6016CITYOFRENTON,WASHINGTONORDINANCENO.6016ANORDINANCEOFTHECITYOFRENTON,WASHINGTON;REORGANIZINGCHAPTER3-1OFTHERENTONMUNICIPALCODEBYMOVINGTHECITYCLERK’SOFFICETOTHEEXECUTIVEDEPARTMENTANDADDINGTHEEMERGENCYSERVICESDIVISIONTOTHEEXECUTIVEDEPARTMENTBYMOVINGSUBSECTION3-4-5.C“CITYCLERKOFFICE”TOSECTION3-1-4OFTHERENTONMUNICIPALCODE,AMENDINGTHELANGUAGE,ANDRENAMINGIT“CITYCLERKDIVISION;”ADDINGANEWSECTION3-1-8“EMERGENCYMANAGEMENTDIVISION”TOCHAPTER3-1OFTHERENTONMUNICIPALCODE;ANDREPEALINGSUBSECTION3-4-5.COFTHERENTONMUNICIPALCODE;PROVIDINGFORSEVERABILITY;ANDESTABLISHINGANEFFECTIVEDATE.THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Section3-1-4oftheRentonMunicipalCodeisamendedasfollows:3-1-4RESERVEDCITYCLERKDIVISION:A.DivisionEstablishedandAppointment:ThereisherebyestablishedthedivisionoftheCityClerk.ThepositionofCityClerkshallbefilledbyappointmentbytheMayor,subecttoconfirmationbyamajorityoftheCityCouncil.B.Duties:TheCityClerkshallhaveallofthepowersgrantedanddutiesimposedbyauthorityofthelawsofthestateofWashingtonandordinancesoftheCitynowexistingorsubsequentlyadopted.TheCityClerkshallbeafull-time,noncivilservicepositionwhoshallbeinchargeoftheCityClerkDivision.TheCityClerk,ordeputyasassignedbytheCityClerk,shallattendallmeetingsoftheCityCouncilandkeepacompleterecordoftheproceedingsthereof;andhavecustodyoftheCity’sseal,theoriginalrollofordinances,theoriginalcontracts,deedsand1 ORDINANCENO.6016certificatesrelativetothetitleofanypropertyoftheCityandsuchotherdocumentsasarerequiredtobedepositedwiththeCity.TheCityClerk,ordeputyasassignedbytheCityClerk,shallattestallpublicinstrumentsandofficialactsoftheMayorandshallprovidecertifiedcopiesoforiginalrecordsasmayberequiredandmakesuchchargethereforasprovidedbytheCityofRentonFeeSchedule.TheCityClerk,ordeputyasassignedbytheCityClerk,shallacceptservicefortheCityduringnormalofficehourspursuanttoRCW4.28.080(2).C.Qualifications:TheCityClerkmusthavethosequalificationsdeemednecessaryforthisjobbytheMayor,indicatedontheCity’sCityClerkjobclassification.D.DesignationofPublicRecordsOfficer:1.ThePublicRecordsAct,Chapter42.56RCW,requiresthatallstateandlocalgovernmentagencies“appointandpubliclyidentifyapublicrecordsofficerwhoseresponsibilityistoserveasapointofcontactformembersofthepublicinrequestingdisclosureofpublicrecordsandtooverseetheagency’scompliancewiththepublicrecordsdisclosurerequirements”underWashingtonlaw.2.TheCityClerkordesigneeisherebydesignatedasthepublicrecordsofficerfortheCityofRenton.MembersofthepublicmaydirectrequestsfordisclosureofpublicrecordsoftheCityofRentonto:CityClerkCityClerk’sOffice7thFloor,RentonCityHall10555.GradyWay,Renton,WA980572 ORDINANCENO.60163.NoticeofthedesignationoftheCityofRenton’spublicrecordsofficershallbemadeinamannerreasonablycalculatedtoprovidenoticetothepublicofsuchdesignation,saidnoticetoinclude,butnotbelimitedto,thefollowing:postingatCityHallandotherCityofRentonbuildings,postingontheCity’sInternetwebsite,regularbroadcastingontheCity’sgovernmentcabletelevisionchannel,andinclusioninappropriateCitypublications.SECTIONIII.Chapter3-1oftheRentonMunicipalCodeisamendedtoaddanewsection3-1-8toreadasfollows:3-1-8EMERGENCYMANAGEMENTDIVISION:TheEmergencyManagementDivisionshallberesponsibleforCity-wideemergencymigration,preparedness,response,andrecoveryprogramming.SECTIONIV.Subsection3-4-5.CoftheRentonMunicipalCodeisrepealedinitsentirelyandmarked“Reserved.”C.Reserved.CityClerkOffice:1.OfficeEstablishedAndAppointment:ThereisherebyestablishedtheofficeoftheCityClerk.ThepositionofCityClerkshallbefilledbyappointmentbytheMayorandconfirmationbyamajorityoftheCityCouncil.2.Duties:TheCityClerkshallhaveallofthepowersgrantedanddutiesimposedbyauthorityofthelawsofthestateandordinancesoftheCitynowexistingorsubsequentlyadopted.TheCityClerkshallbeafulltime,noncivilservicepositionwhoshallbeinchargeoftheCityClerk’sOffice.TheCityClerk,ordeputyasassignedbytheCityClerk,shallattendallmeetingsoftheCityCouncil3 ORDINANCENO.6016andkeepacompleterecordoftheproceedingsthereof;andhavecustodyoftheCity’sseal,theoriginalrollofordinances,theoriginalcontracts,deedsandcertificatesrelativetothetitleofanypropertyoftheCityandsuchotherrecordsordocuments35arerequiredtobedepositedwiththeCity.TheCityClerkshallattestallpublicinstrumentsandofficialactsoftheMayorandshallprovidecertifiedcopiesoforiginalrecordsasmayberequiredandmakesuchchargethereforasprovidedbyordinance.3.Qualifications:TheCityClerkmusthavethosequalificationsdeemednecessaryforthisjobbytheMayor,indicatedontheCity’sCityClerkjobclassification.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVI.Thisordinanceshallbeinfullforceandeffectthirty(30)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis12thdayofApril,2021.i7nA.Set,ityClerk4
