The subject site was formerly used as a church. A Conditional Use Permit was granted for the use of the site as school on March 25, 1999 (LUA-98-177, ECF, CU-H). The site is developed with a 2,523 square foot annex building, a 6,975 square foot school/church building, and associated parking, landscaping, and improvements. The site slopes from east to west and is relatively flat with the exception of some steep slopes (25% to 30%) on the eastern portion of the property. The sloped areas are vegetated with trees and understory. No development is proposed in these areas. The proposal does not require any grading or land clearing and no parking spaces would be eliminated. Upon the issuance of permits, the portables would be installed in approximately 5 days. The portables are each 1,792 square feet in size and would be approximately 15 feet in height. One portable is proposed 30 feet south of the existing school building on an existing gravel yard. The second portable would be located on the west side of the existing drive and parking area, approximately 70 feet west of the building. The proposed portables would be used as classrooms and would be considered an expansion of the existing school. Since the proposal is less than a 10% expansion of the school, the portables are permitted with Administrative Site Plan Approval. The site plan regulations exempt secondary uses, such as these, from public notice and comment requirements (RMC section 4-9-200.B.2). Due to the size of the structures, Environmental (SEPA) Review is also not required. PART TWO: ADMINISTRATIVE LAND USE ACTION - REPORT & DECISION This decision on the administrative land use action is made concurrently with the environmental determination. A. Consistency with Site Plan Criteria In reviewing the proposal with respect to the Site Plan Approval Criteria set forth in Section 4-9- 200.E.1 of the Site Plan Ordinance, the following issues have been identified by City Departmental Reviewers and Divisional Reviewers: siterpt City of Renton P/B/PW Department Administra Site Plan Approval Staff Report ' NEW HORIZONS SCHOOL PORTABLE CLASSROOMS LUA-99-115,SA-A REPORT AND DECISION OF AUGUST 20, 1999 Page 3 of 6 1. Conformance with the comprehensive plan, its elements and policies; The subject site is designated Residential Options (RO) on the City's Comprehensive Plan Land Use Map. The Land Use Element of the Comprehensive Plan contains policies that support the siting of educational facilities in residential designations. For example, Objective LU-KK states that adequate land should be available at appropriate locations for facilities which meet the educational needs of area residents. Policy LU-249 also states that schools should be allowed in residential neighborhoods when adverse impacts to the surrounding area are mitigated. The proposed expansion to the New Horizons School would be consistent with these objectives and policies. 2. Conformance with existing land use regulations; The subject site is zoned Residential at 10 dwelling units per acre (R-10). School expansions of up to 10% are permitted subject to Site Plan Approval. The proposal's compliance with the R-10 development standards is discussed below. Setbacks —The R-10 zone requires a minimum front yard setback of 20 feet and a rear yard setback of 15 feet. The required side yard setbacks are 5 feet. However, if a site is located adjacent to property zoned R-8, a minimum setback of 25 feet is required from that side of the property. Property designated R-8 is located adjacent to the site's west property line. The proposed portable closest to the west property line maintains a setback of approximately 65 feet. Both portables exceed all minimum required setbacks of the zone. Building Height— The R-10 zone restricts building height to 2 stories and 30 feet. The height of the portables would be approximately 15 feet and would satisfy this requirement. Lot Coverage — Maximum lot coverage by buildings is limited to 50% of the total lot area and impervious surfaces are limited to 60% of the total lot area. The applicant has estimated that the total amount of building footprint would be approximately 9,794 square feet and impervious surfaces would be approximately 42,410 square feet. The proposal would arrive at lot coverages of 5.9% by buildings and 25.8% by impervious surfaces— both of which are within the maximum permitted. Parking and Landscaping — The site is currently developed with existing parking areas and landscaping. The parking regulations require the provision of one space for each employee, plus one space for every 10 students. A total of 45 parking stalls are currently provided on the site, including 5 accessible parking stalls. Based on enrollment and employee counts, the school requires 22 parking stalls (15 employee and 7 student). No additional parking above that which presently exists would be required. 3. Mitigation of impacts to surrounding properties and uses; The subject site is fully developed with an existing private school and church. The proposed portables would not change the character of the site or the neighborhood. Therefore, impacts to surrounding properties and uses would be minimal. 4. Mitigation of impacts of the proposed site plan to the site; The proposal is not expected to adversely impact the site. There is a small creek located along the west boundary of the site. However, the proposed portables would maintain a setback of greater than 65 feet from the creek. In addition, no grade or fill would be necessary for the placement of the portables and site disturbance would be minimal. 5. Conservation of area-wide property values; The proposed portable classrooms would allow an existing facility to make desired improvements in its current location. The project is anticipated to conserve property values in the vicinity. 6. Safety and efficiency of vehicle and pedestrian circulation; There are no changes proposed to the existing vehicle circulation and parking layout for the site. Therefore, staff will recommend as a condition of approval that the applicant be required to install a striped walkway denoting a pedestrian crossing across the parking and drive aisle area from the west portable to the main school building. 7. Provision of adequate light and air; The proposed portables would allow adequate light and air circulation to the building and to the site. 8. Mitigation of noise, odors and other harmful or unhealthy conditions; The proposal is not expected to create any harmful or unhealthy conditions. The level of noise would be an incremental increase in the surrounding area. Since the school is presently operating on the site, the noise would not be expected to increase over existing levels. 9. Availability of public services and facilities to accommodate the proposed use; and Utilities and roads adequately serve the subject site. The proposed addition will not require the extension of services or further improvements. 10. Prevention of neighborhood deterioration and blight. Findings, Conclusions & Decision Having reviewed the written record in the matter, the City now enters the following: 1) Request: The Applicant has requested Administrative Site Plan Approval for the New Horizons School Portable Classrooms, File No. LUA-99-115, SA-A. 2) Site Plan Review: The applicant's site plan application complies with the requirements for information for site plan review. In the event that Borrower shall breach any obligation under this Deed of Trust or the Note which it secures or shall: (a) Receive notice that any violation of any Federal, State or local environmental, health or safety law or regulation may have been committed or is about to be committed by Borrower in connection with the Property; (b) Receive notice that any administrative or judicial complaint or order has been filed or is about to be filed against Borrower alleging violations of any Federal, State or local environmental law or regulation or requiring Borrower to take any action in connection with the release of toxic or hazardous substances or release of petroleum or any petroleum product (including, without limitation, crude oil or any fraction thereof) into the environment in connection with the Property; (c) Receive any notice from a Federal, State or local governmental agency or private party alleging that the Borrower may be liable or responsible for costs associated with a response to or clean up of a release of a toxic or hazardous substance or release of petroleum or any petroleum product (including, without limitation, crude oil or any fraction thereof) into the environment or any damages caused thereby in connection with the Property; (d) Receive any notice that Borrower is subject to Federal, State or local investigation evaluating whether any remedial action is needed to respond to the release of any hazardous or toxic waste, substance or constituent, petroleum or petroleum products (including, without limitation, crude oil or any fraction thereof) or any other substance into the environment in connection with the Property; (e) Incur any additional debt without the prior written consent of Beneficiary in connection with the Property; or in the event that: (a) Beneficiary shall reasonably deem itself insecure; (b) Any proceeding shall be instituted by or against Borrower under any bankruptcy or insolvency statute; (c) Borrower shall make an assignment for benefit of creditor; (d) A receiver shall be appointed for Borrower or Borrower's property, Beneficiary may, at its option, without notice or demand, require immediate payment in full of all sums then due and owing on the Note. 5. Borrower shall (1) promptly repair, restore or rebuild any buildings or improvements now or hereafter on the Property which may become damaged or destroyed; (2) keep said Property in good condition and repair, without waste, and free from mechanic's or other liens or claims for lien; and (3) comply with all requirements of law or municipal ordinances with respect to the Property and the use thereof. 6. Borrower shall keep all buildings and improvements now or hereafter situated on said • Property insured against loss or damage by fire, lightning and windstorm under policies providing for payment by the insurance companies of moneys sufficient either to pay the cost of replacing or repairing the same or to pay in full the indebtedness secured hereby, all in companies satisfactory to Beneficiary under insurance policies payable, in case of loss or damage, to Beneficiary, such rights to be evidenced by the standard mortgage clause to be attached to each policy, and shall deliver certificates of insurance evidencing such coverage, to Beneficiary, and in case of insurance about to expire, shall deliver renewal certificates not less than ten (10) days prior to the respective dates of expiration. 7. Borrower agrees to pay reasonable attorneys' fees, costs and expenses incurred by Beneficiary in the collection and enforcement of the above referenced Note. Any forbearance by Beneficiary exercising any right or remedy shall not be a waiver of or preclude the exercise of any right or remedy. 8. The above terms which are incorporated into the Deed of Trust referenced above are agreed to and accepted by the signatories.
