CityofRentonCommunity&EconomicDevelopmentDepartmentAttn:KayrenK.Kittrick,DevelopmentEngineeringSupervisorAugust1,2012Page2byboththeCityofRentonFinanceDepartmentandtheCityofRentonBuildingDivisiononAugust15,2001—seeattachedEXHIBITB);(c)AcopyofanAugust15,2001Interpretation/PolicyDecisiondatedAugust15,2001(andfaxedtomeonAugust16,2001byMr.Jordan)issuedbytheCityofRentonDevelopmentServicesDivision(“DCD”)concerningtheStonewayquarryandrecyclingbusinesses(seeattachedEXHIBITC);and(d)AcopyofanAugust16,2001letterfromMr.WattstoQuarryIndustrialPark,LLC[aMerlinofamilylimitedliabilitycompanythatwasthentheowneroftheentiretyoftheStoneway(Merlino)BlackRiverQuarryproperty](seeattachedEXHIBITD).TheEXHIBITAletterexplainedGMCC’sintentiontohaveStonewayRock&RecyclingsubmitaCityofRentonBusinessLicenseasfollows:[Itis]ourintentiontohaveStonewayRock&Recycling,adivisionofGaryMerlinoConstructionCo.,Inc.,submitanapplicationforaCityofRentonBusinessLicenseforthenon-quarrylandusesattheStonewayBlackRiverQuarryproperty:namely,forourcontractor’sofficewithequipmentandmaterialstorage,constructionmaterialsrecyclingactivities(includingamongothers,thosebeingcoitductedbyCityTransfer,Inc.underitscontractwithus)andconcretebatching.(Emphasisadded.)Backinmid-2000,CityTransfer,Inc.(“CTI”),aconstructioncompany,anticipatedthat,inlate2000orearly2001,itwouldbeawardedbythePortofSeattlethethennextinaseriesofcontractstoprovidefillmaterialfortheThirdRunwayprojectatSea-TacAirport.Inviewofthatprospect,onOctober22,2000,CTIenteredintoanagreementwithGMCCtoacquiretherighttousetheBlackRiverQuarryPropertyasatrans-shipmentpointforfillmaterial.Byvirtueofthatagreement,CIIacquiredacontractualrighttotruckfillmaterialtotheBlackRiverQuarryPropertyandtemporarilystockpileitthereforlatertruckingtoSeaTacAirport.Pursuanttothatagreement,CIIplacedaverylargestockpileoffillmaterialontheBlackRiverQuarrysite,whichtheCityrecognizedasaconstructionmaterialsrecyclingactivityanddidnotobjectto.GMCCsubmitteditsStonewayRock&RecyclingBusinessLicenseapplicationtotheCityofRentonLicenseDivisiononAugust15,2001aspromisedintheEXHIBITAletter.TheletterwentonasfollowstodocumentthatMr.JordanhadadvisedGMCCthatallofthenon-quarrylanduseswerepermitteduses:WeunderstandthattheCityisinterestedindistinguishingtheabove-mentioneduses[whichyouhaveadvisedusarealtpermittedusesunderthesubjectproperty’sHeavyIndustrial(IH)zoneclassification]fromthe CityofRentonCommunity&EconomicDevelopmentDepartmentAttn:KayrenK.Kittrick,DevelopmentEngineeringSupervisorAugust1,2012Page3quarryingatthesite(whichyouhavetolduswillcontinuetobesubjecttothepreviousKingCountyconditionsuntilsuchtimeastheCityhasissuedaGradeandFifiSpecialPermitforthequarrying).YouhaveexpressedtousthatfilingofthesubjectBusinessLicenseapplicationwillenableyourofficetomakethatdistinctionandwithdrawNeilWatts’July27,2001lettertoQuarryIndustrialPark,LLCconcerninghoursofoperation.(Emphasisadded.)InregardtotheEXHIBITCInterpretationlPolicyDecisionissuedbyDCD,thesecondtwoofthethreeparagraphsoftheJustificationsectionconfirmedthenon-quarrylandusesattheStonewayBlackRiverQuarrypropertyasoutrightpermitteduses.Thosetwoparagraphsstate:Thesubjectsitealsoconductsseparateactivitiesthatincludeconstructionmaterialsrecycling,acontractorsofficewithequipmentandmaterialstorageandacoltcretebatchplant,ofwhichtheseusesdonotrequireadditionalpermitting.Instead,theseusesaretreatedasoutrightprimarypermittedusesintheHeavyIndustrial(IH)Zone.Theseparate(non-quarrying)usesarevestedtoKingCountystandardsuntilsuchtimetheyrequireadditionalpermitsorlicensesfromtheCity.Inaddition,theKingCountyHearingExaminer(decisionofSeptember3,1999)foundthat:“theperiodicreviewprocessconductedbytheDepartmentofDevelopmentandEnvironmentalServicesunderauthorityofKCCchapter21.A.22waslimitedtotherockquarryoperationsandexcludedreviewoftheconcreterecyclingactivity....”Therefore,thoseothernon-quarryingusesmttstbeconsideredexistingpermittedusesnotsubjecttotheregulationsimposedonthequarryingoperation.Asthesenon-quarryinguseswereexistingpermittedusesintheCounty,theyshouldalsobeconsideredanappropriatepermitteduseintheCity.(Emphasisadded.)ConsistentwiththosetwoquotedparagraphsfromtheEXHIBITCInterpretationlPolicyDecision’sJustificationsection,thefirstsentenceofparagraph4ofEXHIBITD’sDecisionsectionstates:Thenon-quarryingoperationswillremainsubjecttotheexistingCountyregulationsinplaceatthetimeofannexation.(Emphasisadded.)Mr.Watts’August16,2001letter(EXHIBITD)alsoconfirmed(inthesecondsentenceoftheletter’sfirstparagraph)thatacontractor’sofficewithequipmentandmaterialstorage,constructionmaterialrecycling,andconcretebatchplantusesbeingconductedattheBlackRiverQuarrypropertywere“alloutrightpermitteduses.”(However,thatletterappearstoconflictwith
