6015CITYOFRENTON,WASHINGTONORDINANCENO.6015ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTION4-2-080.A.6OFTHERENTONMUNICIPALCODE,ADDINGREGULATIONSFORMIXED-INCOMEHOUSINGINTHECENTERVILLAGE(CV)ZONE;LIFTINGTHEMORATORIUMFORLARGERESIDENTIALPROJECTSESTABLISHEDBYORDINANCENO.5967ANDASEXTENDEDBYORDINANCENO.5982;PROVIDINGFORSEVERABILITY;ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,onApril6,2020theCityCounciladoptedOrdinanceNo.5967declaringamoratoriumforaperiodofsixmonthsonlanduseapplications(includingbutnotlimitedtoapplicationsforpreliminaryplats,siteplans,masterplans,conditionalusepermits,majormodifications,andminormodifications)foranyLargeResidentialProjects(150dwellingunitsormore)withintheSunsetArea,inparttoallowCitystaffandthePlanningCommissiontostudyissuesrelatedtomixed-incomehousingwithinLargeResidentialProjectsforsubsequentconsiderationbytheCityCouncil;andWHEREAS,onOctober5,2020,theCityCouncilheldapublichearingtoacceptpublictestimonyregardingasix-monthextensionoftheLargeResidentialProjectsmoratoriumdeclaredbyOrdinanceNo.5967;andWHEREAS,afterthepublichearingonOctober5,2020,theCityCounciladoptedOrdinanceNo.5982whichextendedbysixmonthstheLargeResidentialProjectsmoratoriumoriginallyestablishedinOrdinanceNo.5967;andWHEREAS,atitsSectionIV,OrdinanceNo.5982providesthatthemoratoriumextendedtherein“shallbeineffectuntilApril6,2021,unlessearlierliftedorsubsequentlyextendedbyactionoftheCityCouncil;”and1 ORDINANCENO.6015WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,theSunsetAreaCommunityRevitalizationprogramwascreatedwithanumberofplannedpublicinfrastructureandfacilityimprovementstocatalyzeprivatepropertydevelopmentandcreateopportunitiesfornewmarket-ratehousing,affordablehousing,andretailinvestment;andWHEREAS,thebenefitsofmixed-incomehousingdevelopmentsandneighborhoodsarewelldocumentedbycasestudies,threeofwhichwerecitedduringthepublichearingonthismatter;andWHEREAS,theCityofRentonanditspartnershaveinvestedasubstantialamountoffundstoimprovethearea’slivabilityandenticehigh-qualityprivatedevelopmentbydemonstratingacommitmenttoimprovingorcreatingamenities,services,infrastructure,andamixofaffordableandmarket-ratehousingforexistingandfutureresidents;andWHEREAS,pursuanttoRCW36.70A.106,onMay5,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldpublichearingsonJune3,2020andJuly1,2020,consideredallrelevantmatters,andheardallpattiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.2 ORDINANCENO.6015SECTIONII.Subsection4-2-080.A.6oftheRentonMunicipalCodeisamendedbyaddinganewsubsection4-2-080.A.6.d,toreadasshownbelow.Allotherprovisionsin4-2-080.A.6remainineffectandunchanged.U.Mixed-IncomeHousing:UponanysiteanditsabuttinglotsintheCVzone:i.Thereshallbenomorethan:(a)onehundred(100)dwellingunitsforrent/leasewithincomerestrictions,providedthatanadditionalten(10)suchunitsmaybecreatedforeverytwenty(20)market-ratedwellingunits(e.g.,iftwenty(20)market-rateunitsarecreated,ten(10)moreincome-restrictedunitsmaybecreated);or(b)twohundred(200)dwellingunitsforsalewithincomerestrictions,providedthatanadditionalten(10)suchunitsmaybecreatedforeverytwenty(20)market-ratedwellingunits;ortc)anycombinationofonehundredfifty(150)ormoredwellingunitsforrent/leaseorsalewithincomerestrictions,providedthatanadditionalten(10)suchunitsmaybecreatedforeverytwenty(20)market-ratedwellingunits.ii.Withinasite,market-rateunitsshallnothavesubstantiallylessfloorarea,numberofbedroomsorbathroomsascomparedtothevaryingsizesandnumberofbedroomsandbathroomsforincome-restrictedunits(i.e.,inasmuchasthefloorareaornumberofbedroomsandbathroomsvariesamongincome-restrictedunits,market-rateunitsshallhaveasimilarmixofunitfloor3 ORDINANCENO.6015areaandnumberofbedroomsandbathrooms).ThisprovisioncanonlybealteredifbasedonamarketstudyandinconjunctionwithamodificationgrantedperRMC4-9-250.iii.Forthepurposesofthesestandardstheterms“market-rate”and“incomerestricted”dwellingunitsshallhavethefollowingmeanings:{Market-rateUnits:Dwellingunitsforwhichhomeowners(andrenters,ifrented)donothaveincomeeligibilityrestrictionsandthesaleprice(Orrent,ifapplicable)isnotartificiallyrestrictedinanymanner.fjIncome-restrictedUnits:Dwellingunitsthatareonlyeligibleforhouseholdsorindividualsearningnomorethanacertainincomelevel,orforwhichtherentorsalepriceisrestrictedbyanylegalinstrument.SECTIONIII.ThemoratoriumoriginallyestablishedinOrdinanceNo.5967,whichordinanceisentitled“AnOrdinanceoftheCityofRenton,Washington,DeclaringaMoratoriumonLandUseApplicationsforLargeResidentialProjects(150DwellingUnitsorMoreinaProject)withintheSunsetArea;DeclaringaMoratoriumonApplicationsforWaivedFeesforLargeResidentialProjects;SettingForthFindingsofFactinSupportofSaidMoratoriums;ProvidingforSeverability;DeclaringanEmergency;andEstablishinganEffectiveDate,”andwhichordinancewasextendedassetforthinOrdinanceNo.5982,isliftedonthesamedateastheeffectivedateofthisordinance.SECTIONIV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,4
