She wondered whether this position should be made into a regular full-time position with benefits. Jay Covington,Chief Administrative Officer,responded that after the resignation of Laurie Ness,the City's first Volunteer Coordinator,the Administration took the opportunity to combine this function along with special events activities into one contract. Council President Parker explained that this person performs promotion and marketing work for the City as a consultant to specific programs and events. He supported approving the contract this evening as proposed,adding that Council can take up the question of whether it should be made into a full-time regular position during budget deliberations. • Councilman Edwards suggested shortening the ending date of the contract from June 30,2000 to December 31, 1999 to coincide with the City's budget. Councilmember Nelson agreed this would be preferable,as the River Days Board of Directors was concerned that the contract for the event's coordination not expire a few short weeks before River Days. MOVED BY PARKER, SECONDED BY KEOLKER-WHEELER,COUNCIL EXTEND THE CONTRACT WITH SONJA MEJLAENDER FOR SPECIAL EVENT AND VOLUNTEER PROGRAM COORDINATION FROM JULY 1, 1999 THROUGH DECEMBER 31, 1999 FOR$22,500. CARRIED. MOVED BY KEOLKER-WHEELER, SECONDED BY CORMAN, COUNCIL REFER THIS MATTER TO THE FINANCE COMMITTEE FOR DISCUSSION PRIOR TO BUDGET DELIBERATIONS LATER THIS YEAR. CARRIED. CORRESPONDENCE Correspondence was read from the Board of the Highlands Community Citizen Comment: Highlands Association,urging the City to immediately fund necessary improvements to Community Association— properties operated by the Renton Housing Authority in the Highlands. Renton Housing Authority, Mayor Tanner noted that the Housing Authority is an independent entity which Maintenance of Housing Stock controls its own finances and is wholly responsible for operating and maintaining the various properties which it owns. He added that this letter may be related to an application by the Housing Authority to the City's new Neighborhood Program for minor work to some of its buildings. OLD BUSINESS Planning&Development Committee Chair Keolker-Wheeler presented a report Planning&Development recommending that a public hearing be set on July 26, 1999 for proposed Code Committee amendments changing the dates and procedures for the Comprehensive Plan Comprehensive Plan: amendment review process. Transportation Committee Transportation Committee Chair Corman presented a report regarding the Public Works: Pacific Fiber proposed license agreement for Pacific Fiber Link, L.L.C. Pacific Fiber Link Link Fiber Optic System plans to provide high-capacity,inter-exchange transport on a long-term lease Through Renton basis to telecommunications common carriers on underground fiber optic cables. The conduit will be installed using conventional trenching,horizontal boring and directional drilling methods. This is a ten-year license agreement between the City of Renton and Pacific Fiber Link. Pacific Fiber Link(PFL)is a Washington State limited liability company. PFL is owned by Ledcor Industries,Inc. and Mitek Communications,Inc. Mitek Communications,Inc. is a wholly-owned subsidiary of Michel's Pipeline Construction, Inc. PFL has no subsidiaries or other parent companies. City Code encourages telecommunications services such as this to promote competition and provide advance services on the widest possible basis to businesses, institutions and residents of the City. The Transportation Committee recommended concurrence in the staff recommendation to approve the license agreement with Pacific Fiber Link, L.L.C. BACKGROUND During the review of the Maple Valley Highway Taco Time Comprehensive Plan Amendment, Rezone, Development Agreement proposal, the City Council adopted a Planning and Development Committee Minority Report(January 4, 1999)which directed staff to: Amend the Convenience Commercial Zone to add "existing, legal Administrative Headquarters Offices" as a secondary use and "the storage of supplies in conjunction with service and office uses" as an accessory use. For "existing, legal Administrative Headquarters Offices" allow for parking expansions, and for a one-time building expansion of 3,500 square feet maximum. No new Administrative Headquarters Offices would be allowed. The proposed amendments described below would implement the City Council's direction. DESCRIPTION OF AMENDMENTS Administrative Headquarters Office in CC Zone Professional and personal offices are allowed in the Convenience Commercial (CC) Zone as Administrative Conditional Uses, subject to a maximum size of 3,000 square feet, restricted to activities with a limited need for walk-in clientele, and subject to a parking standard of 1 space per 500 square feet. Personal and professional offices are not defined in the Renton Municipal Code. The current definition of Administrative Headquarters Office in Title 4 is: ADMINISTRATIVE HEADQUARTERS OFFICE: A use containing one or more of the day-to- day functions (e.g., management, payroll, information systems, inventory control) related to the operation of the company or affiliated corporate group. Administrative Headquarters Offices are currently allowed in the Industrial, Center Downtown, Center Office and Center Office/Residential zones, and would be allowed in the Commercial Arterial Zone based on previous authorized amendment proposals. PHHNDCC\ 1 1 The CC zone would be amended to allow existing legal Administrative Headquarters Offices as secondary uses. The specific use conditions would state: For existing, legal Administrative Headquarters Offices greater than 3,000 square feet in size, and in existence prior to January 1, 1999, the following expansions may be allowed: 1) Parking expansion may be allowed; 2) A one-time expansion of building square footage, not exceeding 3,500 square feet, may be permitted subject to site plan review. This provision allowing expansion of building square footage shall sunset once the expansion is constructed. These amendments would recognize Taco Time's existing corporate office (total square feet of about 9,750 s.f.) and allow for moderate expansion, but not allow for new administrative headquarters in the CC zone. Accessory Storage Currently, the accessory use of storage in conjunction with retail sales is allowed in all the commercial zones and would be allowed in all industrial zones with the Valley Zoning Amendments. The proposed code would clarify that the accessory use of storage in conjunction with retail sales also allows for accessory storage associated with permitted service and office uses. Accessory storage is limited to 33% of the gross floor area. RECOMMENDATIONS The above office and storage use amendments would make the Taco Time buildings conforming in the CC zone. The storage changes would clarify storage allowances for service and office uses in all the commercial and industrial zones. Staff recommends approval of the amendments. Also, if a sunset clause is applied to the one-time building expansion allowance in the proposed Taco Time Development Agreement, staff would suggest the Convenience Commercial zone amendments allowing a one-time building expansion for existing, legal Administrative Headquarters offices have a consistent sunset date. Land and Shoreline Use (supplemental sheet) Impacts: Administrative Headquarters Offices are currently allowed in the Industrial, Center Downtown, Center Office and Center Office/Residential zones, and would be allowed in the Commercial Arterial Zone based on approved, but not yet adopted amendment proposals. The purpose of the CC zone is: "...to provide for small-scale convenience retail/commercial centers intended to provide for basic retail and service needs of the adjacent area. Uses serving a larger area may be appropriate if they also serve the residents of the immediate area and are compatible with the scale and character of the neighborhood in which they are located." With the secondary use conditions, these amendments would recognize existing corporate offices (Taco Time Corporate Offices) and allow for moderate expansion, but not allow for new administrative headquarters in the CC zone. Currently, the accessory use of storage in conjunction with retail sales is allowed in all the commercial zones and would be allowed in all industrial zones with the Valley Zoning Amendments. The proposed code would clarify that that the accessory use of storage in conjunction with retail sales also allows for accessory storage associated with permitted service and office uses. Accessory storage is limited to 33% of the gross floor area. Mitigation Measures: Non-applicable to the non-project action. Future site-specific development would be subject to subdivision regulations, zoning requirements for setbacks, height, etc., shoreline regulations, and environmental review, as applicable. Public Services Impacts: The small increase in expected allowable square footage and parking area for existing, legal Administrative Headquarters Offices could slightly increase the demand for public services; however, existing, legal uses would receive services currently and the incremental difference is likely to be negligible. Future developments would be reviewed on a site-specific basis. Mitigation Measures: Future site-specific proposals would be subject to Environmental (SEPA) Ordinance, Uniform Fire Code, Street Improvements Regulations, Parking and Loading Regulations, as well as requirements for mitigation fees, utility requirements, and others as applicable. BACKGROUND SUMMARY: During the review of the Maple Valley Highway Taco Time Comprehensive Plan Amendment, Rezone, Development Agreement proposal (LUA 98-042 CPA, R, ECF), the City Council adopted a Planning and Development Committee Minority Report(January 4, 1999) which directed staff to: Amend the Convenience Commercial Zone to add "existing, legal Administrative Headquarters Offices" as a secondary use and "the storage of supplies in conjunction with service and office uses" as an accessory use. For "existing, legal Administrative Headquarters Offices" allow for parking expansions, and for a one-time building expansion \\TS_SERVER\SYS2:\COMMON\-H:\ECONDEV\STRATPLN\PLANNING\LGRUETER\TACO\CODEISS.DOC\cor May 5, 1999 Page 2 of 3,500 square feet maximum. No new Administrative Headquarters Offices would be allowed. The Council requested the Administration to prepare an ordinance for the code amendments and property redesignations, and to prepare development agreements or covenants for consideration by the City Council. This issue paper presents key issues and proposed code language which implements the Council request for the CC Zone amendments. ISSUES Existing CC Zone The purpose of the CC zone is: "...to provide for small-scale convenience retail/commercial centers intended to provide for basic retail and service needs of the adjacent area. Uses serving a larger area may be appropriate if they also serve the residents of the immediate area and are compatible with the scale and character of the neighborhood in which they are located." Commercial uses in general are restricted to 5,000 square feet per commercial use, with a maximum increase possible of 1,000 square feet if approved by the Hearing Examiner as a Conditional Use Permit. Professional and personal offices are allowed as Administrative Conditional Uses, subject to the following conditions in RMC Section 4-2-080.A: 98. Provided that the total gross floor area of each use in any one site shall not exceed three thousand (3,000) square feet and subject to the following criteria: (a) activities with a limited need for walk-in clientele and (b) activities for which a reduction in parking standards to one space per five hundred (500) square feet of gross floor space could be justified. Accessory storage (up to 33% of gross floor area) is allowed for retail activities, but not specifically for office and service uses. Attachment A-1 shows existing CC Zone use allowances and conditions. Some uses are non-conforming, including outdoor vehicle storage, residential flats that exceed density and which do not have ground floor commercial, auto repair which is not associated with a gas station, and the Taco Time offices which do not meet size or parking restrictions. Proposed Amendments Administrative Headquarters Office in CC Zone Attachments A-2 and C indicate the proposed CC zone amendments. The CC zone would be amended to allow existing legal Administrative Headquarters Offices as secondary uses. The current definition of Administrative Headquarters Office in Title 4 is: ADMINISTRATIVE HEADQUARTERS OFFICE: A use containing one or more of the day-to-day functions (e.g., management, payroll, information systems, inventory control) related to the operation of the company or affiliated corporate group. Administrative Headquarters Offices are currently allowed in the Industrial, Center Downtown, Center Office and Center Office/Residential zones, and would be allowed in the Commercial Arterial Zone based on previous amendment proposals described later. There are no definitions for personal or professional offices which are currently allowed in the CC zone and restricted to 3,000 square feet. The definition of Administrative Headquarters Office is May 5, 1999 Page 4 not based upon size or number of employees. A concern could be that existing realty, insurance and other professional service uses found in the CC zone which fall under the personal and professional office use (and currently restricted to 3,000 s.f. maximum and parking restrictions) could also meet the general definition of Administrative Headquarters Office and possibly qualify for the one-time expansion. According to King County Assessor Records or City land use files, the sizes of the existing, small professional offices are: • Kennydale Realty- 1,032 s.f. • Summit Electrical Sales -2,200 s.f. (business license coded as contract trade) • Humble Insurance Office - 2,952 s.f. To help ensure that the amendments do not lead to interpretations that would result in unanticipated additions to personal/professional offices, the amendments would indicate that the allowable expansion applies to existing, legal Administrative Headquarters Offices that exceed 3,000 square feet and which were in existence prior to January 1, 1999. With the secondary use conditions, these amendments would recognize Taco Time's existing corporate office and allow for moderate expansion,but not allow for new administrative headquarters in the CC zone. Accessory Storage It would also be appropriate to make general provisions for storage in conjunction with office and service uses not only in the CC zone, but also in all other industrial and commercial zones. Currently, the accessory use of storage in conjunction with retail sales is allowed in all the commercial zones and would be allowed in all industrial zones with the Valley Zoning Amendments. The proposed code would clarify that that the accessory use of storage in conjunction with retail sales also allows for accessory storage associated with permitted service and office uses. Accessory storage is limited to 33% of the gross floor area. The above office and storage use amendments would make the Taco Time buildings conforming in the CC zone. The storage changes would clarify storage allowances for service and office uses in all the commercial and industrial zones. Other Code Amendment Projects Other general code amendments for the CA Zone allow offices, accessory storage for office/service uses, and shoe repair were studied previously along with the Maple Valley Highway Taco Time CPA/Rezone and Development Agreement proposal. On January 4, 1999, the Council directed staff to: "Amend the Commercial Arterial (CA) zone generally to allow offices, accessory storage for office/service uses, and shoe repair." The CA and CC zone amendments will likely be consolidated into a single ordinance for approval in coordination with the other Maple Valley Taco Time Comprehensive Plan Amendment/Rezone ordinances, and development agreement items specified in the Council's January 4, 1999 Planning and Development Committee Report. Attachment B shows the CA Zone amendments. A separate code amendment proposal primarily addressing the Employment Area Valley includes amendments to similar use categories as are being addressed in the CA and CC zones. The proposed amendments to the CC Zone and Commercial/Industrial Zones are one of the items implementing the City Council's directions related to the proposed Maple Valley Highway Taco Time Comprehensive Plan Amendment,Rezone,Development Agreement and Zone Amendments. In summary, on January 4, 1999, the City Council adopted a Committee report which recommended: • Cedar River Market and Cedar River Barbershop properties: Amend the Comprehensive Plan Land Use Designation and Zoning Map from Residential Single Family/R-8 to Convenience Commercial. • Taco Time lease/option properties: Maintain the Convenience Commercial designation for the Taco Time offices, Transmission Line Easement, and espresso stand site. Redesignate a small triangular portion of the southerly residential lot adjacent to Taco Time offices and the Transmission Line Easement,from Residential Single Family/R-8 to Convenience Commercial to allow Taco Time access across their leased properties. The boundary of the new CC designation will allow for a lot line adjustment that retains the single family residence, and results in a conforming lot. Amend the Convenience Commercial Zone to add "existing, legal Administrative Headquarters Offices"as a secondary use and "the storage of supplies in conjunction with service and office uses" as an accessory use. For "existing, legal Administrative Headquarters Offices" allow for parking expansions, and for a one-time building expansion of 3,500 square feet maximum. No new Administrative Headquarters Offices would be allowed.
