All situate in the City of Renton,King County,Washington (Please see Exhibit A for complete legal description.) That said Grantor, for and in consideration of mutual benefits, does by these presents grant unto the said Grantee a temporary easement for sidewalk and slope purposes with necessary appurtenances thereto over, under, through, across and upon the property in King County, Washington that is legally described in Exhibit A, attached, and graphically depicted on Exhibits B and C, attached. This easement is for the purpose of constructing, improving,maintaining, and repairing sidewalk and slope stabilization facilities over, under, and upon the temporary easement area described in Exhibit A and graphically depicted on Exhibits B and C together with all necessary or convenient appurtenances thereto without prior institution of any suit or proceedings of law and without incurring any legal obligation or liability therefor. Following the initial construction of its facilities, Grantee may from time to time construct such additional sidewalk and slope-related facilities as it may require. This temparary easement is granted subject to the following terms and conditions: 1. The Grantee shall, upon completion of any work within the property covered by the temporary easement,restore the surface of the temparary easement, and any private improvements disturbed or destroyed during execution of the work, as nearly as practicable to the condition they were in immediately before commencement of the work or entry by the Grantee. 2. Grantor shall retain the right to use the surface and subsurface of the temporary easement as long as such use does not interfere with the temporary easement rights granted to the Grantee. Temp Sidewalk&Slope Esmt(DLH 10-26-04).Final.doc Page 1 This temporary easement shall run with the land described herein, and shall be binding upon the parties, their heirs, successors in interest and assigns. Grantor covenants that it is the lawful owner of the property legally-described on Exhibit A and graphically depicted on Exhibits B and C and that it has a good and lawful right to execute this agreement. This temporary easement shall remain in full force and effect until such time as Grantee obtains permanent easement and fee simple right-of-way rights as a part of its Phase II Project for Improvements on SR 169—Maple Valley Highway, at which time this easement shall automatically terminate. Once that happens, within 60 days following written demand of the Grantar(or Grantor's heirs, successors in interest or assigns), the Administrator of the City of Renton Department of Planning/Building/Public Works or his/her designee shall execute and deliver to Grantor in recordable form a written confirmation of such termination of this temporary easement.
