HomeMy WebLinkAboutORD 6022CITYOFREN1ON,WASHINGTONORDINANCENO.6022ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,EXTENDINGTHEINTERIMZONINGCONTROLSFORTHEURBANCENTER(UC)ZONEESTABLISHEDBYORDINANCENO.6012,PROVIDINGFORSEVERABILITY,DECLARINGANEMERGENCY,ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,theCityofRenton’sComprehensivePlanpolicyfortheUrbanCenter(UC)zoneisasfollows,“ZonelandsthatarelocatedwithinRenton’sDesignatedRegionalGrowthCenter,ifthereisapotentialforthecreationofdenseemployment,destinationretail,recreation,orpublicgatheringspacewiththeUrbanCenter(UC)zone.TheUrbanCenterzonedareashavelargeparcelsoflandwiththepotentialforlargescaleredevelopmentopportunitiesthatwillcreateamixed-useretail,employment,andresidentialcenter.UCzoningimplementstheCommercialMixedUselandusedesignation.”PolicyU-17[sic;“PolicyL-17”appearstohavebeenintended];andWHEREAS,thepurposeoftheUCzone,aspartlystatedinSubsection4-2-020.1oftheRentonMunicipalCode,isasfollows,“TheUrbanCenterZone(UC)isestablishedtoprovideanareaforpedestrian-scaleurbanmixed-usedevelopmentthatsupportstheresidentialandemploymentgoalsofRenton’sUrbanCenter;”andWHEREAS,adevelopmentagreementbetweentheCityofRentonandTheBoeingCompany(KingCountyRecordingNumber:20031210001637)governingmanyoftheuseanddevelopmentstandardsintheUCzonesunsettedonDecember31,2020;andWHEREAS,withoutsaiddevelopmentagreementthereareinsufficientzoningcontrolsfornewdevelopmentintheUCzone,ascomparedtothezoningcontrolsofothercommercial zonesintheCity,therebylimitingtheCity’sabilitytofurthertheaforementionedpolicyandpurposeofthezone;andWHEREAS,onJanuary25,2021theCityCouncilpassedOrdinanceNo.6012afterdeterminingtherewasaneedforinterimzoningcontrolsfortheUrbanCenter(UC)zone;andWHEREAS,CitystaffhaveinitiatedaworkprogramtoupdateUCzonedevelopmentstandardsbutadditionaltimeisnecessarytocompletesaidworkprogram;andWHEREAS,theCityCouncilheldapublichearingonJuly19,2021,toconsideranextensionoftheinterimzoningcontrolsestablishedinOrdinanceNo.6012;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthisinterimzoningcontrolordinanceadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.TheinterimzoningcontrolsimposedbyOrdinanceNo.6012areherebyextendedandshallremainineffectuntilOctober31,2021,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.SECTIONIII.ApublichearingwasheldonJuly19,2021.SECTIONIV.IfanySection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyotherSection,subsection,sentence,clause,phraseorwordofthisordinance.2 SECTIONV.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis19thdayofJuly,2021.Jaso&kAPPROVEDBYTHEMAYORthis19thdayofJuly,2021.Approvedastoform:ShaneMoloney,CityAttorneyDateofPublication:7/22/2021(Summary)ORD:2157:7/13/2021Mayor3
