LUA-98-022, SHPL) Dear Mr. Kupferer: I have received your request to vary from the setback requirements of the Residential - Multi- Family - Infill Zone (RM-I). The setbacks shown on the plot plan meet or exceed development standards of the RM-I Zone. It appears that instead of a setback variance,you intended to seek a modification from Section 4-4-080F.8.a.i of the Parking and Loading Ordinance which establishes the minimum permitted length of a standard parking stall. Standard parking stalls are required to be a minimum length of 20 feet. For the proposed duplex, four(4)off-street parking stalls would be provided, two parking spaces in garages, and two parking stalls on the driveway apron. Tandem parking is permitted for duplex units. The proposed driveway apron is shown as 18 feet deep from the property boundary to the duplex building. Therefore, we believe that you are requesting to be permitted to provide parking on an 18-foot long driveway apron, instead of the required 20-foot long apron. The report and decision pertaining to your request follows. Summary of Request The applicant seeks approval of an 18-foot long parking stall to be located on the driveway apron for a proposed duplex structure. Background The Parking and Loading Ordinance requires that duplex residential structures provide 2 parking stalls per dwelling unit. Tandem parking is allowed. Section 4-4-080:F.8.a.i. states that the permitted length of a parking stall is 20 feet. Under a separate Code Section (4-4-080:F.8.b.i) compact stalls are required to be 8-1/2 feet wide by 16 feet long. Modifications from the Parking and Loading Ordinance may be granted by the Department Administrator when findings are made that a specific reason makes the strict letter of the Code impractical, and that the modification is in conformity with the intent and purpose of the Code, and that such modification will: a) meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment; and, b) will not be injurious to other property(s) in the vicinity; and c) conforms to the intent and purpose of the Code; and H:\DIVISION.S\DEVELOP.SER\DEV&PLAN.INGUTH\KPFR.DOC 1055 South Grady Way-Renton,Washington 98055 . r Page 2 April 9, 1999 d) can be shown to be justified and required for the use and situation intended; and e) will not create adverse impacts to other properties in the vicinity. Analysis The reduced parking apron length would function to provide safe off-street parking, without compromising protection of the environment, or the ability of the applicant to maintain the site. While the proposed parking stall would be two feet shorter than required by Code, the 18-foot length is sufficient to park a vehicle,thus conforming to the intent of the Code. And,recently, other jurisdictions, including King County,have reduced the length for standard parking stalls to 18 feet. No adverse impacts to other properties are anticipated as a result of approval of a reduction of two feet to the driveway apron. The subject site is located at the corner of Sunset Boulevard NE and NE 10th Street. Reduction of the driveway apron on the NE 10th Street yard is proposed to enable the applicant to increase the sideyard setback from 5 feet(minimum requirement in the RM-I Zone)to 7 feet along the north property boundary. An increase in the sideyard setback gained from the reduction of the apron length would provide an additional separation between the proposed duplex and a duplex being developed on the adjoining parcel. Two off-street parking stalls per duplex unit would be provided consistent with the Parking and Loading Ordinance. Furthermore, reduction of the driveway apron area would reduce the impervious surface on the site by approximately 40 square feet. Decision The request to reduce the driveway parking apron in front of the garage accessed from NE 10th • Street is approved. All of these items discussed below need to be completed. Please use this letter as a check list to keep your project moving smoothly through the City procedures. The comments are directed to the engineer and or surveyor of this short plat. Short Plat Drawing Concerns: Addressing for the proposed lots is as follows: Lot 1: 1008 Sunset Blvd. NE; Lot 2: 2200 NE 10th St.; and Lot 3: 2204 NE 10th St. Show these addresses on the drawing. Note on the drawing the recording number for the sewer easement and to whom the easement is granted. According to the title report the sewer easement affects the north 5 feet of the whole site not just across new Lot 1 . On the drawing also note the indeterminate water pipeline easement (with recording number). There are two problems with the legal description in the title report that are transcribed to the short plat document. First the call to "said point" when no point is previously defined. Also, the second to last call in the legal description does not give the direction of the call. This item needs to be discussed and resolved with the title company and the decision shown both in the title report and on the short plat drawing. Since there is to be a dedication of a portion of the subject property for right-of-way purposes, a Deed of Dedication document is required. The City Council approves right-of- way dedications and therefore require a separate instrument. The note that alludes to the dedication per recording of the short plat needs to be modified to reflect the separately recorded instrument including recording number. An example of a callout on the face of the short plat drawing is 'Dedicated to the City of Renton under King County Recording No. .' The instrument should be recorded concurrently with the short plat as discussed in the next paragraph. A deed of dedication document is enclosed for your surveyor's convenience. Fees: The Park's Mitigation Fee of $354.51 per unit shall be paid prior to the recording of the short plat. The Fire Mitigation Fee of $488 per duplex structure shall be paid prior to the recording of the short plat. Project Description/Background The applicant, Larry Kupferer has proposed to subdivide and existing 14,370 square foot parcel into three lots. Each lot would be developed by the applicant with a duplex (two-unit) structure. The size of the new parcels would be as follows: Lot 1 - 4,270 square feet, Lot 2 - 5,090 square feet, and Lot 3 - 5,000 square feet. Lot 1 and 2 would have frontage on Sunset Boulevard NE. The sideyard area for Lot 2 would be on NE 10th Street, and Lot 3 would front on NE 10th Street. Access to Lot 1 would be from Sunset Boulevard NE, with a full turnaround so that cars would not back out onto Sunset. Access to Lot 2 and 3 would be from NE 10th Street. The subject parcel is zoned Residential - Multi-Family - Infill (RM-I). This zone is intended to provide and protect suitable environments for multi-family dwellings, and to promote uses that are compatible with a multi- family environment. The RM-I zoning permits densities of from 10 du/acre to 20 du/acre. Duplex, triplex, fourplex and multiple family dwellings are permitted. As proposed, the development would have a density of 18.2 du/ac. Lots that are created in this zone must meet development standards for width, depth, height, lot coverage, and setbacks. Lot width must be a minimum of 50 feet, while the minimum depth requirement is 65 feet. Each of the lots meet the minimum width and depth requirements. Structure height is limited to 2- 1/2 stories or 35 feet. Lot coverage is limited to 35%. The required setbacks for the front and rear yards is 20 feet, while the side yard setback is established based on lot width. For the proposal, the corner lot is required to have a 20 feet side yard setback from the corner, all interior setbacks must be a minimum of 5 feet in width. Environmental Review Short plats are exempt from environmental review, unless sensitive areas are present on site. This proposal is not subject to environmental review. 3. Compliance with ERC Conditions Not applicable. The short plat is exempt from environmental review. 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The proposal is consistent with the following Land Use Element and Housing Element objectives and policies: LU-64 provides for densities of between 10 and 20 du/acre. As proposed, the development would result in a density of 18.2 du/ac. LU-65 seeks compatibility between new development and existing multi-family development in the Residential Multi-Family- Infill, in terms of size, scale, bulk, use and design. LU-69 discusses the need for using land within the RM-I designation efficiently, as the land use designation should not be expanded. The proposal would achieve a density close to the upper limit of the allowable density; at 18.2 du/ac it would be within the allowable 10 to 20 du/ac. Objective H-F discusses the need to provide market rate housing for the widest potential range of income groups. The proposal to construct duplexes would meet this Objective. Policy H-40 encourages innovative site planning to achieve density goals and reduce housing costs. The proposal would meet density goals while providing an alternative to traditional multi-family housing. b) Compliance with the Underlying Zoning Designation The RM-I allows multi-family residential dwellings as a permitted use, including duplexes. Lots created through the subdivision process must meet development standards for minimum width and depth. The minimum permitted width of the parcels is 50 feet, while the minimum permitted depth is 65 feet. Proposed Lot 1 would be a minimum of 50 feet in width by a minimum of 77 feet in depth. Lot 2 would be a minimum of 50 feet in width and 93 feet in depth. Parcel 3 would be 50 feet in width and 100 feet in depth. Lot coverage is limited to 35% unless increased to up to a maximum of 45% through approval by the Hearing Examiner. For Lot 1 at 4,270 s.f., the maximum building footprint would be 1,494 s.f.; for Lot 2 at 5,090 s.f., the maximum building footprint would be 1,781 s.f.; for Lot 3. In addition, the height of structures in the RM-I Zone is limited to 2-1/2 stories or 35 feet, unless increased an additional 10 feet through the Site Plan Review process. The side yard adjacent to a street for a corner lot, such as Lot 2, is required to be 20 feet. And the interior side yards for both interior lots and corner lots is required to be 5 feet. The applicant has demonstrated that the applicable setbacks can be achieved. c) Compliance with Subdivision Regulations Streets: No new streets would be created within the short plat. The existing public street network would provide access to the short plat. Access to Lot 1 would be from Sunset Boulevard NE, with a turnaround located entirely on the lot, and access to Lots 2 and 3 would be from NE 10th Street. The Subdivision Regulations require full street improvements (curbs, gutters, sidewalks, and street lighting) on all streets surrounding the short plat. The applicant applied to the Board of Public Works and on April 8, 1998 was granted a deferral for the installation of the required street improvements. Blocks: No new blocks would be created by the proposal. Lots: Side lot lines would be at right angles to street lines, and each lot would have access to a public street, in conformance with Section 9-12-19A. All lot corners at intersections of dedicated public rights-of-way, except alleys, shall have a minimum radius of 15 feet (Section 9-12-19C). This requirement affects Lot 2 of the proposal. The 15-foot radius will need to be demonstrated by the applicant, and any required dedication would need to occur prior to recording of the short plat. The dedication of the corner for the public street system would reduce the size of Lot 2, and affect the lot coverage figure noted in 5.b) above. The applicant's engineer will need to calculate and depict the required radius for the intersection of Sunset Boulevard NE and NE 10th Street prior to recording of the plat. d) Reasonableness of Proposed Boundaries Access: Each of the proposed parcels would have access to a public street. Lot 1 would access from Sunset Boulevard NE, while Lots 2 and 3 would access from NE 10th Street. Topography: According to the applicant, the site slopes gradually from east to west. There is an elevation difference of approximately 9 feet across the site, with general slopes of about 6%. The steepest slopes are approximately 9% and are located at the east edge of the property. Relationship to Existing Uses: e) Availability and Impact on Public Services(Timeliness) Police and Fire: Renton Police and Fire Departments would provide emergency response and service to the proposed units. The proposal would have minimal impact on Renton Police Department. A Fire Mitigation Fee in the amount of$488 per new duplex structure ($488 x 3 structures= $1,464.00)would be required to be paid prior to recording of the short plat or prior to the issuance of building permits, whichever occurs first. Recreation: The development of three residential parcels with one duplex unit on each parcel would result in impacts to the City's Park and Recreation facilities. The applicant would be required to pay the applicable Parks Mitigation Fee of$354.51 per residential unit (6 units x $354.51 = $2,127.06) prior to recording of the short plat or prior to the issuance of building permits, whichever occurs first. Schools: The addition of three residential lots with six residential housing units would not be expected to adversely impact Renton School District facilities. The project site is located within the Renton School District. Storm Water: Existing stormwater facilities exist in NE 10th Street, and a catch basin is located at the corner of NE 10th Street and Sunset Boulevard NE. Water and Sanitary Sewer Utilities: A 6-inch water main is located in NE 10th Street. An 8- inch sanitary main is located in NE 10th Street. Transportation Network: The addition of six residential units would impact the existing street network. As such, proposals for the subdivision of land are subject to a Transportation Mitigation Fee. The fee is equivalent to$75 per each new average weekday trip, and the traffic volume is calculated based on application of the Institute of Transportation Engineers (ITE) Manual. For the three-lot proposal, and in anticipation of the development of six units in three duplex structures, the fee is estimated to be $2,911.50 ($75 x 6.47 trips x 6 units= $2,911.50). The Traffic Mitigation Fee is due prior to recording of the plat or prior to the issuance of building permits, whichever occurs first. H. The site is not located in the Aquifer Protection Zone. 6. The site is located in the 435 Pressure Zone. 7. There is an existing 6-inch water main in NE 10th Street. 8. A Water System Development Charge of$510 per residential unit is required for the project. The SDC fee is collected either as part of the construction permit (if there is one), or prior to the recording of the short plat. Plan Review--Stormwater 9. The storm drainage report has been reviewed and appears to be in order. 10. The Surface Water System Development Charge fee that applies to the proposal is$0.129 per square foot of new impervious surface (but not less than $385). Plan Review-Transportation 11. The maximum duplex driveway approach allowed by Code is 20 feet. 12. Curb, gutters and sidewalks are required along Sunset Boulevard NE and NE 10th Street adjacent to the project site. 13. Street lighting is required for this project along both adjacent streets. 14. The project is required to underground the power along the frontage of the parcel being developed. 15. A Traffic Mitigation Fee of$75 per each new average weekday trip is required to be paid prior to recording of the short plat or prior to the issuance of the building permits, whichever occurs first. The fee is estimated to be $2,911.50. Parks 16. A Parks Mitigation Fee would apply to the proposal. The fee is calculated based on the number of multi-family residential units x$354.51. The fee is estimated to be $2,126.46 and is due prior to the recording of the short plat, or prior to the issuance of building permits, whichever occurs first. Planning 17. The Subdivision Ordinance (Section 9-12-19:C) requires that all lot corners at intersections of dedicated public rights-of-way, except alleys, shall have a minimum radius of 15 feet. The applicant will need to revise the short plat to show how this Code requirement is met. Intent of the Comprehensive Plan land use designation The site is designated Residential Multifamily Infill (RM-I) in the Comprehensive Plan. The designation is intended to "encourage the development of infill parcels in existing multi-family districts with compatible projects". (Objective LU-L) The proposed multi-family use is appropriate to the designation. 2. Consistency with the Comprehensive Plan The proposal appears to be consistent with the following RM-I policies. Policy LU-64. Development density should generally be in the range of 10-20 dwelling units per acre. At about 18.2 units per acre,the proposal is consistent with the density guidelines for gross area. Policy LU-65. New development in Residential Multi family Infill designations should be compatible in size, scale, bulk, use, and design with other existing multi-family developments. Policy LU-67. Siting and design of new structures should be sensitive to site constraints and adjacent uses. Provision of adequate buffers or setbacks or scaling down building heights may be required to transition from Residential Multi-family infill designations to adjacent lower density uses. Adjacent areas are exclusively RM-I. Therefore, no provisions for a transition would be required. Policy LU-69. Residential Multi family Infill designations should not be expanded. Land within the districts should be used efficiently to meet multi-family housing needs. Additionally,the proposal is supported by the following Housing Element Objective and Policy. Objective H-F: Provide market rate housing for the widest potential range of income groups through the private sector including moderate income households. Policy H-40. KUPFERER SHORT PLAT PROJECT NARRATIVE The project site is zoned Residential Multi-Family Infill (RM-I). The neighborhood surrounding the site is also zoned RM-I and it is largely developed with multi-family residential development. Most of the immediate surroundings are developed at higher residential densities than the subject proposal. The Kupferer Short Plat site is a total 14,370 square feet. The proposal is to create 3 lots. I plan to construct a duplex on each of the lots. However, the construction will be phased and at this point the proposal is only to short plat the lot. The proposed lot sizes are as follows: Lot 1 - 4,270 sq. ft. Lot 2 - 5,090 sq. ft. Lot 3 - 5,000 sq. ft. Yard setbacks and the area available for building is shown for each of the lots. The site is presently undeveloped. It is vegetated with scattered alder trees, black locust trees and several cedar trees with an understory dominated by blackberries. The site slopes gradually and steadily from east to west. There is an elevation difference of approximately 9 feet across the site, with general slopes of about 6%. The steepest slopes are approximately 9% at the east edge of the property. Access to Lots 2 and 3 is proposed off NE 10th Street. Each lot is proposed with a separate driveway to maximize the yard areas. Lot 1 is to be accessed off Sunset Boulevard NE. In order to minimize any potential traffic hazard there will be a full turnaround provided on Lot 1 so cars will not back out onto the street. In addition, I can provide signs to limit turns to a right turn out only. Sunset Boulevard NE is not a busy arterial until further north where it intersects with the freeway access. The proposed access will be safe from a sight distance and traffic safety perspective. The private, separate driveway accesses that I am proposing are essential to maintaining some open space yard areas for each of the lots, and it is the best configuration for promoting privacy and an appearance of lower density development. There are no existing sidewalks, curbs or gutters along the street frontages of NE 10th Street or Sunset Boulevard NE in the vicinity of the site. BACKGROUND I'he project site is located in the Highlands area of Renton at the intersection of Sunset Boulevard NE and NE 10th Street. The property is in the NE Quarter of Section 8, Township 23 North, Lange 5 East, W.M. The parcel size is 14,370 square feet. The site is presently undeveloped. The short plat will create 3 new lots on the parcel. Future construction plans are to build one c uplex on each lot. 71e subject site is outside City of Renton Aquifer Protection Areas. Domestic water and sanitary sewer are available to the lot. EXISTING CONDITIONS 'lie existing soil type is classified as an Indianola (Ic) series by the the United States Department of Agriculture. Soil Conservation Service in the "King County Soil Survu". This soil tv,ne is characterized as a fine sandy loam, with rapid permeaaifflty. 1n(Tiano1a soils are clasO:led Into Hydrologic Group "A", having a high rate of water transmission. The topography of the site slopes gradually from east to west. There is an elevation difference of approximately 9 feet across the site, with general slopes of about 6%. The steepest slopes are ,approximately 9% at the east edge of the property. The site is vegetated with scattered alder, black ocust, and a few cedar trees with an understory dominated by blackberries. STORM DRAINAGE EVALUATION Drring a field inspection of the site there were no indications of water courses, standing water, or flc oding. Existing runoff patterns are dispersed and there are no signs of significant drainage patterns or scouring of channels, ruts, or surface erosion on the site. The permeability of the soils is capable of absorbing the surface runoff. Storm water facilities exist in NE 10th Street and a catch basin is located at the corner of NE 10th Street and Sunset Boulevard NE. The storm system downstream of the site is a pipe and catch ksin system in good repair. There is no evidence of flooding, erosion, or overtopping in the sy stem. Aster approval of the short plat, it is anticipated that a duplex unit will be constructed on each of the new lots. Lot improvements will consist of the structures and driveways. The permeability of the soils and the low amount of impervious lot coverage from the residences and driveways will al ow lot infiltration systems on each parcel. It is anticipated that the infiltration capability of the sc ils will allow the site improvements to be installed without exceeding the 0.5 cfs threshold for the 100 year/24 hour design storm. If infiltration is not sufficient, storm water will be collected and tI en piped to the existing storm water facilities in NE 10th Street. Water quality treatment of nnoff or biofiltration is not anticipated because the project will create less than 5,000 square feet a'impervious surface used by vehicles. S orm drainage improvements for the development will be provided as required by the 1990 King County Surface Water Design Manual, as adopted by the City of Renton.
