HomeMy WebLinkAboutAdden 1AMENDMENT NO. _1_ TO AGREEMENT FOR PHILIP ARNOLD PARK SITE IMPROVEMENTS THIS AMENDMENT, dated _____________, 2021, is by and between the City of Renton (the “City”), a Washington municipal corporation, and HBB Landscape Architecture, Inc. (“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-19-360, dated December 12, 2019, to provide necessary services for the Philip Arnold Site Improvements (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work and change the compensation in order to provide additional professional design services for the Philip Arnold Park site improvements and signage. NOW THEREFORE, It is mutually agreed upon that CAG-19-360 is amended as follows: 1. Scope of Work: Section 1, Scope of Work, is amended to add work and subtract work as specified in Exhibit A-1, which is attached and incorporated herein. 2.Time of Performance:All Work shall be performed no later than December 31, 2022. 3. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $47,795.71 from $392,828.67 to $440,624.38, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-1, which is attached and incorporated herein. 4. All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Per our conversation, I’ve combined several items into this Amendment Proposal. This letter is to inform you that HBB Landscape Architecture has expended our fees for the 30% design phase for the Philip Arnold Park project. I am writing to request compensation for additional level-of effort for the following items: a) 30% Schematic Design Additional Level-of-Effort. b) CED Design at Jones Avenue Additional Level-of-Effort. c) Park Sign Design Additional Level-of-Effort. Also, per follow-up meeting discussions between HBB and the City, we are including the following scope revisions. These bring t he scope of the contract into alignment with the current design and process as noted in City of Renton Phone Call Notes dated 2 November 2020. d) Presentations & Graphics Reduced Level-of-Effort. e) 60% Design Additional Level-of-Effort. f) Future Meeting Clarification. A. 30% Schematic Design Additional Level-of-Effort: HBB has provided several design iterations that went beyond the original scope. In the anticipation that the design and coordination of these could be absorbed into our existing fees, we withheld requesting additional services, but that absorption will no longer be feasible. Additional items to complete 30% have included: 1. Project Management. The original project schedule included a timeline from mid-December 2019 through mid-May 2021. The original contract includes 18 months of Project Management services. The revised schedule has project completion in June of 2022. This adds 12 months to the project for the following 2 items: a. Prepare and provide monthly reports and invoices through June 2022. b. Project contract, schedule, and meeting notes through June 2022. This results in additional 6 hrs for monthly reports and additional 12 hrs for schedule and meeting notes. 2. Per Subtask 2.1, the kick-off and site visit are the same meeting to be efficient. Instead of one (1) meeting, these became 2: one (1) meeting on 1/15/2020 and the site visit on 1/28/2020. Therefore, there was one (1) additional meeting. 3. Per Subtask 2.2, HBB attends up to 3 design reviews/charrettes with City. To Date: HBB has attended 8 design review meetings: 1. Meeting: 2/6/2020 – Concept alternatives and sign concepts 2. Meeting: 3/18/2020 – Review revised preferred concept 3. Meeting: 4/9/2020 – Review final concept 4. Meeting: 5/19/2020 – Budget discussion with Dean only, not a design review 5. Meeting: 6/12/2020 – Sign concepts review, some design comment discussions 6. Meeting: 7/22/2020 – 30% progress review and entry sign updates 7. Meeting (at Site): 9/8/2020 – Site walk review following draft 30% deliverable - tree issues 8. Meeting: 9/30/2020 – Pathway at tennis court options, playground alts, site furnishings, sign updates This results in 5 additional meetings. 4. Per Subtask 2.2, HBB and Consultants attend weekly team meetings. Per the original schedule, these were anticipated to occur through late January and Mid-March or approximately 8 meetings. To date, 11 total team meetings have occurred. And 2 more are anticipated in order to complete 30% by late October 2020. This would be 5 additional meetings beyond those originally scoped. (;+,%,7$ Philip Arnold Park 07 January 2021 Page 2 5. Per Subtask 2.3, HBB prepare 3 conceptual layouts for park improvements. These were presented and reviewed with the City in Meeting on 2/6/2020. Comments were received from the City on 2/12/2020. Per Subtask 2.3, one (1) round of revisions was scoped prior to preparing 30% Schematic Plans. To date, HBB has provided 3 revisions: o REV1: Presented and reviewed site plan in AutoCAD format including revisions from previous review comments with City in Meeting on 4/9/2020. o REV2: Received comments from City on 6/4/2020, revised plan then presented and reviewed with City in Meeting on 7/22/2020. Overall revisions included design refinement at the scramble and planting areas. The plan also included revised path to be 10’ wide, included a pathway through the playground, and CED entry improvements based on City review comments. o REV3: Received comments from City on 9/4/2020, revised plan then presented and reviewed with City in Meeting on 9/30/2020. This included design revisions and refinements based on City review comments and the addition of the Cover Sheet, Preliminary Grading and Drainage Plan, Urban Design Plan and Sections, Planting Plan and Schedule Sheets, and Irrigation Plan and Schedule Sheets. This resulted in 2 additional plan revisions with meetings beyond the original scope. 6. Per Subtask 2.4, the conceptual design families were prepared for Philip Arnold Park, with the understanding that the directional and wayfinding systems may be utilized in other parks. The conceptual families were to be narrowed to one (1) preferred layout to be further developed and integrated into 60%. Additional work in this subtask has included: o REV1: Presented and reviewed on 6/12/2020 and included 3 revised design families at a design development level. ƒAdded monument/park entry sign options to accommodate larger and smaller park signs. ƒAdded monument/park entry sign options to accommodate a 2-sided sign. o REV2: A single, hybrid option of the entry sign, at a design development level, was presented and reviewed on 7/22/2020. This was 2 revisions beyond that originally estimated in the scope. B. CED Design at Jones Avenue Additional Level-of-Effort: 1. Cost estimates were prepared for the CED requested design elements a. Developed cost estimate for CED Design additions per comments received on 6/4/2020. b. Revised cost estimate with CED items sent to the City on 7/8/2020. c. Revised cost estimate with CED items sent to the City on 8/3/2020. 2. Additional scope for the team to develop a memorandum with exhibits outlining design implications of CED request 3. Future design scope for CED Improvements include: a. One (1) additional civil series drawing to include layout and grading of the Jones Avenue curb and gutter. b. coordination with utility companies for relocation or protection of utilities. c. coordination with the US Postal Service for relocation or protection of the existing mailboxes. d. addition and design of ramp across from the Jones Avenue entry. C. Park Sign Design Additional Level-of-Effort: 1. Prior to 30% Design, revise the conceptual entry sign to a lower profile sign with a maximum height of 4-ft and including a single row of park icons. 2. Prepare one (1) sign memorandum for Kiwanis Park. The memorandum provides guidance and templates for the design and fabrication of park sign panels which can be customized in the contract specifications and contract drawings for Kiwanis Park. The memorandum is anticipated to be approximately 4 to 5 pages in 8.5x11 format and will include: a. Section 1: Graphic Standards. This will include font sizes and symbols/graphics. b. Section 2: Materials and Finishes. This will include scaled and dimensioned sign panel design with sign content, standard colors and color variations, and material and finish types for the sign panels. c. Section 3: Sign Types. The following sign types are included: i. Kiwanis Park: 1. One (1) design for a pedestrian-scale park entry sign, double-sided, 4ft-tall maximum height. 2. One (1) design for pedestrian-scale park rules sign. 3. One (1) design for pedestrian-scale wayfinding/direction sign. (;+,%,7$ Philip Arnold Park 07 January 2021 Page 3 Deliverables: a. 60% Design Deliverable: 8.5x11 document in .PDF format with scaled design and layout of each sign type and will include sign graphic standards and materials and finishes in draft format. 60% deliverable may include placeholders for materials, finishes, mounting, lighting, and footings. b. 90% Design Deliverable: 8.5x11 document in .PDF format with detailed information noted above. Includes cover page and table of contents. c. 100% Design Deliverable: Final 8.5x11 document in .PDF format. 3. Prepare for and attend 3 design review meeting/charrettes with the City of Renton to review sign panel design options and progress. D. Presentations & Graphics (revises contract scope item 3.4): 1. The photo boards and preparation and coordination of a PowerPoint presentation will be removed from the deliverables in Task 3.4. The deliverables will include the following color renderings that will be compatible with PowerPoint (.jpg format): a. Rendered plan reflecting the 60% design submittal. b. Up to 2 rendered elevations or vignettes to illustrate design elements. It is anticipated that these 2 will include: i. One (1) rendering of the scramble area. ii. One (1) rendering of the boardwalk area. E. 60% Design Additional Level-of-Effort: 1. Add restoration of the currently non-functional catch basins near the ballfield. Provide recommendations to improve drainage. One (1) option, per Public Work’s recommendation, will evaluate connecting the ballfield catch basins to a new drainage structure in the parking lot. The preferred alternative will be included in the drainage plan by PND. F. Future Meeting Clarification: 1. Meetings below are organized by those listed in the original agreement dated 12 November 2019 in addition to the Sign meetings noted in Task C.3 above. No additional level-of-effort is anticipated for these meetings. The City of Renton and HBB will be in attendance at these meetings. New Total Contract Amount $ 440,624.38 Assumptions: 1. City will provide written approval of design deliverable in each phase prior to beginning the next design phase. 2. HBB will provide all meeting materials (meeting agenda, graphics that will be reviewed, and project schedule) at least 1 day before scheduled city review meetings. 3. Sign options include pedestrian scale sign options. Additional sign types and scales, including vehicular scale, can be included as additional services. 4. All Philip Arnold Park sign elements will be included in the Contract Drawings and Specifications. The Sign Memorandum will only include the design of the sign panels for Kiwanis Park. 5. Sign panel mounting guidelines, posts, footings, and lighting alternatives for Kiwanis Park is by others and is not included in the Sign Memorandum. 6. Structural review of sign footings and pole loads for Kiwanis Park is not included. The above contract amendment request is beyond the existing scope of work tasks as described in our agreement dated 12 December 2019 and would be billed at the rates established in the contract.
