HomeMy WebLinkAboutAdden 2AMENDMENT NO. 2 TO AGREEMENT FOR MADSEN CREEK IMPROVEMENT PROJECT – ADDITIONAL DESIGN CAG-18-085 THIS AMENDMENT, dated December 15, 2020, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Watershed Science & Engineering, Inc. (“Consultant”), a Washington Corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-18-085, dated May 1, 2018, to provide necessary services for the Madsen Creek Improvement Project (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work and change the compensation in order to complete the Madsen Creek flood control improvements for final design based on private property design changes. NOW THEREFORE, It is mutually agreed upon that CAG-18-085 is amended as follows: 1.Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A-2, which is attached and incorporated herein. 2.Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $73,775 from $566,001 to $639,776, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit B-2,which is attached and incorporated herein. 3.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Project Management and Coordination for Final Design, Permitting, and Construction Task Leads: WSE and Herrera The work to complete project design and coordinate the necessary documentation for permitting is taking more time than was anticipated, with construction moved to 2021 . The extended time to complete all of the project technical work requires ongoing project management and administrative support effort commensurate for an additional year. The specific activities to be performed in this task are the same as described in Task 201 in Contract Amendment No. 1. The budget for this task is amended proportionate to that additional duration of the task work. Task 203. Final Design of Flood Reduction Actions Task Lead: Herrera The project will include constructing berms in regulated floodplain areas, requiring compensatory flood storage within the project area. Design of sufficient compensatory storage has required iterative analyses of different ways to modify the Madsen Creek high flo w bypass channel, with consideration of preventing encroachment on the eastern boundary of an easement the City has with a private land owner, preventing alteration of the existing maintenance access road on the west side of the bypass channel, and excludi ng the volume of sediment removal to restore originally constructed bypass channel dimensions. Those constraints present a variety of challenges in optimizing the design to accomplish the desired flood reduction benefits while providing the necessary compe nsatory storage. Herrera has undertaken numerous design iterations to present alternative configurations to the City for review and consideration, supporting a decision on the preferred channel modifications that will be carried forward in project permitting and final design. That iterative design work was not anticipated in this task as previously authorized. Additionally, as the 75% complete design work was nearing completion aside from the compensatory flood storage issue, the private property owner adj acent to Wonderland Estates decided not to be involved in the project, triggering a need to modify the design for what is being called “Site 3” to eliminate any berming and associated riparian vegetation planting on that property. This triggered additional design work to revise the engineering drawings as well as the planting plan for this site, and updating calculations of impacts in the floodplain and critical area buffer at this site that are used for the various permit application documents. This task includes the work to revise the permitting support documents to accurately incorporate DocuSign Envelope ID: 3EC0080A-1E3F-4769-9927-B63DC7E6F4F3 2 estimated quantities of site disturbance, floodplain fill, and other items associated with the iteratively changing design at Sites 2 and 3. As of late 2020, the single -family residential property owner adjacent to Wonderland Estates has expressed willingness to have the City construct a low wall on the property or at the property boundary to contain floodwaters, thereby preventing flooding within Wonderland Estates. This task includes preparation of concept design sketches to enable the City to discuss a preferred design configuration with the property owner, including either cast-in-place concrete with a foundation buried beneath the lawn or made of heavy concrete blocks placed on the ground surface. Once the City and property owner have agreed on a preferred option among those concepts, Herrera will prepare design plans and specifications and a cost estimate for construction of the low wall. Assumptions:  The wall design will be developed for addition to the project’s 75% complete design plans.  The City’s and the property owner’s comments on the 75% design will be addressed in preparing final (100%) stamped design plans and construction specifications and a construction cos t estimate for the wall. If there are any final, minor comments on the 100% design Herrera will address those comments in producing an ad -ready set of design plans and special provisions for construction. Easement Acquisition Support Services Task Lead: Pacific Geomatic Services The work of this is expanded to include expansion of a permanent easement on the east side of the Madsen Creek high flow bypass channel on property owned by New Life Church. The scope of this task in contract amendment No. 1 did not account for this easement. As part of the work to define this easement, Pacifi c Geomatic Services will stake the existing easement boundary on the east side of the bypass channel and include that boundary in an updated site base map for design and permitting.
