OLD BUSINESS: • ON-SITE DEFERRAL, SIERRA COURT SHORT PLAT, 1700 Block of Union Ave.N.E. - applicant requests an extension of the deferral for installation of final lift of asphalt surfacing and landscaping. Action: Moved by Meckling, seconded by Gray to grant a 60-day extension to the deferral, which would then expire on August 26, 2000, and all previous conditions of approval apply to this request. Motion Carried. • ON/OFF SITE DEFERRAL, HIGHLAND COURT,3318 N.E. Sunset Blvd. - applicant requests an extension of the deferral for installation of final lift of asphalt paving. Budget: 1999 Year-end Finance Committee Chair Edwards presented a report recommended approval Adjustments of an ordinance authorizing adjustments to the 1999 Budget to cover unanticipated costs and to establish a new fund, Fund 306, for City Leased Properties. The Committee further recommended that the ordinance regarding this matter be presented for first and second reading and adoption. Transportation Committee Transportation Committee Chair Corman presented a report regarding an Transportation: Commute Trip agreement providing State Commute Trip Reduction (CTR) assistance funds,to Reduction Act Funds, King be administered through King County, for Renton's city-wide Commute Trip County(1999-2001) Reduction program. The basic program requirements for the receipt of these funds remains the same as in previous years. The Committee recommended that Council approve the resolution authorizing an agreement with King County for the acceptance of CTR funds for the period of July 1999 through June 2001. Councilmember Nelson added that last week it was reported that the Issaquah School District over-projected its student population for this year by as many as 500 students. The applicant,W.H. Hughes Jr. Company, Inc, filed a request for approval of an 11-lot Final Plat. 2. The yellow file containing all staff reports,the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit No.l. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Determination of Non-Significance, Mitigated(DNS-M)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located on NE Sunset Blvd and Monroe Avenue NE. 6. The subject site is located within the City of Renton. Annexed in 1954 by Ordinance 1490. 7. The site is zoned Residential 10 DUA/AC (R-10) 8. The Final Plat includes the 11 lots originally intended as part of the plat. 9. The Final Plat complies with both the Zoning Code and the Comprehensive Plan. 10. The preliminary plat was subject to a number of conditions as a result of both environmental review and plat review. The applicant has complied with the ERC conditions related to: 1. Temporary Erosion Control shall be installed and maintained to the satisfaction of the representative of the Development Services Division for the duration of the project. 2. Weekly reports on the status and condition of the erosion control plan with any recommendations of change or revision to maintenance schedules or installation shall be submitted by the Project Engineer of Record to the Public Works Inspector. Certification of the installation, maintenance and proper removal of the erosion control facilities is required prior to recording the plat. 3. Surface water detention requirements for this site shall be limited to the pre-developed rates for the 5 year, 10 year and 100 year storm event, with a 30% safety factor for the 100 year storm event. 4. The applicant shall pay a Park's Department mitigation fee of $530.76 per single-family residential lot. The mitigation fee for the proposal is estimated at $5,307.60. This mitigation fee shall be paid prior to recording of the subdivision. 5. The applicant shall be required to pay a Traffic Mitigation Fee of $75 for each average daily trip associated with the project. The traffic mitigation fee is estimated to be $7,162.50. This mitigation fee shall be paid prior to recording of the subdivision. 6. The applicant shall pay the appropriate Fire Mitigation Fee equal to $488 per single family lot. The Fire Mitigation Fee is estimated to be $4,880. This mitigation fee shall be paid prior to recording of the subdivision. 11. There were six main conditions imposed on the approval of the Preliminary Plat. 1. The applicant shall comply with the ERC mitigation measures. 2. Applicant shall record covenants for access and maintenance for private street easements for each of the lots that gain access or are affected by the access easement. 3. If a common storm facility is required and constructed for the development, applicant shall record a covenant on al the lots for use and maintenance of a common storm water facility. 4. Applicant shall record on the face of the plat a restriction permitting only detached single family residences on each lot. 5. The storm drainage system shall comply with City standards bu also not create any impacts on its downstream neighbors. The applicant cannot alter the flow patterns or quantities of storm water without permission for affected properties. 6. The easement shall be developed with the same materials and standards used by the City for public streets. CONCLUSIONS: 1. The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process. The applicant shall pay a Park's Department mitigation fee of $530.76 per single-family residential lot. The mitigation fee for the proposal is estimated at $5,307.60. This mitigation fee shall be paid prior to recording of the subdivision. 5. The applicant shall be required to pay a Traffic Mitigation Fee of $75 for each average daily trip associated with the project. The traffic mitigation fee is estimated to be $7,162.50. This mitigation fee shall be paid prior to recording of the subdivision. 6. The applicant shall pay the appropriate Fire Mitigation Fee equal to $488 per single family lot. The Fire Mitigation Fee is estimated to be $4,880. This mitigation fee shall be paid prior to recording of the subdivision. 11. There were six main conditions imposed on the approval of the Preliminary Plat. 1. The applicant shall comply with the ERC mitigation measures. 2. Applicant shall record covenants for access and maintenance for private street easements for each of the lots that gain access or are affected by the access easement. 3. If a common storm facility is required and constructed for the development, applicant shall record a covenant on al the lots for use and maintenance of a common storm water facility. 4. Applicant shall record on the face of the plat a restriction permitting only detached single family residences on each lot. 5. The storm drainage system shall comply with City standards bu also not create any impacts on its downstream neighbors. The applicant cannot alter the flow patterns or quantities of storm water without permission for affected properties. 6. The easement shall be developed with the same materials and standards used by the City for public streets. CONCLUSIONS: 1. The Final Plat generally appears to satisfy the conditions imposed by the preliminary plat process. Any remaining improvements seem certain and are appropriately secured through the Board of Public Works. 2. The applicant shall be required to demonstrate complete compliance with payment of all remaining mitigation fees prior to signing of the final plat documents. Paragraph 14 of the MFDT is hereby amended to add thereto the following provisions: "(i) The provisions of paragraph 14, whenever applicable, shall be deemed to • empower Beneficiary or Trustee to make advances or incur costs and expenses for inspecting the premises periodically, keeping the Collateral in good repair and protecting the premises from loss, waste,damage or injury; (ii) Beneficiary or Trustee, as the case may be, shall be the sole and .A conclusive judge of the need for any advances made or expenses incurred under the terms of this paragraph 14; (iii) The amount of the advances made or expenses incurred hereunder shall be added to the indebtedness secured hereby and may be recovered in full,together with interest thereon at the legal rate,by the Beneficiary." 5. Paragraph 25 of the MFDT is hereby amended as follows: (i) Clause (c) thereof is hereby deleted and removed, and the following is added and substituted therefor: "Due on Sale. The Collateral will not be sold, conveyed, encumbered or transferred by Grantor without Benefi.iary's prior written consent. If title to said Collateral shall pass from Grantor by deed or otherwise, or if said property is told on contract, or if the property is vacated by Grantor, such change in title or occupancy shall be deemed to increase the risk of Beneficiary, and Beneficiary may declare the whole amount of principal and interest then unpaid on the Note secured hereby immediately due and payable, or may, at its sole option, consent to such change in title or occupancy and increase the interest rate on said Note." The DeJARLAIS PARCEL is paddle shaped—that is, it consists of approximately 1.2 acres served by an approximately 117 foot long access strip with approximately 22 feet of frontage on Sunset Boulevard N.E. Said access strip is hereafter referred to as the 'ACCESS STRIP.' E. The DeJARLAIS PARCEL has been surveyed and a record of that survey was recorded on February 3, 1993 under King County Recorder's Certificate Number 9302039007. A copy of that recorded survey reduced in size to 81/2 x 11 inches and marked Exhibit D is attached hereto and by this reference incorporated herein in full. F. According to that survey, the house on the McELROY PARCEL encroaches to the east upon the ACCESS STRIP of the DeJARLAIS PARCEL, the northeasterly corner being tv approximately ten feet (10') and the southeasterly corner being approximately four feet (4') f` over the common lot line. .-4 1-4 G. According to that same survey, the driveway serving the house on the NGUYEN O PARCEL also encroaches to the west upon the said ACCESS STRIP. That encroaching ""4 driveway is hereafter referred to as the "NGUYEN DRIVEWAY.' Cs' Cr) H. To prevent losing clear title to their property by adverse potz& sion the DeJARLAISES must: a. reach an agTeement with, or start legal proceedings against, McELROY and the LOMBARDOS, and b. reach an agreement with the NGUYENS and the HUYNHS or either block the NGUYEN DRIVEWAY with fence or start legal proceedings against them and the LENDER. I. The DeJARLAISES are exploring alternate methods of developing the DeJARLAIS PARCEL. OPTION TO ADJUST LOT LINES • Page 2 (DES100794Al1) C:\SMERRON\FORMS\DEJA-LT8.OPT t NOW THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1. Continued Use of NGUYEN DRIVEWAY. 1.1 As used in this option agreement, the term 'PUBLIC ROAD' shall mean a rid that can be used by the owners of the NGUYEN PARCEL for access to the existing garage. 1.2 The NGUYENS and the HUYNHS may continue to use that portion of the NGUYEN DRIVEWAY which is located on the DeJARLAIS PARCEL rent free throughout the term of the option set out in section 3 below, as the term of the option may be extended or shortened as provided therein. 1.3 Subject to the provisions of section 1.5 below if the DeJARLAISES or their successors create a road upon the ACCESS STRIP of the DeJARLAIS PARCEL, it shall be a PUBLIC ROAD as defined above. 1.4 Subject to the provisions of section 1.5 below if the DeJARLAISES elect not to create such a road, at the expiration of the option they will grant the NGUYENS and the HUYNHS an easement for the continued use of the driveway. The alternate casement for continued use of the driveway at the expiration of the unexercised option shall be a non-exclusive easement permitting continued passage and use of the driveway area occupied by the NGUYENS DRIVEWAY and utility improvements, 1.4 prohibiting blockage or fencing thereof but reserving the right in DeJARLAIS to enter ..4 upon the easement and to construct drive and utility improvements not inconsistent with the NGUYENS' use thereof but adequate to service all of DeJARLAIS' contiguous parcel (the servient estate) at its fully developed potential. 1.5 Neither the NGUYENS nor the HUYNHS make any warranty or representation as to whether or not their lender will consent to the release of its deed of trust on the parcel proposed for conveyance to the DeJARLAISES to complete their proposed public roadway dedication. Notwithstanding the generality of sections 1.3 and 1.4 above, if the LET DER refuses to join in this agreement by October 31, 1994, or conditions its joining on prepayment of its loan in whole or in part or upon the payment of fees, the DeJARLAISES shall have the option to: 1.5.1 proceed at their own risk, and the NGUYENS' and the HUYNHS' deed shall be subject to said deed of trust (provided such conveyance would not constitute a breach of any due on sale or other covenant or their loan or security documents in which case no conveyance shall be required until the loan is paid in full) and the DeJARLAISES shall pay any fees or pay-down required; or OPTION TO ADJUST LOT LINES Page 3 (DES1OO794AV) C:\SHERROV\FORMS\DEJA-LT8.OPT 1.5.2 declare this agreement terminated in which case the DeJARLAISES shall not be obligated to convey the easement referred to in section 1.3 above. 2. No Adverse Possession. The NGUYENS and the HUYNHS acknowledge and agree that from this day forward and throughout the term of this option they are using that portion of • the NGUYEN DRIVEWAY which is on the DeJARLAIS PARCEL with the consent of the DeJARLAISES and that for purpose of their claiming the right to use that portion of the driveway by adverse possession, the statute of limitations is no longer running. 3. Opts. The NGUYENS, the HUYNHS and the LENDER hereby grant the DeJARLAISES the option to enter into an Agreement Adju-ting Lot Lines if the LeJARLAISES elect to construct a PUBLIC ROAD (as opposed to a PRIVATE ROAD) on the present ACCESS STRIP (the land between the McELROY PARCEL and the NGUYEN PARCEL) as the road serving the development of the DeJARLAIS PARCEL. 3.1 Terms of Lot Line Adjustment. If the DeJARLAISES exercise this option, the terms of the lot line adjustment shall be as follows: 3.1.1 The DeJARLAISES, in consideration of the conveyance described in section 3.1.2 immediately below agree: 3.1.1.1 To sell and convey to the NGUYENS, HUYNHS and the LENDER the following described real estate situated in King County, .•� Washington: Cr) That portion of the ACCESS STRIP that lies easterly of a line r-4 which is forty (40) feet easterly of and parallel to the westerly line of the ACCESS STRIP which parallel line is hereinafter referred to as the 'ADJUSThU LOT LINES; all as is shown on Exhibit E attached hereto and by this reference incorporated herein which Exhibit is a photocopy of a portion of a topographic survey performed by Hedges do Roth Engineering, Inc. up n which the ADJUSTED LOT LINE has been drawn and labeled. 3.1.1.2 Until a road is constructed on said ACCESS STRIP, the NGUYENS and/or the HUYNHS, their successors and assigns, shall be permitted to use the driveway in its present location for ingress and egress to their garage rent free. 3.1.1.3 After construction, the NGUYENS and/or the HUYNHS, their successors and assigns, will be permitted to use the road in lieu of their present driveway. OPTION TO ADJUST LOT LINES Page 4 (DES100T94AL) C:\SHERROU\FORMS\DEJA-LTE.OPT 3.1.1.4 As part of the construction of such road, the DeJARLAISES or their successors will provide a curb cut for entry into the garage on the NGUYEN PARCEL. 3.1.2 The NGUYENS, the HUYNHS and the LENDER, in consideration of the conveyance described in section 3.1.1 above agree: 3.1.2.1 To sell and convey to the DeJARLAISES the following described real estate situated in King County, Washington: That portion of the NGUYEN PARCEL which lies westerly of a line forty (40) feet easterly of and parallel to said westerly line 4 of the ACCESS STRIP (the ADJUS i r1) LOT LINE); all as is shown on Exhibit E referred to above. • 3.1.2.2 The NGUYENS and the HUYNHS will use their best efforts to persuade the LENDER (or any other party having a security interest in the NGUYEN PARCEL) to join in this lot line adjustment and agree that the land conveyed to them under the provisions of section 3.1.1 above shall be subject to the Deed of Trust referred to in RECITAL B above. N The DeJARLAISES are hereby authorized to approach the 1-4 LENDER to solicit its cooperation and concurrence. 3.1.3 Conveyaces. Each conveyance by a party other than the LENDER shall be by a Statutory Warranty Deed conveying the respective properties free of encumbrances except as herein stated, and those created or suffered by the act or default of the other party. Conveyance by the LENDER may be by either quit claim deed or by an agreement subordinating its security to this lot line adjustment. 3.1.4 Formal Lot Line Adjustment Application. The parties recognize that the lot line adjustments contemplated by this option agreement must be approved by both the City of Renton and King County. 3.1.4.1 Requirements. Such city and county approval would require formal application, and amongst other requirements, a map of the proposed lot line adjustment prepared by a licensed land surveyor. 3.1.4.2 cos. The parties recognize that in addition to the execution and acknowledgment of the deeds, all persons having an interest in the parcels involved will be required to sign the original mylar drawing. The parties, each for himself/herself and not one for the other, agree to cooperate, make themselves available for signing, and in general take such steps or action as may be necessary to efficiently process the application and approve the lot line adjustment. 3.2 Length of Option Period. This option is to continue for eighteen (18) months from the date hereof unless extended or shortened as provided in sections 3.3 and 3.4 below. 3.3 Extension of Option Period. The DeJARLAISES, their successors and assigns, shall have and are hereby granted two (2) options to extend the term of this Option to Adjust Lot Lines as follows: 3.3.1 One eighteen (18) month extension of the original term to begin upon the expiration of the original term of this Option to Adjust Lot Lines; e-1 1-4 3.3.2 One additional eighteen (18) month extension of the combined term to begin at the expiration of the above combined original term and extended term if the option above to extend the term was properlyexercised. � All of the terms, covenants and provisions of this Option to Adjust Lot Lines shall apply to said extended terms. If the DeJARLAISES or their successors shall elect to exercise the above options to extend the term of this Option to Adjust Lot Lints, they shall do so by giving to the NGUYENS and the HUYNHS notice in writing of their intention to do so prior to the expiration of the original term of the Option to Extend Lot Lines and/or the first extension. 3.4 Reduction of Option. The DeJARLAISES or their successors or assigns may terminate the original or any extended option (and thereby terminate the permission contained in section 1 above) by giving the NGUYENS and HUYNHS written notice of their election to do so. 3.5 Method of Notice of Election. Notice of election to exercise the option to adjust the lot lines by the DeJARLAISES or their assigns shall be in writing and shall be given to the NGUYENS and the HUYNHS at 3324 NE Sunset Boulevard, Renton, Washington on or before the expiration of the original option period or any extensions thereof. The NGUYENS and the HUYNHS understand that the DeJARL.AISES contemplate selling their entire parcel and agree that this option agreement may be assigned or transferred to and performed by such purchaser. 5. augccsm. This option agreement and the covenants and agreements herein contained shall be both personal covenants of the parties and covenants running with and binding the respective parcels of each. 6. IntairlAgmanca As between the NGUYENS, the HUYNHS and the DeJARL.AISES, this agreement shall become binding upon them when it has bten signed and acknowledged by said parties (six individuals) subject, of course, to the provisions of section 1.5 above relating to rescission if the LENDER refuses to join. 7.
