6025CITYOFRENTON,WASHINGTONORDINANCENO.6025ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSUBSECTIONS4-8-080.G,4-8-090.F,4-8-11O.C.8,AND4-8410.F.4OFTHERENTONMUNICIPALCODE,AMENDINGPUBLICNOTICEREQUIREMENTSFORAPPEALSANDCLARIFYINGTHEDISTINCTIONBETWEENOPENRECORDHEARINGSANDOPENRECORDAPPEALS,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay3,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonMay19,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-8-080.GoftheRentonMunicipalCodeisamendedasshownonAttachmentA.SECTIONIII.4-8-090.FoftheRentonMunicipalCodeisamendedasfollows:F.NOTICEOFPUBLICHEARING:Publicn44oticeofapublichearingforalldevelopmentapplicationssubjecttonotificationrequirementsandallopenrecordappcalshallbegivenasfollows:1 ORDINANCENO.60251.TimeofNotices:Exceptasotherwiserequired,publicnotificationofmeetings,hearings,andpendingactions,andopcnrccordappeals,asdefinedbychapter42.30RCW,shallbemadeby:a.Publicationatleastten(10)daysbeforethedateofapublicmeeting,hearing,orpendingactionintheofficialnewspaperifonehasbeendesignatedoranewspaperofgeneralcirculationintheCity,b.Mailing(U.S.Postalorelectronictransmittal(email)ifagreedtobyparties)atleastten(10)daysbeforethedateofapublicmeeting,hearing,orpendingactiontoallpartiesofrecord,theprojectproponentandaffectedgovernmentagencies,andc.PostingontheCity’swebpageatleastten(10)daysbeforethedateofpublicmeeting,hearing,orpendingaction.2.ContentofNotice:Thepublicnoticeshallincludeageneraldescriptionoftheproposedproject,theactiontobetaken,anonlegaldescriptionofthepropertyoravicinitymaporsketch,thetime,dateandplaceofthepublichearing,wherefurtherinformationmaybeobtained,andthefollowing,orequivalent,statement:“Ifthehearingonapendingactioncannotbecompletedonthedatesetinthepublicnotice,themeetingorhearingmaybecontinuedtoadatecertainandnofurthernoticeunderthisSectionisrequired.”SECTIONIV.Subsection4-8-110.C.8oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-8-110.Cremainineffectandunchanged.C.GENERALINFORMATIONAPPLICABLETOAPPEALS:2 ORDINANCENO.6025ThefollowingappliestoappealstotheHearingExaminerandCityCouncilunlessotherwiseprovidedelsewhereintheRMCorbystatelaw:1.Standing:Onlytheapplicant,Cityorapersonwhohasbeenmadeapartyofrecordpriortotheissuanceofadecisionmayappealthedecision.Inordertoappeal,thepersonshallbeaggrievedoraffectedbythedecisionpursuanttoRCW36.70C.060.2.TimetoFile:ExceptforfinalEISdecisions,allappealperiodsshallbefourteen(14)calendardays,whichshallbegineitherthree(3)calendardaysafterthedateofmailingofthedecisiontothepartiesofrecordviaU.S.PostalmailbytheCityClerk,orthedatethedecisioniselectronicallytransmitted,postedoremailedtotheappellantandpattiesofrecordbytheCityClerk,ifsuchelectronictransmittalmethodhasbeenpreviouslyapprovedoragreedtobythepatties.TheappealperiodforafinalEISshallbetwenty(20)calendardaysfromthepublicationofthefinaldecision.3.RequiredFormforandContentofAppeals:AnyappealshallbefiledinwritingwiththeCityClerk.Thewrittennoticeofappealshallfully,clearlyandthoroughlyspecifythesubstantialerror(s)infactorlawwhichexistintherecordoftheproceedingsfromwhichtheappellantseeksrelief.Iftheappealisunclearanddoesnotsufficientlyexplainthebasisfortheappeal,anorderrequiringtheappellantamendtheappealwithinten(10)calendardaysofthedateoftheordermaybeissued.Iftheappealisnotsatisfactorilyamendedwithinthetimeallowed,itshallbedismissed.3 ORDINANCENO.60254.FilingofAppealandFee:ThenoticeofappealshallbeaccompaniedbyafeeinaccordancewiththeCityofRentonfeeschedule.5.FacsimileFilings:WheneveranyapplicationorfilingisrequiredunderthisChapter,itmaybemadebyfacsimile.AnyfacsimilefilingreceivedattheCityafterfiveo’clock(5:00)p.m.onanybusinessdaywillbedeemedtohavebeenreceivedonthefollowingbusinessday.Anyfacsimilefilingreceivedafterfiveo’clock(5:00)p.m.onthelastdateforfilingwillbeconsideredanuntimelyfiling.Anypartydesiringtomakeafacsimilefilingafterfouro’clock(4:00)p.m.onthelastdayforthefilingmustcalltheCityClerk’sofficeandindicatethatthefilingisbeingmadebyfacsimileandthenumbertowhichthefacsimilecopyisbeingsent.ThefilingpartymustensurethatthefacsimilefilingistransmittedinadequatetimesothatitwillbecompletelyreceivedbytheCitybeforefiveo’clock(5:00)p.m.inallinstancesinwhichfilingfeesaretoaccompanythefilingofanapplication,thosefilingfeesmustbereceivedbytheCitybeforetheendofthebusinessdayonthelastdayofthefilingperiodorthefilingwillbeconsideredincompleteandwillberejected.6.Motions:TheHearingExaminermaydismissanappealtotheHearingExaminer,withouthearing,whenitisdeterminedbytheHearingExaminertobeuntimely,withoutmeritonitsface,incomplete,orfrivolous.AnyapplicationtotheHearingExaminerforanordershallbebymotionwhich,unlessmadeduringahearing,shallbeinwriting,statingthereasonsfortherequestandsettingforth4 ORDINANCENO.6025therelieforordersought.Writtenmotionsshallbereceivedatleastfive(5)businessdaysinadvanceotthehearing.7.Parties:ThepartiesinappealhearingsshallbetheCity,theapplicant,andtheappellant(s),ifdifferentfromtheapplicantortheCity.Nootherpersonsshallbeallowedtotestifyunlessservingasanexpertwitnessforoneoftheparties.8.NoticeofAppealFiledandPublicHearing:IfanappealisfiledwiththeCityClerk,theCityClerkshallnotifyallpartiesofrecordtothedecisionsubjecttotheappeal.Noticeshallbesentwithinfive(5)calendardaysviaU.S.PostalmailbytheCityClerk,oronthedatetheapplicationofappealisreceivedifelectronictransmittal(email)hadbeenpreviouslyapprovedoragreedtobytheparties,andatleastten(10)dayspriortothepublicappealhearing.Ahearingfortheappealshallbesetwithintwenty-one(21)daysafteracceptanceofacompleteapplicationforappeal.9.RestrictionsonSubsequentActions:Anylaterrequesttointerpret,explain,modify,orretractthedecisionshallnotbedeemedtobeanewadministrativedeterminationcreatinganewappealperiodforanynewthirdpattytothepermit.10.LimitonNumberofAppeals:PursuanttoRCW36.70B.050and43.21C.075,theCityhasconsolidatedthepermitprocesstoallowforonlyoneopenrecordappealofallpermitdecisionsassociatedwithasingledevelopmentapplication.5 ORDINANCENO.6025Thereshallbenomorethanoneappealonaproceduraldeterminationorenvironmentaldeterminationsuchastheadequacyofadeterminationofsignificance,nonsignificance,orofafinalenvironmentalimpactstatement.AnyappealoftheactionoftheHearingExaminerinthecaseofappealsfromenvironmentaldeterminationsshallbejoinedwithanappealofthesubstantivedetermination.11.ExhaustionofAdministrativeRemedies:NopersonmayseekjudicialreviewofanydecisionoftheCityunlessthatpersonfirstexhauststheadministrativeremediesprovidedbytheCity.SECTIONV.Subsection4-8-110.F.4oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-8-110.Fremainineffectandunchanged.F.APPEALSTOCITYCOUNCIL:1.StandingandPartiestotheAppeal:SeesubsectionCofthisSection.2.TimetoFile:SeesubsectionCofthisSection.3.NoticeofAppeal:SeesubsectionCofthisSection.4.CouncilReviewProcedures:NopublicoropenrecordappealhearingshallbeheldbytheCityCouncil.NoneworadditionalevidenceortestimonyshallbeacceptedbytheCityCouncil.Thecostoftranscriptionofthehearingrecordshallbebornebytheapplicant.Ifatranscriptismade,theapplicantisrequiredtoprovideacopytotheCityClerkandtheRentonCityAttorneyatnocost.ItshallbepresumedthattherecordbeforetheCityCouncilisidenticaltothehearingrecordbeforetheHearingExaminer.6 ORDINANCENO.60255.Burden:Theburdenofproofshallrestwiththeappellant.6.CouncilEvaluationCriteria:TheconsiderationbytheCityCouncilshallbebasedsolelyupontherecord,theHearingExaminer’sreport,thenoticeofappealandadditionalargumentsbasedontherecordbyparties.7.FindingsandConclusionsRequired:If,uponappealofadecisionoftheHearingExaminerandafterexaminationoftherecord,theCouncildeterminesthatasubstantialerrorinfactorlawexistsintherecord,itmaymodifyorreversethedecisionoftheHearingExamineraccordingly.8.AlternativeCityCouncilProcedure:AsanalternativetotheprovisionsofsubsectionsESthrough7ofthisSection,theCityCouncilshallaffirmwithoutreviewadecisionoftheHearingExaminerifoneormoreofthefollowingcircumstancesexist:a.Morethanonetimelynoticeofappealwasfiled.Forthepurposesofthissubsection,anamendedorsupplementalnoticeofappealtimelyfiledbythesameappellantshallnotbedeemedaseparatenoticeofappeal;b.TheprojectatissueintheHearingExaminer’sdecisionhasmorethanfifteen(15)documentedpartiesofrecord;c.TheprojectatissueintheHearingExaminer’sdecisionwasissuedaDeterminationofSignificance(DS)undertheStateEnvironmentalPolicyAct;U.AtimelynoticeofappealassertsthatthejurisdictionofoneormoreagenciesotherthantheCityhasbearingontheoutcomeoftheappeal;or7 ORDINANCENO.6025e.Atimelynoticeofappealassertsthatoneormoretreatyrightshavebearingontheoutcomeoftheappeal.9.DecisionDocumentation:ThedecisionoftheCityCouncilshallbeinwritingandshallspecifyanymodifiedoramendedfindingsandconclusionsotherthanthosesetforthinthereportoftheHearingExaminer.Eachmaterialfindingshaltbesupportedbysubstantialevidenceintherecord.10.CouncilActionFinal:TheactionoftheCouncilapproving,modifyingorrejectingadecisionoftheHearingExaminershaltbefinalandconclusive,unlesstimelyappealed.SECTIONVI.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshaltnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis13thdayofSeptember,2021.JaSethk$ permit.The Environmental Review Committee (ERC)is responsible for environmental determinations. 5.The Community and Economic Development Administrator shall hear variances where not associated with a development that requires review by the Hearing Examiner. 6.Shoreline conditional use permits and shoreline variances also require approval of the State Department of Ecology (DOE).DOE has up to thirty (30)days to make a decision on a permit.This time period does not count toward the one hundred twenty (120)day maximum time limit for permit decisions.DOE’s decision is followed by a twenty one (21)day appeal period,during which time no building permit for the project may be issued. 17 ORDINANCE NO.6025 7.An open record appeal of an environmental threshold determination must be held concurrent with an open record public hearing. 8.Street vacations,development regulation text amendments,and Comprehensive Plan map or text amendments are exempt from the one hundred twenty (120)day permit processing time limit. 9.Environmental review for a permitted/secondary/accessory use not requiring any other land use permit. 18
