6026CITYOFRENTON,WASHINGTONORDINANCENO.6026ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ADOPTINGFINALZONINGREGULATIONS,PREVIOUSLYADOPTEDASINTERIMZONINGCONTROLSBYORDINANCENO.5996ANDORDINANCENO.6019WITHCHANGESTOEXPANDTHENUMBEROFZONESINWHICHHOMELESSSERVICESMAYLOCATEANDOTHERWISEALIGNWITHREQUIREMENTSOFESSHB1220,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityofRentonisrequiredasaresultofEngrossedSecondSubstituteHouseBill1220adoptedinthe2021legislativesession(ESSHB1220)toupdatezoningrequirementsrelatedtoEmergencyShelter,EmergencyHousing,TransitionalHousing,andPermanentSupportiveHousing;andWHEREAS,inOrdinanceNos.5996and6019,theCityadoptedinterimzoningcontrolstoprovideapathforpermittingofhomelessserviceswithconditionsbased,inpart,upondocumentedsafety,publichealth,andwelfareconsiderationsrelevanttothesitingofsheltersandhousingcoveredbyEngrossedSubstituteHouseBill1220;andWHEREAS,thosesafety,publichealth,andwelfareconsiderationsremainrelevant;andWHEREAS,pursuanttoRCW36.70A.106,onJuly30,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldapublichearingonAugust25,2021andonSeptember1,2021votedtorecommendtotheCityCounciltomakethepreviouslyadoptedinterimzoningcontrolsfinalwithlimitedchangestocomplywithESSHB1220andadoptdefinitionsanduseclassificationsthatbetteralignwithESSHB1220;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:1 ORDINANCENO.6026SECTIONI.TheaboverecitalsaswellastherecitalsandfindingsoffactinOrdinanceNos.5996and6019areadoptedasfindingsoffactinsupportofthisfinalzoningcontrolordinanceadoptedhereinpursuanttoapplicablelawsandinterpretivejudicialdecisionsandarefoundtobetrueandcorrectinallrespects.SECTIONII.AllportionsoftheRentonMunicipalCodenotshowninthisordinancewithstrikethroughandunderlineeditsorotherwiseexpresslyrepealedremainineffectandunchanged,includingbutnotlimitedtozoningcontrolspreviouslyadopted,amendedand/orextendedas“interim”zoningcontrolsbyOrdinanceNo.6019.SECTIONIII.Subsection4-2-060.GoftheRentonMunicipalCodeisamendedbymodifyingonerowandaddingtworowsasshowninAttachmentA.Allotherprovisionsin4-2-060remainineffectandunchanged.SECTIONIV.Subsections4-2-080.A.88and4-2-080.A.89oftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-2-080.Aremainineffectandunchanged.8$.Rescrvcd.TransitionalHousing,asdefinedunderChapter84.36RCW.issublecttothedensityanddimensionalstandardsofthecorrespondingzoneortonomorethanonehundred(100)dwellingunits,whicheverisless.Thecapofonehundred(100)maybeincreasedtoonehundredfifteen(115)dwellingunitsifthereisawrittenagreementwiththeCitytodesignateatleastfifteenpercent(15%)ofthedwellingunitstothosecurrentlyexperiencinghomelessnessinthe89.Reserved.MinimumnetresidentialdensityandstructuredparkingrequirementsinRMC4-2-120.B,andallrequirementsinRMC4-2-OSOA.16and2 ORDINANCENO.6026RMC4-4-150shallnotapplytonewtransitionalorpermanentsupportivehousingthatisconvertedfromanexistingbuildingoriginallypermittedasahotelinwhichtheroomscontainbothbathroomsandkitchenssothattheymaybeconvertedintoanumberofresidentialdwellingunitsthatdonotexceedthenumberofpreviouslyapprovedhotelrooms.SECTIONV.Subsection4-4-045.1.3oftheRentonMunicipalCode,asadoptedbyOrdinanceNo.5996andamendedbyOrdinanceNo.6019,isamendedasfollows:3.OccupancyLimitsandSize-RelatedDevelopmentStandards:a.AllhomelessservicesusesshallcomplywithoccupancylimitationscontainedinapplicablebuildingandfirecodesandordinancesadoptedoramendedbytheCity.b.Incommercialandindustrialzoneswherehomelessservicesarepermitted,Ovcrnihtsheltersuchfacilitiesshallnotprovidesleepingaccommodationsformorethanonehundred(100)occupantsresidents,oruptoonehundredandfifteen(115)residentsifthereisawrittenagreementwiththeCitytodesignateatleastfifteenpercent(15%)ofthesleepingunitstothosecurrentlyexperiencinghomelessnessintheCity.c.WithintheR-1Zone,homelessservicesusesshallnotprovidesleepingaccommodationsformorethanten(10)occupantsincludingstaff.WithintheR-10andR-14Zones,homelessservicesusesshallnotprovidesleepingaccommodationsformorethanfourteen(14)occupantsincludingstaff.3 ORDINANCENO.6026c.Overnightshelterusesshallcomplywiththcfollowingadditionalrequirements:Id.SheltersHomelessservicesusesshalllocategreaterthanone-half(0.5)milefromanyotherhomelessservicesuse,unlesstheydonotservemorethanacombinedonehundredfifteen(115)residents.44€.SheltersFacilitieswithmorethanfifty(50)bedsshouldshalllocatewithinone(1)mileofapublictransitstop.SECTIONVI.Thedefinitionof“HomelessServicesUse”insection4-11-080oftheRentonMunicipalCode,asadoptedbyOrdinanceNo.5996andextendedbyOrdinanceNo.6019,isamendedasshownbelow.Allotherdefinitionsin4-11-080remainineffectandunchanged.HOMELESSSERVICESUSE:Adays5heltersorovernightshelterhousingasdefinedbelow:1.DayShelter:Afacilitythatoffersahaventopeopleexperiencinghomelessnessbyprovidingasafeplacetorestduringthedayorevening,butwithnoovernightstays.Supportservicesforhomelesspopulationsisanintegralpartofadayshelteruseandincludesbutisnotlimitedtoaccesstofood,seating,showers,laundry,restrooms,storage,acomputerlab,phones,fax,andacriticalmailingaddress.Spacesformeetingsandexaminationsaregenerallyprovidedtoaccommodatecounselingandaccesstomedical/dentalandlegalassistance.2.EmergencyShelter:ConsistentwithRCW36.70A.030,afacilitythatprovidesatemporaryshelterforindividualsorfamilieswhoarecurrentlyhomeless.Emergencysheltermaynotrequireoccupantstoenterintoaleaseoran4 ORDINANCENO.6026occupancyagreement.Emergencyshelterfacilitiesmayincludedayandwarmingcentersthatdonotprovideovernightaccommodations.OvernightShelter:Anyfacilitythatisoperatedforalongtermandindefiniteperiod(andnotinresponsetoasinglesuddeneventsuchasanaturaldisastcr)fortheprimarypurposeofprovidingtemporaryshelterforpeopleexperiencinghomelessnessingeneralorforpccificpopulation&ofpeopleexperiencinghomclcssncss.Supportiveservicesmivormvnotbeprovidedinadditiontotheprovisionofshelter.ACOVID1QdeintensificationsheltermeetingthisdefinitionisaHomelessServicesUse—OvernightShelter.3.EmergencyHousing:ConsistentwithRCW36.70A.030,temporaryindooraccommodationsforindividualsorfamilieswhoarehomelessoratimminentriskofbecominghomelessthatisintendedtoaddressthebasichealth,food,clothing,andpersonalhygieneneedsofindividualsorfamilies.Emergencyhousingmayormaynotrequireoccupantstoenterintoaleaseoranoccupancyagreement.ACOVID-19deintensificationsheltermeetingthisdefinitionisaHomelessServicesUse.SECTIONVII.Section4-11-160oftheRentonMunicipalCodeisamendedtoaddanewdefinitionof“PermanentSupportiveHousing,”inalphabeticalorder,toreadasshownbelow.Allotherdefinitionsin4-11-160remainineffectandunchanged.PERMANENTSUPPORTIVEHOUSING:ConsistentwithRCW36.70A.030,subsidized,leaseddwellingunitswithnolimitonlengthofstaythatprioritizespeoplewhoneedcomprehensivesupportservicestoretaintenancyandutilizes5 ORDINANCENO.6026admissionspracticesdesignedtouselowerbarrierstoentrythanwouldbetypicalforothersubsidizedorunsubsidizedrentalhousing,especiallyrelatedtorentalhistory,criminalhistory,andpersonalbehaviors.Permanentsupportivehousingispairedwithon-siteoroff-sitevoluntaryservicesdesignedtosupportapersonlivingwithacomplexanddisablingbehavioralhealthorphysicalhealthconditionwhowasexperiencinghomelessnessorwasatimminentriskofhomelessnesspriortomovingintohousingtoretaintheirhousingandbeasuccessfultenantinahousingarrangement,improvetheresident’shealthstatus,andconnecttheresidentofthehousingwithcommunity-basedhealthcare,treatment,oremploymentservices.Permanentsupportivehousingissubjecttoalloftherightsandresponsibilitiesdefinedinchapter59.18RCW.SECTIONVIII.Section4-11-200oftheRentonMunicipalCodeisamendedtoaddanewdefinitionof“TransitionalHousing,”inalphabeticalorder,toreadasshownbelow.Allotherdefinitionsin4-11-200remainineffectandunchanged.TRANSITIONALHOUSING:ConsistentwithRCW84.36.043,aproiectthatprovidesone(1)ormoredwellingunitsandsupportiveservicestohomelesspersonsorfamiliesforuptotwo(2)yearsandthathasasitspurposefacilitatingthetransitionofhomelesspersonsandfamiliesintoindependentliving.SECTIONIX.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.6
