The proposal under review by the City of Renton would be part of a 70-mile communication system corridor proposed along existing roads throughout the Seattle Metro area. The Washington State Department of Ecology served as the lead agency for environmental review and issued a Determination of Non-Significance January 22, 1999. The conduit would cross the Cedar River via the Wells Street bridge. Outside of the bridge, but within the shoreline management area, conventional trenching would be used to place the conduit under the existing sidewalk on the west side of the Wells Street right-of- way. At the Springbrook Creek crossing, conventional trenching would also be used for placing the conduit under the existing sidewalk on the northwest side of the Grady Way right-of-way. Boring will be used for placing the conduit across Oakesdale Avenue at the Oakesdale/Grady intersection. Springbrook Creek is culverted under Grady Way via a concrete drainage way. No vegetation would be disturbed, as all work would be conducted in existing roadways. Proposed trenching (1/2 mile per day) would require the use of one backhoe and one compactor. The conduit bundle would be buried 48" deep with 42" of cover. The trench would be backfilled immediately after the conduit is placed. As part of a pollution prevention plan, erosion control would be employed; and where appropriate, silt fencing, hay bales, and other systems would be used to control stormwater drainage. The regional office of the Department of Ecology is to be notified of construction progress on a weekly basis. Construction is proposed to begin upon the issuance of all required permits. PACIFIC FIBER LINK SECTION 1 Grant ofLicense: There is hereby given and granted unto Pacific Fiber Link, L.L.C., "PLL"a Washington State Limited Liability Company, its successors and assigns for a period of 10-years from the taking effect of this license, the rights, privileges, and authority to lay down, construct, operate, maintain, replace, alter, remove and repair one or more communication lines, together with all equipment support structures and appurtenances there to (system), for the telecommunications under, along, over, below and through certain public right-of-way and other public lands within the City of Renton. The following City codes shall apply to this agreement in their entirety: City Code 5-19-04 5-19-09 5-19-10 5-19-11 5-19-12 SECTION 2 Non-Exclusive License (5-19-4)(E): This License is granted upon the express condition that it shall not be deemed or held to be an exclusive License in, along, over, through, under, below or across any of said public rights-of-ways, public thoroughfares, sidewalks, and utility easements within the City of Renton, and such License shall in no way prevent or prohibit the City of Renton or its tenants from using any of said roads, streets or other public or tenant properties or affect its jurisdiction over them or any part of them, with full power to make all necessary changes, relocation's, repairs, maintenance, establishment, improvement, dedication of same as they may deem fit including the dedication, establishment, maintenance and improvement of all new rights-of-ways and thoroughfares and other public properties of every type and description. Pacific Fiber Link, as licensed herein, agrees and covenants at its sole cost and expense to protect, support, temporarily disconnect, relocate or remove from any street any of its installations when so required by the City of Renton by reason of traffic conditions, public safety, street vacations, dedications of new rights-of-ways and the establishment and improvement thereof, freeway construction, change of establishment of street grade or the construction of any public improvement or structure by Government agency acting in a Government capacity, provided that License shall in all such cases have the privilege to temporarily by-pass, in the authorized portion of the same street, upon approval by the City of Renton, any section of the System required to be temporarily disconnected or removed. SECTION 3 Location of Facilities: The location of facilities shall be underground or in accordance with City code 5-19-4(1)1 through 5 as conditions warrant. 99CMOIOLDOC\ • SECTION 4 Construction Permit(code 5-19-10)(C): A Construction permit application is required for each proposed project. All construction, and installation of work wherever same crosses any of the public properties shall be done under the supervision of the duly authorized representative of the Planning/Building/Public Works Administrator, and Grantee shall timely submit onto the Public Works Administrator, prior to any such work, detailed plans and specifications of any proposed work. The location of any Permit on public property in a street, Municipal Airport, or other public area shall be subject to approval of the Public Works Administrator or his authorized representative and such approval shall be provided in writing. The Licensee shall further inform the City of any time or date that the Licensee is performing work within the Licensed area to allow the City to inspect such work. Work within City Streets shall be accomplished through boring rather than open trenching whenever reasonably feasible. SECTION 5 System Components: All components of the System and other components of any communication line,to be placed within any street right-of-way, Municipal Airport, or other public property shall be designated, manufactured and installed in accordance and in full compliance with industry standards and applicable ordinances. Placement of conduit in street.crossings shall be PVC schedule 80 or steel conduit. Schedule 40 PVC is acceptable in areas outside the roadway. SECTION 6 Permanent Records (code 5-19-10)(M): The Licensee shall at all times keep full and complete plans, profiles and records showing the location, installed depth and size of all its installations and systems wherefore laid in the City and hereafter installed. Such plans and records shall be kept current by the licensee. As-built plans and records shall be available to the City at all times upon request. A telephone contact number for requested plans shall be supplied to the city and kept current. SECTION 7 Planning for Construction: During any period of construction, all surface structures, if any, shall be erected and used in such places and positions within said public right-of-way, and other public properties so as to interfere as little as possible with the free passage of traffic and the free use of adjoining property and tenants and licensee shall at all times post and maintain proper barricades during such period of construction as required by the laws and statutes of the State of Washington. The Licensee shall avoid the use of major Arterials and recently constructed or paved overlaid streets as much as possible. Specific route alignments are subject to approval by the City via the construction permitting process. Where commercially practical and when not in conflict with the City Code, the licensee may attach its cable to existing utility poles subject to agreement with pole owners and the City's variance procedure from undergrounding electrical and communication systems. All components of the System constructed and installed by the licensee underground within the City of Renton shall be located in approved locations, buried and installed to a depth of not less than three feet and as otherwise provided for in the aforesaid Code, the laws of the State of Washington, and the ordinances of the City of Renton, now or hereafter in force, regulating such installations. Licensee shall establish and maintain at all times adequate facilities on the portion of each of the systems installed under the authority of this License, and elsewhere on the system, to promptly localize 99CM010L.DOC\ operating troubles and to minimize the effects thereof, whether on City streets or on their use by the public. Approved traffic control plans shall be utilized for each installation when working in the public right-of- way(code 5-19-11)(F). The Licensee shall subscribe to and maintain membership in the regional "One-Call" utility location service and shall promptly locate all of its lines upon request. SECTION 8 Restoration And Repair of Facilities (Code 5-19-10)(H): Licensee, its successors and assignees, hereby agrees and covenants to promptly repair any damage to City or tenant property of every type and nature and all other City or tenant improvements caused by failure of Licensee's work during the life of this License should it be necessary to make any excavation within any public right-of-way, in the laying, constructing, maintenance, removing, replacing, altering or repairing of all or any portion of the system, Licensee shall without delay and at Licensee's sole cost and expense, restore the surface of said right-of-way or other public or tenant property to at least the same condition immediately prior to any such installation and construction. In case of damage by the Licensee to said streets, avenues, roads, alleys, lanes, public places and ways, to the pavement, turnouts, gutters, ditches, walks, poles, pipes, plantings, rail, bridges, trestles, wharves or landings, and/or other appurtenances and improvements, the Licensee shall immediately repair all damage at its sole cost and expense. Licensee shall comply with all ordinances and regulations of the City of Renton, Washington, regarding such excavation and whenever deemed necessary by the Public Works Administrator shall be required to post a performance bond in favor of the City warranting, among other things, that such restoration work will be done promptly to a condition equal or better than the original condition and in a proper, workman like manner. Where concrete encased recorded monuments have been disturbed or displaced Pacific Fiber Link shall restore the monument to federal. state and local standards and specifications. All restoration of public streets, sidewalks and other amenities shall conform to current City of Renton Standard Specifications for Road, Bridge and Municipal Construction and the City of Renton's Trench Restoration Standards. As a condition of receiving the right to work within the public right-of-way, Pacific Fiber Link shall assume full responsibility for using materials and installation methods that are in full compliance with City standards and shall verify this submittal of documentation of materials and testing reports when requested by the City. All costs for performing on-site testing, such as Compaction tests, shall be borne by Pacific Fiber Link. SECTION 9 Hold harmless agreement: Licensee, its successors and assignees, agrees and covenants to indemnify and hold harmless the City of Renton from and against any and all liability, loss cost, damage, whether to persons or property, or expense of any type or nature to the extent it arises from any negligent act or omission or willful misconduct of Licensee, its successors and assigns arising from or connected to the Licensee work under this License, provided, however, that in case any suit or action is instituted against the City by reasons of any such damage or injury, City shall (i) cause written notice thereof to be given unto Licensee and (ii) give all reasonably requested assistance in defense or settlement of such claim at Licensee expense, and (iii)grant the right to control the defense or settlement of such claims. SECTION 10 Liability Insurance (code 5-19-10): 99CM010L.DOC\ Comprehensive general liability insurance shall be provided as stated in City code 5-19-10 (O,P,Q &R) in its entirety. The Licensee shall submit to the City Clerk evidence that it has in full force and effect and shall keep in full force and effect during the life of the License, public liability insurance naming City of Renton as • additional insured with coverage as stated in the referenced City code. SECTION 11 Revocation or Termination of Grant(code 5-19-10)(U&TO: For the purpose of compelling compliance by the Licensee with all the terms and conditions of this License and the maintenance of said System and facilities in good condition, City retains the right to end and terminate and fully forfeit the License herein granted, within (30) thirty days after written notice unto the Licensee, whenever the Licensee fails to comply with any of the material terms and conditions hereof. Upon forfeiture the City shall have the right to require the Licensee to remove any and all of its systems within the City of Renton, all at the Licensee cost and expense, and to promptly and timely restore all roads and other public properties to the condition immediately prior to any such forfeiture and termination. SECTION 12 Reservation of Rights (code 5-19-12)(D): The City of Renton reserves unto itself the right and power at all times to reasonably regulate in the public interest and for the public welfare the exercise of all License rights granted herein. The laying, construction, installation, maintenance and operation of the System and facilities in connection therewith shall not preclude the City of Renton, its authorized agents, contractors and representatives from blasting, grading, excavating or doing other necessary or public works over, unto, abutting, or contiguous to Licensee's System provided, however, that Licensee shall be given two working days written notice of any such blasting, grading, or excavating so that the licensee may take proper steps to protect its communication line and facilities. SECTION 13 Damage, Injury or Loss: (Code 5-19-10)(K)) Except for damage, injury or loss caused by the City of Renton under this paragraph, the Licensee shall have no recourse whatsoever against the City of Renton for any loss cost, expense, or damage arising out of any provision or requirement of this License or the enforcement thereof. This License does not relieve the Licensee of any requirement of any City Ordinance, rule or regulation, or specification of the City,including but not limited to any requirement relating to street work, street excavation permits and fees therefore, or the use, removal or relocation of property and streets. No privilege nor exemption is granted or conferred unto the Licensee by this license except those specifically prescribed herein, and any such privilege claimed under this License by the Licensee in any street shall be subordinate to any prior lawful occupancy of the street or any subsequent improvement or installation therein. SECTION 14 Discontinued License: (Code 5-19-10(1)1-5) In the event the use of any permitted property is permanently discontinued, or no Permit has been obtained therefore upon expiration of this License, or within thirty days after any termination of this 99CM010L.D0C\ License, then the Licensee shall promptly remove from the streets and other properties all its facilities, other than any the City may permit to be temporarily or permanently abandoned. SECTION 15: Ownership Transfer(code 5-19-10(7)1-6):This License may not be assigned to a successor or assigns without the prior written consent of the City Council of the City of Renton. However, an Indefeasible Right of Use ("IRU") may be approved by written notice to the City's Public Works Director. A IRU shall not include the right to physically access the Facilities in the right of way , or to enter or disturb the right of way, unless otherwise authorized by the City. SECTION 16 Security Device (code 5-19-10(Q).: The Licensee shall, within (10) ten days after the award of this License, file with the City of Renton Public Works Department at all times thereafter maintain in full force and effect an acceptable security device or escrow account in duplicate effective for the entire term of this permit, and conditions that in the event its Licensee shall fail to comply with any one or more of the provisions of this License then there shall be recovered jointly and severally from the principal and surety of such security device or escrow account any damage suffered by the City as a result thereof, including the full amount of any compensation, indemnification or cost of removal or abandonment of properties herein above described, up to the full amount of the said bond, said condition to be a continuing obligations within the City of Renton or may have arisen from the acceptance of such License by the Licensee or from its exercise of any such privilege herein granted. The security device or escrow account initially filed in accordance with the requirement of this Section shall be in the amount of Twenty Five Thousand Dollars ($25,000). In the event of substantial change in volume of street space occupied by permitted properties, the City may permit or may require a corresponding change in the amount of such security device or escrow account. SECTION 17 System Expansion: Upon application to the City of Renton Department of Building/Planning/Public works by the Licensee, the Department of Public Works may authorize Licensee to install, construct and/or retain in City streets additional System expansions, as contemplated in Section 1 hereof, in manner satisfactory to the Department of Public Works; such additional installations shall be subject to all of the terms and conditions of this License and to any such additional conditions as may be prescribed by the Department of Public Works as to any such additions. SECTION 18 Telecommunications Fees: • a. Registration Fee: $25.00 b. Annual Administrative Fee: $3,000.00 c. Lease Holders Tax: 12.84%annually d. Construction Permit Fee $50.00 Plus time &materials Cost. PACIFIC FIBER LINK PROJECT - NARRATIVE SUMMARY SITE DESCRIPTION Project Overview The Pacific fiber Link Company is in the process of constructing a multi-conduit, fiber optic communication system corridor around the Seattle Metropolitan area. The project will span approximately two counties and eleven municipalities. The conduit will be installed using conventional trenching, horizontal boring and directional drilling methods. A multiple conduit bundle will be buried 48 inches deep with 42 inches of cover. Environmentally sensitive areas will be avoided as much as possible, but where unavoidable special techniques will be employed to maintain integrity. Streams, rivers and wetlands will be directional drilled or the conduit will be attached to existing structures, e.g., bridges to avoid adverse impact. Project Route This segment of the Pacific Fiber Link conduit route is entirely within the rights-of-way of the City of Renton. It enters the eastern city limits of Renton on NE 4th Street and exists the western city limits in the vicinity of 72nd Avenue South and Southwest Grady Way. The watercourses, i.e., Cedar River and Black Creek will be crossed by utilizing an existing utility corridor within the Cedar River Bridge on Wells Street and by conventional trenching in the right-of-way of Southwest Grady Way to cross the Black River. CITY OF RENTON FEB 09 1999 DESCRIPTION OF CONSTRUCTION ACTIVITY RECEIVED Progress Of Construction Construction is anticipated to begin in June 1999 and to be completed by October 1999. Several contractors, with one or more construction crews, may be used simultaneously on the project. These special crews average 5 to 7 workers. Table 2 shows typical construction progress for each type of construction technique employed. Table 3. The trench will be excavated directly in advance of laying the conduit. Where trenching is used, the trench is backfilled immediately after the conduit is placed, except at manholes or splice box locations. In urban areas, or where there is existing pavement or sidewalks, it may be necessary to open the trench area with an asphalt or cement saw. A trencher or backhoe will then be used to cut the trench for conduit placement. In locations where utilities are present, digging will be done manually. There are areas along the route that will require special construction techniques. Wherever wetlands or flowing watercourses are encountered, directional boring will be utilized. (See Figure 1) Directional boring is conducted with either a trailer-mounted horizontal drilling rig or a larger self-contained horizontal drilling rig. These rigs are capable of directing the boring tip of the drill and controlling it in both horizontal and vertical planes. A sensor placed behind the drill bit controls the direction of the drill. The sensor allows manual tracking of the depth and position of the drill head. Typical Waterbody Crossing Diagram - reach up to 2500 feet. The area to be avoided is delineated, then the rig placed a standard setback distance from the edge of the sensitive area. Setback may vary from a few feet, as for a roadway to several hundred feet, depending upon site construction constraints or sensitive resource buffer specifications identified in permits approved by resource management agencies (i.e. Corps of Engineers, Section 404 and 401 of the Clean Water Act or county and city agencies within the project area). At the entrance and exit sites for directional drilling, sump pits are excavated for the containment and processing of drilling mud returns. At the conclusion of the drilling these sump pits are drained and restored to their pre-drilling condition. The drained material is hauled by water-tight trucks and disposed of at an approved location away from watercourses or wetlands. Environmental inspectors will track the recovery and disposal locations. Soil Disturbance Sequence The installation of this conduit system is typical of industry standards for the application of communi-cations systems. Construction consists of limited trenching, back filling, compaction followed by complete restoration. Several crews working simultaneously will carry out the construction and placement of the of conduit. Estimated Site Area—Total Disturbed Area The length of the conduit corridor within the City of Renton is approximately 5.7miles. It is estimated that a two foot wide area along the right of way will be disturbed or an estimated total of 1.4 acres. Estimated Storm Water Runoff The disturbed area along the corridor will be restored to the preconstruction contours with instant restoration. Name of Watercourses Identified Along the Corridor The Cedar and Black Rivers have been identified as watercourses that cross the proposed Pacific Fiber Link conduit corridor, see the attached vicinity and Flood Insurance Rate Maps for further information on the location and extent of activities within critical areas. These watercourses were submitted to the Washington State Department of Ecology, along with other watercourses with the State Environmental Protection Act(SEPA) Checklist. Wetlands and streams along the route will be directionally bored or avoided by detouring around the sensitive areas. Erosion and Sediment Controls Following construction, sites will be restored based on the type of surface existing prior to construction. Disturbed areas will be regraded and planted with a seed mix recommended by the local Natural Resource Conservation Service (NRCS). This annual mix will stabilize the area until native species can repopulate the site. Additional erosion control methods will be applied such as hydroseeding, mulching and matting, as deemed necessary. On severe slopes and steep terrain, erosion control structures such as water bars, diversion channels, piping and terraces will be employed, as required. Water will be directed away from the construction and right of way zone along with other disturbed areas to reduce the potential of soil erosion. Temporary work areas used at stream and highway crossings and other special sites will be restored to approximate pre-construction conditions. Drilling mud and other spoils shall be disposed of in such as manner that they will not enter state waters. Best management practices and industry standards shall prevail at all of these sites. Suitable mulches and other soil stabilizing practices will be used on all regraded and topsoil enhanced areas to protect soil without vegetation from wind and water erosion. These practices will improve water absorption and prevent degradation of water quality in adjacent fish habitat streams. Best management practices and industry standards will be installed according to directions contained in either the Washington State Department of Transportation Highway Runoff Manual or the Department of Ecology Stormwater Management Manual for the Puget Sound. Stormwater Management Stormwater management will take advantage of the previously designed grading, drainage and infrastructure which is already part of the existing rights-of-way through which the conduit is passing. Where appropriate, silt fence, hay bales or other temporary restraining systems will be employed to protect the right of way and the disturbed area being revegetated. Since no changes to the existing grades are part of the installation, no new control structures such as sedimentation ponds or special features should be required. We are aware of the fact that in any construction job situations will change as the project progresses these might be human generated, geological features as weather related. The individual superintendent and the associated crews have ultimate responsibility for what occurs at the drill site. When drilling under critical waterways such as creeks, streams, wetlands and major rivers, special care must be taken to preserve water quality and prevent any chance of a violation of state water quality or health and safety standards. Materials Materials Safety Data Sheets (MSDS) must be available at each drilling site to describe worker safety and environmental protection from products utilized. Spill Prevention and Containment Best management practices are utilized for spill prevention, containment and control. Containment of drilling fluids can be attained through various precautions implemented upon mobilization to the entrance and exit sites. Certain phases of the containment plan can be implored before the major pieces of equipment are positioned on the proposed sites. At the entrance site, a pit is excavated to the appropriate dimension containment and processing of drilling mud returns. The exit sump pit will also be excavated to the appropriate dimensions to contain drilling fluids for re-cycle and re-circulation into the mud system. In the event inadvertent returns are detected above ground, the affected area will first be contained with straw bails, then, sump pumps are utilized for proper displacement of the fluids back into the drilling fluid maintenance system for reprocessing. If the amount of inadvertent returns is not great enough to allow practical collection, the effected area is diluted with fresh water and allowed to dry and dissipate naturally back into the earth. If the amount of returns exceeds that which can be suitably contained with hand placed containment barriers, small collection sumps (less than 3.8) cubic meters could be used. All spilled materials will be dealt with in a manner that is acceptable to local, state and federal regulatory agencies. A vacuum truck will be on site to contain and remove all drilling mud. Drilling Mud displaced by the pipe after pullback can be contained, collected and disposed of at an approved location away from any watercourse, surface or groundwater. At all watercourse crossings a vacuum truck will be on site to contain and remove all drilling mud. A Pacific Fiber Link Environmental Inspector will approve all disposal sites prior to disposition. Notification of Critical Issues The regional offices of the Department of Ecology will be notified of construction progress along the route on a weekly basis. Unusual events involving environmental issues will be reported to the appropriate regional office of the Department of Ecology and/or other potentially involved agencies. *NOTE: This is a working document and subject to change as comment and suggestions are received. Potential Impacts to Existing Land Use and Vegetation Property Owner/Address Existing Land Use and Vegetation Impacts & Parcel No. City of Renton Existing Land Use Impacts- The Cedar River Crossing is within the Residential "R" land use zone. The conduit route will traverse a existing utility passageway in the Wells Street Bridge so there will be no land use or environmental impacts associated with this crossing. The Black River Crossing is within a Commercial Arterial 'CA" land use zone. The conduit route will be installed by convention- al trenching across the Black River within the confines of the right-of-way of Southwest Grady Way. The Black River channel is an artificial concrete drainage way in this vicinity, no impacts to existing land use or the environment are anticipated. Existing Vegetation Impacts -At the Cedar River Crossing existing vegetation along the river banks is composted of narrow E:UCCHANGE\PRONACFLINK\ESIDECON\PERMITS\RENTON\RENTNS.DOC•2/8/99 riparian strips, mostly native grasses and shrub/trees. The conduit will be installed by conventional trenching within the 200 foot Shoreline Management Zone to the vicinity of the Wells Street Bridge. Since all construction activities will take place on existing road rights-of-way, no vegetative impacts are anticipated. At the Black River Crossing, riparian vegetation exists beyond the artificial channel, i.e., concrete culvert, under the Southwest Grady Way right-of-way and the proposed conduit route. The riparian vegetation is approximately 150 feet north and 125 feet south of the conduit installation. All construction activities are planned within the road right-of-way, so no impacts to vegetation are anticipated. Erosion control measures as part of a comprehensive pollution prevention plan will be strictly enforced. A vacuum truck will be on site in case of spills for immediate containment of drilling fluids. See attached route maps for specific locations of the project. B. ENVIRONMENTAL ELEMENTS 1. Earth a. General description of the site (circle one): Flat, rolling, hilly, steep slopes, mountainous, other_various terrain conditions. The route is approximately 70 miles in length, circling the Seattle Metro- politan area from Renton on the south, Seattle on the west, Mount Lake Terrace to Woodenville on the north, and Redmond to Issaquah on the east. b. What is the steepest slope on the site (approximate percent slope)? The steepest slope varies with the topography of the route, on most sites it follows existing road right-of-ways which are generally less than 6 percent. The relief of the entire site is generally 0-5 percent. c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. There are various soil types found along the route that vary by topography and elevation. d. Are there surface indications or history of unstable soils in the • immediate vicinity? NA, all construction is proposed on existing right's-of-way. e. Describe the purpose, type, and approximate quantities of any filling or grading proposed. Indicate sources of fill. None Anticipated f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe. Yes. Minor soil erosion and compaction could occur as the result of construction-related activities of the proposed project. Erosion by flowing •water would be the principal impact during a storm water generation event. g. About what percent of the site will be covered with impervious surfaces after project construction (for example, asphalt or buildings)? The proposed project will rehabilitate existing cover to the same condition as prior to construction, this may require replacing areas with impervious surfaces. Proposed measures to reduce or control erosion, or other impacts to the earth, if any: I:\xchange\pflsepa.doc ♦ 10-21-98 To Be Completed by Applicant Evaluation for Agency Use Only • As part of Pacific Firm Link's revegetation plans, Pacific Fiber Link is proposing to reseed disturbed areas after construction with seed mixtures developed in consultation with the NRCS. Seed mixtures will be developed for both wetland and upland areas, will maintain the native species diversity in the Project Area, and will establish erosion-controlling vegetation quickly. Procedures include placing silt fences and/or straw bales between construction areas and wetlands and waterbodies to prevent sediment from entering waterbodies. Sediment control structures will remain in place until vegetation is sufficiently reestablished to control erosion. • 2. Air a. What types of emissions to the air would result from the proposal (i.e. dust, automobile, odors, industrial wood smoke) during construction and when the project is completed? If any, generally describe and give approximate quantities if known. A temporary reduction in local ambient air quality could be caused by fugitive dust and emissions generated by construction equipment. This short-term impact would occur only in the immediate vicinity of the project. Once construction and testing is completed, the fugitive dust emissions would subside. b. Are there any off-site sources of emissions or odor that may affect your proposal? If so, generally describe. None c. Proposed measures to reduce or control emissions or other impacts to air, if any. Excessive dust generated during construction will be controlled with water spray as necessary. Proper equipment maintenance practices will be utilized to reduce smoke and related emissions. 3. Water a. Surface ,- 1) Is there any surface water body on or in the immediate vicinity of the site (including year-round and seasonal streams, saltwater, lakes, ponds, wetlands)? If yes, describe type and provide names. If appropriate, state what stream or river it flows in to. Yes. Numerous water bodies, e.g., rivers, lakes, wetlands, streams, and intermittent streams are in the immediate vicinity of the project route. Route and watercourse identification maps are attached. The intermittent streams on the project site are channelized drainage ditches. The water types of the streams are not classified in the DNR database. Wetlands found along the route of the project are primarily palustrine scrub-shrub, palustrine emergent, and palustrine forested, according to the National Wetlands Inventory and field research. Construction activities associated with the proposed conduit installation will require work over, in, and adjacent to the described surface waters along the project route. Some of these waters are part of the King and Snohomish Counties' Shorelines Master Program. 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected. Indicate the source of fill material. There is no filling or grading on this project. 4) Will the proposal require surface water withdrawals or diversions? Give general description, purpose, and approximate quantities if known. No. 5) Does the proposal lie within a 100-year floodplain? If so, note location on the site plan. List threatened or endangered species known to be on or near the site. The Fish and Wildlife Service (FWS) and Washington Department of Natural Resources (WDNR) indicated that there is no record of any federally listed plant species occurring in the project area. Proposed landscaping, use of native plants, or other measures to preserve or enhance vegetation on the site, if any: Where necessary, the 18-24 inch wide conduit right-of--way will be revegetated following construction. Pacific Fiber Link will consult with the Natural Resources Conservation Service (NRCS) to develop seed mixtures for the restoration effort. 5. Animals a. Circle any birds and animals which have been observed on or near the site or are known to be on or near the site: Birds: Redtail hawk, heron, eagle, songbirds, other: Northern flicker, song sparrow, winter wren, robin, crow. Mammals: Deer, bear, elk, beaver, other: deer mouse, house mouse, pocket gopher, coast mole, long-tailed weasel, vole. Fish: Bass, salmon, trout, herring, shellfish, Other: Common raven, pine sisken, Swainson's thrush, American goldfinch, black-capped chickadee, common flicker, douglas squirrel, opossum, ring-necked pheasant b. List any threatened or endangered species known to be on or near the site. The only federally listed species of wildlife identified by the FWS as occurring in portions of the project vicinity is the federally threatened bald eagle. However, the WDNR database indicated that no bald eagle nests or wintering areas are located within one mile of the Project route. No threatened or endangered species will be expected to be affected by the project because none are known or expected to breed or winter there as described previously. c. Is the site part of a migration route? If so, explain. Anadromous fish species do occur in most of the major rivers and streams along the route. d. Proposed measures to preserve or enhance wildlife, if any: To minimize habitat loss, project features have been located in previously disturbed areas (e.g., existing utility right-of-ways, roads, industrial areas, agricultural areas) and outside wetland areas as practicable. Additional mitigation measures for wildlife and habitat impacts include: • Retaining native vegetation as much as possible in the affected areas to preserve wildlife habitat and providing a buffer of vegetation for surrounding areas. • Revegetate disturbed habitats with native vegetation to reduce the duration of habitat disturbance. In areas requiring maintenance, planting native grassland species, which need less frequent maintenance than native pioneer shrubs to reduce the frequency of human activity in the area. • Scheduling construction and ground-disturbing activities to avoid wildlife breeding periods. The construction season will be limited to I:\xchange\pflsepa.doc ♦ 10-21-98 To Be Completed by Applicant Evaluation for Agency Use Only summer and fall, which will avoid much of the breeding and rearing season of most wildlife species that could potentially be affected. 6. Energy and Natural Resources a. What kinds of energy (electric, natural gas, oil, wood stove, solar) will be used to meet the completed project's energy needs? Describe whether it will be used for heating, manufacturing, etc. Construction activities will use electric power, and gasoline and diesel internal combustion engines. b. Would your project affect the potential use of solar energy by adjacent properties? If so, generally describe. No. c. What kinds of energy conservation features are included in the plans of this proposal? List other proposed measures to reduce or control energy impacts, if any: No special measures. 7. Environmental Health a. Are there any environmental health hazards, including exposure to toxic chemicals, risk of fire and explosion, spill, or ha?ardous waste, that could occur as a result of this proposal? If so, describe. The risk of fire is slight in the fall and winter months in that dry vegetation is lacking. During high fire precaution periods the construction companies associated with the project will be required to provide fire suppression equipment during periods of high fire precautions. There will be no debris burn along the route. A contingency plan for oil and hazardous substance spills will be developed along with notification procedures to the appropriate agencies, federal, state, and local governments. Designated area will be established along the construction route to maintain heavy equipment. These sites will be selected away from watercourses and sensitive areas. Special care will be given to avoid the accidental spills of lubricants and fuel oils. Trash will be dealt with immediately, cleaned up and disposed of in an appropriate manner. 1) Describe special emergency services that might be required. Emergency medical services and the local fire department would be utilized in the event of a construction accident that results in injury requiring first-aid and evacuation. 2) Proposed measures to reduce or control environmental health hazards, if any: Pacific Fiber Link's engineering standards prescribe material specifications, conduit and component design, and proper procedure for construction and testing. The plan provides for the safety of the general public and of individuals at the site. It includes notifying the appropriate public officials when an emergency has occurred and coordinating with these officials regarding planned responses and actual responses during an emergency. Weekly safety meetings, for construction crews are a requirement. b. Noise 1) What types of noise exist in the area which may affect your project (for example: traffic, equipment, operation, other)? Existing noise sources include passing vehicles and air craft. • 2) What types and levels of noise would be created by or associated with the project on a short-term or long-term basis (for example: traffic, construction, operation, other)? Indicate what hours noise • would come from the site. Short-term noise will be generated by construction equipment used for trench construction and minor access road construction. Noise associated with these activities will occur during daylight hours. 3) Proposed measures to reduce or control noise impacts, if any: Proposed noise abatement measures include proper maintenance of heavy equipment. This will reduce noise levels. It is not anticipated that there shall be any long-term impacts due to noise levels. 8. Land and Shoreline Use a. What is the current use of the site and adjacent properties? The approximately 70 mile long conduit right-of-way will be contained within existing road and utility right-of-ways. The route is mostly on road right-of-way owned by local municipalities, counties, and the State of Washington Department of Transportation, adjacent to public and private business sites and lands. b. Has the site been used for agriculture? If so, describe. There could be a minor amount of the right-of-way utilized for small farms and for pasture. c. Describe any structures on the site. There maybe existing structures adjacent to the conduit right-of-way and only regeneration sites will require small equipment storage buildings. d. Will any structures be demolished? If so, what. None. e. What is the current zoning classification of the site?
