Project Description/Background: The applicant, Charles Sharin, has applied for an administrative setback variance to allow a carport within the required five-foot (5') side yard setback area. The carport, which has already been constructed, is not set back from the north side yard property line. The existing residence and attached garage, is setback 22 feet from the front property line, 36 feet from the rear property boundary, 48 feet from the side yard property line on the south, and 0 feet from the side yard boundary on the north. The subject site is a corner lot zoned Residential - 8 Dwelling Units per Acre (R-8) and requires a minimum 15-foot side yard setback on the side yard facing the street. Interior side yard setbacks in the R-8 Zone are required to be a minimum of 5 feet. The applicant states that the setback variance is necessary to accommodate additional vehicles beyond the existing two-car garage located on the site. Alternative carport locations on the site are either inaccessible due to grade, or would require the removal of existing trees. FINDINGS, CONCLUSIONS & DECISION Having reviewed the written record in the matter, the City now makes and enters the following: D. Findings 1) Request: The Applicant, Charles Sharin, has requested approval for an Administrative Sideyard Setback Variance for his property located at 2213 Aberdeen Court SE. 2) Administrative Variance: The applicant's administrative variance application complies with the submittal requirements for information for a variance. The applicant's site plan and other project photographs are entered as Exhibits No. 2 through 4. ADVAR.DOC/ Sharin Carport Variance--Administrate , ✓ariance LUA-98-065,V-A page 3 3) Existing Land Use: Land uses surrounding the subject site include: North: residential; South: residential; East residential; and West: residential. 4) CONSISTENCY WITH VARIANCE CRITERIA Section 4-31-19F.3. lists 4 criteria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These include the following: The Zoning Administrator shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The size and shape of the subject parcel does not preclude locating a carport in either the rear or opposing side yard. However, the rear yard is difficult to access as grades slope away from Aberdeen Court SE and 22nd Place SE. And the applicant would need to remove existing coniferous trees in the south side yard area to accommodate either a driveway or carport. When the residence was constructed, the original location was shifted 10 feet to the north, in order to avoid the same coniferous trees. There does not appear to be a unique situation applying only to the subject property because most of the properties in the neighborhood have similar lot sizes, terrain and building layout on the property. It appears that there are no special characteristics of the subject property which would limit or restrict its use for the construction of a carport other than in the side yard setback area. However, the applicant has submitted photographs documenting other property owners in the vicinity, under identical zoning classification, that have developed surface parking areas. One of the properties has an additional carport on the property attached to an existing garage. It is not known whether that carport structure encroaches into the required side yard area. Parking aprons are allowed in the sideyard setback area. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The granting of the variance would not result in materially detrimental impacts to the public welfare. It may be considered injurious to property improvements in the vicinity and zone because it would allow for construction that differs from the standard that generally apply to all properties in the R-8 Zone. This could set a precedent and create uncertainty about maintaining zoning standards which have been adopted to protect and enhance single family residential neighborhoods. Staff has received four letters from neighbors opposing the granting of the setback variance. One of the letters notes that homeowner's association covenants restrict the type of buildings and businesses that can occur in the neighborhood. The City does not have the jurisdiction to enforce standards or violations of Covenants and Restrictions and it is considered a civil matter between the homeowner and the Parkwood South Home Owners Association. The Uniform Building Code requires structures to be set back at least three feet from a property line or provide a one-hour fire wall separation. The Code allows a roof overhang of one foot, or the overhang to be within two feet of the property line. The application indicates that carport has been constructed to the property line, which is in violation of the Building Code. If a variance is approved, the applicant would be required to comply with Building Code requirements. If the Zoning Administrator approves the variance ADVAR.DOC/ Sharin Carport Variance--Administrative Variance LUA-98-065,V-A page 4 application, the carport would have to be constructed with a solid one-hour fire wall along the north wall and along the property line. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: Approval of the subject variance may be considered a grant of special privilege because it would provide an exception from a zoning standard that limits most properties in the vicinity of the subject property. Most properties in the area have limited side yard areas available for constructing carports while maintaining the side yard setback requirements. The granting of the variance would then allow the applicant to utilize the required yard area that is unavailable for use by other properties. The applicant's submittal includes photographic documentation of carports, driveways, and recreational vehicle parking that is located within side yard areas for other homes in the surrounding neighborhoods. Parking aprons are permitted in the sideyard setback. It is not known whether the carport illustrated intrudes into the required sideyard setback. Carport structures are required to have a minimum 5-foot interior sideyard setback in the R-8 Zone, unless a setback variance is granted by the City. d. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: The proposed carport would not be set back from the side yard property line, where a five-foot minimum yard is required. The carport is ten feet wide, which is the necessary minimum width. The proposal may be considered to be the minimum variance necessary to accomplish the desired purpose. However, the carport may be located elsewhere on the property without needing an exception from the zoning standards. E. Conclusions 1. The subject site is located at 2213 Aberdeen Court SE, within the Residential - 8 Dwelling Units per Acre (R-8) Zoning designation. 2. The R-8 Zone requires a minimum 5-foot interior side yard setback for attached accessory structures. The referenced carport has been constructed on the side yard property line with a 0-foot setback. 3. The analysis of the proposal according to variance criteria is found within the body of the Staff Report. F. We strongly oppose any variance that would allow Chuck Sharin to keep intact the eyesore that masquerades as a "carport." As importantly, we believe that granting City approval retroactively for Mr. Sharin's blatantly illegal addition sends the wrong message to an individual who hardly needs any encouragement for future reckless behavior. We moved into our house four years ago. We have had a series of problems with Mr. Sharin, whose property borders ours on the east. The most serious of these was the car repair/part shop/junkyard Mr. Sharin operated at his address. Thanks to Bob Arthur in the City's compliance division and our homeowner's association, that situation has somewhat abated—although it has taken more than two years and has not completely gone away. Now, instead of twenty (20!) junker cars ringing the property, including in the backyard, we deal with "only" three or four at a time, plus several large appliances sitting in the driveway and in the street (this type of repair apparently having been added to Mr. Sharin's fix-it repertoire). My understanding is that it was during Mr. Arthur's investigation into the car repair operation being conducted by Mr. Sharin that the carport problem came to light. This is significant because it underscores Mr. Sharin's way of operating—namely, "do it until you get caught." The car repair excess continued until the City got involved and made it stop. The requests made by the neighbors and, eventually, the homeowner's association meant nothing, despite Mr. Sharin's former involvement in the association as vice-president and (self- congratulatory) newsletter contributor. Without the car repair problem, the Jennifer Toth Henning May 10, 1998 Page 2 complaints by me and others about the carport might not have been taken as seriously. In short, not only is there no good reason for a variance, there is every reason not to grant one in this case. Mr. Sharin needs another reminder that one can't do whatever one wants, disregarding the rules of the community and the legitimate interests of all others around him. I have to look at his ugly, unkempt yard and his makeshift, unsightly "lean-to" storage sheds (yes, in addition to an illegal carport he also apparently needs "extra storage," for who knows what) because I'm not aware of any laws, regulations, or ordinances that prohibit these things. Mr. Sharin is requesting a variance for his "carport" presumably because there is a prohibition on structures built without regard for the five-foot side yard setback. My wife and I strongly urge you to deny the request and direct that the property be returned to the way it was before the carport was constructed.
