Project Description/Background: The Waste Water Utility Section of the City of Renton operates a lift station on the local sewer main at the Devil's Elbow. This lift station is necessary due to the topography of the surrounding neighborhood. The pump that is part of the lift station is electrically operated and normally is supplied from the local Puget Sound Energy lines. In the event of a power failure to this section of the City, the Waste Water Utility would still need to operate the lift station at the Devil's Elbow. If the lift station was to stop operating raw sewage would quickly overflow the holding tank, that is part of the lift station, and spill into Honey Creek. In order to prevent this from happening, the Utility would like to build a structure to house an electrical generator that would be used in the event of a power failure. The Waste Water Utility section has negotiated with a land owner in close proximity to the lift station to use a vacant parcel of land for the generator building. This lot has remained vacant due to the steep slope at the rear of the lot. The soils engineer hired by the City of Renton has recommended that a setback from the top of the slope of 20 feet be maintained. This moves the building forward on the lot to a point where the front of the building will extend into the front yard setback area by ten feet. It is not possible to move the building back on this site without disturbing the 20 foot wide setback from the top of the slope established by the engineer. STAFFRPT.DOC/ Administrative Variance LUA-97-023 FINDINGS, CONCLUSIONS & DECISION Having reviewed the written record in the matter, the City now makes and enters the following: D. Findings 1) Request: The Applicant, City of Renton, Waste Water Utility Section, has requested approval for an Administrative Variance for property located on NE 24th Street. 2) Administrative Variance: The applicant's administrative variance application complies with the requirements for information for a variance. The applicant's site plan and other project drawings are entered as Exhibits No. 1 thru 2. 3) Existing Land Use: Land uses surrounding the subject site include: North: Vacant; South: Single Family Residential; East. Single Family Residential; and West: Single Family Residential. 4) CONSISTENCY WITH VARIANCE CRITERIA Section 4-31-19F.3. lists 4 criteria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Zoning Administrator shall have authority to grant an administrative variance upon making a determination, in writing,that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant does suffer an undue hardship in that when the lot was platted it contained only a narrow strip of level land along the street and a steep slope (25% to 40+%) at the rear of the site. Honey Creek is located at the bottom of the slope. The applicant, due to existing City Ordinances and the presence of the Creek, can not fill in anymore of the site to create a suitable building pad. An engineer hired to review the site has reported that the proposed structure must be located a minimum of 20 feet from the top of the slope. If the building were to be located closer to the top of the slope, the building could adversely impact the stability of the slope. This required setback requires that the building be located in a manner that the building extends 10 feet into the front yard setback. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The granting of the variance will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity of the proposed project. The proposed structure will be constructed to blend in with the adjacent single family homes along the street frontage. The location of the structure was selected so that it will not block the view of vehicular or pedestrian traffic on the adjacent street. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The granting of this variance will not constitute a grant of special privilege. The lot was platted for the construction of a single family home. If someone purchased this lot for a single family residence they would be subject to the same setback requirement from the top of slope. They would need to apply for the same or a greater variance from the front yard setback requirement as established in the R-8 zone. STAFFRPT.DOC/ Administrative Variance LUA-97-023 d. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: This is the minimum variance to allow for the construction of the garage on the proposed site. The building must be located as proposed to allow the truck-generator unit to be backed into the garage. If the garage was turned in the opposite direction it would not extend into the front yard setback as far as proposed but it would not be possible to put the generator into the structure. Therefore, the garage structure must be located as proposed. E. Conclusions The variance request is justified as proposed as the applicant has an undue hardship, the steep slope at the rear of the subject property, and the applicant has requested the minimum variance necessary in order to locate the emergency generator at this site. To provide an acceptable level of safety for a proposed emergency generator building, the City's engineering consultant has suggested that the new structure be setback a minimum of 20 feet from the top of the existing slope. If the building is setback 20 feet from the top of the bank, then the front of the structure would be 10 feet from the right-of-way and approximately 13 feet from the existing sidewalk. The City is therefore seeking a reduction in the frontage setback requirements from 20 feet to 10 feet. The future emergency generator building is proposed to be located on Lot 8 of Aloha Ranch No. 2. This lot is at the end of a cul-de-sac in the 2700 block of NE 24th St. The size of the lot is 9200 square feet, with approximately 6700 square feet located on a steep slope. The site is currently vacant. Due to the steep slope which covers most of the property, this lot is the only one which is undeveloped in the plat. The City of Renton (applicant) proposes to construct an emergency generator building on the subject lot. This building will house a portable generator and provide electrical connection to provide temporary emergency power to the Devil's Elbow Lift Station during power outages. This emergency power will allow the lift station to continue operation during power outages which will decrease the potential for sewage overflows that would drain to Honey Creek. The location for the emergency generator building was chosen to provide quick and easy access for maintenance crews to provide the lift station with power. Typically, the emergency connection for a City lift station is located on the lift station structure. However, since the Devil's Elbow lift station is located at the bottom of a ravine near Honey Creek, and the access road to it is prone to blockages by falling trees during high winds and/or heavy rains, utilizing the proposed site for connecting emergency power would be quicker and much safer for City maintenance personnel. The proposed structure will be a 12 foot by 18 foot wooden building on a concrete slab and resemble a single-story, single car garage. The new building will be constructed to match the current style of the neighborhood. The building will also be constructed with a system to muffle the noise of the emergency generator.
