SUMMARY OF ACTION: Development Services Recommendation: Approve with conditions DEVELOPMENT SERVICES REPORT: The Development Services Report was received by the Examiner on July 15, 1998. PUBLIC HEARING: After reviewing the Development Services Report,examining available information on file with the application,field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the July 21, 1998 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,July 21, 1998, at 9:05 a.m. in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the original Exhibit No.2: Vicinity map application,proof of posting,proof of publication and other documentation pertinent to this request. Exhibit No.3: Preliminary plat map The hearing opened with a presentation of the staff report by JENNIFER HENNING,Project Manager, Development Services,City of Renton, 1055 S Grady Way,Renton,Washington 98055. The applicant requests approval to subdivide an existing 13,251 square foot parcel into two single family lots. Because this plat had been short-platted within the last five years, a preliminary plat is required by State law and City ordinance. The original short plat separated the portion of the property that fronts on NE 12th from the subject property,which is the rear portion. This property is located in the Highlands generally along NE 12th and Annette Demps Demps Development Preliminary Plat File No.: LUA-98-086,PP August 3, 1998 Page 2 between Aberdeen and Edmonds. The existing parcel will be divided into 6,732 square foot and 6,519 square foot lots. The Environmental Review Committee(ERC)reviewed this project and issued a Determination of Non- Significance-Mitigated(DNS-M)with four mitigation measures. The measures included payment of traffic, parks and fire mitigation fees. The fourth measure was if no construction is planned on the site within 90 days of the time that an existing house on the parcel is demolished and site grading work occurs,then all areas of the site not disturbed by the removal of the existing structures would be hydroseeded or otherwise stabilized. The Comprehensive Plan(CP)designation is Residential Single Family and the policies of the CP encourage the achievement of minimum densities and lot sizes as small as 4,500 square foot. The zoning designation is Residential/8-dwelling units per acre,or the R-8 zone. The minimum lot size in this zone is 4,500 square feet, and the subject lot sizes are compatible with existing parcels in the area. The access to the lots will be from NE 12th street via a private existing easement,as well as an easement across the new Lot 1 to serve Lot 2. There is an arc indicated on the plat map that provides a proper turning radius for the hammer-head.Applicant has been requested to revise the short plat to include meets and bounds description of how the triangular arc is defined in terms of the easement. The existing gravel driveway that comes in from NE 12th would need to be paved to comply with City code. Both parcels also comply with minimum area,setbacks and width. The site is relatively flat and the adjacent development is single family residential in character. This proposal is expected to generate an average of 10 weekday vehicle trips. Police and Fire Departments have indicated they have sufficient resources to furnish service to the proposed development. The subject parcel is located within one mile of Gene Coulon Park and will pay a parks mitigation fee. One new student could be generated through this proposal and would attend schools in the Renton School District. In terms of storm water,the existing runoff from the subject site does drain to public catch basins located on the adjacent lot to the south and there is also a catch basin located in NE 12th. There are no water quality or detention provisions required for this proposal. There are existing water mains in NE 12th as well as a sanitary sewer main to serve the proposed plat. Staff would recommend approval of this preliminary plat, subject to the condition that they be required to comply with the ERC mitigation measures. It is also recommended that an easement for the triangular shaped portion of the driveway be conveyed. Willie B.Rogers.Jr., 2300 NE 12th Street,Renton,WA 98056,applicant representative herein, stated that he lives in the house on the front portion of the parcel and there was an easement agreement for the triangular portion of the driveway which accesses the new lots. The Examiner called for further testimony regarding this project. There was no one else wishing to speak,and no further comments from staff. The hearing closed at 9:25 a.m. FINDINGS. CONCLUSIONS & RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: Annette Demps Demps Development Preliminary Plat File No.: LUA-98-086,PP August 3, 1998 Page 3 FINDINGS: 1. The applicant, Annette Demps, filed a request for approval of a Preliminary Plat. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Determination of Non-Significance- Mitigated(DNS-M)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located at 2302 NE 12th Street. The site is located at the north end of an easement driveway that provides the access to NE 12th Street. The subject site is between Aberdeen Avenue NE on the west and Dayton Avenue NE on the east. 6. The subject site was part of a two-lot short plat approved and recorded in 1995. State law prohibits any lot created by a short plat from being further short platted within five(5)years. A full, preliminary plat including the lot may be approved. 7. The subject site was annexed to the City with the adoption of Ordinance 1822 enacted in March 1960. 8. The short plat was approved in July 1995 (LUA-95-086). 9. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such development without consideration of other policies of the Plan. 10. The applicant proposes dividing what was Lot 2,the rearmost, of the former short plat. The existing parcel is 13,251 square feet. The applicant proposes dividing the parcel into a 6,732 square foot parcel, Proposed Lot 1, and a 6,519 square foot parcel, Proposed Lot 2. 11. Proposed Lot 1 of the new plat would be the western lot. It would be served by a private driveway. A hammerhead turnaround would provide access to Proposed Lot 2. Part of the turnaround appears to be on the other lot of the former short plat. That owner would have to agree. 12. An existing home on Proposed Lot 1 would be removed to accommodate the hammerhead access and a new home. 13. The proposed density would be approximately 6.57 lots per acre which falls within the range of 5.0 to 8.0 required in the R-8 zone. 14. The proposed subdivision would generate approximately one new student and approximately 10 vehicle trips per day. 15. The City will be providing sewer and water to the subject site. This preliminary plat, like the short plat that preceded it,appears to serve the public use and interest. It provides additional housing choices in an area with appropriate urban services. It meets the density requirements imposed by both the Comprehensive Plan and the Zoning Code. 2. The layout and access are appropriate,although the applicant will have to submit an agreement for the necessary easements for the driveway and the full area needed for the hammerhead turnaround. 3. The one new lot will not tax the transportation corridors or schools or parks. The site can be appropriately served by public services including sewer and water. 4. In conclusion,while this is a preliminary plat, it is merely a technical requirement created by the redivision of a recently divided parcel. The City Council should approve the preliminary plat. RECOMMENDATION: The City Council should approve the preliminary plat subject to the following conditions: 1. The applicant shall comply with the conditions imposed by the ERC. 2. The applicant shall submit an easement agreement for the access driveway that shows both the driveway and hammerhead turnaround. State law and local ordinance require that if such a lot is further subdivided within five (5) years, then the subdivision must be reviewed through the preliminary plat process. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971 as amended), on June 16, 1996 the Environmental Review Committee issued a Determination of Non-Significance - Mitigated. 3. COMPLIANCE WITH ERC MITIGATION MEASURES The Environmental Review Committee issued the Determination of Non-Significance - Mitigated (DNS- M) with four mitigation measures that the applicant is required to comply with. The combined comment/ appeal period for the environmental determination ended July 6, 1998. No appeals were filed. The ERC Mitigation Measures and compliance by the applicant are as follows: 1. The applicant shall submit a Traffic Mitigation Fee of$75.00 per net new average daily trip (total of$716.25 for the plat)prior to the recording of the final plat. The following preliminary plat criteria have been established to assist decision makers in the review of the plat: (a) Compliance with the Comprehensive Plan Designation. The proposal is consistent with the Comprehensive Plan designation of Residential - Single Family (RSF). The minimum lot size permitted in the R-8 Zone is 4,500 square feet. The proposed plat would provide 2 lots, 6,732 s.f. and 6,519 s.f. in size. These lot sizes are compatible with other existing lots in this area. Permitted net densities range from 5.0 to 8.0 dwelling units per acre in the R-8 Zone (excluding roads and designated sensitive areas). As proposed, the Demps Development Preliminary Plat would achieve a density of 6.57 dwelling units per net acre and would be within the allowable density range. System Development Charges (sewer, water and drainage) will be required for construction of a new house on the newly created parcel at the issuance of a building permit for the house. FIRE PREVENTION 8. A fire hydrant with 1000 gpm required fire flow is required within 300 feet of all new single family structures. If the square footage of the structure exceeds 3600 square feet in area, the fire flow increases to 1500 gpm and requires two hydrants within 300 feet of the structures. 9. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. Earth Impacts: The applicant owns a lot that was created through the short plat process in 1995. State law and local ordinance require that if such a lot is further subdivided within five years, then the subdivision must be reviewed through a preliminary plat process. The applicant is requesting to subdivide the lot into two lots using the preliminary plat process. There is an existing house and concrete driveway that will be removed as part of this subdivision. The applicant will need to remove the structure and driveway prior to recording the final plat. The applicant is responsible for obtaining a demolition permit and associated permits for the removal of the existing house. The removal of the house, shed, and concrete paving will leave a large area of exposed soil that will be subject to wind and hydraulic erosion. If no construction is planned for this site the applicant will need to hydroseed or otherwise stablize the soil to prevent dust or water erosion. Mitigation Measures: If no construction is planned on this site within 90 days, all areas of the site that are disturbed by the removal of the existing structures or concrete paving will be hydroseeded or otherwise stabilized to prevent soil erosion. Dust will be controlled by sprinkling the site as required and the other erosion control measures required by existing ordinance. Exhaust from construction equipment, vehicles, and heating sources is already controlled by existing state and federal regulations. No further site specific mitigation measures are required for this project. Mitigation Measures: No further site-specific mitigation is required. Nexus: N/A 3. Water Impacts: The applicant is subdividing a 13,251 sf lot into two parcels. One of the two lots has an existing house with a paved driveway that will be removed as part of the subdivision process. The two new lots will be developed for single family homes. These two new homes will not result in a large enough impervious area subject to vehicular traffic to require the installation of water quality systems or a detention system as identified in City Ordinance. Storm runoff from the site will continue to be collected in the drains located on the parcel to the South and in NE 12th Street. Storm water is directed through the City's storm water system to Lake Washington. The applicant prepared a Level One Down Stream Analysis for this project. No capacity issues were identified within this report. Mitigation Measures: No mitigation is required. Nexus: N/A 4. Fire and Police Services Impacts: Police and Fire Department staff indicate that they will be able to provide service to the new homes provided that the Code-required improvements are installed. The property owner's signature needs to be notarized (include notary block) and preceded with a certification block. The site has an existing residence. Level 1 Downstream Drainage Analysis Runoff from the site drains to existing public catch basins located on the adjacent lot to the south, and to a catch basin located on the NE 12th Street frontage. This conveyance system flows 400' south along Camas Avenue North to the drainage system in SR 900. This conveyance system continues west along SR 900 downhill toward Lake Washington, past 'A mile downstream of the site.
