ORDINANCENO.6018helpkeeptheemployeeswhodependonthejobsthathavebeenimpactedandjeopardizedbythecoronavirusshut-downsemployed;andWHEREAS,parkletsandprefabricatedoutdoorspacesmeettheintendedpurposeof“expandingtheareawithinwhichabusinessmayprovidegoodsorservicestocustomerswhilekeepingwithpublichealthguidelines”thatservedasthebasisforestablishingEconomicRecoveryRevocableRight-of-WayPermits,and,thus,theCityCouncilwishestoallowforthemasanelementofencouragingeconomicrecoveryintheCity;andWHEREAS,OrdinanceNo.5974alsoestablishedandtemporarilyallowedbusinessestoplacesignsknownas“EconomicRecoverySigns”intheformofA-FrameSignsandEventSigns,throughDecember31,2020;andWHEREAS,onDecember7,2020,theCityCouncilextendedandamendedOrdinanceNo.5974,viaOrdinanceNo.5997,inresponsetothecontinuedimpactstheCOVID-19publichealthemergencyhashadonbusinesses.OrdinanceNo.5997isvalidthroughJune7,2021orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccurredfirst;andWHEREAS,inadditiontoextendingandamendingtheinterimzoningcontrolsestablishedinOrdinanceNo.5974,OrdinanceNo.5997waivedtherequirementtoobtainaTemporaryUsePermitforthetemporaryexpansionofabusinessintoanadjacentvacantspaceinamulti-tenantbuildingincompliancewiththeGovernor’sSafeStartplanandpublicheathguidelinesforCOVID19;andWHEREAS,inordertoassistthestrugglingdowntownbusinesscommunity,OrdinanceNo.5997approvedthedesignationofalimitednumberofexistingpublicparkingstallswithin2 ORDINANCENO.6018theareazonedCenterDowntown(CD)asshort-termparkingforcurbsidepick-upottogoorders;andWHEREAS,inordertoaccommodatetheanticipatedincreasesinshort-termparkingintheareazonedCenterDowntown(CD)andtoassistthestrugglingdowntownbusinesscommunity,OrdinanceNo.5997temporarilywaivedhourlyparkingfeesintheCity’sCityCenterParkingGaragelocatedat655S2’St.forparkingperiodsofupto10hours;andWHEREAS,sincetheadoptionofOrdinanceNo.5997theGovernorhasissuedvariousproclamations,inwhichthe“SafeStart—StayHealthy—County-By-CountyPhasedReopening”Planhasbeenreplacedwiththe“HealthyWashington—RoadmapToRecovery”;andWHEREAS,HealthyWashington—RoadmaptoRecoveryhaseliminatedthereferencetoPhase4re-opening;andWHEREAS,themostrecentProclamationissuedbytheGovernor,20-25.13,statesthatProclamation20-25,etseq.,willcontinuetobeineffectuntilthestateofemergency,issuedonFebruary29,2020pursuanttoProclamation20-05,isrescinded;andWHEREAS,duetothecontinuedstateofemergencytheCityCouncilhasdeterminedthatthereisaneedtoextendbeyondJune7,2021theinterimzoningcontrolsestablishingtheEconomicRecoveryRevocableRight-ofWayPermit,establishingandallowingEconomicRecoverySigns,waivingtherequirementtoobtainatemporaryusepermitfortemporaryexpansionofbusinessintoanadjacentvacantspaceinamulti-tenantbuilding,permittingthetemporarydesignationofshorttermparkingstallswithintheCenterDowntown(CD)zoningdistrictforcurbsidepick-uportogoorders,andwaivingparkingfeesfortheCityCenterParkingGarage;and3 ORDINANCENO.601$WHEREAS,theCityCouncilheldapublichearingonJune7,2021,toconsiderasix-monthextensionoftheinterimzoningcontrolsestablishedinOrdinanceNo.5974andOrdinanceNo.5997;andNOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportoftheinterimcontrolsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.CouncilherebyextendstheinterimzoningcontroltemporarilyestablishingthenewpermitknownasanEconomicRecoveryRevocableRight-ofWayPermitintheCityofRenton.EconomicRecoveryRevocableRight-of-WayPermitsshallbe:(1)Availabletobusinessesseekingtousethepublicright-of-wayfrontingtheirbusinessesand/ortheirprivateparkinglotsabuttingtheirbusinessestoexpandtheareawithinwhichcustomersareserved,suchasforsidewalksales,sidewalkpick-up,parkletswithoutstructuralcomponents,pre-fabricatedandengineeredparklets,and/oroutdoorrestaurantseating.ObtaininganEconomicRecoveryRevocableRight-of-WayPermitforsuchusesshallnotexcuseabusinessfromcomplyingwithapplicablepublichealthrequirementsandguidelines,includingsocialdistancing;and(2)IneffectfromthedateofissuancethroughDecember7,2021;and(3)Subjecttothesameapplicationandreviewprocessasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2,exceptthatnoapplicationfeeorpermitfeeshallberequired;and4 ORDINANCENO.6018(4)Subjecttoleaseholdexcisetaxtothesameextentasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2.(5)ForEconomicRecoveryRevocableRight-of-WayPermitsthatwereapprovedand/orissuedbetweenJuly8,2020andJune7,2021andthatwerestillvalidandunexpiredasoftheeffectivedateofthisordinance,thefollowingshallapply:TheperiodofvaliditythatwouldotherwiseapplyunderthestandardexpirationdateslistedinthisordinanceisextendeduntilDecember7,2021.SECTIONIII.Asaninterimzoningcontrol,CouncilherebyextendstheperiodforthenewsigntypeknownasanEconomicRecoverySignintheCityofRenton,byextendingthesameregulationsestablishedunderOrdinanceNos.5974and5997forsuchsigns.Accordingly,EconomicRecoverySignsshallcontinuetobesubjecttothefollowingforanextendedperiodasstated:(1)Allowedforbusinessestoadvertiseeconomicrecovery-relatedeventssuchasgrandre-openingsorexpandedservicesorcapacities;and(2)AllowedintheformofA-FrameSignsandEventSigns,asfurtherspecifiedbelow;and(3)IfanA-FrameSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100.J.5:a.Number:I.WithinCityCenterSignRegulationArea:Onlyoneofthesesignsispermittedperbusinessperstreetfrontage.5 ORDINANCENO.6018ii.ElsewhereintheCity:Oneofthesesignsispermittedperbusinessperstreetfrontageand,inaddition,anadditionalsignispermittedtobelocatedabuttingthebusinessandbuildingtowhichthesignrelates.b.LocationRequirements:I.PermittedLocation:(1)WithinCityCenterSignRegulationArea:A-framesignsmustbeplacedagainstthebuildingandbusinesstowhichthesignrelates.(2)ElsewhereintheCity:A-framesignsmaybelocatedonthepublicsidewalkabuttingthebusinesssiteand/orwithinthelandscapingareaonorabuttingthebusinesssite,however,A-framesignscannotbeplacedinthelandscapestripbetweenthecurbandouteredgeofthepublicsidewalk.Additionally,forbusinesseslocatedwithinshoppingcenters,anadditionalA-framesignmaybeplacedagainstthebuildingandbusinesstowhichthesignrelates.ii.PedestrianClearance:Aminimumoffourfeet(4’)ofunobstructedsidewalkareabetweentheouteredgeofthesignandthestreetcurbisrequired.iii.ClearVisionArea:NosignshallbelocatedastoposeadangerandviolatetheclearvisionareaspecifiedinsubsectionRMC4-4-100.C.6,ProhibitedSigns.Whereatrafficvisionhazardiscreated,theCitymayrequireamodificationtotheheightorlocationofasigntothedegreenecessarytoeliminatethehazard.6 ORDINANCENO.601$c.Size:Signsshallbenolargerthanthirty-twoinches(32”)wideandthirty-sixinches(36”)tall.d.ConstructionSpecificationsandMaterials:Thesignmustbeprofessionallymanufacturedofdurablematerial(s).Nolightingorattachments,suchasballoonsarepermitted.e.MaintenanceandAppearance:SignsmustbemaintainedinaccordancewiththeprovisionsofRMC4-4-100.D.3,SignMaintenanceRequited,andsubsectionRMC4-4-100.D.4,AppearanceofSigns.f.AlterationofLandscapingProhibited:NolandscapingmaybedamagedormodifiedtoaccommodateanA-framesign.TheCitymayrequirereplacementofanydamagedlandscapingpursuanttoRMC4-4-070.Q,DamagedLandscaping.g.RemovaluponCloseofBusinessRequired:A-framesignsshallnotbedisplayedduringnonbusinesshours.h.ProofofInsuranceandHoldHarmlessAgreementforSignsonPublicRight-of-Way:BeforeplacinganysuchA-Framesign,thebusinessmustprovidetheCommunity&EconomicDevelopmentDepartment’sDevelopmentServicesDivisionwith(1)proofofgeneralcommercialliabilityinsurance(certificateofliabilityinsurance)meetingtherequirementsofRMC4-4-100.L.4and(2)asignedholdharmlessagreementthatspecifiesthattheownerofthesignwilldefend,indemnify,andholdtheCityharmlessforanyloss,injuries,damage,claimsorlawsuit,includingattorney’sfeesthatarisefromthesign.7 ORDINANCENO.6018i.ConfiscationofSigns:SignsthatdonotcomplywiththeseprovisionsmaybeconfiscatedbytheCity;and(4)IfanEventSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100.J.6:a.[Intentionallyomitted.]b.TypesofEventSignageAllowed:Anycombinationofthefollowingtypesofsignagearepermitted:balloons,pole/wallstrungandwall-hungbannersnotexceedingonehundred(100)squarefeeteachinsize,pole-hungbannersnotexceedingtwenty(20)squarefeeteachinsize,flags,inflatablestatuary,pennants/streamers,searchlights,windanimatedobjects,andothersimilaradvertisingdevicesapprovedbytheDevelopmentServicesDivision.Rigidportablesignsarealsoallowedprovidedthesignisamaximumofthirty-two(32)squarefeetinareaononefacepersignnotexceedingsixfeet(6)inheight.RigidportablesignsarelimitedtooneperstreetfrontageoutsidetheAutomall.c.[Intentionallyomitted.]U.[Intentionallyomitted.]e.PlacementUmitationsforEventSigns:i.Roof:Nosignoradvertisingdeviceshallbeplacedontopofarooforextendverticallyabovethefasciaofthebuilding.ii.PerimeterStreetLandscaping:Eventsignageshallnotbelocatedwithinrequiredperimeterstreetlandscaping;and(5)AllowedwithoutapermitandwithoutafeethroughDecember7,2021.8 ORDINANCENO.6018SECTIONIV.Asaninterimzoningcontrol,CouncilherebyextendsthetemporarywaiveroftherequirementtoobtainaTemporaryUsePermitforthetemporaryexpansionofabusinessintoanadjacentvacantspaceinamulti-tenantbuildingincompliancewiththeGovernor’sHealthyWashington—RoadtoRecoveryplanandpublicheathguidelinesforCOVID-19.Allotherpermitsrequiredforsuchexpansionsshallcontinuetoberequired.SECTIONV.CouncilherebytemporarilyextendsapprovalofthedesignationbytheAdministratorofthePublicWorksDepartment,ordesignee,ofalimitednumberofexistingpublicparkingstallswithintheCenterDowntown(CD)zonetosupportshort-termparkingforcurbsidepick-uportogoordersfrombusinesseslocatedintheCitycenter.SECTIONVI.CouncilherebytemporarilyextendsthewaiverofthefollowingparkingfeesestablishedinSectionIlloftheCityofRentonFeeScheduleforthefollowingparkingperiodswithintheCityCenterParkingGarage:•Zero(0)totwo(2)hours;•Two(2)tofour(4)hours;•Four(4)tosix(6)hours;and•Six(6)to(10)hours.SECTIONVII.TheMayororhisdesigneeisauthorizedtoimplementanyandalladministrativeproceduresnecessarytocarryoutthedirectivesofthislegislation.SECTIONVIII.ApublichearingwasheldonJune7,2021.SECTIONIX.TheinterimcontrolsextendedhereinshallbeineffectuntilDecember7,2021,unlessearlierliftedorsubsequentlyextendedbyactionoftheCityCouncil.9
