HomeMy WebLinkAboutLUA98-027 CITY OF RENTON PLANNINGBUILDING/PUBLIC WORKS MEMORANDUM DATE: April 17, 1998 TO: Peter Rosen FROM: Bob Mac Onie T SUBJECT: Oakesdale Business Park Lot Line Adjustment, LUA-98-027-LLA Legal Lot Documentation On April 15, 1998, Mr. Jeff Chalfant of Barghausen Consulting Engineering, Inc. presented Technical Services with legal descriptions and other documents establishing the legal status of lots noted as `I', `J' and 'N' on the subject lot line adjustment submittal. Attached for your file are copies of the documentation. Please inform the applicant that the city's concerns regarding the legality of the lots are no longer an issue. They should proceed with addressing the other items noted in our review memo dated March 16, 1998. There are, however, two other items relating to the depiction of the lots which still need to be addressed. First,the drawing shows a line across Lot"J"in the same weight and line type as the other original lot lines. There is no documentation to support the existence of this line and nothing on the lot line adjustment document itself to explain it; see the highlighted line on one of the attached pages. The second item concerns the northerly right of way margin of SW 43rd Street. The drawing shows a uniform right of way width for SW 43rd Street. City records indicate that the width of said street is not uniform. Pursuant to my conversation with Bob Mac Onie, for a lot to be determined as a legal lot, it must be created through a recognized subdivision process or identified in a separate deed or conveyance. As a result, the following documentation establishes the legal lot status of existing Lots H, I, J, and N, and is enclosed for your review: 1. Existing Lot N is established by a deed dated June 4, 1947 (King County Recording No. 3692816). 2. Existing Lot J is established by a deed dated November 8, 1923 (King County Recording No. 1798903). 3. Lots H and I are described as one parcel in a deed dated January 25, 1941 (King County Recording No. 3142872). 4. Existing Lot I is described in a deed dated December 7, 1965, excepting out existing Lot H (King County Recording No. 5961940). Although a separate deed describing the existing Lot H has not been located, individual legal descriptions for all of the surrounding parcels have been identified, excepting out Lot H. After reviewing the documentation presented to us by Jeff, we determined that the concerns we had regarding the legality of the lots were no longer an issue. The lots were found to have been separately conveyed in the past, and therefore were legal lots. A memo was sent to you on April 17, 1998, asking that you inform the applicant of this decision. City records do not indicate that more than one lot exists. If there is only one legal lot,then this subdivision needs to be submitted as a short plat. The drawing submittal does not include a 40' X 60' portion of the property lying northerly of the drainage ditch center line, adjoining "Adjusted Parcel N" (sheet 2 of 3).
