Theimpactofanaverageincreaseinnoiseappliestothetimeperiodwhichencompassesthetypicalnoiseenvironmentofthereceiver,e.g.forbusinessesorschools,an8-hourdaytimeaverage,andforresidences,a24-hourday-nightaverage.MeasuredorpredictednoiseincreasesaredeWnninedattheoccupieddwelling,school,orbusiness,notatthepropertyline.Noiseimpactisassessedbynumericallycomparingtheprojectnoiselevd.atanyreceiverlocationwithambientnoiselevels.Thelevelofdistantnoisefromexistingrecyclingoperations,on-goingconstructionandactivitiesatneighboringindustrialsites,highwaytrafficnoise,combinedwithlocalresidentialactivitiesnaturallyoccuning.wiid.noise,aircraftflights,alltakentogether,constitutethecurrentambientnoiseenvironment.Afintherdiscussionofthenoiseelementofperiodicreviewisindudedintheconclusionssectionofthisreport.fiounofOoeration‘: 1The‘BlackRiverQuarrypeimitisconditiónçdtoillowoperationsfrom7:00a.m.throuèh10:00p.nMondaythroughStday.‘Thiscondiflonwasestablishedwiththeissuanceofthe$lackRiverQualypermitin.1972;Normalandroutinemaintenanceactivitiesandequipmentwahn-UpinthemorningsarenotrestHàtedbythehoursofOperation.The&iginalSEPAchecklistwlwtitiedqñMarch.15,1977doesnotdiécussthis’issue.TheccmtroffingauthorityfOrcohdidoninghoursofoperationsforgradmpermitshasbeenarequirementthatthepe9nztteecomplywiththeapplicablenoisestandard.(seeittacbifl11,cqnditions0080;0091).InAngustOf1996,BlackRiverQuarörwascitedbythedepartmentforiviolStionofoperatinghours.Theoperator’sposifionwasthe“historicoperalioniQncliding24-hourperdayOperAtions)atthesubjectproperty,theBlackRiverQuany,pre-dateKingcountysuch,Stonewaycontdidsthatithasalegalri&httoconductoperationspriorto7:00a..ñi.notwithstandingpermitcondition#0091assetforthinGradingPermit#L9oGRO17.”SubEequeilttothecitationbyDDBSfortheallegedviolation,discussionswereheldbetw’theoperatorandDDES.Asaresultofthosediscussions,onAugust8,1996,Stoneway,throughtheirlegalcounsel,advisedthedepartmentthattheywoulçlvoluntarilyIuspendoperationsoutsideofthehoursnotedinthepennitconditions.,.Itshouldbenotedthattheresticdonsonoperatinghoursimposedthroughthepermitrelatetotheminingoperationssuchasthecccavation,processing—haulingofmaterialproducedonsite.ThehaulingofmaterialsfortherecyclingoperationarenotsubjecttothispermitandarenotregulatedbythehoursofopeitonunderthisUlasdnnBlackRiverQuarrycurrentlyusesdrillingandblastingtominematerialintherockquarry.BlastingoperationsgenerallyoccuraboutonceortwiceaweekduringthePage4 •monthsdfAprilthroughOctoberwhendemandfortheproductishighest.Blastingocçinssubjecttothestan&rdscontaine4.inKC.C.21kfl070.B;B.’.Blastingshallbeconthictet•1.Consistennv,ththemethodtspecifiedjntheOfficeofSurfaceMining,1927BlastingGa/danceMwwal;•2.Durindaylighthours;wLIAccordingtodtimexhethslethat;.a.featuresregukworprethctabkUmes,exceptmtheseofanemergency;and•.b.isprmd4edtoresidentswithinone-In(frn/kofthesite;Currently,.thepermitisconditioned’toincludeextensiveconditions(attachment1,conditions5050through5100)regardinggroundvibrations,grounddisplacementandfrequencycharactethlicsand,allowablesoundpressurelevels.Therehavebeencomplaintsoverthelastthreeyearslodgedbytheadjacentapartmentcomplexregardingtheblastingissue.Theconcernwaswithlackofpriornoticeaidononeoccasion7in1991,theapartmentmanagernotifiedthedepartmentthatflyrockfromablasthadshoweredthecomplexandparkinglot,hiadditionasaresultofdiscussionswiththe.quanyandwiththeneighboringEmpireEstatesApartments,additionalconditions(attachment1,conditions5102and5103)wereplacedonthepermitin1997whichrequireatwenty-fourhournoticetotheapArtmentspriortoblastingandwhichrequirethepérnütteetosubmitallseismographreportsrecordedduringblastingtothisdepartmentwithintendaysoftheblast.Blastingisrestrictedtodaytimehoursonly...&wOuai’tvMitigationofthgitivedustconsistsofmaintainingtheaggregateina.moistconditionwhileitisbeingconveyed;sorted,crushedorstockpiled.ThespecificregulationspertainingtofUgitivedustareconfainedinSectidns9.15and9.20ofPSAPCA’sRegulationIandrequiretheuseofbestavailablecontroltechnologytocontrolemissionswhichwouLdachievethegoalofnovisibledust.ThesiteisoperatingunderanapprovedPSAPCApermitwhichincludesafugitivedustcontrolplan.Currentlytheentranceroadtothesiteispavedtothescalehouseforthepurposeofreducingdustandtrackingfromtucksenteringandleavingthesite.Inaddition,awatertruckservicesthesiteasneededtokeephaulroutesandtraveledwayswetteddovbtTheconvcyorsalsohaveasysteminplacewithawatertankandspraybarstowetmaterialonthebeltsifnecessazy.Includedinthissystemarespraybarsforwettingmaterialsinthecrusherandscreeningplantsduringprocessing.Asitevisitduringpreparationofthisreportrevealednodustproblems.However,eventhoughitwasdiyandwindy,therebadbeensomerainovernightAreviewoftheavailableinformationinthefileindicatesthatuntilrecently,thedepartmenthadnotreceivedcomplaintsregardingdustasanissueatthissite.• •—:L*pdtsefattenis•HHS4eVicinityThesttecompnseseightparcelsituatedinatriangularshapewiththehypotenôsemnmngalongthesouthwestonortheastpropertylineThesquthemfoijrparcelsareonedIndustrialandthenorthernIburparcelsarezonedOfficeThreeparcelsborderthenorthernpropertylint,all!tonedR-24Currentlythev,ester1ycyoofçheseparcelsremainundevelopd,SvhiletheeasterlyparcelisthesiteoftheEmpireflatesApartmentcomplexThatcomplexcontains240hvhigun4tsandwascopstructedin197QThesepropertiesareadjacenttoslidaccessedfromMadmLdtherKmgYrWay1IThewesternboundaryofthesitebordersKentonConcreteRecyclersandisalsotheRentonCitylimit:Thecitylimitsborlerthepropertyasnoted,onthe*èst,ndalongthecommonçfrop’ertylinSrunnihgsouthwesttonortheast.adjaccnttothe•railroadrightofway.TheprkpertyacrossthelrqckstothesoutheastisundevelopedwithheexceptionofthecoütrolfacilityintheBlackRiver.DirectlysouthwestoftheentrancetothequayacrossMonsterRoadisanoperatingtransferstation.AcrossMofisterroadtotheEouthastisanofficecomplex.•.IUndertheoperating,planssubmittedin1989forreviewofthepermitduringtheseparationofthetwgoperations,a50-footbufferwasestablished.Thebufferprovidedscreeningand.noiseattenuationbetweentheoperationsofthequarryandtheapartmentcomplexalongtheeasterlyportionofthesite’snorthpropertyline.In19%theoperator,whileälearingthecastroportionoftheproperty,intrudedintoandremovedthetreesandvegetationfrOriapproximatelyfivehundredfeetofthebuffer.BlackRiverQuanywasrequiredtosubmitabufferrestorationplanforreviewbyDDES.Thedepartment,inMayof1997,approvedafinalreplanfingandrestorationplanandthereplantinghasoccurred.Thereplantingiscurrentlybeingmonitoredforanadequatesurvivalratethroughtheroutineinspectionofthequarry.An.inspectiontakenduringpreparationofthereportrevealedtheunderstozyrecoveringandanapproximate20percentmortalityofthereplantedtrees.AnadditionalinspectionduringJanüaiyofthisyearrevealedseveralofthesmallerfirsplantedasapartoftheapprovedrevegetationplanhadbeencutdownandremovedinDecemberbypartyorpartiesunknown.ReclamationWashington’sSurfaceMiningAct(Chapter78.44RCW),whichisadministeredbytheDepartmentofNaturalResources,definesreclamationa“thereasonableprotectionofallsurfaceresourcessubjecttodisruptionfromsurfaceminingandrehabilitationofthesurfaceresourcesaffectedbysurfaceminingincludingtheareaunderstockpiledmaterials.AlthoughboththeneedforandthepractIcabilityofreclamationwillcontrolthetypeanddegreeofreclamationinanyspecificinstance,thebasicobjectivewillbetoreestablishonacontinuingbasisthevegetativecover,Page6 soilstability,waterconditions,andsafetyconditionsappropriatetotheintendedsubsequentuseofthearea.”RCW78.44.alsostatesthat“theslopesofquarrywallsinrockorotherconsolidatedmaterialsshallhavenoprescribedangleofslope,butwhereahazardousconditionisàreàtedthatisnotindigenoustotheimmediatearea,thequarryshallbeeithergradedorbadthlledtoaslopeofonefoot.horizontaltoonethotverticalorotherprecautionsmustbetakentoprovideadequatesafety”.ThegoalofRCW78.44isthatreclamationcreatesstable,usablelandataminedsite.KingCountyDOESandWADNRhaveinplaceaninter-agencyagreement(attachment6)thatdefinesthjurisdicton1rolesofeachagency.Generally,KingCountyDDESisresponsibleforthepermittingandinspectionforcompliancewiththedaytodayoperationalissuesassociatedwithminesinunincorporatedKingCounty.WADNRhastheresponsibilityforreview,approvalandenforcementrelativetothefinalreclamationofminesintheunincorporatedareasofthecounty.Theprocessforpentittingofnewoperationsinvolvessubstantialcoordinationbetweenthetwoagenciesliitheapprovalofthefinaloperatingplan.Obviously,thecountymustbecareftilnottoapproveaplanthatwouldrenderthestateapprovedreclamationplanunachievable.Forinstancç,twooftheissuesreviewedduringsheinspectionsbyODESstaffinvolvemaldngsurethatsetbacksfrompropertylinesarebeingproperlyobservedandthatslopesasapprovedbyWADNRarenotbeingoverexcavated.Bothareintegraltobeingabletoachievethefinalreclamationasapproved.KingCountyDUESandWADNRworkedtogetherduringtherepermittingofthesitein1989and1990toestablishacoordinatedoperatingplanmeetingtherequirementsofbothstateandcountyregulations.Coordinationbetweentheagenciesisalsocrucialinachievingthesegmentalrethmationcommoninminingoperations.Segmentalreclamationinvolvesthereclamationofthe“Workedourportionsoftheminewbileminingcontinuesinotherareasofthesite.KingCountyautenUyhasafeestructurethatencouragessegmentalreclamation.Thefeesarebased,inpart,uponareaopenandunreclaimed,whichprovidesanincentivetotheoperatortoachievereclamationinatimelymanner.Miotherareaofcooidinafionbetweentheagenciesisbonding.gingCountyDOESisresponsibleforobtainingoperatingbondsforthedaytodayoperationsofthesite.Thopurposeofthepperatgbondistoassureasourceofflm4ing.fOrrepairofoffsitefadlideidamagedbymineoperdontBlackRiverQuarrycunendyhasoperatingbombinplaceinlbamountof$5,000.00and515,04)0.ReclatadonbondsaresetandadministeredbyWADNRThecriteriaforthosebondsarcbasedupOntheestinatedcosttostabilizethesite,eliminatehazards,andreplantáhouldtheOperatorBilltomeettheobligatiOnestablishedthroughtheapprovedreclamationplan.Thecurrentreclamationbondbeingheldbythestateforthissiteis$34,500.00.TheWADNRhasrecentlyreviewedthebondingstatusofthesiteandhasrequestedanincreaseintheredimationbondamountto$166,000.00.ThenewbondhasbeenreceivedbyWADNKPage7 Dnma2eandWaterOnailtyIngenetal,thebedràckfônnationsonthepropertyarerclativel9resistantto’erosion.Thesoils.coveringthebedrockhavebeenidentifiedasBeausitewhichaccordingtoSOS,.11-55.Sócon4Edidon.June1986,hasamoderatelylowmn-offotentia1.Evenwiththelownin-offpotentWofthesoil.%andmaterialbeingmined;theactivides.commcnlyocamingonshedoproducefinesedimentsandaswillbenoted.laterluthissection,thosesedimentsarenotallbeingcapturedonsite.Theentiresite,withtheexceptionofthebuffer(seeLand.UsePattcrnspage0)hasbeencleared.Thewbddngthee,ofthequarryisinthehighestreliefonthesitein.thenoftbwestedyportionoftbepropctty‘atde’ation250.Frorn.thatpointthesheslopegtotheeastalongthenorthpropertylinetpsrielevationof90andtothesoutheastcornerofthepropertytoanelevtion.of301,Ontheriortheasterncdneroftheiteisaswaleandconveyancesystem.Thisswaiecollectsdrainagefromtheapartmentcomplexarea,carriesitthroughthesite,dischargesthewaterdowntheslopeinarock-linedditchanddischargestothesouthofftheproperty.andintotherailroadright-ofway.Aninterceptorswalebeginsimmediately.tothewestofthisdischargepointandcontinuesalongthesoutheastedgeoftheoperationparallelingthepropertyline.Theditchultimatelydischargesintothepondlocatedeastofandadjacenttotheentrancetothesitehithesouthwestcorner.Thisditchcapturessiteramofffromafillslopeandfromtheclearedarea.Thesoutheastareaalongthelengthoftheditchhasbeenfilledovertheyearsandtheditchislocatedonthefillformuchofitslengthbeforeenteringthepond.Thepondhasthreecellsbeingseparatedbytwqrockdividerstoaidinprecipitationofanysuspendedsolids.Volumeofthepondsiscalculatedatapproximately60,000cubic.feetwhich,accordingtothenomographusedforcapacitycalculationatthetimeofconstruction,providesadequatestoragefortheshe.Aninspectionduringpreparationofthisreportnotedthepondwasrecentlycleanedtorestorethecapacity.Itshouldbenotedthatthepondswerenotsizedtoincludetheareaclearedin1996.Theapprovedplansdosetforththerequirementforanadditionalpondontheeasterlyportionoftheandonce,thatareahasbeencleared,theadditionalpondwillbeconstructed.Allsitedrainagefromtheoperationsareaisdirectedtothepond.Thisincludesthesurfacedrainagefromtheentranceroadaswellasfromthesplashfromthewheelwashfacilitieslocatedonbothendsofthethickscale.Thewateriscapturedbydropinletsandpipedandbyanasphaltinterceptoracrosstheroaddirectingtheflowstotheponds.WaterusedforthedaytodayoperationsofthesiteiseitherprovidedbytheCityofRentonwatersupplyoristruckedfromStoneway’splantsiteontheeasternsideofRentonontheMapleValleyHighway.Page8 BlackRfreQuarryiscurrentlyoperatingunderanerosioncontrolanddrainageplanreviewedandapprovedJanuary10,1991.AnNPDESpermitwasissuedonJuly6,1994bythestateDepartmentofEcology,Thçcurrentpermitconditionsandapprovedsiteplanallowsnodischargefromthesite.OnMarch13,1998,theDOEcitedthequarryfordischargingfromthesiteintotheBurlingtonNorthernROWwherethewaterwoulddischargethrougha24”pipethroughtherailroadbedandthenintotheBlackRiver.Inaddition,theoperatorwascitedfordischargeofturbidwaterinexceedanceoftheallowedstandardandforfailingtonotifyDOEoftheviolation(seeattachment7).TheoperatorandDOEhavebeenworkingtogethertoresolvetheseissuesandhaveagreedtoblockthedischarge.TheoperatorhasprovidedthedepartmentwithcorrespondencemunorializingtheagreementbetweenthemandtherailroadregardingtheirjointculvØrtinstallationwhichallowsthestonñwatergenerallyflowingfromnorthtosouthacrosstheqàarryproperty.PriortotheculvertinstallationthestormwaterpondedagainstthenorthsideofthetrackInspectionsofthesitehaverevealednoissueswithwoundwattThepitfloorandfacearerelativelythyandexcavationhasbeencOmpktedtothefloorelevationofabout60intheworkarea.Therearenorçcordsofàtiyactivewellsintheareaandneighboringpropertiesaresenicdbyincipalwatersupplies.sensitiveAreasThesitecontainsnosensitiveareasasdefinedbyKC.C.2EA.TheBlackRiver,aclass2Sstream,doeslieontheothersideoftherailroadROW.TheriverhasbeenidentifiedasanimportantfisheriesresourceandincludestheBlackRiverRipariánForestsurroundingthereservoircreatedbythecontrolstructureintheriverCliff-likesteepOpelaràbei%createdonthenortháidêofthesitethroughhistoricndcurrentminingofthàproperty.KCC.2lkD.5allowsminingunderanapprovedplanasanallowedalterationofsteepslopesAtthispointintheminingofthepropertyitisdifilculttoascertainifsteepslopesexistedpriortothemining,lioweversteepslopeswithbenchesasapprovedtindertheWADNRmhtingpextititAnllresultasminingcontbuies.__ _ _ _*:IAreviéwoftbefilendre’rdf&theBikRiverQuarr3revealsthatthissitehashadanextensivehistoryofproblemswithtiaddngofmudanddinontothepublicright-of-way.Duringtheseparationofthesheduring1989-1991andthesubsequentissuanceoftheseparatepermittoBlackRiverQuarry,additionalconditionswereimplementedthatrequiredtheoperationtoinstallandmaintai1iapressurizedwheelwashforthedilationoftheoperation(seeattachment1,condition2110).Theoperationinstalledtwowheeltvashsystems,oneoneitherendofthetruckscale,Thereportedincidentsoftrackinfontothepublicroadhavedecreaseddramatically,Page9
