsalestaxes.TheadditionalcompensationshallbepaidbaseduponWorkactuallyperformedaccordingtotherate(s)oramountsspecifiedinExhibitB-i,whichisattachedandincorporatedherein.4.AlltermsoftheAgreementnotexplicitlymodifiedhereinshallremaininfullforceandeffectandsuchtermsshallapplytoWorkperformedaccordingtothisAmendmentasiffullysetforthherein.AMENDMENTNO.1TOAGREEMENTFORMADSENCREEKIMPROVEMENTPROJECTCAG-18-085 MadsenCreekImprovementProjectExhibitA-i:ScopeofWorkTask201.ProjectManagementandCoordinationforFinalDesign,Permitting,andConstructionTaskLeads:WSEandHerreraTheworkdescribedinsubsequenttaskswillrequirescheduling,coordination,invoicingandprogressreportingworkbytheconsultantteam.Thistaskrepresentstheeffortforthosepartsofthework.Theteamwillberesponsibleforadministrativeactivitiesincludingbutnotlimitedto:>CommunicationwiththeCity’sprojectmanger>Projectbudgetmonitoringandmanagement>Schedulemonitoringandmanagement>MonthlyinvoicesthatincludeashortprogresssummaryTask202.EnvironmentalPermittingAssistanceforaFloodReductionActioninKingCountyJurisdictionTaskLead:HerreraAsofFebruary2020,HerreraisadvancingthedesignforfourfloodreductionactionsalongtheMadsenCreekhighflowbypasschannelandlowflowchanneltoapreliminarydesignlevelofdetailthatprovidessufficientinformationneededforpermitapplications,andassistingtheCityinpreparingdocumentationforalloftherequiredCityofRentonpermitapplications.ThesearecalledSites1-4inthedesignandpermittingdocumentation.ThescopeofworkforthistaskisfocusedonsupportingacquisitionofCityofRentonpermits.AportionofproposedcreeksidebermconstructionatSite4northofStateRoute169onthenorthbankofthelowflowchannelisinKingCountyjurisdiction,andrequiresacquisitionofKingCountypermitsandapprovals.ThistaskcomprisestheworkspecificallyneededtoobtainthoseKingCountypermitsandapprovals.Therequiredpermitsandcorrespondingsubmittalinformationareasfollows:oClearingandGradingpermitoShorelinepermitoCriticalAreaAlterationExceptionoFloodplainDevelopmentpermitoFloodHazardCertificationAssumptions:>TheSEPAchecklistpreparedforCityreviewpreviously,andforwhichtheCityistheleadagency,canencompassallofSite4,suchthatnoadditionalSEPA-relatedworkisnecessaryaspartoftheCountypermittingprocess.1 >PermitsandapprovalstobeobtainedfromKingCountywillrequireattendingapreapplicationmeetingandcoordinationwiththeKingCountyDepartmentofLocalServicesandtheKingCountyWaterandLandResourcesDivision(whichsupportsLocalServicesfarfloodplainimpactreviews).ThistaskincludesthatmeetingtimeandcoordinationtoaddressCountyquestionsandcommentsoninformationsubmittedtotheKingCountyDepartmentofLocalServices.>Allwetlandandstreambuffermitigationwilloccuronsite,andwillnotrequireoffsitemitigation.>ThecriticalareasreportandmitigationplanpreparedfortheCitypreviously,andwhichencompassesSite4,willsufficefordocumentationKingCountyneedsregardingwetlandandstreamdelineationsandratings,andfordiscussionofcompensatoryfloodstoragerequirementsandproposedmitigationinCountyjurisdiction.>TheCitywillpayallpermitapplicationfees.Deliverables:>AllrequiredKingCountypermitapplicationformsanddocuments—draftforCityreviewKingCountypermitapplicationformsanddocuments—finalforsubmittaltoKingCountyDepartmentofLocalServices>MeetingagendasandnotesforuptotwomeetingswithKingCountypermitapplicationintakeandreviewstaffTask203.FinalDesignofFloodReductionActionsTaskLead:HerreraandWSEHerrerawillpreparefinaldesignplans,specifications,andconstructioncostestimatesforcompetitivecontractorbidding,andrecorddrawingsetforfourfloodreductionactionsalongtheMadsenCreekhighflowbypasschannelandlowflowchannel(calledSites1-4inthepreliminarydesignandpermittingdocumentationpreparedinprecedingtasks).WSEwillassistwiththedesignsbyincorporatingdesigniterationsintheexistinghydraulicmodelandverifyingthefinalconstructionmeetshydraulicrequirements.FinaldesignswillbeincludedinthehydraulicmodelthatisdeliveredtotheCityattheendoftheproject.Designsubmittalmilestonesinclude75%stageofcompletion,100%completion(proofcopyforprojectadvertisementforbidding),ad-readyconstructiondocuments,recorddrawings,andsignedletterofverificationthefinalconstructionmeetsrequiredhydraulicdesignandpermittingrequirements.Herrerawillpreparedesigndrawingsin22”x34”(11”x17”compatibility)formatinAutoCADCivil3D2019orcompatibleversion,adheringtoapplicableCitydrawingformatstandards.HerrerawillpreparespecialprovisionssupplementingtheWSDOT/APWAStandard2
