The prezoning would be for the R-8 zone which is consistent with the Residential Single Family land use designation shown for this site on the City's Comprehensive Plan Land use map. Such zoning would be applied at the time the subject site is annexed into the City. The City is anticipating that a special election for this annexation will be held in April, 2003. The existing use of much of the 9.26-acre site as a storage yard for heavy construction equipment would likely cease pending the site's redevelopment for single-family detached housing. Location: 13029 136th Avenue SE Comments: I Planning& Development Planning and Development Committee Chair Briere presented a Committee report regarding the City process for street vacations. The Vacation: Process Committee met with staff to discuss the process for how the staff processes street vacations. Victoria Runkle,Finance and Information Services Administrator,reported that the total proposed 2003 Budget for the City of Renton is $142,201,100. She noted that the General Governmental Funds are $64,127,100. Ms. Runkle indicated that the property tax levy for 2003 is not yet known,but she estimates that the general tax levy will be $3.22 per$1,000 of assessed valuation. Responding to Council inquiry, Mr. Runkle stated that the final assessed valuation for the property tax levy will be available by December 1st, and she confirmed that the general tax levy for 2002 was $3.26. Public comment was invited. A letter was read from Suzanne Chandler, 14131 149th P1. SE, Renton, 98059, expressing her concern regarding the implementation of a recreation fee increase for all non-Renton residents. Annexation: Tydico, 136th This being the date set and proper notices having been posted and published in Ave SE accordance with local and State laws,Mayor Tanner opened the public hearing to consider the resolution authorizing an annexation election and consideration L it ll 01.-1 ► 3 of R-8 (Residential Single Family; eight dwelling units per acre)prezoning for the Tydico Annexation; 9.46 acres bounded by NE 3rd Pl. to the north,NE 2nd St. to the south, and Bremerton Ave.NE(136th Ave. SE)to the east. The applicant,Liberty Ridge LLC, is in the process of acquiring the Tydico site and will be its owner by the end of the year. Don Erickson, Senior Planner, described the proposed annexation area,pointing out that it contains a single-family dwelling and a nonconforming heavy construction equipment storage facility. The site abuts Renton on its northern, western, and southern boundaries, and he noted the presence of a seasonal stream along the western property line. Mr. Erickson stated that the site is within Renton's water and sewer service area; fire protection for the site is provided by Fire District#25; and roadway and storm water improvements are likely. He also reported that the existing King County land use designation is Urban Residential with R-4 zoning, and Renton's Comprehensive Plan designates this area Residential Single Family, with R-8 zoning. Continuing,Mr. Erickson explained that since the invalidation of the petition process of annexation by the State Supreme Court in March,the election process of annexation is the only process available and can be initiated by either a petition signed by 10%of the registered voters in the proposed annexation area, or by a resolution from the City Council. He stated that the resolution approach is preferred in this case, and if approved, the election could occur on April 22, 2003. Mr. Erickson noted that the applicant will reimburse the City for the cost of the election, which is estimated at$1,500. Mr. Erickson reported that the applicant submitted a pre-application for a Comprehensive Plan amendment in October to change the existing Residential Single Family land use designation on the site to Residential Options, which would allow R-10 (Residential Single Family; ten dwelling units per acre) November 18,2002 Renton City Council Minutes Page 436 zoning. He described how the proposed annexation complies with the City's Business Plan goals,relevant City policies for annexations, relevant King County Boundary Review Board objectives, and relevant City rezone policies. Mr. Erickson also reviewed the fiscal impacts of the proposed annexation, which include a one-time park acquisition and development cost of$31,979.40. In conclusion,Mr. Erickson stated that staff recommends that Council: authorize an election for voters within the area to be annexed; authorize the Administration to draft a prezone ordinance for R-8 zoning for the annexation area; and authorize the Administration to submit the Notice of Intent Package to the King County Boundary Review Board. Councilman Persson encouraged Councilmembers to support the annexation, noting that the site has caused Renton residents a lot of problems, and annexation to the City would help to alleviate those problems. Public comment was invited. David Halinen,representative for Liberty Ridge LLC, 10500 NE 8th St., Suite 1900,Bellevue, 98004, explained that Liberty Ridge is in the process of acquiring the Tydico site, and proposes to develop a single-family residential subdivision. He stated that Liberty Ridge intends to apply for a Comprehensive Plan amendment to change the land use designation of the site to Residential Options, which would allow R-10 zoning. Along with that request, Liberty Ridge is proposing a development agreement to limit site development to single-family detached, and is proposing that the southern lots would be limited to the R-8 zoning width for consistency with neighboring property lots. Cheryl Mosteller, 161 Bremerton Pl.NE,Renton, 98059, commented on the problems neighboring residents have had with the Tydico site over the years. She questioned how Renton will ensure, if the proposed development does not occur,that the property will be kept in compliance. Ms. Mosteller expressed her hope that the City will make sure that the business will operate according to the rules set forth by the King County prosecutor. She also expressed her concerns about the compatibility of the proposed zoning for the site, the property grade,traffic patterns, and density. In addition,Ms. Mosteller noted that according to King County, the southern portion of the site is not to be used for business purposes, and she hoped that if the site is annexed, the City would adhere to that directive. Responding to Mayor Tanner's inquiry regarding whether the business would remain on the site,Mr.Halinen explained that Tydico is currently a tenant on the site, and its lease extends to March or April of 2004. He stated that his client intends to move forward with the subdivision application as soon as the zoning for the site is approved. Council discussion ensued regarding Tydico's lease, its compliance to regulations,the City's code enforcement, and moving forward with the annexation while there are still issues to be addressed. Ed Gullekson, 111 Bremerton Pl.NE,Renton, 98059, thanked the Council for supporting the neighboring residents in their fight with Tydico. He stressed how important it is for the City to address the details regarding this matter because it is not a foregone conclusion that Tydico will maintain compliance. Mr. Gullekson also pointed out that the seasonal stream on the subject site is active nine months out of the year, and that grade soil brought onto the site by Tydico from an unknown source,may be contaminated. Planning: Employment Area This being the date set and proper notices having been posted and published in Valley,Freestanding Sign accordance with local and State laws,Mayor Tanner opened the public hearing Code Amendment to consider the proposed City Code amendments to allow additional height for the freestanding IKEA sign at SW 41st St.,and to limit applicability to big-box retail uses of a certain size in the Employment Area Valley(EAV)land use designation. Sue Carlson,Economic Development Administrator,explained that the freestanding IKEA sign has become obscured by the East Valley 13 (ACT III) Theatre and nearby trees. Since IKEA was unable to negotiate with the neighboring property owner to trim down or cut the trees,Ms. Carlson stated that IKEA has asked the City to amend its Sign Code to raise its existing freestanding sign height. Gil Cerise, Senior Planner, stated that existing City Code that is applicable to large retail uses over 450,000 square feet of developable property,allows a freestanding sign height of up to 60 feet. The existing 50-foot-high IKEA sign, which stands on the northeast corner of the IKEA site,is situated to direct customers arriving from the SR-167 southbound off-ramp and from westbound traffic on SW 41st St. Mr. Cerise indicated that the proposed City Code changes will raise the maximum freestanding height to 115 feet,which would allow visibility of the sign above mature growth tree lines. Continuing,Mr. Cerise explained that the proposed amendment would also limit the applicability of the 115-feet freestanding sign height to big-box retail uses in buildings over 350,000 square feet in the EAV. He displayed pictures of different views of the IKEA sign at its current height and at a simulated height of 112 feet. Citizen Comment: Zammit— Karen Zammit,Renton resident,expressed her appreciation for the human Childcare Funding Assistance services that Renton provides and for the proposed increase of$30,000 in human services funding for 2003. However, she indicated that there are many Renton parents that need help paying for childcare in order to continue working,especially since King County and the State are cutting back on their childcare programs. She listed the choices parents are facing now that they have lost their childcare assistance including the inability to pay rent or other bills,rationing food,and leaving children home alone. She suggested that Renton subsidize some childcare slots for low-income resident families at childcare facilities located at the Federal Aviation Administration building or Renton Technical College. Ms.Zammit concluded by saying that investing in children and families is more important than investing in capital improvements. When annexation occurs the City will officially adopt the pre-zoning as the site's new zoning. Because Renton's Comprehensive Plan Land Use Map designation for this area is Residential Single Family (RS) the R-8, Residential Single Family 8 du/ac zoning is proposed. This zone would supplant the County's R-4 zoning at the time of annexation. Allowed densities under Renton's R-8 Zone are higher than those allowed under County's R-4 Zone but not twice as high. This is because the County calculates density based upon gross area and Renton calculates it based upon net area. Under the County's R-4 zoning the site could be expected to accommodate ± 38 dwelling units whereas under Renton's R-8 zoning the site could be expected to accommodate ± 60 dwelling units. Annexation will also allow the City to expedite clean up of this former heavy construction equipment storage site, lessening potential impacts from this use to the environment. Project Location: The affected area is between the existing city limits on the west as well as on the north (NE 3`d Street, if extended, and on the south (NE 2"d Street, if extended). Because these notes are provided as information only, they are not subject to the appeal process for environmental determinations. Planning 1. The site is designated Residential Single Family on the Comprehensive Plan Land Use Map. 2. The property is currently zoned R-4, Residential Single Family - 4.0 dwelling units per gross acre (du/ac), in King County. 3. Densities allowed under the City's R-8 Zone are 5.0 dwelling units per net acre (du/ac), minimum, to 8.0 du/ac, maximum. 4. Densities allowed in the existing R-4 Zone in King County are 4.0 du/gross acre to 5.8 du/gross acre with bonuses for trails and low or moderate income housing. 5. Annexations are SEPA exempt (RCW 43.21 C.222) and the prezoning is considered to be a non-project action. 6. No development is proposed at this time as a part of this proposal. D. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. 1. Earth Impacts: The relatively flat site can be described as relatively flat with slopes of 1% to 3%, from south to north. The soils are classified as Alderwood gravelly sandy loam according to the Soil Conservation Service, 1972. The site is generally clear except for a few trees along its southern boundary. There are three or four mounds of soils in the northwest corner of the site that create slopes of 25% to 40%. No change of topography is anticipated as a consequence of the proposed pre-zoning. Mitigation Measures: • No mitigation measures are anticipated or needed for this non-project action. Future development will be reviewed at the project level and impacts, if any, addressed at that time. Policy Nexus: SEPA Environmental Regulations 2. Surface Water Impacts: No impacts are anticipated to surface water from this non-project action. It is anticipated that upon annexation the existing non-conforming heavy equipment and construction business will leave. Mitigation Measures: None specified for this non-project action. Access/Transportation Impacts: Access to the 9.46 acre site is anticipated to be primarily from Bremerton Avenue SE which may require improvement if the site is developed with ± 60 new single-family detached dwelling units. The maximum number of new vehicular trips per average week day under Renton's R-8 zoning would be approximately 600 week day tripends while under the County's existing R-4 zoning the maximum number of tripends would be approximately 380. Mitigation Measures: None specified for this non-project action. At the time development is proposed traffic impacts will be assessed in more detail and addressed. Also, a traffic mitigation fee of $75 per trip would most likely apply at that time. Future development would pay a Fire Mitigation Fee of $488 per Single-family residence. If the area is not pre-zoned R-8, I would be very much opposed to the annexation as I would be concerned Tydico would continue using the land as a construction business as it has been doing. I have been told that Gary Merlino is one of the parties concerned in this annexation. He also was one of the owners of Tydico when it first bought this parcel and started the increased use that required the neighbors to the south to hire a lawyer and have our lives disrupted with noise and pollution for 2 years. I would like to be reassured that he really wants to develop homes now. I am also concerned about how the site will be developed. McCann and Tydico have changed the elevation of the land. New developments seem to have very tall houses with very little lawn. Are we to the south of the property going to have homes towering over our property with no privacy, is some type of landscaping going to be done to make a nice flow from one neighborhood to the other. Or, are the developers going to squeeze as many homes into the site as they can, no matter how it affects the neighbors to the south? I am also concerned about the stream that runs through on the western edge. Renton has done very little to protect this stream north of us. I am concerned that Renton will let it be paved over even more. It would certainly be more of an assest to clean up the stream bed, even though it is now only a part year stream due to all the other development, and maintain some type of landscaping around it. At this time we have many types of birds in the greenbelt to the south of the proposed annexation area, I would like to see the city doing something to help preserve this habitat. Because annexations are SEPA exempt the checklist only addresses the prezoning of the 9.46-acre former Tydico Construction Company site along the eastern boundary of the City. With the State Supreme Court having ruled that the petition method of annexation was in violation of Article 1, Section 12 of the State Constitution this last March, the only way the City can currently annex this site is through the election process. Special elections for such annexations can only be held on certain dates and must be coordinated through the King County Division of Elections and Accounting. There are two dates in the spring of 2003 that such an election could be held for this project, March 11t and April 22d, 2003. In order to meet these dates this application must be expedited. We would like to route this application on October 18, 2002 for a one week internal comment period so that we can get this item before the Council by November 4t. At that time it is hoped that the Council would pass a resolution authorizing an election for this annexation. H:\EDNSP\PAA\Annexations\Tydico\Transmittal memo.doc\d TYDICO SITE ANNEXATION —ELECTION METHOD PROJECT NARRATIVE The City is in receipt of a request from David Halinen, representing 5050 First Avenue,LLC,the new property owner of record for the "Tydico" site, for an Election Annexation for the 9.46-acre former Tydico site along Renton's eastern boundary. The subject site is within the City's Potential Annexation Area and is designated as Residential Single Family on the Comprehensive Plan Land Use Map. Because the site currently has County R-4 zoning it is the City's intent to prezone it R-8, 8 du/net acre, so this zone can be applied at the time the site comes into the City. The site would accommodate approximately 60 single-family dwelling units under R-8 zoning. The annexation site appears to have reasonable boundaries. The City surrounds it on its north, west, and south sides. Bremerton Avenue NE, if extended, would define its eastern boundary. The site is relatively flat and not known to have any critically sensitive areas. There are some steeper ridge lines shown on the site but these are believed to be from past excavations. Heather Downs Park is located approximately 700 feet to the west. An existing single-family dwelling currently exists on the site. There appear to be two registered voters currently residing on the site. The annexation site has been used for the last several years as a storage yard for a construction company. It has been the subject of some controversy because the use is considered to be a non-conforming use under King County's zoning regulations. Portions of the use are subject to zoning code violations in the King County system. Residents within the City have complained about noise and dust emanating from the site. The annexation site is within Renton's Water Service Area but is currently served by Water District 90. It is also within Renton's Sanitary Sewer Service Area. Sewer appears to be available to the site from the west and possibly from the south. The present use as a storage yard was recently denied sewer availability, however, based on Renton's Comprehensive Plan Land Use Element. This situation could possibly change with annexation and a change of use. The site is located within Fire District No. 25 where Renton is under contract to provide fire suppression services. The proposed annexation is exempt from SEPA under the provisions of RCW 43.21C.222, however, the prezoning of the site to R-8 does require SEPA compliance. Upon receipt of comments from city staff, EDNSP will prepare a report for Council's consideration that will include an issue paper and fiscal impact analysis. It is then anticipated that Council will schedule a public meeting to allow public comment before adopting a resolution in support of the annexation. Such a resolution would call for a public election to be held to submit to voters of the proposed annexation area the issue of annexation, as well as the issue of property owners within the annexation area assuming a proportionate share of the City's outstanding indebtedness. King County is installing approximately 1,800 feet of 72- Public Works: Eastside inch pipe in the area of Houser Way S.,Burnett Ave. S., and Morris Ave. S. Interceptor Project,Street On June 11,2001,the Council approved street closures for three intersections Closures for this project. Due to unexpected delays,construction on this project is now behind schedule,and King County Metro has requested extension of the approved street closures. The project experienced delays early in the construction process. The special new tunneling machine used for the project arrived about two months late, delaying the start of the tunneling work. Additionally,problems with extensive groundwater in the vicinity of Houser Way S. and Burnett Ave. S.required considerably more dewatering efforts than originally planned. The project contractor has attempted to get the project back on schedule by expanding work hours to 12 to 14 hours per day, six days a week through the summer. This extra effort has reduced the schedule delays,but additional time is still required to complete the work in the three street closure areas. The intersection at Houser Way S. and Morris Ave. S. was originally approved to be closed through October 31st. Work at this intersection is nearing completion,pending removal of a temporary transformer at S. 5th St. and Morris Ave. S. by the contractor for Puget Sound Energy. This transformer was set as a community relation gesture to eliminate the noise impacts of using diesel generators. The intersection at Burnett Ave. S. and Houser Way S. was originally approved to be closed through August 30th. The groundwater problems at this location resulted in modifications to the tunneling schedule,which resulted in significant delays in starting work at this intersection. The concrete structure will need to be completed,with a concrete cure of about one week. The manhole riser will then be installed; the site backfilled; steel plates removed; and the road returned to normal traffic operations. The intersection at S. 7th St. and Morris Ave. S. was originally approved to be closed though September 30th.
