6019CITYOFRENION,WASHINGTONORDINANCENO.6019ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,EXTENDINGTHEINTERIMZONINGCONTROLSESTABLISHEDINORDINANCENO.5996WITHAMENDMENTSTOTEMPORARILYALLOWCONTINUEDOPERATIONSOFADEINTENSIFICATIONSHELTERINTHECOMMERCIALARTERIAL(CA)ZONINGDISTRICTANDREVISEHOMELESSSERVICESUSEPERMITTINGREQUIREMENTSTOBETTERACCOMMODATENEWEMERGENCYANDPERMANENTSUPPORTIVEHOUSING.WHEREAS,theCityCounciladoptedOrdinance5996toallowahomelessdeintensificationshelteroperatedbyDowntownEmergencyServiceCenter(DESC)andtotemporarilycontinueoperationsduringtheCOVID-19pandemicandtocreateinterimzoningcontrolstopermitnewpermanenthomelessservicesuses;andWHEREAS,thenumberofpeopleexperiencinghomelessnessisincreasingaroundthecountryandinthestateofWashington;andWHEREAS,KingCountyisworkingwithhomelessserviceproviderstopurchasehotelsandconvertthemintoemergencyhousing,transitionalhousing,andpermanentsupportivehousing;andWHEREAS,KingCountyisworkingwithDESCtopurchasepermanentlocationsoutsideoftheCityofRentontorelocatetheresidentsofitsdeintensificationsheltercurrentlyoperatingintheCityofRenton;andWHEREAS,KingCountyandDESCintendtorelocateresidentsoftheRentonDESCdeintensificationshelterinphasesastheyacquirenewpropertieswherelongtermnonpandemicrelatedhomelessservicescanbeprovided;and1 ORDINANCENO.6019WHEREAS,althoughKingCountyhasagoaltodecommissiontheRentondeintensificationshelterandrelocateitsresidentstoamorepermanentlocationbytheendof2021,thetimingoftherelocationisdependentuponmanyfactorsthatmaycauseatleastaportionoftherelocationtobedelayedtoaslateastheendofSeptember2022;andWHEREAS,onMay12,2021,GovernorInsleesignedESSHB1220,whichwillrequireallcitiestorefinezoningcontrolsbySeptember30,2021toprovidespecificaccommodationsforavarietyofhomelessservicesuses;andWHEREAS,additionaltimeisneededfortheCitytodevelopzoningcontrolsthatcomplywithESSHB1220;andWHEREAS,whilesuchzoningcontrolsarebeingdeveloped,itisintheinterestofpublichealthandsafetytoaccommodatenewhomelessservicesusesonanemergencybasisandcontinueallowingDESCtooperateitsemergencydeintensificationshelterwhileitworkswithKingCountyonapermanentrelocationofitsoperations;andWHEREAS,thisordinanceisnecessarytoextendOrdinance5996withamendmentsinordertoaccommodateapressingneedforhomelessservices;andWHEREAS,pursuanttoRCW36.70A.390,theCityCouncilheldapublichearingontheextensionofOrdinance5996onbeforeadoptingthisordinance;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TherecitalssetforthaboveareincorporatedhereinasthefindingsoffactrequiredbyRCW36.70A.390.2 ORDINANCENO.6019SECTIONII.TheinterimzoningcontrolsimposedbyOrdinance5996areherebyextendedandshallremaineffectasamendedhereinforsix(6)monthsunlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.Notwithstandingtheexpirationoftheinterimzoningcontrols,adeintensificationshelterallowedbyOrdinance5996,asamended,maycontinuebeyondexpirationasprovidedinSectionIVofthisOrdinance.SECTIONIII.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONIV.Subsection4-2-080.A.101oftheRentonMunicipalCode,asamendedbyOrdinance5996,isamendedtoreadasshownbelow.Allotherprovisionsin4-2-080.Aremainineffectandunchanged.101.UntilnolaterthanSeptember30,2022,aAsmanyasone(1)COVID19deintensificationsheltermayoperatewithintheCityofRentonwithoutobtainingaconditionalusepermittooperateasaHomelessServicesUsesolongasitsoperatorisdiligentlyattemptingtoacquirepermittedlocationsformotepermanentoperationsandattemptingtoreducethenumberofhomelessservicessleepingunitstoonehundredthirty-five(135)assoonaspracticable.ThefollowingappliestoaCOVID19deintensificationshelteroperatingpursuanttothisexemptionfromtheconditionalusepermitrequirementsthatwouldotherwiseapplytoaHomelessServicesUse:a.AfterJune1.2021.theCOVID19dcintensificationsheltershallnotmorethanonehundredtwentyfive(125)personsatanytime;and3 ORDINANCENO.6019b.ThcCOVID19deintensificationsheltershallceaseoperationsnolaterthanJanuary1,2022,afterwhichdatetheCOVID19dcintcnsificationhcltcrwillbeunlawfullyoperatingifitdoesnotholdavalidconditionalusepermitforaHomelessServicesUscandisnotoperatinginalocationinwhichHomelessServicesUsesarcallowed.SECTIONV.Subsection4-4-045.DoftheRentonMunicipalCode,asadoptedbyOrdinance5996,isamendedtoreadasfollows:D.APPROVALPROCESSREQUIRED:Ahomelessservicesuserequiresaconditionalusepermit,approvedbyaHearingExaminerandprocessedpursuanttotheprovisionsofRMC4-9-030andtheprovisionsofthisSection.Asanalternativetotheconditionalusepermitprocess,ifrequestedbytheapplicantandrecommendedbytheMayor,anapplicantforahomelessservicesusemayrequesttheCouncilapproveanegotiateddevelopmentagreementundertheprovisionsofRCW36.70B.170-.210.TheCityCouncil’sdecisiontoenterintoadevelopmentagreementisadiscretionarylegislativedecisionandapprovalofsuchagreementisnotsubjecttothecriteriainRMC4-4-045.HorthesubmittalrequirementsinRMC4-4-045.F,butrelatedinformationmaybeincorporatedintoanegotiateddevelopmentagreement.SECTIONVI.Subsection4-4-045.H.1oftheRentonMunicipalCode,asadoptedbyOrdinance5996,isamendedtoreadasfollows:1.ApplicabilityofCityReviewProcess:Unlessapprovedbywayofdevelopmentagreement,aAhomelessservicesuserequiresapprovalofa4 ORDINANCENO.6019conditionalusepermitbyaHearingExaminer.TheconditionalusepermitshallbereviewedpursuanttoRMC4-9-030asenhancedbytheprovisionsofthisSection.SECTIONVII.Subsection4-4-045.1.3oftheRentonMunicipalCode,asadoptedbyOrdinance5996,isamendedtoreadasfollows:3.OccupancyLimitsandSize-RelatedDevelopmentStandards:a.AllhomelessservicesusesshallcomplywithoccupancylimitationscontainedinapplicablebuildingandfirecodesandordinancesadoptedbytheCity.b.Inadditiontocomplianccwith1.3ofthisSection,oOvernightshelterusesshallnotprovidesleepingaccommodationsformorethanonehundred(100)residents,oruptoonehundredandfifteen(115)residentsifthereisanagreementwiththeCitytodesignateatleastfifteenpercent(15%)ofthesleepingunitstothosecurrentlyexperiencinghomelessnessintheCityandshallcomplywiththefollowingadditionalrequirements.c.Overnightshelterusesshallcomplywiththefollowingadditionalrequirements:I.TheCityshallimposeaconditiononanyapprovedovernightshelterusclimitingthenumberofbedstothoserequestedbytheapplicantoronehundred(100),whicheverii&Sheltersshalllocategreaterthanone-half(0.5)milefromanyotherhomelessservicesuse,unlesstheyarecolocatedaspartofasingle5 ORDINANCENO.6019developmentanddonotservemorethanacombinedonehundredfifteen(1500)residents.iii.Shelterswithmorethanfifty(50)bedsshouldlocatewithinone(1)mileofapublictransitstop.SECTIONVIII.Subsection4-4-045.LoftheRentonMunicipalCode,asadoptedbyOrdinance5996,isamendedtoreadasfollows:L.INDEPENDENTTECHNICAL.REVIEW:TheCitymayrequiretheapplicantshalltopayforindependenttechnicalreviewbyaconsultantretainedbytheCityforreviewofmaterialssubmittedbytheapplicanttodemonstratecompliancewiththerequirementsofthisSection.SECTIONIX.IntheCOZone,minimumnetresidentialdensityandStructuredParkingrequirementsinRMC4-2-120B,andallrequirementsinRMC4-2-O8OA.16andRMC4-4-150shallnotapplytonewemergency,transitional,orpermanentsupportivehousingthatisconvertedfromanexistingbuildingoriginallypermittedasahotelinwhichtheroomscontainbothbathroomsandkitchenssothattheymaybeconvertedintoanumberofresidentialdwellingunitsthatdonotexceedthenumberofpreviouslyapprovedhotelrooms.SuchconversionofusemaybeapprovedbywayofnegotiateddevelopmentagreementundertheprovisionsofRCW36.70B.170-210,whichdevelopmentagreementmayincorporatethemasterplanandsiteplanreviewprocessofRMC4-9-200.SECTIONX.Duringtheinterimperiodinwhichtheseinterimzoningcontrolsareineffect,CitystaffaredirectedtoreviewtheregulationstoadvancecodesconsistentwithESSHB1220.Citystaffaredirectedtobringfurtherproposedlegislationthroughthepublicprocessthat6 ORDINANCENO.6019appliestoproposedamendmentstotheRentonMunicipalCode’sdevelopmentregulations,includingthepublichearingprocessbeforetheCity’sPlanningCommission,andthentopresentsuchfurtherlegislationtotheCityCouncilforitsconsideration.SECTIONXI.IfanySection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyotherSection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONXII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofJune,2021.JasA.SethClerkAPPROVEDBYTHEMAYORthis14thdayofJune,202Armone,Mayor7
