Grantor grants to Grantee an easement for the construction, maintenance and operation of a public street over and across the following described real property in King County, situated in the SW '/4 of Section 30, Township 23 North, Range 5 East and the SE '/4 of Section 25, Township 23 North, Range 4 East, W.M., an 80 foot wide strip of land across the 40 ft. right of way of Springbrook Creek, the northerly and southerly boundaries of said easement being the northerly and southerly margins, respectively, of SW 34th Street right of way as extended, said right of way being 80 ft. in width as platted in the plat of Burlington Northern Industrial Park of Renton, Division No. 2, as recorded in Volume III of plats, pages 42-44, records of King County, Washington. Grantee will install, and from time to time and at all times hereafter, will repair, maintain ancl clean two 10 ft. 8 inch by 6 ft. 11 inch arch culverts within said easement for the purpose of allowing and maintaining the flow of drainage water. WHEREAS the parties are desirous of amending that portion of the easement which is quoted above; NOW, THEREFORE, in consideration of One Dollar($1.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor does hereby amend the foregoing provision of said easement to read as follows: [language follows on next page] -�...;,�_ '� , J 3. Grantor grants to Grantee an easement for the construction, maintenance and operation of a public street and appurtenant culverts over and across the following described real property in the City of Renton, King County,Washington, situated in the SW 1/4 of Section 30, Township 23 North, Range 5 East, W.M. and the SE '/4 of Section 25, Township 23 North, Range 4 East,W.M.: that portion of the 40 foot wide right of way of Springbrook Creek, said right of way being 20 feet on each side of the north-south section line common to Section 30, Township 23 North, Range 5 East, W.M. and Section 25, Township 23 North, Range 4 East, W.M., bounded on the north by a line lying one hundred and fifty(150) feet north of, and parallel with, the centerline of the SW 34th Street right of way as platted in the plat of Burlington Northern Industrial Park of Renton, Division No. 2, as recorded in Volume 111 of plats, pages 42-44, records of King Cflunty, Washing�an, and bounded on the sou�h �y a line lying one hundred and fifty (150) feet south of, and parallel with, the centerline of the SW 34th Street right of way as platted in said plat; the dimensions of said easement being forty(40) feet by three hundred (300) feet. Grantee will install, and from time to time and all times hereafter, will repair, replace, maintain and clean a three-sided box culvert and appurtenant structures within said easement for the purpose of allowing and maintaining the flow of storm water drainage. All modifications contained herein shall take effect immediately, and Grantee's exercise of any of the rights contained herein shall be deemed an acceptance of the terms, provisions and conditions of said easement and this amendment. Except as modified herein, all remaining terms and provisions of the easement shall remain in full force and effect.
