The City of Renton's subdivision ordinance does not have a process for modifications to a short plat. Recently, the City passed a revision to the subdivision ordinance covering modifications to preliminary plats. This is perhaps our best guideline for making decisions regarding modifications for short plats. The ordinance describes what may be considered minor modifications and, therefore, not requiring a whole new process. One of the criteria for a minor modification is that no additional lots are to be created. Your proposal is to create an additional lot(three lots instead of two.) Expanding a short plat from two lots to three lots cannot be considered a minor modification. Therefore, in order for the City to process such a change, we will need to go through the short plat process over again. Grady Pr Way - Renton, Washington 98055 +��' RE: Renton Village Short Plat LUA 98-029 • Dear Mr. Hansen: The purpose of this letter is to request approval to a minor modification of the above referenced short plat, conditionally approved by City of Renton. The following discussion will explain the basis for our request and the reasons we believe our request represents a minor modification of the short plat. The only change requested is a division of Lot C2. The perimeter boundary of Lot C1 remains unchanged. The perimeter boundary of Lot C2 remains unchanged, although we request dividing the parcel about in half — a change necessitated by our proposed ground lease with Motel 6. Lot C1 is entirely self sufficient in terms of access and parking. There is no impact on the short plat application previously submitted. Undeveloped Lot C2 and the resulting undeveloped Lot C3 will each be self sufficient in terms of parking and each lot will have the same access to private and public roadways that otherwise exists on the original Lot C, prior to the short plat. A copy of the access easement is attached to this letter. Background Renton Village Shopping Center (Lot C — 609,960 SF) has always had two separate identities —the developed shopping center property and undeveloped land. The primary purpose of the short plat, at the date of filing, was to segregate development land from the shopping center when the property was re-financed. Development of the excess land would be greatly facilitated if the development land were not pledged as security under a loan. We were fortunate in completing a re-finance of the property in September 1998, and succeeded in removing the development land as security under the loan. The lots subject of the short plat were identified in the Master Application as Lots C1 and C2. The boundary of Lot C1 was established so that the shopping center, would be self sufficient in terms of parking. In fact, Lot C1 has about 50 stalls excess parking. Boundary of the remainder, Lot C2, was configured to facilitate access through the 15 January 1999 Mr. James C. Hansen Page 2 property and be large enough to accommodate several different retail and hospitality users. The Master Application was submitted and approved by City of Renton, subject to the following conditions: • Construction of the remaining portion of the sidewalk along proposed Lot C1 and C2 frontages with S. Grady Way • Recording of reciprocal easements in favor of Lots C1 and C2, 'permitting access to the adjoining public and private roads • Recording of an easement relating to water line revisions at the shopping center in 1993. Lot Sizes, Site Coverage, Parking and Other Improvements — Original Short Plat The original short plat proposed segregated Parcel C of Renton Lot Line Adjustment 001-88 into Parcel C1 and Parcel C2. According to the survey earlier provided, Parcel C1 was to have an area of approximately 9.5 acres, or 413,820 SF. Parcel C2 was to have 196,140 SF, or 4.50 acres. Site Coverage - Parcel C1 site coverage is 22%, well within the zoning allowance of 65% (buildings only). Parcel C2 is unimproved —site coverage currently is 0% Parking for parcel Cl (improved shopping center parcel) is specified in the City's Parking and Loading Ordinance at 4 stalls per 1,000 SF of building area. Using this baseline and an improved usable area of 91,204 SF, required parking is as follows: 91,204 SF/ 1,000 SF x 4 Stalls = 365 Parking Stalls A physical count of currently striped parking stalls on both Parcels C1 and C2 indicates 487 stalls are provided. Parking within the boundaries of Parcel C1 is as follows: Required Parking — 365 stalls Available Parking — 417 stalls Excess Parking — 52 stalls Parking for Unimproved Parcel C2 was not specific at the time of original application, as no specific development plan was submitted with the original short plat application. A major portion of the site is paved and 86 parking stalls are striped. The stalls on Parcel C2 are used by the shopping center and cinema patrons under existing reciprocal parking agreements. Reciprocal parking agreements are of record between the Evergreen Office Building, the cinema, shopping center and Holiday Inn properties. Concrete sidewalks have now been constructed by Renton Village Associates along the entire frontage of Parcel C1 and Parcel C2 along S. Grady Way. Hansen Page 3 Request for Modification of Short Plat Shortly after the short plat was conditionally approved by City of Renton, we were approached by Motel 6 regarding a long term ground lease at Renton Village Shopping Center. The lot requested for ground lease was a portion of the shopping center development land and a portion of Lot C2, identified in our original short plat Master Application. Hansen Page 5 • Summary We believe the request herein, represents a minor modification to City of Renton Short Plat LUA 98-029. The shopping center parcel (Lot C1) is unchanged. The parcel is entitled with the same access and parking both before and after the modification requested. Lot C2 is the Motel 6 proposed ground lease. Other than lot area, no change is planned and development of the site will be governed the City of Renton site plan and building plan approval process. This site will be entitled with access to both signalized intersections with S. Grady and S. Renton Village Place. Lot C3, has exactly the same site characteristics as C2. This site will be entitled with access to both signalized intersections with S. Grady and S. Renton Village Place. Any subsequent development of this site will be governed by the City of Renton site plan and building plan approval process. E5 _El ti RECIPROCAL EASEMENT AGREEMENT This Reciprocal Easement Agreement is dated as of , 199_ by RVA CENTER _ LLC, a Washington limited liability company (the "Declarant") to establish the joint rights set forth below. RECITALS A. Declarant is the owner of that certain real property described on Exhibit A attached hereto and incorporated here and by this reference (the "Shopping Center Parcel"). Declarant has submitted to the City of Renton an application for a short plat providing for the subdivision of the Shopping Center Parcel into three (3) separate legal parcels, more particularly described on Exhibit B attached hereto as "Parcel C-1", "Parcel C-2" and "Parcel C-3 ". B. As a condition to the approval of such short plat, approved by the City of Renton as short plat no. , recorded contemporaneously herewith under King County Recording No. , Declarant has agreed to provide for certain reciprocal easement rights as more particularly set forth in this Agreement. C. Declarant further desires to provide for the continued maintenance of certain common areas within the Shopping Center Parcel and for the reimbursement of the owner of Parcel C-1 for certain costs of such maintenance. NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Declarant hereby declares, conveys, and establishes the following: 1. Vehicular Ingress and Egress to South Renton Village Place. Declarant hereby declares and establishes for the benefit of Parcels C-2 and C-3 a nonexclusive easement for vehicular ingress and egress between South Renton Village Place and the easterly boundary of lot C-2 over that property more particularly described on Exhibit C attached hereto and incorporated here and by this reference (the "South Renton Village Access Easement"). 2. Vehicular Ingress and Egress to South Grady Way. Declarant hereby declares and establishes for the benefit of Parcels C-2 and C-3 a nonexclusive easement for vehicular ingress and egress between South Renton Village Place and the easterly boundary of lot C-2 over that property more particularly described on Exhibit D attached hereto and incorporated here and by this reference (the "Grady Way Access Easement"). 3. Vehicular Ingress and Egress - East-West Driveway. Declarant hereby declares, establishes and conveys for the joint and mutual benefit of Parcels C-1, C-2 and C-3 a nonexclusive easement for vehicular ingress and egress over that property more particularly described on Exhibit E attached hereto and incorporated here and by this reference (the "East- West Driveway"). 1720\037.1/11/99 -1- REC1P EASEMENT.AG2 JMASON\SANDORFF\MOTEL6 4. Maintenance. a. The Center. The Shopping Center Parcel is a portion of a larger parcel of property _ developed as an integrated mixed-use office, retail and theater development legally described on Exhibit F attached hereto (the "Center"). The owner of Parcel C-1 (the "C-1 Owner") shall operate and keep and maintain in good condition and repair the common areas of the Center, including without limitation roadways and the easements established hereunder, the parking lots, drive aisles (including paving, curbing and striping), common area lighting, and common area landscaping, but excluding common areas on Parcel C-2. Landlord shall maintain the common areas in a neat and clean condition in compliance with all applicable governmental laws, regulations and other requirements. For purposes of this Agreement, "common areas" shall mean all those portions of the Center now and hereafter designated for nonexclusive use for the owners of the parcels within the Center, their tenants, customers, business invitees, licensees and employees. "Common areas" shall not include any portion of Parcel C-2 except that portion of Parcel C-2 within the East-West Driveway. Also for purposes of this Agreement, an "owner" shall mean the fee owner of a Parcel or the owner of a leasehold estate in an entire Parcel. • b. Reimbursement. The owners of Parcel C-2 and C-3 shall each reimburse the C-1 Owner for a portion .of the Common Area Costs (defined below) equal to a fraction, the numerator of which is equal to the ground floor area of the building constructed on the Parcel, and the denominator of which is the gross leasable area of all space (including the Parcel) in the Center. For purposes of this.Section 4, "Common Area Costs" shall mean all costs of operating and maintaining the common areas in a manner deemed by the C-1 Owner to be appropriate for the best interests of the tenants and other occupants of the Center, which shall include, but may not be limited to, all costs and expenses of protecting, operating, repairing, repaving, lighting, cleaning, painting, stripping, insuring, removing of snow and ice debris, police protection, security and security patrol, fire protection, traffic regulation, inspecting, repairing and maintaining of machinery and equipment used in the operation of the Common Areas, and administrative and overhead costs equal to 15% of Common Area Costs (excluding real estate taxes and insurance). On January 1st of each year, the foregoing ratio shall be adjusted to reflect any changes in gross leasable area within the Center. c. Payment. Each owner's share of Common Area Costs shall be paid to the C-1 owner in monthly installments.on the first day of each calendar month. Payments for any partial year shall be apportioned pro rata on a calendar year basis. Within sixty (60) days after the end of each calendar year, the actual Common Area Costs shall be calculated by the C-1 Owner, and the other owners' shares paid for that period shall be immediately adjusted by refund of any excess, or payment of any deficiency. d. Failure to Maintain. If the C-1 Owner fails to undertake and complete all necessary maintenance or repairs as required hereunder within thirty (30) days after written request [or such longer period if the repair cannot be reasonably completed within the thirty (30) day period and the C-1 Owner promptly commences and is diligently pursuing completion of such repair] (except in the event of an emergency, in which event no more than twenty-four (24) hours notice shall be required), another owner shall have the right to undertake and complete 1720\037:1/I1/99 -2- RECIP EASEMENT.AG2 JMASON\SANDORFF\MOTEL6 such repairs at the C-1 Owner's expense. The C-1 Owner shall be responsible for payment of all costs and expenses incurred by an owner in connection with the exercise of its rights under this section. The C-1 Owner shall have thirty (30) days from receipt of said invoice(s) for such costs - to make payment in full. 5. Reasonable Regulation: No Obstructions or Hazards. The rights established hereunder shall be exercised reasonably and subject to reasonable rules and regulations adopted by the owners of the Parcels. No owner shall cause or allow to be caused any obstructions or hazards within the easement areas. No owner shall install or place any improvements, signs or structures within the easement areas without the written consent of the other owners. 6. Amendment and Termination. This Declaration shall not be modified or amended except by written instrument signed by all record owners of the Shopping Center Property or any portion thereof, and shall automatically terminate on the date which is sixty (60) years for the date of the recording of this Declaration. 7. Successors and Assigns. This Declaration shall run with the Property and be binding upon and inure to the benefit of the Declarant and all tenants, heirs, successors and assigns of the Property or any portion thereof. The easements created and assigned under this Declaration are subject to all existing easements or matters of record affecting the Property or any portion thereof • 8. Attorneys' Fees. In the event of any legal action or proceeding brought by and party entitled to enforce any part of this Declaration, the prevailing party shall be entitled to reimbursement for all costs and reasonable attorneys' fees incurred, including any costs and fees incurred on appeal. 9. No Merger. This Declaration and the easement created hereby shall not be extinguished based upon title to the Shopping Center Property, or any portion thereof, and the Parcels being vested now or in the future in the same party or parties. 10. Not-a Public Dedication. The Declarant reserves unto the C-1 Owner the right to erect, at least once in each calendar year (and more often if legally desirable), barriers or chains across any portion of the easements described herein for the purpose of prohibiting access, ingress or egress by the public in order to avoid the possibility of dedication for public use. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The subject site is located within the Employment Area - Commercial (EAC) Comprehensive Plan designation. Comprehensive Plan policies do not directly address lot sizes or the subdivision of property. The proposed short plat would not affect the coordinated development of the shopping center. b) Compliance with the Underlying Zoning Designation Lot Size/Dimensions: There are no lot size or lot dimension requirements in the Commercial Arterial (CA) zone. Lot Coverage: The maximum lot coverage for buildings is 65% of the total lot area. Lot C1 which is developed with the existing shopping center has a building coverage of approximately 22%. Setbacks: There is a minimum 10 foot front/street setback requirement. There are no rear or side yard setback requirements in the CA zone. The proposed short plat does not include additional construction or development and therefore the setback standards are inapplicable to the proposal. Landscaping: A 10 foot wide landscape strip is required along streets. This exists along the lot frontage of Lot C1 and would be required when development is proposed on Lot C2. Parking: The Parking Code requires a minimum of 4 and a maximum of 5 parking spaces per 1,000 square feet of gross leasable area for shopping centers. The existing shopping center development on Lot C1 includes 91,204 square feet of usable floor area. Therefore, the required parking is between 365 and 456 parking spaces. There are 417 existing parking stalls within the boundaries of Lot C1 which complies with parking code requirements for the shopping center. There are 86 parking stalls striped on Lot C2. The parking stalls on Lot C2 are used by the shopping center and cinema patrons. Reciprocal parking agreements are on record between the Evergreen Office Building, the cinema, shopping center, and Holiday Inn properties. c) Compliance with Subdivision Regulations Streets: Both parcels would have access off South Grady Way, a public street. South Renton Village Place is a public street along the south property line of Lot C1. Lot C2 would not have direct access to South Renton Village Place. No street extensions are required with the proposed short plat. The Subdivision Ordinance requires street improvements (curb, gutter, sidewalks) along the entire frontage of a property. The applicant should complete the concrete sidewalk along South Grady Way for the easterly portion of Lot C1. Improvements are required along the property frontage on South Renton Village Place. Required improvements may be waived or deferred by the Board of Public Works. Blocks: NA Lots: The proposed lots comply with lot standards of the Zoning Code and Subdivision Ordinance. d) Reasonableness of Proposed Boundaries Access: Both parcels abut and would have access off South Grady Way, a public street. The number and location of driveway cuts onto South Grady Way for access to Lot C2 will be determined at the time of a specific development application. South Renton Village Place borders the south property line of Lot C1. The public right-of-way does not extend to the proposed lot line for access to Lot C2. The application does not indicate whether there is a common access agreement between the proposed lots. Evidence of a common access agreement should be provided prior to recording the short plat. Topography: The entire site is essentially flat and surfaced with both asphalt and gravel. Relationship to Existing Uses: The subject site is surrounded by existing commercial and office development. The 10 foot sanitary sewer easement, recorded under King County Recording No. 6631804, which runs generally in a north-south direction westerly of the retail stores building, was partially released by the city under King County Recording No. 9406130334. This same information is apparently included is a reference on the drawing to"See Note 10". However, Special Exception #10 is in the title report. This will need to be made plain on the final short plat document. Nothing in city code requires metes and bounds legal descriptions for new lots on the face of short plat documents. PROJECT NARRATIVE Zoning Designation The shopping center site is currently zoned CA, Commercial Arterial. The site subject of the short plat is surfaced both with asphalt and gravel. Topography of the site is essentially flat, with minor changes in elevation to facilitate drainage. No steep slopes exist. The site subject of the short plat does not include wetlands. Current Use, Acreage and Existing Site Improvements Current use of the site is a neighborhood shopping center with undeveloped, excess land. Uses within the shopping center include: Grocery Drug store Personal services —dry cleaners, film processing, hair salon General retail use — coffee shop, restaurants, pet store, knitting supplies, clothing store, beauty supplies, electronic pagers, card shop Upon approval of the short plat, two sites will exist — a site improved with a 92,000± SF shopping center including all necessary parking and utilities, and an undeveloped site partially improved with asphalt paving. Acreage of the present shopping site is 14.00 acres and 609,960 SF according to King County Assessor's records. Following short plat of the site, the improved shopping center site will be approximately 9.52 acres (414,880 SF) and the undeveloped site will be 195,080 SF or 4.48 acres. Existing site improvements (Exhibit A) include the shopping center of 91,000± SF, supporting sub-surface utility systems, parking lot lighting and paving. The portion of the shopping center site to be sub-divided is currently improved only with asphalt paving. There are no current plans for development of the undeveloped land, although improvements envisioned will be in conformance with permitted uses under CA zoning. Purpose of the proposed short plat is administrative only — no alteration of existing shopping center building improvements is planned. Utilities Public and private sanitary sewer lines currently service the improved shopping center parcel and the unimproved parcel subject of this short plat. An 8" "looped" public water line serves the improved shopping center parcel and is within 25' of the unimproved parcel. Underground telephone and power also serve both parcels. Lot Sizes, Site Coverage, Parking and Other Improvements Lot sizes are shown on the attached survey. This short plat proposal will segregate Parcel C of Renton Lot Line Adjustment 001-88 into Parcel C1 and Parcel C2. According to the survey provided, Parcel C1 will have an area of approximately 9.5 acres, or 413,820 SF. Parcel C2 is 196,140 SF and 4.50 acres. Site Coverage - Parcel C1 site coverage is 22%, well within the zoning allowance of 65% (buildings only). Parcel C2 is unimproved —site coverage currently is 0% Parking for parcel Cl (improved shopping center parcel) is specified in the City's Parking and Loading Ordinance at 4 stalls per 1,000 SF of building area. A major portion of the site is, however paved and 86 parking stalls are striped. The stalls on Parcel C2 are used by the shopping center and cinema patrons under existing reciprocal parking agreements. Reciprocal parking agreements are of record between the Evergreen Office Building, the cinema, shopping center and Holiday Inn properties. Concrete sidewalks have been constructed by Renton Village Associates along the Parcel C2 frontage with S. Grady Way. Renton Village Associates also constructed concrete sidewalks along the Parcel C1 frontage with S. Grady Way, from the proposed Parcel C1 / Parcel C2 boundary, east to the primary shopping center entrance (vacated Shattuck Avenue S.) Private streets paved and maintained by Renton Village Associates provide convenient access between all properties at Renton Village, including the One, Two and Three Renton Place office complex and The Holiday Inn. All private streets are paved, 30 foot roadways. Fire control is constructed according to Current City of Renton code, including a "looped" system that was required for construction of the McDonald's restaurant in 1996/1997.
