HomeMy WebLinkAboutContract - Full File CAG-97-164 CITY OF RENTON and SOOS CREEK WATER AND SEWER DISTRICT INTERLOCAL AGREEMENT FOR THE ESTABLISHMENT OF SERVICE BOUNDARIES THIS AGREEMENT, made and entered into this day of Ti06tC C-- , 19 9.9 ,by and between the CITY OF RENTON,a Washington municipal corporation, hereinafter referred to as "the City", and SOOS CREEK WATER ANT)SEWER DISTRICT, a Washington municipal corporation,hereinafter referred to as 0 "the District",both being duly organized and existing under and by virtue of the laws of the o m State of Washington, =iT WITNESSETH: E z CI WHEREAS,both the City and the District are public agencies authorized by law and m o qualified to engage in furnishing water service and sanitary sewer service within their prescribed O c areas;and m m z WHEREAS, it is in the public interest for the parties herein to amend the boundaries A z previously agreed to under the 1991 Interlocal Agreement to provide for the efficient planning _ and development of water and sewer services in areas which may be served by either,or both, of the parties herein. -'-n mm NOW,THEREFORE: o rn IT IS HEREBY AGREED by and between the parties hereto as follows: 0 cri rnn 1. Water Service Boundary. The parties have agreed on a revision to the permanent water service area boundary between them. The revised boundary is legally described in i x Exhibit"A",which is attached hereto,and by this reference incorporated herein. The boundary ! is graphically depicted on the map attached hereto as Exhibit "B", which is by reference z incorporated herein. _ N 2. Sewer Service Boundary. The parties have agreed on a revision to the permanent ! z sewer service area boundary between them. The revised boundary is legally described in Exhibit"C",which is attached hereto,and by this reference incorporated herein. The boundary I m is graphically depicted on the map attached hereto as Exhibit "D", which is by reference incorporated herein. Renton/Soos Creek Interlocal Agreement for the Establishment of Service Area Boundaries- 1 i I 1 3. Transfer of Service Area. The City shall assume responsibility to provide service to the area(s) on the City's side of the respective service area boundaries as revised by this agreement, whether or not annexed to the City. The District shall assume responsibility to provide service to the area(s)on the District's side of the respective service area boundaries as revised by this agreement,whether or not annexed to the City. AS part of this agreement, the sewer facilities installed under District ULID 11 shall be transferred to the City as described in the November 19, 1974 interlocal agreement notwithstanding that the properties served by these sewers have not been annexed to the City. 4. Governmental Approvals. The parties may give notice of the adoption of this Agreement to Metropolitan/King County, to the Department of Ecology, to the Department of Health,and to any other agency with jurisdiction or mission relevant to the terms hereof,and o shall cooperate and assist in all reasonable manner in procuring any necessary approvals hereof n by those agencies. rn 5. Sanctity of Agreement. This agreement constitutes the entire agreement of the parties I c� regarding the subject matter hereof,and there are no other representations or oral agreements o m other than those listed herein,which vary the terms of this agreement. We have come to an o agreement on the proposed interlocal agreement. 0 RECOMMENDATION: cn • The Planning/Building/Public Works Department recommends that Council approve the • agreement and adopt the resolution authorizing the Mayor and City Clerk to execute the agreement. BACKGROUND SUMMARY: The City of Renton and Soos Creek Water and Sewer District (District) entered into a water -a and sanitary sewer boundary agreement in 1991. In 1997, Renton and the District entered � m into another agreement to revise the service area boundaries. All ether parts of the original agreement remained intact. As part of the original 1991 agreement, Renton took over a part of the District's sanitary sewer facilities. For `payment', Renton agreed to collect and pass through the District's System Development Charge for any new development connecting to the system that flows into the line(s) we took over. • I December 4, 2003 Page 2 All of the sewer facilities Renton acquired from the District flow to a point where S 55th Street would intersect State Route 167. At the point the sewers cross the freeway, the facilities become the District's again. The District also had facilities upstream that are still connected to those that Renton took over and remained theirs. Soos Creek has approached us with a proposal to connect an additional portion of their system to our system. Under the original agreement, they would have the right to connect to the portion of the system that we acquired from them. Where they are asking to connect is not part of the system we acquired from them whereas all conditions and obligations contained in the m We have worked out an agreement her g � .. original agreement regarding the pass through of the District connection fees are deemed satisfied in full. The agreement also requires that, if the District does utilize our system, they will pay us one-half(1/2) of their System Development Charge for each unit that connects to ! o m the system that flows into ours. m 8 o2 The area that would be served into Renton's sewer system projects to about 125 new units. .� The District's System Development Charge is just over$2000 per unit. The City Wastewater m z Utility could get up to approximately $125,000 of revenue by letting the District utili7e. our down stream sewers. We have analyzed the capacity in the existing facilities and have determined that the additional 125 units will not impact our system. rn There are not any proposed changes to the service boundaries as part of this addendum. Nothing in this addendum affects the water portion of the agreements. I m CONCLUSION: g I'. I • 1 . 1 October 1, 1996 • Page 2 ' DISCUSSION: • Minor adjustments to the water and sewer boundaries to coincide where practical: • When the original boundaries were drawn they were drawn to reflect the best ability of each utility (sewer and water) to serve the area. Typically, the areas near the boundaries could be served either • direction. We are now proposing that we make small adjustments in those areas to make the water and sewer boundaries the same. This will allow one provider to furnish both water and sewer zU service. 0 n • Minor adjustments in the area of the O'Conner Plat: rn -71 The adjustment would allow the District to provide service to the entire plat. While this proposed rn plat is in the City, it is almost all within the District's water and sewer service area. It would not be v m practical or cost effective for both providers to serve their portion of the plat. We also determined m that the City did not have the ability to obtain the service area without either a substantial cost to our -4 On • rate payers or a substantial delay to the developer. e mm • Adjustment to the water and sewer boundaries to include Parks Department parcels in Renton's p service areas: c 2 • The Parks Department owns parcels just south of the City along Talbot Road. By being in our 4 yr service areas the Parks Department will avoid dealing with another district and eliminate the Om m requirement to pay the District's Development fees. 2 P. mm • Proposed taking over sewer service to the Scott's Terrace Plat: 0 N r 0 m This plat is at the northeast corner of Talbot and Carr Roads. It is currently outside of the City while c tri being bounded by our limits on three sides. They currently receive water service from the City. z r Based upon a 1974 interlocal agreement,this service area and the facilities involved would be turned over to the City at no cost at the time it annexes. It is our anticipation that these facilities would be City owned when it was time to replace or rehabilitate them in fifty years. We felt that it was prudent to start collecting rates,as soon as possible,toward these eventual costs. • It is also interesting to note that only about half of the parcels in this area are served by facilities that Renton would own. The remaining parcels,while being our rate payers,connect directly to the King 0 County-Metro trunk that passes through the neighborhood. For those parcels we would collect revenue and have no maintenance costs. It is our desire to charge the in-city rate for the Scott's Terrace parcels. We feel that it is not fair to assess the 50% surcharge to these rate payers when they are transferred to our service area through no action of their own. The City would continue to asses the 50% surcharge on the water service. • There is a precedent in charging the in-city rate for existing parcels that are assumed by the City as part of an interlocal agreement to adjust boundaries. In 1991-92 the City Council agreed to charge the in-city rate for parcels with existing service that were taken over from an adjacent district. Governmental Approvals. The parties may give notice of the adoption of this Agreement to Metropolitan/King County,to the Department of Ecology,to the Department of Health,and to any other agency with jurisdiction or mission relevant to the terms hereof,and shall cooperate and assist in all reasonable manner in procuring any necessary approvals hereof N= by those agencies. m 5.
