EXHIBIT1TOTHEINTERLOCALAGREEMENTFORCOOPERATIONBETWEENTHECITYOFRENTONANDTHERENTONREGIONALFIREAUTHORITYOFFICEOFTHEFIREMARSHALSERVICES1.OfficeoftheFireMarshalServices.PriortotheestablishmentoftheRRFA,theCity’sFireandEmergencyServicesDepartmentprovidedCommunityRiskReductionServicesthroughitsCommunityRiskReductionSection,nowreferredtoastheOfficeoftheFireMarshal(OFM).Theseservicesinclude,butarenotlimitedto,administrationandenforcementofapplicablefirecodeandpreventionregulations(“CodeorCodes”),includingRMC4-5-070asthatsectionmaybeamendedorrecodifiedbytheCity.TheRRFAwillcontinuetoprovidetheseservicesfortheCitywithintheCity’sboundaries,andasthoseboundariesmaybeadjustedinthefuture.AsfurtherdescribedwithinthisExhibit1,1OFMServicesarecomprisedofOEMAdministrationServicesFirePreventionCodeEnforcementServices,FirePreventionDevelopmentServices,andFireInvestigationServices(collectively,the“Services”).2.FireServiceFeesPaidtoRRFA.TheCityshallcontinuetocollectapplicableOEMFeeslistedinSubsectionXIII(a)fi-vi)andSectionXIII(b)(iii)ofthecurrentCityofRentonFeeSchedule.BynolaterthanAugust1ofeachyear,theRRFAmaysubmittotheCityproposedupdatestotheOEMfeeschedule.UpdatestothefeeschedulearesubjecttoCityCouncilapproval,whichwillnotbeunreasonablywithheld.IntheeventtheCityCouncildoesnotapprovethefeescheduleproposedbytheRRFA,theRRFAmay,usingtheprocessidentifiedinSectionXVI(C)oftheAgreement,requestdiscussionofthefinancialimpactstotheRRFAofnothavingitsproposedfeescheduleapproved.AllFireDepartmentOFMfees,assuchfeesmayberenamed,shallbepaidtotheRRFAascompensationfortheRRFAprovidingtheCitytheservicesdescribedinExhibit1.TothedegreethesefeesandanyassociatedlatefeesarecollectedbytheCitythroughitsbilling,permitorlicensesystems,theCitywillremitthefundscollectedtoRREAinatimelymanner.Thepartiesagreethesefees,alongwithanyotherconsiderationprovidedbythisAgreement,constitutefull,fair,andcompletecompensationfortheRREA’sperformanceoftheServicesdescribedinExhibit1.3.OFMAdministrationServices.TheRRFAshallprovidethefollowingOFMAdministrationServices:a.DirectthemanagementandsupervisionofpersonnelperformingtheServices.1ThedescriptionofOFMServicesinthisExhibit1isintendedtoprovideanoverviewoftheServicesthatwerepreviouslyprovidedbytheCity’sFireandEmergencyServicesDepartment.Withtheexceptionofemergencymanagementservices,theServicesshouldbeconstruedbroadlysothattheRRFAwillcontinueseamlesslyprovidingallservicespreviouslyprovidedbytheCity’sFireandEmergencyServicesDepartment.EXHIBIT1—OFFICEOFTHEFIREMARSHALSERvIcESPsge1of19 4.FirePreventionCodeEnforcementServices.TheRRFAshallprovidethefollowingFirePreventionCodeEnforcementServicesinRentoncityboundaries:a.PerformallinspectionsrequiredorauthorizedbytheCode,includingtheinspectionofneworrelocatedbusinessesforCodecompliance,permitissuance.b.InvestigateandresolveCodeviolationcomplaintsorinquiries.c.PerformallCodeenforcementdutiesoftheFireMarshall,FireCodeOfficial,and/orFireChiefasprovidedintheCode.Provided,however,theCityshallberesponsibleforprovidingprosecutionservicesandlegalcounselnecessarytoprosecuteanycivilorcriminalcodeenforcementissueswhenenforcementrequiresjudicialaction(includinghearingexaminerproceedings).OnceenforcementisturnedovertotheCityforjudicialaction,theCityretainsindependentprosecutorialdiscretionastohoworwhethertoproceedwithenforcementaction.TheCitywillalsomaintainresponsibilityforanyCodeenforcementactivitiesthatrequirethepresenceorinvolvementofcommissionedlawenforcementofficers.TheRRFAstaffwhoinspectedthepropertyandfoundittobeinviolationshallappearbeforeanycourt,hearingexaminer,board,committee,orotherbodyempoweredtoenforcetheprovisionsoftheIFCinordertoassistRentonwithenforcingtheIFCatthesolecostoftheRRFA.Ifthepartiesmutuallyagree,theCitymayprovideemployeesoftheRRFAwithalimitedlawenforcementcommissiontoenforceportionsoftheCodethatrequiresuchcommission(e.g.issuanceofinfractionsforfirelaneparkingorfireworksenforcement).ThepartiesacknowledgethattheRRFA,bystatute,hasnodutytoenforceanyprovisionsofthecodeortoenforceordinancesoftheCityexceptunderthetermsofthisInterlocalAgreementandtheRFAPlan.AnydutytheRRFAdoeshavetoenforcetheCodeisnotintendedtobenefitanyspecificmembersofthegeneralpublic.TheCityagreesthatallcourtcostsandotherlegalcostsincurredinthejudicialenforcementoftheCodewithintheCitylimitsshallbepaidbytheCityandshallnotbeconsideredanoperatingexpenseoftheRRFA.U.CoordinatewiththeCitywhenenforcementeffortsarecontestedandwhentheCityisundertakingrelatednon-firecodeenforcementefforts.e.PerformspecialinspectionsrequiredbyoutsideagenciessuchasDepartmentofDefense,DepartmentofEarlyLearning,DepartmentofSocialandHealthServices,andprivateinsurancecompanies.f.CoordinatewiththeCityonpost-disasterbuildingandsysteminspectionsand/orevaluations.g.Approveandreviewfiresafety,emergencyevacuation,lockdown,shelter-in-place,andhazardousmaterialsmanagementplans.EXHIBIT1—OFFICEOFTHEFIREMARSHALSERVICESPage3of19 h.AttendandprovidetestimonyandexhibitsatCodeenforcementhearingsbeforetheCity’sHearingExaminer,anduponappeal,ifany,tocourt.i.PerformallothertasksrelatedtoprovidingtheaboveFirePreventionCodeEnforcementServices.5.FirePreventionDevelopmentServices.TheRRFAshallprovidethefollowingFirePreventionDevelopmentServicesinRentoncityboundaries:a.ManagetheKnox/Supralockboxprogram.b.CoordinatewiththeCitytoprovidetimelydevelopmentreviewprogramservices,includingansweringprojectinquiries,attendingmeetings,reviewingplansforCodecompliance,andapprovingplanswhenincompliancewiththeCode.c.Providedevelopmentinspectionprogramservicestoincludepre-constructionmeetings,inspections,troubleshootingfireprotectionsystems,finalacceptancetests,fieldreviewofbasicpermits,coordinationwiththeBuildingServicesDivisionfortheissuanceofCertificatesofOccupancy.U.AssistandadvisetheCityinitseconomicdevelopmentactivitiestoincluderesearchofproperties,systemsandcoderequirementsforpotentialprojectsandexistingbuildings.e.Approvehydrantplacementonpublicandprivateprojects.f.Providefalsealarmreductionprogramactivities,whichshouldincludefollowupwithownersoffaultyalarmsystems,coordinationwithpropertyowner/agentinitseffortstotroubleshootandrepairfaultyalarmsystems,andqualityassuranceofincidentreportsfromfalsealarms.g.Providefireprotectionsystemconfidencetestprogramactivitiestoincludeevaluationofconfidencetestsprovidedbythirdparties,issuanceofcorrectionnoticesand/ornoticesofviolation,anddraftingofcorrectionagreementsandfieldinspections.h.PerformallothertasksrelatedtoprovidingtheaboveFirePreventionDevelopmentServicesandanyrelatedtasksarisingfromapplicationoftheCode.6.TimelineofWorkProvided.AllservicesprovidedpursuanttothisExhibitshallbeperformedinaprofessionalandcompetentmannerpursuanttoandwithinthetimelinesrequiredoftheCode,Citypoliciesandprocedures,includingapplicablecustomerservicestandards,andanystateorfederallawsapplicabletotheperformanceofthatwork.ExHIBIT1—OFFICEOFTHEFIREMARSHALSERVICESPage4ofl9 7.LevelofService.TheconsiderationprovidedfortheservicesidentifiedinthisAgreementateintendedtomaintainexistinglevelsofservice.Theexistinglevelsofserviceincludeinitialdevelopmentreviewcompletedaccordingtheschedulesgenerallydescribedasfollows:a.LandUse:•GreenFolder;stReviewcompletedwithintwo(2)weeks•Pre-Application;stReviewcompletedwithintwo(2)weeks•SEPA5tReviewcompletedwithintwo(2)weeksb.ConstructionPermits*:•SingleFamilyPReviewwithintwo(2)weeks•CommercialTI5tReviewwithintwo(2)weeks•CommercialStReviewwithinfour(4)weeks*ltisrecognizedbybothpartiesthatthereareexceptionsthatarisethatimpactturnaroundtimesthatshallbetakenintoconsiderationindeterminingcompliancewiththissectionoftheagreement.8.IntheeventtheCity,foranyreason,determinesthatitisintheinterestoftheCitytoincreasethedefinedLevelofService,theCityshallberesponsiblefortheadditionalcostsincurredbytheRRFAtoprovideadditionalstaffingtomeettheincreasedLevelofService.AnymodificationtotheLevelofServiceshallbeprecededbyanagreementrelatingtothemodificationsandthefundingrequirements.IneventsubstantialvolumeincreasesaffecttheabilityoftheRRFAtomeetthedefinedLevelofService,thepartiesagreetocollaborateinthepublicinteresttoaddressadjustmentsinfundingorserviceslevelsonmutuallyagreeableterms.9.FireMarshal/FireCodeOfficialReportstoCity’sCAOorCommunityandEconomicDevelopment(CED)Administrator.TheCity’sFireMarshal/FireCodeOfficialshallprovidereportstotheCAOortheCity’sCEDAdministratorasrequested.WhiletheFireChiefshallhavetheauthoritytodirecttheworkoftheRRFAemployees,theCity’sCEDAdministratorordesigneeshallbekeptinformedofthedevelopmentreviewworkperformedbytheRRFAemployees,andshallhaveauthoritytoprovideinputtotheFireChiefinsettingthedesiredoutcomesofstaffperformingdutiesofFirePreventionDevelopmentServices.10.EquipmenttoPerformServices.EquipmentforstaffthatperformsOFMServicesshallbeprovidedbytheRRFA.ForthepurposesofperformingtheServicesandsubjecttolicensingtermsandsecurityrequirements,thepartiesagreetocooperateandshareEXHIBIT1—OIFICEOFTHEFIREMARSHALSERvIcESPage5of19 accesstoelectronicpermittingsystemsandotherelectronicsystemsnecessarytocoordinateservices.TheCityshallallowtheRRFAtoaccesssuchsystemsfromtheRRFAnetworkwheneveritisfeasibletodoso.11.OfficeSpacetoPerformServices.Aspartialconsiderationfortheservicesprovided,theCitywill,ifrequestedbytheRRFA,providetheRRFAwithadequateofficespacetohousetheRRFAstaffnecessarytoprovidetheservicesidentifiedinthisExhibit.12.TransmissionofFeesandCharges.TheCityshallestablishastandardprocedureforthetransmissionofallfeesitcollectspursuanttoSectionXIVoftheAgreementandremitthemoneytotheRRFAonatimelybasisthatisnolessfrequentthanmonthly.WhenremittingpaymenttotheRRFA,theCitymaydeductanycostsitincurredtocollectthefees,includingbutnotlimitedtocourtcosts,attorneys’fees,andpaymentstodebtcollectioncompanies.13.AccountingofFeesandCharges.WhentheCitytransmitsmoneytotheRRFApursuanttoSection12ofthisExhibit,theCityshallprovidetheRRFAwithsupportingdocumentsthatdescribetheServicesforwhichthemoneywascollected.Partiesrecognizethesefeesareadministeredthroughthepermitsystemthatbothpartieshaveaccessandresponsibilitytoensuretheaccuracyandintegrityofthedata.TheRRFAhasarighttorequestanauditofthesystemnomorefrequentlythanonceperyear.ThecostofanauditrequestedbytheRRFAshallbepaidbytheRRFAunlessotherwiseagreedbytheparties.14.CollectionofFees.ThepartieswillcooperatetocollectoutstandingunpaidfeesandchargesfortheServices.TheCityisnotrequiredtopaytheRRFAforuncollectedorunpaidfees.15.FireInvestigationServices.TheRRFAshallperformFireInvestigationServiceswithintheCitylimitsthatincludebutarenotlimitedto:a.Investigatethecauseandoriginoffires,interviewsuspectsandwitnesses,examinefirescenes,documentfindingsandpreparereports,protectevidence,cooperatewithprosecutorsandlawenforcement,beavailableforinterviewsandcourtroomtestimony,andotherassociatedduties.b.Investigateallfiresthatarearson,suspicious,injurious,andfireswithalossoftenthousanddollars($10,000)ormore.c.CoordinatearsoninvestigationactivitieswiththeRentonPoliceDepartmentasnecessary.d.Staffthe24/7FireInvestigationUnitbyrespondingtoallworkingfireswhenrequested.e.Participateinregionalandstatefireinvestigativeorganizationsandactivities.EXHIBIT1—OFFICEOFTHEFIREMARSHALSERVICESPage6of19 f.PerformallothertasksrelatedtoFireInvestigationServices.g.ProvidingcrosstrainingtoCityPersonnelinthediscretionoftheFireMarshall.16.EvidenceRetention.AllevidencegatheredduringthecriminalinvestigationofafireorothereventforwhichFireInvestigativeServicesareprovidedshallbecollectedandmaintainedbytheevidencecustodiansoftheCity’sPoliceDepartmentpursuanttothepoliciesandproceduresforthemaintenanceofevidencesetforthbytheCity’sPoliceDepartment.17.CooperationinCriminalInvestigations.ThepartieswillcooperateandkeepeachotherinformedastothestatusofallfiresintheCitythatoccurasaresultofsuspectedorconfirmedcriminalconductbyprovidingstatusreportsofinvestigationsastheinvestigationsevolve.Thisobligationshallnotbeconstruedtorequirethedisclosureofinformationifdisclosurecouldjeopardizeacriminalinvestigation.18.Records.AllrecordsrelatingtotheprovisioningoftheservicescalledforinExhibit1shallbemaintainedasfollows:a.FirePlansReviewRecordsshallbemaintainedinapermitsystemprescribedbytheCity,thatshallbeaccessiblebytheassignedRRFApersonnel.b.FireInspectionRecordsshallbemaintainedinarecordsmanagementsystemprescribedbytheRRFA.RecordsshallbemadeavailablewithinareasonabletimeframetotheCityuponrequest.c.Otherrecords,notspecificallylistedherein,shallberetainedinamethodthatismutuallyagreeduponbetweentheCityandtheRRFA.RecordsshallbemadeavailablewithinareasonabletimeframetotheCityuponrequest.d.Recordretentionshallbeinaccordancewithstaterecordsretentionrequirements.CustodyanddisclosureoftherecordsshallbemanagedinaccordancewithExhibit6.19.EmployeePerformanceFeedback.TheCityofRentonshallprovideregularfeedbacktotheFireChiefpertainingtotheperformanceofRRFAemployeesperformingservicescalledforinExhibit1.20.NewEmployees—HiringorAssignment.Whenfeasible,theCity’sCAOshallhaveinputintotheappointmentorassignmentofanypersontoapositionthatperformsservicespursuanttoExhibit1,whichcouldincludeone(1)ormoreRentonemployeesservingonaninterviewpanelforthehiringand/orassignmentofthatposition.ExHIBIT1—OFFICEOFTHEFIREMARSHALSERVICESPage7of19 EXHIBIT2TOTHEINTERLOCALAGREEMENTFORCOOPERATIONBETWEENTHECITYOFRENTONANDTHERENTONREGIONALFIREAUTHORITYINFORMATIONTECHNOLOGYSERVICES1.Purpose.TheCityofRentonprovidedInformationTechnologyfIT)servicestotheRRFAsincetheRFAwasestablished.AspartoftheRRFA’stransitiontoitsownIToperations,theRFAwillneedtooperateequipmentintheDataCenterspacesinFireStation12whichisoperatedandmaintainedbytheCityofRenton,andtheCityofRentonwillcontinuetooperatesomeelementsoftheCityITNetworkwithinstationsoftheRFA.2.CrownNetwork.TheCityofRenton,WirelessNetwork(CROWN)isoperatedbytheCityofRentontobenefititscitizensandpublicsafetypersonnel.Thisnetworkprovidesoutdoor,parkinglotWiFiaccessatsomeRRFAstations.TheRRFAagreestotheCity’sITDepartmentcontinuingtooperateitsWiFinetworkforoutside-buildingaccessatthelocationsitiscurrentlyprovided.TheRRFAwillallowCityITstaffaccesstoequipmentspaceswhereCROWNequipmentandnetworkconnectionsaremaintained.TheCityITdepartmentwilllabelallnetworkrelatedequipmentsothatRRFAITstaffareawarethatmaintenanceandoperation(M&O)ofthelabeledequipmentistheresponsibilityiftheCityITDepartment.IftheRRFAITdepartmentwillbeworkingintheareaofCROWNequipment,itwilladvisetheRentonITdepartment,andwilltakemeasuretonotdisturbCROWNoperations.TheRRFAwillallowCityITstaffaccesstoCROWNNetworkequipmentduringnormalweekdaybusinesshours(8AM—5PM,Monday—Friday)forpurposesofmaintenance,operations,andrepair.3.FireStation12EquipmentColocation.TheCityITdepartmentoperatesabackupdatacenterfortheCityIToperationsatFireStation12pursuanttotherightsgrantedtotheCityunderthe2016GroundLeaseAgreementwiththeRFA.TheCityagreestoprovidetheRFAupto10rackUnitsspacesonthesecondfloorofFireStation12,Uninterruptablepowersupply,andenvironmentalconditioningtotheequipmentlistedinAppendixAofthisExhibit.TheCityofRentonwillprovideRRFAITstaffthemeanstoaccessthisspaceona7x24x365basisforthepurposesofoperating,maintaining,repairingandconfiguringRRFAequipmentinthedatacenter.TheRRFAagreestotheCity’srequirementthataFBI-CJIS—Certifiedemployeewillescortanyemployeeorcontractorneedingaccesstothisroomatalltimestheyareintheroom.Thepartiesshallworkcooperativelytoestablishadditionalaccessandsecuritymonitoringequipmentandproceduresonaproportionalcostsharingbasis.EXHIBIT2—ITSERVICESPageSof18
