TOGETHER WITH the right to make all necessary slopes for cuts and itlls upon the abutting property on each side of any road which is not, or may be constructed hereafter on said property, may be made on their property as herein set forth, in conformity with standard plans and specifrcations for highway purposes, and to the same extent and purposes as if the rights herein granted had been acquired by condemnation proceedings under Eminent Domain statutes of the State of Washington. E:ccept as may be otherwise set forth herein, Grantee's rights shall be exercised upon that portion of the Property("Easement Area"herein)described as follows: Beginning at the intersection of.'Vortheast 24th Street and 138th Avenue Southeast(Coal Creek Parkway Southeast), said intersection being a 3/4 inch copper rod monument. Thence north O�l°SS'30" east 130.�9 feet along the existing right-of-way center line of 138th Avenue Southeast (Coal Creek Park►vay Southeast) to the beginning of a tangent curve having a radius of 573.14 feet and whose center bears north 85°04'30"west. Thence northwesterly along said curve a distance of 251.54 feet along the existing right- of-way center line of 138th Avenue Southeast(Coal Creek Parkway Southeast) through a central angle of 25°OS';!7". Thence north 69°-�6'-�3"east 30.00 feet, to a point lying on the east right-of-way line of 138th Avenue SE (Coal Creek Par/cway SE), said point being the TRUE POINT OF BEGINNING. Thence north 66°03'3st"east 39.53 feet. Thence north 23°56'-f6"west.i.00 feet. Thence south 66°03'3,t" west 39.22 feet to the beginning of a non-tangent curve to the right having a radiz�s of 603.1-1 feet and whose center bears south 69°18'10"west. Thence sozrthwesterly along said curve a distance of 5.01 jeet through a central angle of 00°28'33"to the TRUE POINT OF BEGINNING. Containing 197 square feet more or less. rollowing the initial construction of all or a portion of its systems, Grantee may, from time to time, construct, maintain, repair, or alter such additional facilities as it may require for such systems. Grantee shall have the right of access to the Easement Area over and across the Property to enable Grantee to exercise its rights hereunder. Grantee shall compensate Grantors for any damage to the Property caused by the exercise oi such right of access by Grantee. Grantee shall have the right to cut, remove and dispose of any and all brush, trees, or other vegetation in the Easement Area. Grantee shall also have the right to control, on a continuing basis and by any prudent and reasonable means, the establishment and growth of brush, trees or other vegetation in the Easement Area. Grantors reserves the right to use the Easement Area for any purpose not inconsistent with the rights herein granted, provided, however, Grantors shall not construct or maintain any buildings, structures, or other objects on the Easement Area and Grantors shall do no blasting within 300 feet of Grantee's facilities without Grantee's prior written consent. This easement shall be a covenant runninQ with the land and shall be binding on the Grantors and Grantors' successors, heirs and assigns.
